City Council Minutes 1993 03-11-93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF
THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL
COUNTY, ILLINOIS , HELD AT CITY HALL ON MARCH 11 , 1993 .
Mayor Kittoe called the meeting to order at 7 : 00 p.m.
and led the Council in the Pledge of Allegiance .

Alderman Jahp moved to waive the reading of the MINUTES APPROVAL
minutes from the February 25 , 1993 City Council
meeting and accept them as presented , seconded
by Alderman Pfister . Motion carried .
Alderman Pfister moved to approve and pay bills BILLS APPROVAL
as presented , seconded by Alderman Jahp. Clerk

There were no citizen comments . CITIZEN COMMENTS
PLAN COMMISSION/ZONING BOARD OF APPEALS -
Alderman Bown reported that the Zoning Board of ZEITER-DICKSON
Appeals met March 8 to hear the variance request VARIANCE APPROVED
for Zeiter-Dickson, and also for Jim Perkins
variance request , and the ZBA recommended approval
for both these items . Alderman Bown moved to
approve the variance request by Zeiter-Dickson to
extend the driveway to 88 feet from 25 feet .
Alderman Pfister seconded the motion. Clerk Albin
called the roll :

Motion carried with five ayes , and three nays .
Alderman Bown reported that with regard to the
Perkin ' s variance request was within the 15
percent , and thus no Council action is required .
ATTORNEY ' S REPORT- Attorney Kramer reported that PC MEETING DATE
the Plan Commission will meet on March 31 instead CHANGED TO 3/31
of March 24 in order to accommodate Amurol and
two petitions from Inland to annex commercial
zoned properties at the fringes of town.
Attorney Kramer reported that he drafted an
amendment to the Zoning Ordinance regarding fees
charged for review and expert consultation, and
asked Council to review this, and further discuss
at next week ' s Committee of the Whole meeting .
Attorney Kramer reported that he had prepared
the No-Smoking Ordinance with the changes Council
had requested .

Attorney Kramer reported that Ron and Martha Diederich LICENSE AGREE .
and purchasing the building at Van Emmon and Route 47 , RENEWED
and that the garage which belongs to the property is
1 .8 feet on the City ' s property on Jefferson St . , and
ghat they would like to renew the license agreement with
the City. Alderman Bown moved to renew the license
agreement , seconded by Alderman Johnson. Motion
carried .
Attorney Kramer reported that Illinois Public Action
Group is requesting permission to extend the hours
for soliciting. He reported that he will be sending
a copy of the solicitor ' s ordinance to them.
Attorney Kramer reported that negotiations with
Holdiman ' s regarding the annexation of their property
on looking good . This would involve all the land
north of Aldi ' s to Kennedy road on the east side of
Route 47 .
Alderman Baird moved to approve the No-Smoking NO-SMOKING
Ordinance, seconded by Alderman Johnson. Alderman ORDINANCE APPROVE.
Clark amended the motion to set the effective date
of May 1 , 1993 , seconded by Alderman Jahp. Mayor
Kittoe called a voice vote for amendment .
Amendment carried , with 7 ayes , and one nay.

MAYOR ' S REPORT - Mayor Kittoe read a Resolution YHS WRESTLING
honoring the Yorkville High School wrestling team TEAM HONORED
for their State Championship victory . Alderman
Bown moved to approve the Resolution honoring the
Yorkville High School wrestling team, seconded by
Alderman Jones . Motion carried .
Mayor Kittoe reported that Bristol Township will CLARK APPOINTED
be starting their own Plan Commission, and LIAISON
appointed Alderman Clark as a liaison.
Mayor Kittoe reported that he has received numerous SAW MILL COMPLAIN
complaints regarding the saw mill downtown. Mayor
Kittoe reported that he has met with the owner and
discussed this , and that the owner is loading up
and shipping the logs out as soon as possible .
Mayor Kittoe reported that Attorney Kramer is looking
into what was agreed upon previously regarding this
property, and will have more information at the next
Committee meeting.
Alderman Fey presented a plaque to Jerry Hanson to PLAQUE PRESENTED
be displayed at the Bank of Yorkville . The plaque (ROXANNE BURTON
was presented to City of Yorkville for display at FUND)
the Bank of Yorkville from the Roxanne Burton fund .
CITY CLERK ' S REPORT - No report .
CITY TREASURER/BUDGET OFFICER ' S REPORT - Treasurer
Huston reported that the February Budget Report
will be ready for the next meeting.
CITY ADMINISTRATOR ' S REPORT - Administrator Peck BELTZ CONTRACT
reported that the contract with Beltz Excavating
will be coming in shortly, and he needed approval
for the Mayor to enter into the agreement with
Beltz in the amount of $53 ,764 . 12 . Alderman Pfister
moved to authorize the Mayor to sign the contract
with Beltz Excavating for work on Somonauk St . ,
seconded by Alderman Bown. Motion carried .

