City Council Minutes 1993 04-08-93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON APRIL 8 , 1993 . Mayor Kittoe called the meeting to order at 7 :00 p.m. and led the Council in the Pledge of Allegiance . Clerk Albin called the roll : ROLL CALL Ward 1 - Baird - Present Jahp - Absent Ward 2 - Fey - Present Clark - Present Ward 3 - Jones - Present Pfister - Absent Ward 4 - Johnson - Present Bown - Absent A quorum was established . QUORUM Guests were introduced : Jeff Baker, Jackie GUEST INTRODUCTION Allison, Kathleen Sullivan, Walter Sullivan, May Halmagyi , Jack Kane, Jerry Lawyer , Mary Pitstick, Deborah Cooper , Herman Brewer , Steve Halmagyi and members of the press . ********************************************************** At this time Alderman Baird moved to adjourn PC93-3 Annex. & from regular Council into Public Hearing PC93-3 Rezone to B-3 at 7 :05 p.m. , seconded by Alderman Johnson. Rts . 47 & 71 Motion carried . Attorney Kramer explained that this Public Hearing regarding the annex of property located at the northwest corner of the intersection of Route 47 and 71 . The property is owned by Inland Real Estate in a land trust . Atty. Kramer explained that the Plan Commission has reviewed this , and recommends annexation . At this time Attorney Kramer asked for any public comments . May Halmagyi questioned what was going to be done with this property, and Attorney Kramer explained that nothing was known at this time, and that the purpose of this was to annex and rezone to B-3 , and as far as developing this the petitioner would have to come back to Plan Commission and City Council for approval . There were no further questions, and the Public Hearing PC93-3 was closed . Attorney Kramer explained the second Public Hearing PC93-4 Annex & on the agenda, PC93-4, the triangular portion of Rezone to B-3 land at Routes 126 and 71 . He explained that Inland Rts . 126 & 71 Real Estate owns this in a land trust , and they are requesting annexation and rezoning. He asked for any comments regarding this . Steve Halmagyi expressed concern regarding his property taxes increasing with the annexation of this property. Attorney Kramer explained that as long as Mr . Halmagyi ' s property was outside of the City limits he would not have to pay City taxes . Jerry Lawyer who lives next to Pride commented that his taxes have increased $60 .00 or $70 .00 over a four year period . Attorney Kramer also explained that the developer ' s would be paying to extend sewer and water to both of the properties requesting to be annexed . There were no further questions or comments , and the Public Hearing PC93-4 was closed. Administrator Peck explained that the next Public Hearing is for Obtaining Citizen Views and to Identify Community Development Needs and Priorities for Assistance in the City of Yorkville . Page 2 April 8 , 1993 Attorney Kramer explained that this Public Hearing is in regards to a grant the City of Yorkville has filed with the State for the extension of water and sewer mains north of town. Administrator Peck explained that the amount requested in the grant application is $400 ,000 .00 . He also explained that there are two Public Hearings regarding this , one to have people voice their opinions about community development funds for the City, and the second one for the people to voice their opinion regarding the City applying for such funds . Attorney Kramer explained that testimony for both hearings will be taken at one time . Debbie Cooper, of Development Services Group from Springfield explained that the application is being prepared for this grant is being prepared for DECCA (Department of Commerce and Community Affairs ) , and that DECCA wants to be assured that it is viable to extend the water and sewer mains north of town. She explained that the only thing holding this is application up is waiting for information from Amurol regarding their financial status, etc. Mayor Kittoe questioned if there were any comments regarding this , and since there were none Alderman Baird moved to close the Public Hearings at 7 : 30 p.m. , seconded by Alderman Johnson. Motion carried. Alderman Baird moved to return to regular Council session at 7 : 32 p.m. , seconded by Alderman Johnson. ****************************************************************** Alderman Fey moved to waive the reading of the minutes MINUTES APPROVAL from the March 25 , 1993 City Council Meeting and accept them as presented , seconded by Alderman Baird . Motion carried . Alderman Johnson moved to approve and pay bills as BILLS APPROVAL presented , seconded by Alderman Baird . Clerk Albin called roll : Clark - Aye Fey - Aye Johnson - Aye Jones - Aye Baird - Aye Kittoe - Aye Motion carried. CITIZEN COMMENTS - There were no citizen comments . PLAN COMMISSION/ZONING BOARD OF APPEALS - Attorney PC93-3 APPROVED Kramer questioned if there were any questions from (Q Q?, the Alderman regarding PC93-3 (Rt . 