City Council Minutes 1994 11-03-94 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT KENDALL COUNTY BOARD ROOM, ON November 3, 1994 Mayor Kittoe called the meeting to order at 7: 00 p.m. and led the Council in the Pledge of Allegiance. Clerk Allison called the roll: ROLL CALL Ward 1 - Callmer Present Ward 2 - Baker Present Clark Present Ward 3 - Prochaska Present - Wold Present Ward 4 - Johnson Absent Stafford Absent A quorum was established. OUORUM INTRODUCTION OF GUESTS Mayor Kittoe asked those persons present to introduce themselves. December 7, 1994 7 : 00 p.m. City Hall Downtown Revitalization Nov. 8, 1994 7 : 00 p.m. City Hall Public Safety November 21, 1994 6: 30 p.m. Beecher Administration November 15, 1994 7: 00 p.m. City Hall Special Service Area Nov. 7, 1994 8 : 00 p.m. Yorkville National Bank - Fox Industrial Park Traffic Study November 14, 1994 7: 00 p.m. St. Pat's PUBLIC HEARINGS NONE PLAN COMMISSION / ZONING BOARD OF APPEALS Alderman Baker indicated that the Country Hills Subdivision, (Dwyer) final plat has been reviewed and recommended for approval by the Plan Commission as well as the Planning Council. Alderman Prochaska asked if the changes on the covenants had been made. Alderman Baker reminded everyone that this is not a City issue. A motion was made by Alderman Baker to approve the final plat on Dennis and Barbara Dwyer, Country Hills Subdivision Unit One, pending final engineering approval of Bill Schmanski. Seconded by Alderman Prochaska. Bill Schmanski indicated that no problems are anticipated with the final engineering as the developers agreed to all changes requested. The changes which were requested were very minor changes. Clerk Allison called the role: Stafford - aye Wold - aye Clark - aye Johnson - aye Callmer - aye Baker aye Prochaska - aye Motion carried. Regular Council Minutes - November 3 , 1994 - page 2 CITIZEN COMMENTS Ross Ament, Yorkville's representative to the Aurora Area Tourism Council introduced Sue Voss, the Executive Director of the Aurora Area Tourism Council. Ms. Voss gave a brief presentation on the Tourism Council and what their goals and objectives are. The Tourism Council has asked for additional input from the City of Yorkville on how they would like the City of Yorkville's Tourism to develop. Dr. Robert Coleman of the Open Door Rehabilitation Center informed the Council that the Open Door has a building in the Fox Industrial Park that can be rented or purchased. He informed the Council of this building in case the City has a need to rent the building until the City finalizes its plans for updated locations of the administrative and police departments. He stated that an on-site view of the property could be organized if the city council was interested. The rental price would be at $2 per square foot. MINUTES APPROVAL Alderman Baker made a motion to accept the minutes from the regular council meeting of October 27, 1994 and approve the minutes as presented. Seconded by Alderman Johnson. Motion carried. BILLS APPROVAL Alderman Prochaska made a motion to approve and pay bills in the amount of $73 ,707 . 19 as presented. Seconded by Alderman Clark. Alderman Prochaska asked if the bill to the State of Illinois that was tabled at last week's meeting was researched. Administrator Nanninga stated that the agreement between the State and the City was located and that the bill was appropriate. ATTORNEY'S REPORT ORDINANCE 1994-40 Attorney Kramer indicated that previously the Council had taken action on some easements in the Woodworth Subdivision but at that time written form was not completed. Alderman Baker made a motion to approve Ordinance 94-40, an Ordinance Vacating / Roadway easements in the Woodworth Estates Subdivision, Phase Four. Seconded by Alderman Prochaska. Clerk Allison called the role: Stafford - aye Clark - aye Wold - aye Prochaska - aye Johnson - aye Baker - aye Callmer - aye Motion carried. MAYORS REPORT Mayor Kittoe informed the Council that a letter was received from the Elmhurst Bicycle Club thanking the City for its help in making their July Invitational Tour a success. Mayor Kittoe read the letter allowed. The Bicycle Club donated $500 to the City. Regular Council Minutes - November 3 , 1994 - page 3 Chief Graff stated that one possibility of the use of the funds would be towards the Beecher Center since the Club did utilize the building for the Tour. Mayor Kittoe indicated that an appointment will be made at the next council meeting for the Ward I Council position. Mayor Kittoe appointed Bob Johnson as Vice Chairman of the Administration Committee. CITY CLERK REPORT - no report CITY TREASURER / BUDGET OFFICER REPORT Treasurer Baird indicated that the proposed levy was discussed at the Administration Committee meeting. The levy will represent an increase at approximately 13%. This will realize an increase of $10. 