MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF YORKVILLE, KENDALL COUNTY, ILLINOIS

Mayor Johnson called the meeting to order at 7:00 pm and led the Council in the Pledge of Allegiance.

AMENDMENTS TO THE AGENDA
Alderman Prochaska announced the Administration Committee would present the Levy for the 1996/97
fiscal year in the amount of$894.402.00. This would be presented for public hearing on December 19,
1996, and with passage of the levy the City Council can then vote on the levy in that amount or less.
Alderman Callmer announced the Public Safety Committee would be tabling the traffic item on the
agenda as it will go to C.O.W. first.

MINUTES APPROVAL
A motion was made by Alderman Prochaska, and seconded by Alderman Lynch to approve the minutes
of November 7, 1996.
Motion is carried.
BILLS APPROVAL
A motion was made by Alderman Prochaska and seconded by Alderman Lynch to approve the bill list in
the amount of$253,217.81 vendor, and $52,823.49 payroll., for a total of$306,041.30.
Alderman Jones asked if the payment to Scorpio Construction was the final payment. Administrator
Nanninga stated it was not, the City was holding 5% for retention and change order
Alderman Spang asked if the bill payment to R.J. Kuhn, would have saved on costs saving if the City
Crew had done the work, and what the policy was on work of that nature. Public Works Director
Johnson stated that it would have saved money. but in that situation the burden to show structural
damage is on the resident, and Kuhn in fact dug for two days without finding anything. Alderman
Prochaska asked if the bill being paid to Pandolphi was a final. Administrator Nanninga stated he felt it
wasn't as it was generally listed as final. Temporary Deputy Clerk Marker called the roll.

MAYOR'S REPORT
Mayor Johnson announced that in regard to the joint meetings between Plano Schools and City Council
and Yorkville Schools and City Council, he is presenting a proclamation tonight, as discussed at the last
City Council meeting. Alderman Prochaska made a motion and Alderman Spang seconded to pass the
Proclamation between Plano and Yorkville. Temporary Deputy City Clerk Makrer called the roll:

Mayor Johnson also reminded the Council of the C.C.I. meeting coming up on Tuesday, November 26
1996 at 7:00 pm at the Zieter Dickson Insurance Building. He encouraged the Aldermen to be involved
in this through being involved in the sub-committees.

CITY ADMINISTRATOR'S REPORT
Administrator Nanninga announced that the cost on the Elizabeth Street Storm Sewer had been
estimated at$79,954. The City received a payment for flood damage in the amount of S19,000. Making
the total outlay cost amounting to $61,000. Leaf pick-up went very well, and they were able to do the
North side and move to the South side the next day J.T. Johnson stated it went so well that they will do
both the North and South side again on Monday, 11/25.
Alderman Spang thanked Nanninga and the Public Works Director and Crew for a super job on the
Elizabeth Street Storm Sewer. Stating it was a real plus, and below budget.

Alderman Callmer asked for approval of the Job Description for Chief of Police with one amendment,
that it include attendance be mandatory to attend meetings.
A motion was made by Alderman Callmer and seconded by Alderman Spang to adopt the Job
Description for Chief of Police as amended, effective December 1, 1996. Temporary Deputy Clerk

Alderman Callmer made a motion and Alderman Jones seconded to approve appointment of Daniel C
Pleckham, Jr. to the position of full time Police Officer effective December 15. 1996 with a one year
probationary period, and with a salary prescribed by the current collective bargaining agreement for an

ADMINISTRATION COMMITTEE
Alderman Prochaska stated that after the C.O.W. last week it was the consensus of the council that they
present the public with a Levy for the 1996-1997 fiscal year in the amount of$894,402.00 which is
1.0076 as the taxing rate. It is an increase of 8.14% over last years expenses and therefore will go to a
Public Hearing on December 19, 1996, and will be on view at the City Offices. With passage the
Council can vote on a Levy in that amount or less_

