City Council Minutes 1996 04-25-96 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT THE KENDALL COUNTY BOARD ROOM ON Thursday, April 25, 1996 Mayor Johnson called the meeting to order at 7:00 p.m. and led the Council in the Pledge of Allegiance. Clerk Allison called the role: ROLL CALL Ward I Callmer Present Spang Absent Ward II Baker Present Lynch Present Ward III Jones Present Prochaska Present Ward IV Sowinski Absent Stafford Present A quorum was established. QUORUM INTRODUCTION OF GUESTS Mayor Johnson welcomed those present and asked them to please sign in on the sign-in sheet provided. AMENDMENTS TO THE AGENDA Mayor Johnson stated that the Public Hearing for the 1996 - 1997 Budget has been continued until May 9, 1996. Also, the Public Hearing for PC 96-7, Gail Fisher, has been tabled until the Plan Commission process has been completed. PC 96-7 under the Economic Development Committee will also be continued at this time. MEETING DATES The council reviewed the listing of committee meetings. All Committee meetings will be held as listed. The Public Safety Committee has scheduled their meeting for 6:30 p.m. on May 29th. The Administration Committee will be scheduling their meetings on the second Tuesday of each month. Public Works will be held on the first and third Monday of each month. RIVERFRONT PROJECT -- DONATIONS Mayor Johnson and Alderman Jones accepted donations on behalf of the Riverfront Committee. Donations included the park benches from Stan Free representing the Bank of Yorkville; a cash donation by Steve Steinwart representing Meadowvale; and, plumbing supplies and labor from Nancy and Joe Martin of Martin Plumbing. Mayor Johnson thanked all those who have donated towards this project. CITIZEN COMMENTS Mayor Johnson asked for any citizen comments. Dave Palowski of Bristol Township stated that there is a problem with trash from contractors building in the Blackberry North Subdivision. He indicated that there is concern from local farmers regarding the trash entering their fields and creating possible machinery problems. The City will look into this problem. Also, Mr. Palowski asked for a meeting to be scheduled between the City of Yorkville and the Bristol Township Incorporation Committee. Mayor Johnson stated that this will be determined and placed on the appropriate COW meeting agenda. PUBLIC HEARINGS -- NONE PLAN COMMISSION / ZONING BOARD OF APPEALS Ordinance 96 - q PC 93 - 5 (Fox Hill) A motion was made by Alderman Baker and seconded by Alderman Jones to approve PC93-5, Fox Hill Subdivision, Unit 5, Pod 11, for the Final Plat. Ordinance 96 - PC 95 - 15 (Coach Road Hills) A motion was made by Alderman Baker and seconded by Alderman Jones to approve an Ordinance approving PC 95-15, Coach Road Hills, rezoning from R-1 to R-2, PUD rezoning subject to the approval of the PUD Agreement. MINUTES APPROVAL A motion was made by Alderman Prochaska and seconded by Alderman Baker to accept the regular City Council minutes dated April 11, 1996 as presented. Motion carried. BILLS APPROVAL A motion was made by Alderman Prochaska and seconded by Alderman Stafford to approve and pay bills dated April 11, 1996 in the amount of $45,871.09 vendor, $46,650.10 payroll for a total of $92,521.19. A question was raised by Alderman Prochaska regarding a line item entered as a donation. This is not a donation and should be clarified. Also, question was raised on page 10 where it discusses bonding. This was paid so that the bonding did not lapse but is actually being paid from next year's budget. ATTORNEY'S REPORT Attorney Kramer informed the council that a counter-offer has been received on the two city lots for sale at $25,500 per lot. This will be sent to committee for review. The amount is 80% of the appraised value as required. Attorney Kramer also distributed a letter to the council members updating them on the Hotel Tax Litigation in process. There are several items that have been distributed to council members for review. MAYOR'S REPORT Proclamation Mayor Johnson read the PROCLAMATION IN RECOGNITION OF NATIONAL POLICE WEEK. This will be observed May 12 18, 1996. Resolution 96 - ' i Public Works Director A motion was made by Alderman Prochaska and seconded by Alderman Baker to approve the resolution appointing a Public Works Director for the City of Yorkville. Clerk Allison called the role: Baker - aye Lynch - aye Jones - aye Prochaska - aye Stafford - aye Callmer - aye City Council Regular Session - April 25, 1996 - page 3 Motion carried. Appointments - Department Heads Mayor Johnson stated that he is recommending the following for the positions indicated under the 1996 - 1997 fiscal year. Resolution 96 -6 Riverfront Project A motion was made by Alderman Jones and seconded by Alderman Lynch to approve the resolution authorizing the Yorkville Riverfront Foundation, a not-for-profit Corporation to perform work at the Riverfront / Riverwalk Site. Motion carried. City Council Regular Session - April 25, 1996 - page 4 Mayor Johnson reminded everyone of