66 (2 .37% increase) on a $138, 500 assessed valued home. A discussion was held concerning the proposed levy and the need to hold a Truth and Taxation hearing. Treasurer Baird indicated that the sales tax in the City of Yorkville is lagging behind neighboring communities. If the City could increase local business this would help the local citizens tax billings. Treasurer Baird reported that the Annual Treasurer's Report has been submitted and filed. Alderman Stafford publically announced a 12 .95% increase which would represent a $10. 60 per home increase on a home assessed at $140, 000 value which would be a 2 . 37% increase to the homeowner. The Truth and Taxation Hearing will be scheduled for December 1, 1994 at 6: 00 p.m. prior to the normally scheduled City Council meeting. The tentative levy amount will be $696, 035. CITY ADMINISTRATOR REPORT Administrator Nanninga reported that Real Estate Inspections of Wheaton has been hired to view the Courthouse building and to double check all of the data. Administrator Nanninga reported that the site work on the Meetballs building discussed at the last council meeting will begin on November 15th. Mayor Kittoe stated that he offered to help Mr. Ryan but was not contacted concerning this issue. Administrator Nanninga reported that a problem has developed at the southwest sewer extension at Silver Dollars Restaurant. The contractor has notified the State Fire Marshall concerning the gas tank located at this site. A discussion was held concerning this matter and what avenues the City has to proceed with their work. In order to continue the process on the other side of the street it would cost an additional $35, 000. This would be pooled into the other costs and would be covered by recapture fees. There is approximately $26, 000 remaining in the budget. The additional $10, 000 would need to be located. Attorney Kramer will visit with Administrator Nanninga concerning this issue. A motion was made by Alderman Baker and seconded by Alderman Prochaska to authorize up to $35, 000 additional funds to complete the south sewer project. Regular Council Minutes - November 3 , 1994 - page 4 Alderman Clark asked why there were no garbage fee increases in the budget. It was commented that this was due to the commercial property owners who pay this fee but do not receive any benefit from it. Administrator Nanninga reported on the Countryside street lights project. The recommendation will be to purchase brand new light poles and not utilize the eight previously discussed. The original amount budgeted for the project was $15, 000 with the new budget reflecting $16, 000. The actual cost will be $18,500. Wiring will be additional. A motion was made by Alderman Baker to approve an additional $2,500 for purchase of street lights for Country Club Estates. Seconded by Alderman Stafford. The motion was amended by Alderman Baker to read Countryside Subdivision. Seconded by Alderman Johnson. Clerk Allison called the role on the amended motion: Clark - aye Baker - aye Prochaska - aye Stafford - aye Johnson - aye Wold - aye Callmer - aye The amended motion carried. Alderman Clark stated that she would like to be sure that part of the $60, 0000 budgeted for Main street remains in place for Main Street. Administrator Nanninga stated that Yorkville will be able to benefit from Aurora' s volume sales if the place their orders along with the City of Aurora's. Fliers will be distributed to the public at large concerning the traffic study meeting to be held on November 14, 1994 at St. Pat's Parish. Also, a letter has been prepared and sent to the Historical Society concerning City Hall. KENDALL COUNTY ECONOMIC DEVELOPMENT - no report KENDALL COUNTY GOVERNMENTAL LEAGUE REPORT - no report SCHOOL COMMUNITY REPORT - no report OLD BUSINESS The closing for the sale of the City's North property house will be held upon the signing and the recording of the plat. NEW BUSINESS - none COMMITTEE REPORTS PUBLIC WORKS COMMITTEE A motion was made by Alderman Prochaska and seconded by Alderman Clark to accept the July and August 1994 Building Department reports and the August 1994 Water Department Report. This must be completed by 2 : 00 p.m. Friday. ADMINISTRATION COMMITTEE Alderman Stafford stated that the following items will be on the agenda for the November 15th committee meeting: Perc tests for southside sewer extension proposed tax levy personnel manuals courthouse review of information A garbage surcharge will be discussed at next week's Committee of a Whole meeting. ADHOC / RECYCLING COMMITTEE - no report ADDITIONAL BUSINESS - none ADJOURNMENT Motion was made by Alderman Prochaska and seconded by Alderman Johnson to adjourn the meeting at 8 :25 p.m. .