Position Summary
The Chief of Police is an exempt position appointed by the Mayor with the approval of a majority
vote of the City Council. The Chief of Police works closely with the City Administrator and City
Staff to provide for prevention and suppression of crime,protection of life and property,enforcement
of laws and ordinances and the preservation of the peace.
The Chief of Police is the chief executive officer of the department and the final departmental
authority on all matters of policy, operations and discipline. He is responsible for the planning,
budgeting,staffing,directing,coordinating and controlling of all department functions and activities;
for maintaining safe working conditions in the department and overseeing compliance with the safety
procedures and policies of the City; for ensuring the continued efficient and effective operation of
the department; for the maintenance of positive relations with citizens of Yorkville, the City
government and all other agencies.
The Chief of Police ensures the City is provided with prompt emergency police services by planning,
organizing and directing the entire operation of the Police Department, including the implementation
of all authorized programs and activities.
Specific Duties and Responsibilities
1. Direct the administration and operations of the department in the most cost-effective manner.
2. Establish, in written form for all employees, policies, procedures,rules and regulations and
directions for administration and operation of the department.
3. Discipline employees in accordance with city ordinances, employee manual, collective
bargaining agreement(when applicable)and work rules for breaches of department policies,
procedures, rules and regulations and directions which measure within his authority.
4. Responsible for the fiscal management of budgetary resources.
5. Review offense reports, arrest reports, accident reports and case reports prepared by
Yorkville Police Department officers.
6. Prepare surveys or other reports as directed by the Mayor, City Council or City
Administrator making recommendations as needed.

7. Provide information to the media about department activities, investigations and projects.
8. Promote Community Oriented Policing philosophy by building a strong relationship with
citizen groups,business organizations, school,religious organizations, service organizations,
social agencies, and other law enforcement agencies.
9. Discharge all duties imposed upon him by law and ordinances of the city.
10. Be responsible for the faithful and efficient conduct of the operation of the department.
11. Be responsible for the enforcement and maintenance of law and order.
12. Have custody of all apparatus and property pertaining to the department and shall be
responsible for the maintenance thereof.
13. Shall make monthly report to the Mayor and the City Council of the activities of the
department during the month. The data to be submitted will indicate the current crime trend
report,juvenile, accident and other statistical data. The Chief of Police shall also make a
year-end report consisting of the same data. This report will be made available at the end of
the calender year.
14. Shall have the custody of all lost, abandoned or stolen property recovered in the city.
15. Shall see that all records and original reports shall be preserved and secured.
16. Shall be responsible for public safety planning for special events, in regards to the public
welfare of the community,IE:Traffic Plan,Carnival Safety,Crowd Control,Liquor Licensee
Review.
17. The Chief of Police may make or prescribe such rules and regulations as he/she shall deem
advisable. Such rules and regulations shall be binding on the members of the department.
Such rules and regulations may cover, besides the conduct of the members, uniforms and
equipment to be worn or carried, hours of service, vacations and all other similar matters
necessary or desirable for the improved efficiency of the department.
Educational Qualifications
1. Must be a state certified peace officer.
2. Minimum requirement is a Bachelor's degree in a police-related field, a Master Degree is
preferred.
3. Ten(10)years progressive experience with a law enforcement agency, at least five (5)years
of which are in a supervisory capacity with a comparably sized department.
4. Experience and specialized police training may substitute for education, IE: Federal Bureau

