City Council Minutes 1994 12-01-94 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT KENDALL COUNTY BOARD ROOM, ON December 1, 1994 Mayor Kittoe called the meeting to order at 7: 00 p.m. and led the Council in the Pledge of Allegiance. Clerk Allison called the roll: ROLL CALL Ward 1 - Callmer Present Ward 2 - Baker Present Clark Present Ward 3 - Prochaska Present Wold Present Ward 4 - Johnson Present Stafford Present A quorum was established. OUORUM INTRODUCTION OF GUESTS Mayor Kittoe asked those persons present to introduce themselves. Amendments to the Agenda Plan Commission - None Public Works - Addition of a Report on the Traffic Study Administration -- Addition of Truth and Taxation Ordinance MEETING DATES The following meeting dates were announced and/or confirmed: Public Works December 12, 1994 7: 00 p.m. Beecher (will cancel the December 5 & 19 meetings scheduled) Economic Dev. December 7, 1994 7: 00 p.m. City Hall Public Safety to be scheduled Administration December 6, 1994 7 : 00 p.m. City Hall Adhoc December 12, 1994 6: 00 p.m. Beecher PUBLIC HEARINGS NONE PLAN COMMISSION / ZONING BOARD OF APPEALS NONE CITIZEN COMMENTS NONE MINUTES APPROVAL Alderman Prochaska made a motion to accept the minutes from the regular council meeting of November 17, 1994 and approve the minutes as presented. Seconded by Alderman Clark. Motion carried. BILLS APPROVAL Alderman Stafford made a motion to approve and pay bills in the amount of $88, 640.81 vendors, with total of $135, 504 . 55 with payroll. Seconded by Alderman Johnson. There were several questions asked concerning payment of various bills on the listing. Treasurer Bill Baird or the appropriate Department Head responded to the questions asked. Mayor Kittoe asked the Administration Committee, along with the Department Heads, Jim Nanninga and Tony Graff, review the City's usage and price being paid on gasoline purchases. Tony Graff did indicate that the police department had recently reviewed the department's usage. ATTORNEY'S REPORT Attorney Kramer indicated that the proposed Levy ordinance has been prepared and reviewed. Also, the Hart and County easements are completed. Jim Nanninga's revised contract has been submitted to Committee for final review. MAYORS REPORT Alderman - Ward I Mayor Kittoe has recommended that Jeffrey Spang be sworn in as Alderman for Ward I for the remaining five months of this term. A motion was made by Alderman Callmer and seconded by Alderman Clark to approve Mayor Kittoe's recommendation for Jeffrey Spang to be Alderman, Ward I for the remaining five month term. Clerk Allison called the role: Wold - aye Stafford - aye Prochaska - aye Johnson - aye Clark - aye Callmer - aye Baker - aye Motion carried. Mayor Kittoe swore in Jeffrey Spang as Alderman Ward I. Executive Session A motion was made by Alderman Wold and seconded by Alderman Baker to move into executive session to discuss Chief Graff 's recommendation for disciplinary action. Chief Graff, Attorney Kramer, City Clerk, Council members and the Mayor will be in attendance. Clerk Allison called the role: Baker - aye Callmer - aye Clark - aye Johnson - aye Prochaska - aye Stafford - aye Spang - aye Wold - aye Motion carried. A motion was made by Alderman Johnson and seconded by Alderman Wold to move out of executive session into regular council meeting. Clerk Allison called the role: Johnson - aye Clark - aye Callmer - aye Baker - aye Wold - aye Stafford - aye Prochaska - aye Spang - aye Motion carried. Mayor Kittoe stated that "As Mayor of the United City of the Village of Yorkville, I hereby approve the recommendation of Chief Graff to take disciplinary action to dismiss Thomas Barna as a Yorkville Police Officer pursuant to the recommendations of Chief Graff dated November 17 , 1994 and December 1, 1994 , effective as of December 2, 1994. " City Council Regular Meeting - Dec. 1, 1994 - page 3 A motion was made by Alderman Callmer to concur with the Mayor's approval of the Police Chief's recommendation to dismiss Lt. Thomas Barna from the Yorkville Police Department. Motion was seconded by Alderman Johnson. Clerk Allison called the role: Callmer - aye Johnson - aye Baker - aye Prochaska - aye Stafford - aye Wold - nay Clark - nay Spang - present Motion carried with a vote 5 ayes to 2 nays. CITY CLERK REPORT - no report CITY TREASURER REPORT Treasurer Baird stated that the audit on the North sewer project is in process. CITY ADMINISTRATOR REPORT Administrator Nanninga stated that the Committee of a Whole meetings will be held in the Austin room at the Beecher Center for the month of December. Administrator Nanninga stated that the street lights in the Countryside subdivision are in place and working. KENDALL COUNTY ECONOMIC DEVELOPMENT - no report KENDALL COUNTY GOVERNMENTAL LEAGUE REPORT - no report SCHOOL COMMUNITY REPORT Alderman Johnson reported that he will be attending a meeting to review and analyze the school district's space and curriculum needs. The next school board meeting will be on December 5, 1994 at 7: 30 p.m. OLD BUSINESS - none NEW BUSINESS - none COMMITTEE REPORTS PUBLIC WORKS COMMITTEE Alderman Prochaska stated that Bob Smith of Pavia Martin has requested that all corrections needed on the Traffic Study be submitted by Tuesday December 6th. A final report will then be completed. ECONOMIC DEVELOPMENT COMMITTEE - no report PUBLIC SAFETY COMMITTEE - no report City Council Regular Meeting - Dec. 1, 1994 - page 4 ADMINISTRATION COMMITTEE ORDINANCE 94-42 Alderman Stafford made a motion to adopt a Tax Levy for Corporation and Special Purpose Real Property taxes for 1994 - 1995 Fiscal Year in the amount of $696, 035. Motion was seconded by Alderman Prochaska. Clerk Allison called the role: Baker - aye Callmer - aye Clark - aye Johnson - aye Prochaska - aye Stafford - aye Wold - aye Spang - aye Motion carried. The next meeting will be held on Tuesday, December 6, 1994 at City Hall.
