City Council Minutes 1993 11-04-93 MINUTES OF THE REGULAR MEETINB OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD Mayor Kittoe called the meeting to order at 7: 00 PM and led the Council in the Pledge of Allegiance. QUORUM NITRODUCl"101\1 OF GUESTS Mayor Kittoe asked all present to introduce themselves. A motion was made by Alderman Johnson and seconded by Alderman Baker to move into public hearing on PC-93-8, John Conover and PC-93-10, John Lies. Motion carried. Attorney Kramer presented information regarding the John Conover request to annex and rezone the property led ated north of Faxon and west on Cannonball Trail into the City of Yorkville as A-1 zoning. Attorney Kramer presented information regarding the request for John Li to annex and rezone the property located at the southwest corner of the intersection of on Rd. and Cannonball Trail as A-1 zoning. A motion was made by Alderman Prochaska and seconded by Alderman Jones to close the public hearings on PC 93-87 John Conover and PC 93-10, John Lies. Motion carried. Alderman Johnson made a motion to accept the minutes of the October 28, l993 meeting as presented. Seconded by Alderman Stafford and motion carried. RILI APPROVAL Alderman Baird moved to approve and pay bills in the amount of City Council Minutes - November 49 1993 - Page 2 $214,247. 31 as presented. Seconded by Alderman Baker. Deputy Clerk Bell called the roll : Baird - Aye Baker - Aye Callmer - Aye Clark - Aye Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Motion carried 8-0. CITIZENS COMMENTS David and Mary Steidl of 413 E. Somonauk in Prairie Lands Subdivision , presented information regarding a problem in their back yard of standing water. Administrator Peck stated that a storm sewer must be constructed. He will get with Jack Purcell and Barry Niles as it is the responsibility of the subdivision developer and the adjacent subdivision developer to correct the problem. Administrator Peck will have a report by next week. ANNEXATION OF PC 93-8 jOHN CONOVER A motion was made by Alderman Jones to annex and rezone PC 93-8, John Conover from Kendall County A to City Ag-1 zoning. Seconded by Alderman Baker. Deputy Clerk Bell called the roll : Clark - Aye Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Baker - Aye Callmer - Aye Motion carried 8-0. A motion was made by Alderman Jones and seconded by Alderman Prochaska to authorize the Mayor and Clerk to sign the annexation agreement for PC 93 8, John Conover. PC 93-13 COOPER ANNEXATION AGRE,EMENT. A motion was made by Alderman Jones to authorize the Mayor and Clerk to sign the Annexation Agreement for PC 93-13, Cooper 's Home Furnishings that was approved at the meeting on October 28, 1993. ATTORNEY 'S REPORT Attorney Kramer passed out correspondence regarding pending litigation. He reported that the Remline annexation papers should be to us by December. He would like to have this before the Tax Levy is passed. Also discussed was drafting a nuisance ordinance. He has also been in contact with Amoco in regard to that property. MAYOR 'S REPORT A motion was made by Alderman Callmer and seconded by Alderman Jones to approve a resolution to pay the Aldermen a flat fee for salary for 24 meetings per year and they would also be paid extra for Special City Council meetings. City Council Minutes November 4, 1993 - Page 4 CITY CLERK 'S REPORT - No report. CITY TREASURER/BUDGET OFFICER 'S REPORT Treasurer Huston passed out the final audit report and management letter for 1993 from Pandolfi , Topolski , Weiss & Co. , Ltd. A meeting will be held with Pandolfi on November 15, 1993 to answer questions on this report. Alderman Baird made a motion to accept the audit report as presented from Pandolfi , Topolski , Weiss & Co. , Ltd. Seconded by Alderman Jones. Deputy Clerk Bell called the roll : Callmer - Aye Clark - Nay Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Baker - Aye Motion carried 7-1 . Treasurer Huston would like to have • the treasurer 's report approved each month. ADMINISTRATOR 'S REPORT Administrator Peck recommended that the City purchase the backhoe from Caterpillar. The old backhoe is too costly to repair and would be used for backup. It would be paid for out of Public Works Development Fees. NEW BACKHOE PURCHASE Alderman Baird made a motion to authorize the Mayor and Clerk to sign the agreement to purchase the backhoe from Caterpillar at a cost of $48,675. 00. Seconded by Alderman Baker. Deputy Clerk Bell called the roll : Baird - Aye Baker - Aye Callmer - Aye Clark - Aye Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Motion carried 8-0. Administrator Peck recommended that the water line be extended through the alley to Van Emmon on the west side of Rt. 47. WATER LINE IN ALLEY ON W. SIDE OF RT. 47 Alderman Clark made a motion to approve the expenditure of not more than $12,000. 00 to run the water line through the alley to Van Emmon on the west side of Rt. 47 behind the downtown businesses and for the cold patch. Seconded by Alderman Callmer. SCHOOL. - The next: school board meeting will be Monday, November 8, 1993 at 7:30 PM.. OLD BUSINESS - Alderman Baker inquired about the computer planning for the City by Wheeler , Inc. Wheeler has been contacted and they Mayor is waiting to hear from him. - Attorney Kramer has correspondence regarding the Ken:Jail l County Council of Government asking that the City participate in this organization. R �~7��~�J� - �� � Alderman Clark made a motion that the City pass a resolution to approve the Intergovernmental Agreement to participate in the Kendall County Council of Governments. Seconded by Alderman Baker and Deputy Clerk Bell called the roll : Baker - Aye Callmer - Aye Clark - Aye Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Motion carried 8-0. PUBLIC WORKS commIrr Alderman Clark thanked Administrator Peck for the letters that were sent to residents regarding the Cannonball Trail project. Alderman Clark made a motion to accept the October Building Report as presented. Seconded by Alderman Prochaska and motion carried. The yield signs at the corner of Cannonball Trail and John St. have been taken care of Alderman Prochaska thanked all who worked at the new City Park last Saturday. It was suggested that the fence line in Countryside also be cleaned up. Alderman Prochaska reported that the bin is still there. The Oliver/Niles annexation must go back to the Planning Commission. A Building and Zoning Committee meeting will be held on Thursday, December 9 1 993 at 6: 00 PM to discuss this annexation. Alderman Clark will attend the Bristol Township meeting on Mondayv November 8, 1993 at 7: 00 PM. . . ^ . City Council Minutes November 4, 1993 - Page 6 Administrator Peck reported that a meeting will be held on Tuesday, November 9, 1993 at 3: 00 PM at Jim Olson 's office with himselfv Olson and the Niles/Oliver developers to discuss the routing of the sewer. PUBLIC SAFETY COMMITTEE Alderman Johnson reported that a presentation on street gangs will be held on November 17, 1993 at 8: 00 PM at the Yorkville National Bank. The next Public Safety Committee meeting will be held on Tuesday, December 7, 1993 at 5: 30 PM at City Hall , ADMINISTRATION COMMITTEE Alderman Baird passed out information regarding assessments in the City of Yorkville. This information will be helpful in preparing the Budget. The Tax Levy Ordinance will be discussed at the Committee of the Whole meeting next Thursday. AD[JOC/RECYCLING COMMITTEE Alderman Clark reported that the Committee and TCD Services attended the Lions Club meeting on Tuesday night and it was well received.