Administrator Peck reported that he needed DOLPH ST. REPAIR
approval to spend up to $7, 500 .00 for repairs APPROVED
on Dolph St . Alderman Bown moved to approve

to approve the Public Works report as presented ,
seconded by Alderman Baird. Motion carried .
POLICE DEPARTMENT REPORT - Chief Graff reported
that the union ratified the tentative agreement .
Alderman Clark moved to approve the Police
Report dated March 3 , 1993 , seconded by Alderman
Fey. Motion carried.
BUILDING DEPARTMENT REPORT - Alderman Baird moved
to approve the Building Dept . Report , seconded
by Alderman Bown . Motion carried .
PARK BOARD REPORT - Alderman Baird moved to approve
the Park Board report . Alderman Bown seconded the
motion. Motion carried .
KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION REPORT
Mayor Kittoe reported that the City of Yorkville has
put an application in for funds to run the sewer and
water south of town. The next meeting will be April
13 , 1993 at 7 :00 p.m.
SCHOOL COMMUNITY REPORT - Chief Graff explained
"Safe School Zone" to the Council . He explained
that this is an awareness program, where penalties
for gangs ,weapons , drug useage are enhanced .
OLD BUSINESS - No old business .
NEW BUSINESS - Alderman Baird moved to approve the LANNERT GROUP
hiring of Lannert Group for consulting services , HIRED
effective May 1 , 1993 . Alderman Jones seconded
the motion. Clerk Albin called the roll :

FINANCE - Alderman Jahp reported that there will
be a budget meeting March 15 at 6 : 30 p.m. at City Hall .
PERSONNEL - No report .
PUBLIC RELATIONS - No report .
BUILDING, ZONING AND ANNEXATIONS/FUTURE PLANNING -
Alderman Bown reminded everyone of the change in
date for the Plan Commission, set for March 31 , 1993 .
PUBLIC PROPERTY AND BUILDINGS - No report .
WATER - No report .
SEWER - Attorney Kramer reported that Siefried ' s
who live at the corner of King and River have donated
an easement to the City. Administrator Peck will
look into this and see if it is beneficial to the City,
and will advise Council .

POLICE - No report .
HEALTH, SANITATION AND WASTE MANAGEMENT - Alderman
Johnson reported that representatives from Plano
and Oswego attended last Tuesday ' s Committee meeting
and explained how their municipalities are approaching
recycling. Alderman Johnson reported that he will
be contacting TCD to come to Committee and review
their proposal for recycling.
YORKVILLE BUSINESS AND ECONOMIC DEVELOPMENT AND COUNTY
ECONOMIC DEVELOPMENT - Mayor Kittoe reported that
After Hours will be held at Yorkville National Bank
March 16 at 5 :00 p.m.
CITY BUILDING AD HOC - No report .
SCHOOL BOARD REPRESENTATIVE - Alderman Johnson
reported that the School Board voted to adopt
a single tier bus system, and also voted to
extend Supt . Engler ' s contract to 1996 .
YBSD BOARD REPRESENTATIVE - Alderman Pfister reported
that the next meeting will be April 19 , 1993 at 5 :00 p.m.
LIBRARY BOARD REPRESENTATIVE - No report .
PARK BOARD REPRESENTATIVE - No report .
CHAMBER OF COMMERCE REPRESENTATIVE - No report .
ADDITIONAL BUSINESS - Administrator Peck reported
that the firm of Harding and Lawson Assoc. is
conducting a environmental study of the Fisher
property, and will have a report by March 24, 1993 .
Alderman Fey reported that he would like to discuss
a reduction of the utility tax.
Alderman Bown moved to adjourn for 10 minutes and
go into Executive session at 8 : 05 p.m. to discuss
Collective Bargaining, seconded by Alderman Pfister .

8 : 15 p.m. with no action taken, seconded by Alderman
Pfister . Motion carried .
