City Council Minutes 1991 08-22-91 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED
CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD
AT CITY HALL ON AUGUST 22, 1991.
Mayor Kittoe called the meeting to order at
7:30 n.m. and led the Council in the Pledge of
Allegiance.

Guests were introduced: LeRoy and Shirley Guest Introduction
Duckett, Joyce Johnson, Bob Thorpen, Tom Ames,
Carol Willbanks, Tom Schiffleger, Dean Forbes,
Burt Callmer, Ted Shick, Barry Niles, Tom Hughes
and members of the press.
Alderman Baird moved to waive the reading of
the minutes from the August 8, 1991 City
Council meeting, and approve them as presented,
seconded by Alderman Bown. Motion carried.
Alderman Bown moved to approve and nay bills as
presented. Alderman Jahp seconded the motion,
and Clerk Albin called the roll:

Mr. LeRoy Duckett along with other concerned
citizens brought up a concern about the proposed
townhomes planned for Game Farm Road. He and
the other citizens questioned why they were
not informed of being notified of the Planning
Commission meeting. Alderman Bown said that
the Planning Commission has only looked at
the preliminary plans for these townhomes, but
until they have a Public Hearing with the
Planning Commission that the topic is not to
be brought before the Council for approval.
The citizens were informed by Alderman Bown
that he will get back to the Planning Commission
and schedule another special meeting regarding
this issue and notify the public so that any
concerned citizens can attend the Public Hearing
and voice their concerns.
Barry Niles was informed that he doens't need to
go back to the Plan-.Commission but there has to
be a Public Hearing with the City Council to
amend the P.U.D. agreement. This will be scheduled
for the next Council meeting to be held 9/12/91.
Barry was also informed that there will be posting
of the road as Spring St. and McHugh Rd. are Class
II designated.

Mr. Dean Forbes, a resident on W. Washington St. voiced
concerns with a drainage easement on his property as he'd
like to build a garage. Mr. Burt Callmer ( a neighbor of
Mr. Forbes) commented that there is a problem with the
drainage in that area and it is not flowing properly.
Don Peck commented that he has looked at the problem and
he feels that the channel needs to be reshaped to correct
the flow. Don reported that he is looking into possibly
using wire baskets called gadions that would be filled
with rocks. Don also reported that he is looking into
getting a detention area upstream of the subdivision.
He has not finished with his analysis at this time and
informed both Mr. Forbes and Mr. Callmer that he will be
getting in touch with them before anything is done so he
can get their thoughts on this.
Ted Shick reported that he had a problem with the driver
of a road grader on Park Street. Don reported that he
had talked to the driver and he apologized. Don said
that he'd be on the site first thing in the morning.
Tom Hughes, owner of Pride, is working with Don to get the
sewer and water in while Routes 71 and 47 are under
construction. Don proposed two alternates One was to
put sanitary sewer and water in place across the two
roads. IDOT informed him that casing pipes are needed to
go around the roads in the event of future problems . The
price Don received was very unacceptable. Don said that
going in with casing pipes and bulkheading them off would
eliminate the need to go back in and excavate or bore under
the road. Mr. Peck proposed authorization to indebt the
City for up to $4,500.00 for the casings as this needs to
be done with 10 days. Alderman Baird moved to authorize
Don to spend up to $4,500.00 for water and sewer work at
Routes 47 and 71. Alderman Bown seconded the motion, and

PLAN COMMISSION/ZONING BOARD OF APPEALS - No report.
A'TTORNEY'S REPORT - Attorney Kramer reported that he looked
over the Illinois Bell agreement that the Illinois
Municipal League negotiated. If there are any comments
about this franchise agreement then they should be brought _LA--
to Attorney Kramer, otherwise they'll enter into a statewide
contract with the municipalities and will be reimbursed on
the terms set out. Illinois Bell will be sending out a
representative in the next 6 weeks to Committee for any
questions.
Attorney Kramer advised that the correspondence regarding
a lawsuit against the City involving a woman who tripped
over the sidewalk on Bridge St. has been referred to the
city's insurance company. No action has been taken regarding
this matter.
Attorney Kramer also reported that a letter has been sent to
IDOT regarding a stop light possibly at Route 47 and Somonauk
or at Route 47 and Spring St. He reported that a study
would have to been by IDOT to determine the number of cars
passing through. Another possibility would be to angle
Game Farm Road to Spring St. and make that the main road
as more traffic. travels Spring St. than Somonauk St.
due to the new development in the Spring St. area.

