City Council Minutes 1993 05-13-93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON MAY 13, 1993 Mayor Kittoe called the meeting to order at 7 : 00 p.m. and led the Council in the Pledge of Allegiance. Clerk Allison called the roll : ROLL CALL Ward 1 - Baird Present Callmer Present Ward 2 - Baker Present Clark Present Ward 3 - Jones Present Prochaska Present Ward 4 - Johnson Present Stafford Present A quorum was established. QUORUM MINUTES APPROVAL Alderman Baird moved to waive the reading of the minutes from the April 22 , 1993 regular council meeting and approve the minutes as presented. Seconded by Alderman Johnson. Motion carried. BILLS APPROVAL Alderman Baird moved to approve and pay bills as presented. Seconded by Alderman Jones . Clerk Allison called the roll : Callmer - Aye Clark - Aye Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Baker - Aye AWARDS - PAST ALDERMAN Alderman Jones presented Awards to the Past City of Yorkville Alderman in attendance at the meeting. Those presented with the awards were Past-Alderman Jahp and Past-Alderman Pfister. CITIZEN COMMENTS Kim Crowe of Yorkville informed the Council of the upcoming St. Jude' s Bike A Thon to be held on May 22, 1993 from 9 a.m. to Noon in the City of Yorkville. Don Peck requested permission for a Block Party to be held May 23, 1993 on behalf of Yorkville resident, Inez Florence, at the East end of Fox Street. A fire lane will remain open during the entire party. At this time, Alderman Jones presented an Award to Past City Alderman Bown for his years of service to the City of Yorkville. PLAN COMMISSION / ZONING BOARD OF APPEALS Mayor Kittoe reported that the next Plan Commission meeting will be held on Wednesday, May 19 , 1993 . The agenda for this meeting is quite large. Each alderman has received a packet of the six public hearings to be held that evening. Several annexations are on the agenda. There will also be several other items discussed at this meeting. ATTORNEYS REPORT -- No Report MAYORS REPORT Mayor Kittoe read the Proclamation to designate the week of May 23 - 29, 1993 as Emergency Services Week. Bob Smith, Administrator of the Association was present at the meeting to answer any questions regarding the event. A full week is planned and all are encouraged to attend. Page 2 -- May 13, 1993 City Council Meeting Mayor Kittoe informed the Council that a discussion will be held next Thursday, May 20th at the Committee as a Whole meeting to discuss committee appointments . Mayor Kittoe made the following appointments : Daniel Kramer City Attorney Don Peck City Administrator Anton Graff City Police Chief Anne Scholle Recreation Director Robert Jackson Library Director J.T. Johnson Superintendent Public Works Joe Moore Water Operator in Charge Delene Drew Budget Officer Alderman Clark made a motion to reappoint the individuals listed above. Alderman Jones seconded. Motion carried. Mayor Kittoe reappointed Sandy Adams to the Planning Commission. A motion was made by Alderman Callmer to accept the appointment. Seconded by Prochaska. Motion carried. The Mayor will be reviewing the Library Board and Park Board members . The Yorkville Area Chamber of Commerce Business After Hours will be held on Tuesday, May 18, 1993 at the Williamsburg Inn from 5 p.m. - 7 p.m. CITY CLERK' S REPORT -- No Report CITY TREASURER' S REPORT / Budget Officer' s Report The Preliminary Budget Report through April 30, 1993 was distributed for the Council to review. The Budget was previously distributed to the Council . There are some line item transfers needed. These do not increase the budget however move the funds from one area to another. This will be discussed in Committee after the Council has had time to review the changes . A resolution will be presented at the next council meeting. The City has issued the $15,000 check to the Yorkville Lions Club for the pool . This will be given to Chuck Stading, a member of the Lions Club Board. Also discussed was the need to authorize additional persons to be on the City' s checking accounts and safety deposit boxes . This will be discussed further at Committee Meeting on Thursday. Two signatures are required on all checks . A resolution will be presented at the next Council meeting. Treasurer Huston also requested names of the newly elected officials who wish to attend the Illinois Municipal League Conference in Rosemont on June 4 and 5 . Anyone interested should contact the City Office as soon as possible so that Reservations can be made. A Saturday meeting can be set up for the Treasurer and Budget Officer to explain and familiarize the new Council Members with the City Budget. If anyone is interested, please notify the City Office. A discussion was held regarding mileage reimbursement for City business . Currently, the City is paying $ . 20 per mile. Treasurer Huston is recommending that the City implement a policy to pay the IRS prevailing rate. The IRS prevailing rate was $ .28 per mile as of January 1992 . The State of Illinois prevailing rate is $ .25 per mile. The proposed Employee Policy Manual will indicate a rate to be paid at the IRS mileage rate. Page 3 -- May 13, 1993 City Council Meeting Alderman Baird made a motion that as of May 1, 1993 the City of Yorkville will reimburse all City Employees and Officials at the IRS prevailing rate of mileage reimbursement. Seconded by Alderman Jones . Roll Call : Baker - Aye Callmer - Aye Clark - Aye Johnson - Nay Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Motion Carried 7-1 . CITY ADMINISTRATOR' S REPORT The City has been looking at trailers to purchase for hauling mower equipment. Several trailers have been viewed. A discussion was held regarding the types of trailers viewed and what was actually needed. Administrator Peck is recommending that the Council approve up to $1,080 to purchase a new trailer. A motion was made by Alderman Clark to authorize Administrator Peck to purchase a new trailer to haul mower equipment at $1,080 . Seconded by Alderman Jones . The motion was amended by Alderman Clark to read: To purchase a new trailer to haul mower equipment not to exceed $1,080 . Amended motion was seconded by Alderman Johnson. Roll Call : Johnson - Aye Jones - Aye Prochaska - Aye Stafford - Aye Baird - Aye Baker - Aye Callmer - Aye Clark - Aye The motion carried 8-0 . The original motion was then voted on: Prochaska - Aye Stafford - Nay Baird - Aye Baker - Aye Callmer - Aye Clark - Aye Johnson - Nay Jones - Aye The motion carried 6-2 . PUBLIC WORKS / WATER REPORTS - No Report POLICE REPORT A Respect the Law Banquet was held on April 29th which was sponsored by the Oswego Optimist Club. Alderman Johnson attended on behalf of the City. Sgt. Ron Diederich of the Yorkville Police Department was a candidate for Officer of the Year. This recognition was due to Sgt. Diederich going beyond the call of duty to help a citizen in need. The plaque received from the Optimist Club was re-presented to Sgt. Diederich. A packet of information was distributed to the new Alderman for their review. This information represents the recent Collective Bargaining data, CPAT information, and the end of year Police Report. Also distributed to the Council was a letter of Thanks received from the Aurora Board of Realtors regarding the recent Safety Class presented to the area realtors . Chief Graff also distributed a survey received from the Metro Chicago Information Center regarding persons moving from the city to the suburbs and the reasons why people make this move. Page 4 -- May 13, 1993 City Council Meeting Chief Graff reported on a recent squad car accident. The insurance carrier, attorney, and Alderman Clark were notified. The low bid for the repair was received from the Old Coach Works at $568 . The person did not have insurance. Attorney Kramer recommended the State ' s Attorney' s office be notified. This has been done. BUILDING DEPARTMENT REPORT - No report. BEECHER BUILDING REPORT - No report. PARK BOARD REPORT - A Park Board meeting was held last evening. Alderman Baird was unable to attend. Alderman Baird reported on a need for outside ash tray' s at the Beecher Building due to the No Smoking Ordinance. There are no facilities for persons to utilize when disposing of their smoking materials . Alderman Baird read a letter received from the Department of Conservation regarding a boat access on the river. Possible grant alternatives will be discussed at the next Committee meeting. The Lions Club Pool will be filled on May 22, 1993 . KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - No Report. SCHOOL COMMUNITY REPORT -- The next School Board meeting will be held on May 24 , 1993 . OLD BUSINESS Alderman Clark inquired about the Adopt A Highway program. Administrator Peck will make copies to distribute to the Council at next week' s Committee meeting. A letter was received by all Alderman and the Mayor regarding the Ament variance request and a court date scheduled for June 17 , 1993 . The City will not act on this until a recommendation was received from the Zoning Board of Appeals . A discussion