THE KENDALL COUNTY BOARD ROOM ON Thursday, October 12, 1995
Mayor Johnson called the meeting to order at 7: 00 p.m. and led the
Council in the Pledge of Allegiance.

Mayor Johnson asked those present to introduce themselves.

MEETING DATES
The council reviewed the listing of meetings. Meetings will be
held as follows:
Public Works Committee -- October 23 , 1995 at 6:30 p.m.
Administration Committee -- October 30, 1995 at 7:00 p.m.
Economic Development Committee -- October 17, 1995 at 7:00 p.m.
Public Safety Committee -- October 24, 1995 at 6: 30 p.m.
All of the above meetings will be held in Suite 3 , Conference Room,
in the Kendall County Building.
PUBLIC HEARING -- NONE
PLAN COMMISSION / ZONING BOARD OF APPEALS
Alderman Baker reported that the Plan Commission was held where the
rezoning for the old button factory located on Hydraulic was
discussed. A few concerns were brought up which will be discussed
at the next Economic Development Committee meeting and then the
Committee of a Whole on Thursday.

MINUTES APPROVAL
A motion was made by Alderman Baker and seconded by Alderman Spang
to approve the regular council minutes dated September 28, 1995.
BILLS APPROVAL
Alderman Prochaska indicated that a payment of $1,005.00 should be
removed from the bill list as indicated on page 6 to Pandolfi .
This indicates it is payment for the final audit. Due to the fact
this has not been received, this bill will not be paid at this
time.

A motion was made by Alderman Prochaska and seconded by Alderman
Spang to pay bills in the corrected amount of $106, 765.05 vendor
bills, with payroll of $48,782 .65 for a total corrected amount of
$155,547 .70. Clerk Allison called the role:

ATTORNEY'S REPORT
Attorney Kramer stated that he has distributed three resolutions
which will be discussed during the Public Works Committee report.
Also, he has received signed easements for the F.E. Wheaton
property from the Peter Washington Land Trust. Commonwealth Edison
has agreed to an easement and the Burlington Northern easement is
being worked on.
Attorney Kramer also indicated that he is working on the revised
language on the Conover EPA permit process and it is going well.
MAYOR'S REPORT
Mayor Johnson presented a 20 year service plaque to City Employee
Luanne Erickson. Luanne has worked for the City of Yorkville 20
years as of September 1, 1995. Mayor Johnson thanked her for her
service to the City.
Mayor Johnson announced that the City of Yorkville's trick-or-treat
hours will be on October 31, 1995 between the hours of 4 p.m. and
7 p.m.
Mayor Johnson announced that the Town Meeting will be held on
October 16, 1995 at 7:00 p.m. at the Beecher Building.

CITY ADMINISTRATOR REPORT
Administrator Nanninga reported on several projects in process.
The Hydraulic Street repaving project has begun. Sidewalks have
been removed and it should be completed within two weeks. The
Super 8 Motel has been started, and the Center Parkway Street
project should have curbs completed next week and then the blacktop
will be completed.
Economic Development Commission Report
Mayor Johnson reported that the committee approved the Accurate
Enterprise Loan request. This company is located in the Industrial
Park. This will be presented to the full County Board for final
approval.

Aug/Sept 1995 Building Reports
A motion was made by Alderman Stafford and seconded by Alderman
Baker to approve the August 1995 and September 1995 Building
Reports as presented.
Resolution 95-34 Rejecting Water Tower Painting Bids
A motion was made by Alderman Stafford and seconded by Alderman
Prochaska to approve the Resolution Rejecting Water Tower Painting
Bids. Clerk Allison called the role:

Resolution 95 - 35
** Authorizing Acceptance and Execution of Illinois
Pollution Control Board Order PCB 95-142 issued September 7, 1995
A motion was made by Alderman Stafford and seconded by Alderman
Prochaska to approve the Resolution to accept the Illinois
Pollution Control Board order and authorize the Mayor and City
Clerk to execute the Board order on behalf of the City. Clerk
Allison called the role:

ECONOMIC DEVELOPMENT COMMITTEE
#95 - 25 An Ordinance Amending Chapter 1 of Title Two of
the Yorkville City Code to Modify the Plan Commission Membership
A motion was made by Alderman Baker and seconded by Alderman
Sowinski to approve An Ordinance amending Chapter 1 of Title two of
the Yorkville City Code to modify the Plan Commission Membership.
Attorney Kramer clarified the changes made in the ordinance. It
was indicated that one word, additional, was deleted where it
states the Plan Commission includes these members and also, the
word has been changed from shall to may as previously discussed.

PUBLIC SAFETY COMMITTEE
A motion was made by Alderman Stafford and seconded by Alderman
Baker to approve the April, May, and June 1995 Monthly Police
Reports as presented. Motion carried.

A motion was made by Alderman Stafford and seconded by Alderman
Baker to approve the CPAT Quarterly Reports as presented.
Chief Graff indicated that this refers to the June 1 - August 31,
1995 quarterly report. Alderman Sowinski asked what happens to the
seized vehicles referred to in the report. Chief Graff responded
that the vehicle may be awarded to the CPAT unit and they in turn
would determine what occurs with the vehicle. Motion carried.
ADMINISTRATION COMMITTEE
The committee will begin to discuss the tax levy at the next
committee meeting.
ADDITIONAL BUSINESS
Executive Session
Yorkville Police Dept j Collective Bargaining
A motion was made by Alderman Baker and seconded by Alderman Lynch
to move into Executive Session at 7:22 p.m. to discuss the
Collective Bargaining for the Yorkville Police Officers. Session
is to include the City Attorney, Chief Graff, City Administrator.

A five minute recess will be taken prior to closing the session.

A motion was made by Alderman Stafford and seconded by Alderman
Baker to approve the employment agreement between the United City
of the Village of Yorkville and the Illinois Fraternal Order of
Police Labor Council / Yorkville Patrolman Unit effective through
April 30, 1998; and to further authorize the Mayor and City Clerk
to execute the written agreement upon conformation of the actual
written agreement to the terms of the ratified employment
agreement, effective May 1, 1995. Clerk Allison called the role:

Executive Session -- Litigation
A motion was made by Alderman Baker and seconded by Alderman
Prochaska to move into executive session to discuss any current and
on-going litigation with the City of Yorkville; session to include
the City Attorney, Chief Graff and City Administrator Nanninga.

Mayor Johnson announced that there was no action taken in regard to
the second executive session held this evening.
**** Alderman Lynch announced the Haunted House to be held at 507
West Ridge this Friday and Saturday. Proceeds will be donated to
the WSPY Children's Christmas Fund and any canned goods will be
donated to the local food pantry.
