City Council Minutes 1993 04-22-93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON APRIL 22 , 1993 . Mayor Kittoe called the meeting to order at 7 : 00 p.m. and led the Council in the Pledge of Allegiance . Clerk Albin called the roll : ROLL CALL Ward 1 - Baird - Absent Jahp - Present Ward 2 - Fey - Present Clark - Present Ward 3 - Jones - Present Pfister - Present Ward 4 - Bown - Present Johnson - Present A quorum was established. QUORUM Alderman Bown moved to go into Public Hearing PC93-5 for the annexation of the Bullock property into the City of Yorkville, seconded by Alderman Fey . Motion carried . **********************PUBLIC HEARING PC93-5*********************** Alderman Bown questioned if there were any comments regarding the annexation of Bullock ' s property(PC93-5 ) and there were no public comments . Alderman Bown moved to adjourn PC93-5 Public Hearing, seconded by Alderman Jones . Motion carried . **********************PUBLIC HEARING PC93-6************************ Alderman Bown moved to go into Public Hearing PC93-6 for the annexation of the Kane property southeast of town into the City of Yorkville, seconded by Alderman Clark. Motion carried . Alderman Bown asked if there were any questions or comments from the Public, and there were none . Alderman Bown also explained that this petition is requesting a change in zoning from A-1 to B-3 Highway Business District . Alderman Bown moved to adjourn PC93-6 Public Hearing, seconded by Alderman Pfister . Motion carried . ******************************************************************* 1993-94 BUDGET PUBLIC HEARING Alderman Jahp moved to go into a Public Hearing for the 1993-1994 Budget , seconded by Alderman Jones . Treasurer Huston reported on some changes which have been made and added that these changes are reflected on new pages to be inserted in the budget . Alderman Jahp asked if there were any questions or comments from the Public , and there were none. Alderman Jahp moved to adjourn the Public Hearing for the 1993-1994 Budget , seconded by Alderman Pfister . Motion carried . Page 2 April 22 , 1993 Alderman Bown moved to approve and pay bills as BILLS APPROVAL presented, seconded by Alderman Jahp. Clerk Albin called the roll : Johnson - Aye Pfister - AYe Fey - Aye Jahp - Aye Jones - Aye Clark - Aye Bown - Aye Arlen Vollman, business manager of the sheet metal D.A.D. FUND RAISING workers , requested permission to solicit funds for APPROVED (6/19 ) Dollars against Diabetes (D.A.D. ) the day before Father ' s Day at the intersection of Routes 34 and 47 . This would be June 19 from 9 : 00 a .m. to 2 : 00 p.m. Alderman Pfister moved to allow this to take place, seconded by Alderman Jahp. Motion carried. PLAN COMMISSION/ZONING BOARD OF APPEALS- Alderman Bown reported that the Plan Commission met April 21 , and recommended Bullock ' s annexation (PC93-5 ) be approved , and Plan Commission approval of Kane ' s annexation and rezoning (PC93-6) with the addition of a 25 feet easement along Route 126 . Alderman Bown also reported that the Plan Commission recommended approval of the Morgan St . Grain Elevator(PC93-1 ) project with the following conditions , it come in under a PUD with R-4 zoning, with 4 units on the north side of the railroad tracks , and 12 units on the south side of the railroad tracks . Alderman Bown also reported that the Perkins ' re- subdivision on Walnut St . approved the final plat , with the addition of some dimension information added to it to make it clearer as to what is being done , and also that Administrator Peck review and approve this plat . Alderman Bown moved to authorize the annexation of PC93-5 APPROVED the Bullock property into the City of Yorkville at (BULLOCK ) such time the property becomes contiguous to the City as R- 1 City zoning as requested , seconded by Alderman Johnson. Motion carried . Alderman Bown moved to take the Kane annexation PC93-6 REFERRED and rezoning to Committee before it is brought to TO COMMITTEE Council , seconded by Alderman Clark. Motion carried . (KANE) Alderman Bown moved to take the Grain Elevator PC93-1 REFERRED development to Committee before it is brought to TO COMMITTEE Council for approval , seconded by Alderman Johnson. (GRAIN ELEV. ) Motion carried . Alderman Bown moved to approve the Perkins ' final ZBA-93-2 plat contingent to addition of the dimension (PERKINS ) information, and approval by the City Engineer. Alderman Jahp seconded the motion. Motion carried . Alderman Bown moved to authorize the Mayor to sign the documents for the Bullock annexation, seconded by Alderman Fey. Motion carried . Alderman Bown moved to authorize the Mayor to sign the documents for the Perkins ' plat when they become available, seconded by Alderman Clark. Motion carried . ATTORNEY 'S REPORT - Attorney Kramer wasn ' t present yet . MAYOR ' S REPORT - Mayor Kittoe reminded everyone of next Tuesday night at 6 : 30 p.m. at the Williamsburg . Alderman Jones reminded everyone to bring appropriate stories , gifts , etc. for a roast in honor of the out- going Alderman. Mayor Kittoe reminded everyone that the Trade Fair is tomorrow and Saturday. Page 3 April 22 , 1993 Mayor Kittoe reported that he would like a motion JAHP APPT. TO to appoint Alderman Jahp to the Library Board . LIBRARY BOARD Alderman Bown moved to appoint Alderman Jahp to the Library Board effective May 1 , seconded by Alderman Jones . Motion carried . Mayor Kittoe reported that he would like a motion FEY APPT. TO EDC to have Alderman Fey appointed the Economic