the Tuesday, April 30, 1996 Steering Committee meeting for the Competitive Communities Initiative at the Beecher Center in Yorkville. CITY CLERK'S REPORT Clerk Allison stated that one week of Executive Session minutes was reviewed by several council members prior to the meeting. A motion is needed to accept the minutes as presented. A motion was made by Alderman Baker and seconded by Alderman Jones to accept the Executive Session Minutes dated April 11, 1996 as written. Motion carried. CITY TREASURER'S REPORT No Report CITY ADMINISTRATOR REPORT Administrator Nanninga updated the council regarding the Riverfront Project. The project is coming along well and a special thanks was expressed to J.T. Johnson who has been working on the project during his vacation time. Economic Development Commission Report The next meeting is Tuesday, May 14, 1996 at 7:00 p.m. in the Kendall County Board Room. Kendall County Governmental League Report No Report School Community Report Alderman Jones informed the council that two meetings have been scheduled. A special meeting to be held on April 29th at 6:30 p.m. and the regular school board meeting on May 28, 1996 at 7: 30 p.m. Old Business No Report New Business No Report COMMITTEE REPORTS PUBLIC WORKS COMMITTEE Re S C) (o -9 Step - Pay Increase - Public Works Dept., A motion was made by Alderman Stafford and seconded by Alderman Baker to enact an ordinance creating step pay increases for the Public Works employees including a 2% merit increase effective November 1, 1996 based upon the City Administrator's recommendation and, further that a position of Public Works Director be established as a salary of $50,000 per year. These modifications will supercede any and all conflicting previous legislation as it relates to these issues. A motion was made by Alderman Stafford and seconded by Alderman Baker to accept the March, 1996 Water Dept Report as presented. Motion carried. ECONOMIC DEVELOPMENT COMMITTEE No Report PUBLIC SAFETY COMMITTEE Police Chief Tony Graff acknowledged the presence of several parties due to the PROCLAMATION IN RECOGNITION OF NATIONAL POLICE WEEK. Chief Graff indicated that Master Sergeant Ken Kaupus and members of the Bob Browne family were on hand to recognize loved ones who had died in the line of duty, those being Robert Kolowski and Bob Browne. Also, several Yorkville Police were on-hand as well. • . .. City Council Regular Session - April 25, 1996 - page 5 It was also noted that a breakfast was being held on Sunday at the Moose from 7 - 11 a.m. to assist those police officers attending the 1996 Olympics under the Adopt-a-Cop program. A motion was made by Alderman Callmer and seconded by Alderman Stafford to purchase a Dictaphone System at a cost not to exceed $23,995 and this price reflects the State Contract Discount of $6,780. ADMINISTRATION COMMITTEE Resolution 96- /O Contract Agmt Mercy Center Emp Asst program A motion was made by Alderman Prochaska and seconded by Alderman Callmer to authorize the Mayor and City Clerk to sign the Agreement between Mercy Center for Health Care Services for the Employee Assistance Program. Clerk Allison called the role: Callmer - aye Lynch - aye Jones - aye Prochaska - aye Stafford - aye Baker - aye Motion carried. Resolution 96- I ( Creation of City Engineer Position A motion was made by Alderman Prochaska and seconded by Alderman Lynch to create a position known as City Engineer in the City of Yorkville in the City of Yorkville. Clerk Allison called the role: Lynch - aye Stafford - aye Jones - aye Prochaska - aye Callmer - aye Baker - aye Motion carried. A motion was made by Alderman Prochaska and seconded by Alderman Lynch to hire Joe Wyrot as City Engineer at a salary of $51 ,000 per year effective May 13, 1996. Clerk Allison called the role: Baker - aye Lynch - aye Jones - aye Stafford - aye Prochaska - aye Callmer - aye Motion carried. :._ Resolution 96-i Creation of City Engineer Position A motion was made by Alderman Prochaska and seconded by Alderman Lynch to approve the Resolution creating the position of engineering technician at a salary of $29,000 for the City of Yorkville. That the City of Yorkville shall observe May 12-18, 1996 as Police Week in the City. 2. That during Police Week the City of Yorkville shall support the Organization of Concerns of Police Survivors (C.O.P.S.) by flying blue ribbons in such support. 3. That in recognition of Police Week and the C.O.P.S. Program that City salutes and honors all law enforcement personnel who have died in the line of duty and extends this honor to special agent Robert Kolowski, a member of our community who died in the line of duty February 25, 1993 serving the Illinois State Police and who will have his name placed on the Illinois Law Enforcement Memorial on May 2, 1996 4. That by observance of Police Week the City of Yorkville, its governing body, staff and citizens extend their sincerest gratitude to all those who have served are serving and will serve as Law Enforcement personnel across the Country.