Attorney Kramer said that this matter should be discussed
at the next Committee meeting to determine exactly where
the stop light should be, as IDOT needs to know. The
whole process could take 2 to 3 years .
Attorney Kramer reported that he has been trying to get
in touch with the manager of the Farm Bureau and hopes to
have something for either the next Committee or Council
meeting.
MAYOR'S REPORT - Mayor Kittoe reported that there will be
a squad car at Route 126 for the starting of school.
Alderman Jones brought a matter regarding sidewalks to the
Mayor's attention. Alderman Jones reported that there is
no sidewalk running parallel to the street on a new apartment
on Main St. Don said he will look into it.
Mayor Kittoe said that he would like to have an ordinance
prenared regarding"No Parking - Snow Removal" in certain
areas. Mayor Kittoe questioned that "No Parking on Parkway"
ordinance and Attorney Kramer reported that it was designed
to keep cars off the grass and applies to streets with or
without curbs.
Mayor Kittoe presented a Commendation to Joe Moore. Mr. Moore
received the certificate for completion of his examination
with 90% accuracy from the State of Illinois EPA for a Class
B Public ,Supply Water Operator.
CITY CLERK'S REPORT - Clerk Albin reported that a. voting
delegate and alternate delegate need to be designated for
the Illinois Municipal Leage Conference to be held in
October. Alderman Bown nominated Alderperson Clark as the
voting delegate and Alderman Baird as the alternate. .Alderman
Pfister seconded the motion. Motion carried.
CITY TREASURER'S/BUDGET OFFICER'S REPORT - No report.
CITY AnM=S79ATOR'S REPORT - Don Peck reported that the high
bidder for the l9b4 Impala is Mike Johnson for the amount of
$501.00. Alderman Bown moved to accept the bid of 1501.00 for
the 1984 Impala. Alderman Jahn seconded the motion. Clerk
Albin called the roll:

Don reported that some patching has been done on E. Washington
due to drainage problems. He is working with the owner on the
north side of the road to reinstate the ditch.
Mr. Peck reported that he has gotten no bids back ,yet for the
Main Street Tennis Courts.
Mr. Peck reported that non Young has not gotten back T�Tlth him
yet, and non will wait a week and contact him again.

Pon reported that the Spring St. bids were opened and the
lowest big was over 20o more than than the the City has money
for. Don's recom-endation is to re-bid this and scope it 'l
down to get within the constraints. Alderman Bown moved to �r, I V
re-bid Spring St. The motion was amended to reject former
bids and re-bid Spring St. Alderman Baird seconded the motion.
Don reported that 3 file cabinets were received from Caterpillar
and are at the City Offices.

non reported that we will lose the generator from Caterpillar
if we don't take it soon. non said that Caterpillar will load
and mount the generator for us. Mayor Kittoe talked of
purchasing a used trailer to transport the generator. Don
reported that he is looking into the purchase of a trailer
to transport the generator at a cost of approximately t2,500.00.
Alderman. Pfister moved to expend up to $2,500.00 to purchase
a trailer for the generator. Alderman Baird seconded the

reported that the KCEDC recommended starting the PHH Fantas
Phase I at a 112,000 cost. The next meeting is scheduled for
9/17/91 at 7:00 p.m.
SCHOOL COMMUNITY - No report. School opens 8/27/91 for day.
OLD BUSINESS - Alderman Fey moved to rescind the vehicle sticker
ordinance for 1992. Alderman Fahrlander seconded the motion.

