City Council Minutes 1993 02-25-93 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF
THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL
COUNTY, ILLINOIS , HELD AT CITY HALL ON FEBRUARY 25 , 1993 .
Mayor Kittoe called the meeting to order at 7 : 00 p.m. ,
and led the Council in the Pledge of Allegiance .
Clerk Albin called the roll : ROLL CALL

Ward 3 - Jones - Absent (arrived at 7 : 30 p.m. )

A Quorum was established . QUORUM
Alderman Johnson moved to adjourn into Public Hearing
for PC93-2 (Wrigley) at 7 :03 p.m. , seconded by
Alderman Baird . Motion carried .
*****************PUBLIC HEARING PC93-2********************
Attorney Kramer explained that there was a Public
Hearing held at the last Plan Commission meeting
held February 17 , 1993 . He explained that this
would cover the two parcels south of Cannonball
Trail which are both going to retain Ag zoning,
and everything north of Cannonball Trail would be
annexed and zoned M-1 . Mike Shick questioned
how many acres are going to be annexed all together,
and Attorney Kramer replied that there would be close
to 300 acres . Alderman Fey questioned what advantage
there would be to bring this property in under M-1
zoning as opposed to R-1 ,A-1 or some other zoning.
Attorney Kramer replied that this zoning does not
cost the City for bringing sewer and water mains
and other improvements for residential . Mayor
Kittoe asked if there were any further questions
or comments , and since there were none Alderman
Baird moved to return to regular Council , seconded
by Alderman Johnson. Council resumed at 7 : 10 p.m.
Motion carried .
Guests were introduced : Frank and Laurel Willman,
June Malvis , Mike Shick, Jeff Baker, Jerry Lawyer ,
and members of the press .
Alderman Baird moved to approve the minutes from the MINUTES APPROVAL
February 11 , 1993 City Council Meeting , seconded
by Alderman Johnson. Motion carried .
Alderman Clark requested that under the "First Name"
column on the bill list she would like to see
a line item number corresponding with the budget
to check and see if the part of the budget is over
or under budget to enable Council to check and see
where the budget is at .
Alderman Baird moved to approve and pay the bills BILLS APPROVAL
as presented, seconded by Alderman Jahp. Clerk Albin
called the roll :

Clark - Nay Jones - Aye
Motion carried with five ayes , and one nay .
There were no citizen comments . CITIZEN COMMENTS
Attorney Kramer reported that there were two items PC93-2 APPROVED
on the agenda for Plan Commission that were heard .
The first being Amurol PC93-2 . Alderman Baird
moved to authorize the Mayor and City Clerk to
sign the annexation agreement for Amurol , seconded
by Alderman Jahp. Clerk ALbin called the roll :

it becoming contiguous, seconded by Alderman

Attorney Kramer explained that the name of RON HILL ESTATES
Frank Willman ' s proposed subdivision which was APPROVED
reviewed by Plan Commission on Feb. 17 , has
been changed from Pavillion Hills to Ron Hill
Estates to eliminate any confusion from Pavillion
Heights Subdivision. Attorney Kramer reported
that the Plan Commission recommenced approval .
He reported that this property will annex upon
it becoming contiguous . He reported that this
plan conforms to everything in the City ' s 12
mile radius . Alderman Baird moved to recommend
this plan ' s approval to the County, seconded by
Alderman Jahp. Alderman Jones moved to amend
the motion that this include sidewalks , seconded
by Alderman Fey. Clerk ALbin called the roll
on the amended motion :

Mayor Kittoe voted Aye . Motion carried .
Attorney Kramer reported that Sue Bullock will be ITEMS REFERRED
getting an annexation petition to Clerk Albin, and TO PLAN COMM.
that Inland has brought the two parcels for
annexation, one for the corner of Route 47 and
Route 71 involving approximately 80 acres , and
14 acres at Route 126 and Route 71 . Alderman
Baird moved to refer the above items to the Plan
Commission, seconded by Alderman Jones . Motion
carried .
Attorney Kramer reported that there will be a
Zoning Board of Appeals meeting to be held
March 8, 1993 at 7:00 p.m. at City Hall . The
two items to be heard are ZBA93-1 Zeiter - Dickson
variance , and ZBA93-2 Perkins variance .
ATTORNEY ' S REPORT - Attorney Kramer reported that
brought the City up to date regarding an injunction,
commented that this is a boundary line dispute .
Attorney Kramer distributed two different anti-
smoking Ordinances for Council to review.
MAYOR ' S REPORT - Mayor Kittoe reported that he
would like to have an Annexation meeting next
Tuesday, March 2 at 5 :00 p.m.
Mayor Kittoe also reported that he has 106 names
on a petition from Willowbrook and Storybrook who
would like to annex into Yorkville .
Mayor Kittoe reported that J .T. Johnson ' s mother-
in-law passed away.
CITY CLERK ' S REPORT - No report .
CITY TREASURER ' S REPORT - Treasurer Huston reported
that he has passed around a resolution requesting
Governor Edgar to retain the income tax surcharge, as
this represents $110 ,000 in revenue to the City of Yorkville .

Alderman Jahp moved to approve the income tax INCOME TAX SUR-
surcharge resolution and send it to the proper CHARGE RESOLUTIC
authorities , seconded by Alderman Clark. Motion
carried .
CITY ADMINISTRATOR ' S REPORT - Administrator Peck
was not present .
PUBLIC WORKS - ALderman Baird moved to approve
the Public Work ' s report as presented , seconded by
Alderman Johnson. Motion carried .
POLICE DEPARTMENT REPORT - Chief Graff requested POLICE CARS
that he be authorized to purchase two new squad PURCHASED
cars at a cost of $ 13 ,632 .06 each. He requested
that he put the purchase order in for these vehicles
at Celozzi-Ettelson. Alderman Baird moved to
authorize the purchase of two 1993 Chevrolet Caprice
Police Pursuit vehicles not to exceed $28 ,000 .00 ,
seconded by Alderman Jones . Clerk Albin called roll :

a Budget Committee meeting on March 1 at City Hall
beginning at 6 : 30 p.m.

be a meeting with Chief Graff ' s management staff at
4 : 00 p.m. on February 26 .
PUBLIC RELATIONS - No report .
BUILDING, ZONING AND ANNEXATIONS/FUTURE PLANNING -
No report .
PUBLIC PROPERTY AND BUILDINGS - No report .

STREETS AND ALLEYS - No report .
POLICE - No report .
HEALTH, SANITATION AND WASTE MANAGEMENT - Alderman Johnson
reported that the next meeting is set for March 9 at 5 : 30 p.m.
at City Hall .
YORKVILLE BUSINESS AND ECONOMIC DEVELOPMENT AND COUNTY
ECONOMIC DEVELOPMENT COMMISSION - No report .
CITY BUILDING AD HOC - No report .
SCHOOL BOARD REPRESENTATIVE - Alderman Johnson reported
that a Public Hearing was held last Monday regarding
the bussing issue, and that the issue will be voted on
Monday, March 8 .
YBSD BOARD REPRESENTATIVE - No report .
LIBRARY BOARD REPRESENTATIVE - No report .

that Council accept the low bid of $53 , 700 .00 from