was held regarding the variance request. At this time, no action will be taken by the City until the court case is settled. A discussion was held regarding the property located at 201 N. Bridge Street, Yorkville. A letter from Attorney Kramer was reviewed indicating that the property was shown as a duplex at the last census and does have a history of being used as a duplex. Two water bills have not been billed on the property which is a violation of city requirements . A discussion was held regarding this issue. A motion was made by Alderman Clark to recognize the property located at 201 N. Bridge Street as a legal non-conforming use and upon inspection by Administrator Peck that the two units are metered and billed separately, both units may be occupied. The motion was seconded by Alderman Jones . Roll Call : Jones - Aye Prochaska - Aye Stafford - Aye Baird - Nay Baker - Aye Callmer - Nay Clark - Aye Johnson - Aye Motion carried 6-2 . NEW BUSINESS Alderman Jones made a motion to refer PC 93 - 5 through PC 93 - 10 to the Plan Commission for Public Hearing on May 19, 1993 . Seconded by Alderman Baker. Motion carried. Page 5 -- May 13, 1993 City Council Meeting Alderman Baird requested authorization from the City Council on behalf of the VIETNOW group to conduct a fund raiser in Yorkville at the corner of Route 34 and Route 47 on May 29, 1993 from 10 a.m. to 2 p.m. A certificate of insurance will be required. Alderman Baird made a motion to allow the Vietnow group to solicit donations on May 29, 1993 from 10 a.m. to 2 p.m. upon receipt of the required Certificate of Insurance and Commercial Permits as required by Chief Graff. Seconded by Alderman Jones . Motion carried. COMMITTEE REPORTS Finance -- A letter was distributed for review by the council . This will allow Wheeler Inc. to evaluate the City' s short term and long term computer network needs. Mr. Wheeler will be present and this will be discussed at the next Committee Meeting. A Notice of Bid has been publicized for the sale of the 1983 Chevrolet to be held on May 21, 1993 at 10 : 30 a.m. in the City Hall . Personnel -- A meeting was scheduled for Friday, May 14th regarding personnel . Alderman Baird is requesting a postponement on this meeting until after the new Alderman can be informed. This will be discussed at Committee. Administrator Peck is requesting authority to hire the City' s summer help. One position is for three months and one for almost six months . Alderman Clark made a motion to hire one summer employee immediately and advertise for the second position in the Kendall County Record. Seconded by Alderman Johnson. Motion carried. All future job opportunities will be advertised. Public Relations The Amurol Company has scheduled their Ground Breaking Ceremony on Tuesday, May 25, 1993 . Building, Zoning, Annexations / Future Planning Administrator Peck has received the BOCA review of the Amurol site this afternoon. After review, Mr. Peck will forward to the Amurol Company. Administrator Peck responded to a letter from Attorney Hallogen on the Emerson property. Attorney Hallogen and his clients will be at the Committee meeting next week. Public Property & Buildings Alderman Baird informed the council that the Metallic Corporation would like to meet with the Council regarding the new City Building. Water - No Report Sewer - The Somonauk Street repairs are still in process . Streets & Alleys -- The City has advertised for bids on the upcoming street program. This will be held on May 21, 1993 at 10 : 00 a.m. in the City Hall . Police - No Report Health, Sanitation & Waste Management - No Report Page 6 -- May 13, 1993 City Council Meeting Yorkville Business & Economic Development & County Economic Development Alderman Baird indicated that there was information received in the mail from the DuKane Council for review. Alderman Baird also informed the Council that the Chamber of Commerce has requested Chris Lanark and his firm meet for a breakfast meeting. Invitations will be mailed. This will discuss the importance of good planning. Administrator Peck indicated that a meeting has been scheduled on May 20, 1993 at 5 : 30 p.m. at the Williamsburg. City Building Ad Hoc - No Report School Board Representative - No Report YBSD Board Representative - Next meeting - May 17, 1993 at 5 p.m. Library Board Representative - No Report Park Board Representative - No Report Chamber of Commerce Representative - Alderman Baird indicated that Alderman Jones will now be the representative to the Chamber of Commerce Board.
