City Council Minutes 1997 05-08-97 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT THE KENDALL COUNTY BOARD ROOM, 111 W. FOX ST., YORKVILLE ON THURSDAY, MAY 8, 1997. Mayor Bob Johnson called the meeting to order at 7:04 p.m. and led the Council in the Pledge of Allegiance. Clerk Simmons called the role: ROLL CALL Ward I Spang Present Sticka Present Ward II Lynch Present Kot Present Ward III Jones Present Prochaska Present Ward IV Sowinski Present Stafford Present QUORUM A quorum was established. INTRODUCTION OF GUESTS Mayor Johnson welcomed those present and asked them to introduce themselves and to enter their name on the attendance sheet provided. GIFT PRESENTATION Mayor Johnson presented gifts to outgoing City Clerk Jackie Allison, Alderman Jeff Baker and Alderman Bert Callmer. RIVER FRONT DONATIONS Sylvia Brogan with Farmers Insurance presented Mayor Johnson with a check for $1,000.00 to be used for the river front. Alderman Jones stated there was to be a second river front donation from Aurora Concrete but the individuals were unable to come to the meeting. Aurora Concrete donated 6 manhole flower pots to be used on the river front.. AMENDMENTS TO THE AGENDA Alderman Sowinski stated under Public Works Report, the Martin Plumbing request is tabled and would go back to Public Works on May 19. Alderman Prochaska stated under Administration Committee Report the Agreement with the School District is tabled and would be going back to The Committee of the Whole for discussion. Alderman Prochaska also stated that there would be two sets of minutes being presented for approval, one from April 10 and one from April 24, 1997. Alderman Jones stated under Planning Commission/Zoning Board of Appeals, the Planned Unit Development/Annexation Agreement for Fox Hollow should also be to approve the Preliminary Site Plan and the Annexation Agreement. MEETING DATES The council reviewed the listing of committee meetings. Meetings will be held as stated. CITIZENS COMMENTS Mayor Johnson asked for any citizens comments. There were none. PUBLIC HEARING A motion was made by Alderman Prochaska and seconded by Alderman Kot to move into continued Public Hearing for PC 96-20 on the Planned Unit Development/Annexation Agreement for Landmark America. Attorney Tom Grant stated he did not have any comments other than for the benefit of each member of the council he handed out copies of the final Preliminary Site Plan and the only possible change would be in the alignment of the road. He also stated he and the Committee of the Whole worked out the final changes. There were some minor changes, mostly correcting typos, and on page 1 the name of the developer was changed to Fox Hollow LLC, A Maine Limited Liability Co. A motion was made by Alderman Sowinski and seconded by Alderman Lynch to move out of Public Hearing. PLANNING COMMISSION/ZONING BOARD OF APPEALS Planned Unit Development Agreement with Lawyer and Developers of Fox Hollow A motion was made by Alderman Jones and seconded by Alderman Prochaska to approve authorizing the Mayor and City Clerk to execute the Annexation and Planned Unit Development Agreement with Gerald Lawyer and the Developers of Fox Hollow Senior Development subject to receipt of the school district letter and engineering. Annexation and Zoning as R-3 Residential PUD for Lawyer and Fox Hollow Parcel A motion was made by Alderman Jones and seconded by Alderman Lynch to approve Annexation and Zoning as R-3 Residential Planned Unit Development for the Lawyer and Fox Hollow parcel. Approve Preliminary Site Plan for PC 96-20 A motion was made by Alderman Jones and seconded by Alderman Lynch to approve the Preliminary Site Plan for PC 96-20 subject to engineering. At this time Alderman Jones stated that there would be a Zoning Board of Appeals meeting on Monday, May 12, 1997 at 7:00 p.m. in the Austin Room at the Beecher Center. She stated that a Public Hearing is scheduled for 97-1, a builder in Country Hills, it is a rear yard variance. MINUTES APPROVAL A motion was made by Alderman Prochaska and seconded by Alderman Sowinski to approve the minutes of April 10, 1997 and April 24, 1997 as presented. Motion carried. BILLS APPROVAL A motion was made by Alderman Prochaska and seconded by Alderman Lynch to approve bills dated May 8, 1997 in the amount of$44,233.26 (vendor), $55,930.89 (payroll) for a total of$100,164.15 Clerk Simmons called the role: Sowinski aye Jones aye Prochaska aye Spang aye Sticka aye Kot aye Lynch aye Stafford aye Motion carried 8-0. ATTORNEY'S REPORT No report. MAYOR'S REPORT Proclamation - "Poppy Awareness Days" Mayor Johnson proclaimed May 15, 16 and 17, 1997 as American Legion"Poppy Awareness Days in the city of Yorkville to honor our dead and requested all citizens to observe these days by wearing a Poppy and making contributions for this worthy cause. (Proclamation attached). Proclamation in Recognition of National Police Week Mayor Johnson proclaimed that the United City of Yorkville shall observe May 11-17, 1997 as Police Week in the city. (Proclamation attached). Appoint - Jerry Lynch as Representative to Aurora Tourism Council A motion was made by Alderman Prochaska and seconded by Alderman Jones to appoint Jerry Lynch as Representative to the Aurora Convention and Tourism Council. Motion carried. Present Certificate of Appreciation to Fox Valley YMCA Mayor Johnson presented a Certificate of Appreciation to Michelle Faye and Joe Martin for the Fox Valley YMCA for sponsoring the Community Swim Nights the summer of 1996. CITY CLERK'S REPORT Clerk Simmons asked for a recommendation to accept the Executive Session Minutes. A motion was made by Alderman Lynch and seconded by Alderman Kot to accept the Executive Session Minutes of 2-10-97, 3-20-97, 4-10-97, 4-17-97 and 4-24-97 as corrected. Motion carried. CITY TREASURER'S REPORT No report. City Council Minutes -May 8, 1997 -page 4 CITY ADMINISTRATOR `S REPORT Jim Nanninga reported on the river front. He stated that the fountain was done being painted and was going to be started up Friday, May 9. He stated that work on the playground is scheduled to begin on Saturday May 17, 1997 and they are looking for volunteers. ECONOMIC DEVELOPMENT COMMISSION REPORT Mayor Johnson stated the Economic Development Commission would be meeting on Tuesday, May 13, 1997 at 7:00 p.m. in the County Board room. SCHOOL COMMUNITY REPORT Alderman Prochaska stated that the next regular school board meeting will be held on Tuesday, May 27, 1997 at 7:30 p.m. at the district offices. OLD BUSINESS None NEW BUSINESS Alderman Jones stated there would be a plant sale sponsored by the Garden Club, at the river front park on Saturday, May 10, 1997 from 9:00 a.m. to 3:00 p.m. COMMITTEE REPORTS PUBLIC WORKS COMMITTEE REPORT March Water Report A motion was made by Alderman Sowinski and seconded by Alderman Stafford to approve the March Water Report as presented. Motion carried. River Crossing Fee Ordinance River Crossing Fee Ordinance was tabled for two weeks. ECONOMIC DEVELOPMENT COMMITTEE Erdmann Contract A motion was made by Alderman Jones and seconded by Alderman Sowinski to authorize the Mayor to execute a contract with Erdmann Advertising, Inc. to provide 48 hours monthly of economic development services per month at a rate of$1,500.00 per month for the 1997-98 fiscal year as presented. PUBLIC SAFETY COMMITTEE March Police Report A motion was made by Alderman Stafford and seconded by Alderman Lynch to accept the March Police Report as presented. Motion carried. 1996 Annual Police Report and 1996 Illinois Uniform Crime Report A motion was made by Alderman Stafford and seconded by Alderman Kot to accept the 1996 Annual Police Report and the 1996 Illinois Uniform Crime Report as presented. Motion carried. Certificate of Appreciation for Fox River Lanes Mayor Johnson asked Tony Graff to make mention of the Certificate of Appreciation for Fox River City Council Minutes - May 8. 1997 - page 5 Lanes. Tony Graff stated no one from Fox River Lanes was able to be present at the meeting tonight and he would personally present the certificate to them. The certificate was being presented to Fox River Lanes for sponsoring glow in the dark bowling for teens last summer and for giving their annual fee of$1,000.00 for the DARE program. ADMINISTRATION COMMITTEE REPORT Sign Wage Re-Opener Agreement for Yorkville Police A motion was made by Alderman Prochaska and seconded by Alderman Lynch to authorize the Mayor and the Chief of Police to sign the Memorandum of Agreement between the United City of Yorkville and the Illinois Fraternal Order of Police Labor Council/Yorkville Patrolman Unit as an addendum to the current Collective Bargaining Agreement. Except as expressly amended for wages, all other provisions of the existing collective bargaining agreement remain unchanged and in full force and effect. Sue Swithin, recreation director for the Park Board presented information on the pending agreement between the Yorkville Park Board and the Yorkville School District. Questions were asked by Council Members on the wording in the agreement on the use of the schools during the summer. It was finally agreed upon after lengthy discussion the wording should be, During the non-school hours as mutually agreed upon. Motion to Approve Intergovernmental Agreement-Parks/School A motion was made by Alderman Prochaska and seconded by Alderman Stafford to approve an Intergovernmental agreement between the Board of Education of Yorkville Community School District 115, Kendall, Illinois, in the United City of Yorkville for the recreational usage of the Yorkville Community Unit School District Facilities as corrected. G ic,z...i.,...,.} Bob Johnson, ar PROCLAMATION IN RECOGNITION OF NATIONAL POLICE WEEK WHEREAS,Police Officers of this nation and of this community have worked devotedly to safeguard the lives and property of the citizens of this Country and of this community; and WHEREAS,those same officers have selflessly worked to build better communities without regard to perils or hazards to themselves; and WHEREAS,these men and women have died in the line of duty across this nation,and in our own community; and WHEREAS,the Congress of the United States of America has declared May 15 of every year Peace Officers Memorial Day and the week of such May 15 Police Week; NOW THEREFORE the Mayor and the City Council of the United City Yorkville hereby proclaim as follows; 1. That the United City of Yorkville shall observe May 11 - 17, 1997 as Police Week in the City. 2. That during Police Week the United City of Yorkville shall support the Organizations of Concerns of Police Survivors (C.O.P.S.) by flying blue ribbons in such support. 3. That in recognition of Police Week and the C.O.P.S.Program that the City salutes and honors all law enforcement personnel who have died in the line of duty and extends this honor to special agent Robert Kolowski,a member of our community who died in the line of duty February 25, 1993 serving the Illinois State Police and who had his name placed on the Illinois Law Enforcement Memorial on May 2, 1996. 4. That the United City of Yorkville honors and supports the Loyal Order of the Moose Lodge for their support to Law Enforcement Officers killed feloniously or accidentally in the line of duty. Furthermore, for raising public awareness of the need to assist and support the Law Enforcement profession and its survivors. 5. That by observance of Police Week the United City of Yorkville, its governing body, staff and citizens extend their sincerest gratitude to all those who have served, are serving and will serve as Law Enforcement personnel across the Country.