Development Commission (EDC) . Alderman Jahp moved to appoint Alderman Fey to the EDC effective May 1 , seconded by Alderman Bown. Motion carried . Mayor Kittoe reported that Clerk Albin, Attorney NEW ALDERMAN & Kramer and himself canvassed the vote . At this CLERK SWORN IN time Mayor Kittoe swore Jeff Baker, Burt Callmer , Art Prochaska , Bob Johnson, and James Stafford in as Aldermen. Mayor Kittoe swore in the new City Clerk, Jacqueline Allison. Mayor Kittoe reminded everyone that there will be GOLF OUTING 5/6 no Committee meeting on May 6 because of the golf outing. CITY CLERK ' S REPORT - No report . CITY TREASURER/BUDGET OFFICER ' S REPORT - Treasurer SPECIAL COUNCIL Huston requested that a Special City Council meeting MTG . SET 4/29 be held before the next Committee meeting April 29 . CITY ADMINISTRATOR ' S REPORT - Administrator Peck SHARP COPIER reported that after looking over 3 new copiers PURCHASED for purchase , he recommends the purchase of the Sharp copier at a cost of $8 ,460 .00 . Alderman Jahp moved to purchase a Sharp Copier SF-2035 for $8 ,460 .00 , seconded by Alderman Bown. Report be accepted as presented, seconded by Alderman Clark. Motion carried . POLICE DEPARTMENT REPORT - Alderman Clark moved to adopt the Blood Pathogen Plan, Policy and Procedures for the City of Yorkville, seconded by Alderman Jones . Alderman Clark amended the motion to state upon review by the City Attorney, seconded by Alderman Jones . Vote on amendment, motion carried . Vote on first motion. Motion carried . Chief Graff reminded everyone that the Aurora Bicycle Club will be coming Sunday . BEECHER BUILDING REPORT - Alderman Jahp moved to accept the Beecher Building Report , seconded by Alderman Pfister . Motion carried . KENDALL COUNTY ECONOMIC DEVELOPMENT - No report . SCHOOL COMMUNITY REPORT - No report . OLD BUSINESS - No old business . NEW BUSINESS - Nothing new. Page 4 April 22 , 1993 ATTORNEY ' S REPORT - Attorney Kramer reported that a vote canvass was done this morning. Alderman Pfister moved to allow Mayor Kittoe, Clerk Albin, and Attorney Kramer to execute the Canvass and send to County Clerk, seconded by Alderman Jahp. Motion carried . Attorney Kramer reported that the May 27 Council meeting at 6 : 30 p.m. a Public Hearing should be held regarding adopting a resolution regarding the sale of the Walnut St . property the City owns . Attorney Kramer reported that at last night ' s Plan Commission Attorney Grant got all the signed petitions from Mrs . Cimaglia , and also received a letter from Holdiman ' s attorney agreeing to the annexation. Attorney Kramer reported that both of these will be going to the Plan Commission for May. Bud Leedy expressed concern with the ongoing situation regarding the Ament property regarding the dispute over lot lines . Alderman Bown moved to refer the Bob Ament construction on State Street to the Zoning Board of Appeals for their input , seconded by Alderman Jones . PERSONNEL - Alderman Jones thanked everyone who attended the Committee meeting April 21 to work on the employee manual . PUBLIC RELATIONS - Alderman Jones reminded everyone of the Golf Outing May 6 and that there will be no Committee meeting that evening. BUILDING, ZONING & ANNEXATIONS/FUTURE PLANNING - Alderman Bown reminded everyone that the next Plan Commission meeting is set for May 19 at 7 : 00 p.m. PUBLIC PROPERTY AND BUILDINGS - No report . WATER - No report . SEWER - Administrator Peck reported that the major construction on the Somonuak St . sewer is complete, and that it is operative. STREETS AND ALLEYS - Alderman Jahp commented that there are alot of potholes which need to be filled. POLICE - No report . HEALTH, SANITATION AND WASTE MANAGEMENT - No report . YORKVILLE BUSINESS & ECONOMIC DEVELOPMENT & COUNTY ECONOMIC DEVELOPMENT - Ng Y @part = • Page 5 April 22 , 1993 CITY BUILDING AD HOC - Alderman Pfister moved that the property commonly known as 610 Tower Lane be officially designated where the City will eventually build a new building, seconded by Alderman Clark. Clerk Albin called the roll : Johnson - Aye Pfister - Aye Fey - Nay Jahp - Aye Jones - Aye Clark - Aye Bown - Abstain SCHOOL BOARD REPRESENTATIVE - Alderman Johnson reported that the next meeting will be April 26 at 7 : 30 p.m. YBSD BOARD REPRESENTATIVE - Alderman Pfister reported that the next meeting will be May 17 at 5 : 00 p.m. LIBRARY BOARD REPRESENTATIVE - No report . PARK BOARD REPRESENTATIVE - No report . CHAMBER OF COMMERCE REPRESENTATIVE - Mayor Kittoe reminded everyone that After Hours will be held in the tent at the Trade Fair at Countryside Friday, April 23 at 8 : 00 p.m. ADDITIONAL BUSINESS - Alderman Pfister noted that Alderman Baird will be taking over as Chairman of the City Building Ad Hoc Committee. Alderman Clark thanked the four Alderman who are leaving for their knowledge and the time they have given to the City, and told them they will be missed . Alderman Fey moved to reduce the Utility Tax in the City of Yorkville by % each year for the next four years to bring it down to the 3% level , seconded by Alderman Pfister . Clerk Albin called the roll : Clark - Nay Fey - Aye Pfister - Nay Jones - Nay Jahp - Nay Bown - Nay Johnson - Nay Motion defeated . Alderman Jahp thanked the current Council and those who have gone on before him, and he encouraged everyone to get involved . Alderman Bown told the new Aldermen to contact him if they have any questions . Alderman Pfister wished luck to the new Alderman, and commented that it has been a great experience .