47 & 71 annex and rezone) CJ and there were none . Alderman Baird moved to authorize the Mayor and City Clerk enter into an annexation agreement for the purpose of annexing and rezoning PC93-3 , seconded by Alderman Jones . Clerk Albin called roll : Jones - Aye Clark - Aye Fey - Aye Johnson - Aye Baird - Aye Motion carried . Alderman Baird moved to annex and rezone PC93-3 to B-3 q Highway Business District , seconded by Alderman Jones . Alderman Baird moved to authorize the Mayor and City PC93-4 APPROVED Clerk to enter into an annexation agreement for the 19 q 3_ I0 purpose of annexing and rezoning PC93-4 , seconded by Alderman Johnson . ATTORNEY ' S REPORT - Attorney Kramer explained that he SPECIAL USE ORD. had prepared a Special Use Ordinance for Amurol to HELIPORT & SILO permit a heliport and a variance for the sugar silo up AMUROL to 65 feet . Alderman Baird moved to create a Special Use Ordinance for the location of a heliport and a `_ variance for silo height at the Wm. Wrigley Jr. property located on Route 47 . Alderman Jones seconded the motion. Clerk Albin called the roll : Baird - Aye Jones - Aye Clark - Aye Johnson -Aye Fey - Aye Motion carried. Attorney Kramer reported that the Police Committee CITY AND POLICE and Council as a Whole has finalized the Collective ENTER INTO COLLECT Bargaining Agreement with the Police Department . IVE BARGAINING He reported that a resolution is needed for this . Alderman Baird moved to approve a resolution to % q3 - 4-I authorize the United City of the Village of Yorkville and the Yorkville Professional Police Association enter into a Collective Bargaining Agreement on behalf of the City of Yorkville , seconded by Alderman Jones . MAYOR ' S REPORT - Mayor Kittoe reminded everyone of the event at the Williamsburg Inn to be held April 27 at 6 : 30 p.m. Mayor Kittoe also reminded everyone of the Personnel meeting next Wednesday. CITY CLERK ' S REPORT - No report . CITY TREASURER/BUDGET OFFICER ' S REPORT - Treasurer Huston reported that he passed out changes in the proposed budget , and has a new revised summary of the budget . CITY ADMINISTRATOR ' S REPORT - No report . POLICE DEPT. REPORT - Alderman Clark moved to accept the March Police Dept . Report , seconded by Alderman Johnson . Motion carried . BUILDING DEPT. REPORT - Alderman Clark moved to approve the Building Dept . Report as presented , seconded by Alderman Fey. Motion carried . BEECHER BUILDING REPORT - Alderman Baird moved to approve the Beecher Building Report as presented, seconded by Alderman Fey . Motion carried . KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION REPORT - Alderman Fey reported that the next meeting is Tuesday, April 13 at 7 :00 p.m. at the County Office Building. SCHOOL COMMUNITY REPORT - Alderman Johnson reported that Supt . Engler will be coming to Committee to discuss impact or transitional fees . OLD BUSINESS - No report . NEW BUSINESS - No report . PERSONNEL - Alderman Baird reported that the next meeting is next Weds . at 7 :00 p.m. and that the Committee will be going into Executive Session. PUBLIC RELATIONS - Alderman Jones reported that the Candidates forum was held April 7 and it went well , but if was not well attended . He also reported that there was an interest in having "Town Meetings" . BUILDING, ZONING AND ANNEXATIONS/FUTURE PLANNING - Alderman Baird reported that in the next couple of weeks the City will be seeing alot of requests for annexations . PUBLIC PROPERTY AND BUILDINGS - No report . WATER - No report . SEWER - No report . STREETS AND ALLEYS - Alderman Baird commented that there will be alot of money spent on streets this year , and that there is a program in place to identify the streets which are most in need of repair . POLICE - Chief Graff reported that a citizen survey regarding the police department ' s performance was included in this month ' s newsletter . HEALTH, SANITATION AND WASTE MANAGEMENT - No report . YORKVILE BUSINESS & ECONOMIC DEVELOPMENT & COUNTY ECONOMIC DEVELOPMENT - No report . CITY BUILDING AD HOC - Alderman Baird reported that a meeting needs to be set , and this will be discussed at the next Committee meeting. SCHOOL BOARD REPRESENTATIVE - No report . YBSD BOARD REPRESENTATIVE - The next meeting will be May 3 at 5 :00 p.m. LIBRARY BOARD REPRESENTATIVE - The next meeting will be Monday , April 12 . PARK BOARD REPRESENTATIVE - The next meeting will be next Weds . at 7 :00 p.m. CHAMBER OF COMMERCE REPRESENTATIVE - Administrator Peck reported that the City will be posting all minutes from Council , Committee, Library and Park Boards and Plan Commission in the City Office . Chief Graff reported that the Trade Fair will be April 23 from 4 :00 p.m. to 8 :00 p.m. with after hours following, and on April 24 from 10 :00 a .m. to 3 :00 p.m. ADDITIONAL BUSINESS - No report .