of Investigation, National Academy, Northwestern Staff& Command School, Southern
Police Institute Certificate.
5. Thorough knowledge of principles and practices of police administration and police methods
and procedures.
6. Good administrative and communication skills with a high level of professional standards.
7. Must possess strong leadership qualities.
Physical Qualifications
1. Must be in excellent health.
2. Must successfully complete a physical examination by the City's designated physician.
Office of the Chief of Police
The office of the Chief of Police is created as an executive office of the City government by City
ordinance and shall report to the Mayor.
The Chief of Police shall be specifically charged with the supervision of all members of the police
department and shall be held strictly responsible for the conduct and efficiency of all such members
for the general good order of the police department. The Chief of Police shall have a thorough
knowledge of all sections of the City of Yorkville and when going on duty shall immediately
familiarize himself with all police business transacted since his last tour of duty.
The Chief of Police shall diligently inquire into all complaints and charges of laxity or misconduct
in the performance of duty by members under his command and shall take such steps as set forth in
the department's rules and regulations, or as he may deem necessary when not in conflict with the
rules and regulations.
The Chief of Police in the exercise of his duties shall have the power to establish and enforce rules
and regulations for the governing of the members and employees of the department, which rules
shall,however, be consistent with the ordinances of the City of Yorkville and the laws of the State
of Illinois.
The Chief of Police shall cause the public peace to be preserved and shall enforce all ordinances of
the City of Yorkville of which the police department must take cognizance.
The Chief of Police is empowered to issue rules and regulations, general orders, special orders, and
bulletins to govern the members of the police department in the performance of their duties; and
these rules and regulations, general orders, special orders, and bulletins shall be binding on all
members of the police department.
The Chief of Police shall receive and give proper attention to complaints of all persons referred to
him and perform such other duties as may be required from time to time prescribed by the

department's rules and regulations.
The Chief of Police shall have full power and authority in his discretion to reprimand or suspend any
department member for disciplinary purposes, with or without pay, for a period of time not to
exceed three days in length. He may further file charges against any member of the department with
the Mayor and/or City Council for a review on non-conformance with these rules and regulations.
The Chief of Police shall maintain or cause to be maintained a personnel file for each employee of
the department. He/She shall have custody and control of all books, records, machines, tools,
apparatus or equipment of every kind necessary for use by the police department.
The Chief of Police shall develop the organizational structure of the department in accordance with
professional standards and, by consideration of sound management techniques and principles,
integrate related activities under the control of intermediate supervisors. He shall hold them
accountable for effective conduct of such activities.
The Chief of Police shall keep or cause to be kept, a record of all arrests made,with the name of the
person(s)arrested,and the cause therefor; and he shall keep or cause to be kept a record of all traffic
or other accidents reported to the Police Department which result in the loss or damage or injury to
persons or property.
The Chief of Police shall ensure that notice is given to the City Attorney of all arrests made by the
police department for violations of City ordinances. He/She shall notify the City Attorney of any
violation of City ordinance of which he/she becomes cognizant. He/She shall give like notice to the
State's Attorney where violations of state laws are involved.
The Chief of Police shall annually report in writing to the Mayor, and the City administration,the
overall condition of the police department with a detailed statement of transactions of the department
for the preceding year. This report shall include the administrative and law enforcement activities
of the department and shall show complete statistics of all police work in accordance with generally
recognized standards.
The Chief of Police shall prepare and submit to the Mayor each year a report of the financial
requirements of the department for the ensuing fiscal year.
The managerial duties of the position include evaluation the performance of the supervisors, as well
as, directing and overseeing the performance evaluation of all department personnel. The
performance evaluations are used to determine eligibility for merit pay for supervisory personnel.
The Chief of Police ensures compliance to all established City and Departmental policies and
procedures. This includes initiating disciplinary action and recommending promotions, demotions
and dismissal of departmental personnel. The position also recommends the hiring of all civilian
personnel.
The position reviews and approves the monthly manpower schedule,vacation schedule and overtime
requests for each division. The Chief of Police ensures that the department is properly staffed

according to established policy and the approved budget. This includes authorizing the temporary
transfer of personnel from one activity to another so that departmental objectives can be fulfilled.
The Chief of Police directs the preparation of the annual division budgets and approves the
departmental budget which is submitted to the City Administrator for consideration. The position
presents the budget to the City Administrator and subsequently, to the City Council. Once the
budget is approved,the Chief of Police implements the budget by directing the assignment of staff
and resources accordingly.
The position ensures that the sworn personnel receive the proper training by identifying and
assessing training needs,along with reviewing and approving the annual training programs designed
by the Training Coordinator. The Chief of Police attends City Council Meetings and subcommittee
meetings when necessary to provide technical advised on a broad range of police related topics.
The Chief of Police develops and maintains communications and working relationships with other
law enforcement agencies,judiciary officials and civic and professional groups. In addition, the
position works closely with residents and citizen groups to resolve community related problems,
thereby, developing a positive police image in the community.