WATER - Alderman Pfister reported that there will be a conference
972-3 - 9/25 on drinking water. Joe Moore might attend and none
would like to as well. The registration is 1100.00. Alderman
Pfister moved to authorize spending up to 1200.00 for the registration Al,
fees for this conference. Alderman Bown seconded the motion and
Clerk Albin called the roll:

Alderman Pfister also reported of a hearing to be held in Chicago
on September 12 regarding raising radium standards and he wants
to have someone from the City to go and represent us. Mayor Kittoe '
said that he will make sure someone goes.

STREETS AND ALLEYS - Alderman Fey questioned why there are two
stop signs on both sides of the street facing drivers at McHugh
Rd. and Main St. Don said he will look into this.

POLICE - Alderperson Clark reported that a crossing guard has
resigned. mom Barna would like the authority to hire a crossing
guard at the salary of 118.50 a day. The Council has already s'
approved 2 crossing guards.
HEALTH AND SANITATIONS/UTILITIES - No report.
PUBLIC PROPERTY - No report.
YORKVILLE BUSINESS AND ECONOMIC T)EVELOPD11ENT - Alderman Jahp
reported that he received a phone call from a realtor repre-
senting K.C. General Stores and they are looking into the old
Amoco Station on Main Street.
WASTE MANAG7,1EN7 :REPRESENTATIVE - Alderperson Clark reported
that the next meeting will be held 9/11/91.
YSBT) BOARD REPRESENTATIVE - Alderman Pfister reported that
the next meeting will be held 9/16/91.
LIBRARY BOARD - Alderman Jahp corrmlented that the Open House
for the new director, Robert Jackson, went well. The next
meeting is scheduled for 9/9/91 at 7:00 p.m.
PARK BOARD REPRESENTATIVE - No report.
CHAMBER OF COMMERCE REPRESEWAT1VE - Alderman Baird reported
Solar Press will not be moving to Yorkville. He also re-
ported that the Lion's Club has sold their house. Alderman
Baird reported that Ball Park Days will be held downtown
Yorkville 8/30 - 8/31 to support the downtown merchants.
Alderman Baird reported that the Chamber of Commerce would like
to have Mayor Kittoe proclaim August 22-28 Chamber of Commerce
Week. There will be a meeting 9/17 at 7:00- p.m. at the Yorkville
National Bank. Mayor Kittoe and Alderman Baird will attend.
Alderman Baird. discussed the possibility of having each business
in downtown Yorkville checked by the Police each evening after
closing. Mayor Kittoe said that this will be brought to Committee.
ADDITIONAL BTTSIT\TFSS - Alderman Jahn passed out correspondence
from a citizen asking that an ordinance be proposed to restrict
construction noises in a residential area before 8:00 a.m.
Alderman. Jahp commented that he knows of many people who start
work at 7:00 a.m. and even earlier and he doesn't feel that a
contractor should be told he cannot start work until 8:00 a.m.
Alderman Baird stated that he had talked to the citizen and it's
a real problem. Alderman Fey questioned whether there is some
noise legislation passed. Attorney Kramer reported that there
are OSHA levels and EPA standards . Alderman Bown suggested that
this be handled by negotiating rather than by ordinance.

elected officials in attendance: Gary Bown, Robert Fey,
Pat Clark, Dennis Fahrlander, Bill Baird, Jack Jones, Ralph
Pfister, Cliff Jahp, and ,?)elene Drew.
Mr. Jahp moved to appoint Ken Kittoe to discuss salary negotiations
with salaried employees for year 1991-92 on Saturday, August
243 1991, and if employees agree to the proposal it will be
irmediatly put into effect retroactive to May 1, 1991. and
Ralph Pfister seconded. Roll call vote: Mr. Bown - Aye, C
Mr. Fey - Aye, Mr. Fahrlander - Aye, Mr. Baird - Ave, Mr. Pfister-
Aye, Mr. Jahp - Aye, Mrs. Clark - Aye, Mr. Jones - Nay. Motion

Mr. Fey moved to nay the budget director a salary of t25,000.00
a year and any overtime hours will be paid at time and a half, �x3��
