City Council Minutes 1990 02-08-90 MINIITF,S OF THE REGULAR MEETING OF THE CITY COIINCIT, OF THE 1lNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON FEBRUARY 8, 1990 . Mayor Davidson called the meeting to order at Call to Order 7 : 30 p .m. , and led the council in the Pledge of Allegiance . Clerk Erickson called the roll : Roll Call Ward 1 - Small - Present Jahp - Present Ward 2 - Radke - Absent Fev - Present Ward 3 - Hayden - Present Pfister - Absent Ward 4 - Fahrlander - Present Bown - Present A quorum was established . Guests were Kathy Farren of the Kendall County Guests Record, Liz Clark of WSPY who introduced Erin, the new reporter for WSPY, Barry Niles , Scott Wade, Ron Walker , Kris Kosinski , and Penny Baird of the Beacon News . Alderman Bown moved to waive the reading of the minutes from the January 25 , 1990 City Council meeting, and approve them as presented, seconded by Alderman Small. . Motion carried . Alderman Small moved to the bills as presented, Bown. Clerk called the Hayden - Aye Bown - Aye Jahp - Aye Motion carried. authorize payment of seconded by Alderman roll : Fey - Ave Fahrlander - Aye Small. - Aye CITIZEN COMMENTS - Barry Niles addressed the council regarding the ordinance passed at the last meeting on the posting of the city streets , with regards to garbage and utility company trucks being allowed on them. He s«ggested a designated feeder route to serve heavy traffic in the construction areas ; to possibly increase building fees during the time the road posting is in effect to cover damage to the streets ; an impact fee to cover street damage ; or , to minimize to half loads during that period of time . Alderman Bown moved to refer the street posting issue to the Council of the Whole meeting on Febrxxary 15 , 1990 at 7 : 30 p.m, for further discussion and recommendation. Page 2 February 8 , 1990 MINUTES OF THE PUBLIC HEARING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS , HELD AT CITY HALL ON FEBRUARY 8, 1990 RE: PURCHASE OF HANSON PROPERTY FOR SHALLOW WELL CONSTRUCTION TO ALLEVIATE THE RADIUM PROBLEM. Mayor Davidson called the Public Hearing to order and requested the City Clerk to call the r. ol. l . Aldermen Present were Small , Jahp, Fev, Hayden , Bown , and Fahrlander . Aldermen absent were Pfister and Radke . Attorney Dickson stated the public notice was given , and adjoining property owners were notified regarding the Public Hearing for the City ' s purchase of the Hansen property off Eldamain Rd . , north of Route 34 for the purpose of constructing a shallow well to alleviate the radium problem. The floor opened for comments . Bill Rolf , an adjacent property owner , is concerned with the inaccuracy of the fence line and requests it be corrected before any closing . Attorney Kramer stated that Chicago Titre has been instructed to come up with a title report , and that the transaction may require some quit claim deeds . Joe Martin , an adjacent property owner , stated he has no objection to the purchase , and commanded the City on its efforts in radium removal . Mr . Martin is concerned about the water table , and if the City would make available to those adjacent to the property a water rate that is compatible with Yorkville ' s residents . Mayor Davidson explained the present surcharge that is in affect for those outside the corporate limits . Mr . Martin also asked if Plano comes out with water to Eldamain Rd . if it would affect his being able to purchase water from Yorkville . Mayor Davidson stated he sees no problem with purchase from Yorkville . Rick Brummel asked about a water tower . Mayor Davidson responded that if it became necessary , it would be located closer to the highway or on the other side of El.damain Rd . , but that so far the agreement has been for no water tower . Scott Wade, owner of property west of Eldamain Rd , had similar comments . There being no further comments , Alderman gown moved to refer the concerns to the Council of the Whole committee meeting on April 5 , 1990 at 7 : 30 p .m. for further discussion with those concerned , seconded by Alderman Fey . Motion carried . Alderman Bown moved to pass ORDINANCE # 1990-3 Ord. # 1990-3 entitled "RESOLUTION AUTHORIZING EXECUTION OF AN Easement-Wildwood EASEMENT AGREEMENT BETWEEN COMMONWEALTH EDI'SON Comm Ed/City AND THE UNITED CITY OF THE VILLAGE OF YORKVILLE" , seconded by Alderman Hayden_ Motion carried. This is in regards to the Wildwood Subdivision Attorney Kramer reported that the Fair Realty, Bob Thomas , and Stark annexations are on the Plan Commission agenda for the next meeting . He has heard back from Ali. ' s , the SW Corner owner , Gr. owmark , and Brown ' s Motel , but not from the owners of Walnut Ridge . K&K has requested a new set of papers . Attorney Kramer reported that 701 N. Bridge tenants have paid up to date , but there is a need to verify records with the payment , along with the right to proceed i.f they miss a payment in the future . MAYOR ' S REPORT - Mayor Davidson reported that he has sent a letter to Montgomery requesting a meeting with Montgomery , Sugar Grove , and Oswego regarding the boundary lines , impact fees , and land cash ordinances to school systems . Alderman Bown moved , with second by Alderman Fey, that Mayor Davidson not be authorized to sign any agreements regarding boundary lines , until the others have signed , and to authorize Mayor Davidson as leadman regarding the facility plan with Montgomery . Motion carried . Mayor Davidson reported that he , along with Don Schwegel of Baxter & Woodman, Alderman Pfister , and Engineer Klaas went to Springfield for a meeting regarding a loan for the s /w sewer interceptor , and it looks good for getting one at less than 4% interest , CITY CLERK ' S REPORT - Alderman Bown moved to refer the following petitions to the Plan Commission meeting on February 21 , 1990 ; PC90-5 - Annexation & Zoning to B-3 by Pride Petroleiim - S/W Corner Rt . 71 & 47 ; PC:90-6 - Annexation & Zoning to R-2 by Charles Doetschman - Route 71 ; and PC90-7 - Annexation & Zoning to R- 1 by Davidson/Wheeler - Route 47 . PC90-6 - Doetschman PC90-7 - Davidson/ Wheeler Page 4 February 8 , 1990 CITY ENGINEER ' S REPORT - Alderman Jahp moved to adopt RESOLUTION #1990-1 appropriating $ 15 , 275 in MFT funds for maintenance and supplies for 1990 , and to authorize the City Clerk to sign. Motion was seconded by Alderman Small . Clerk called the roll : Fahrlander - Aye Small - Aye Bown - Aye Jahp - Aye Hayden - Aye Fey - Nay Motion carried. 5- 1 . Alderman Jahp moved to authorize Attornev Kramer to draft a Resolution increasing the necessary hours for TMRF from 600 to 1000 , seconded by Alderman Small . Clerk called the roll : Hayden - Aye Bown - Abstain Small - Aye Fey - Aye Fahrlander - Aye Jahp - Aye Motion carried . Fngineer Klaas presented copies of the newly printed employee manual . Engineer Klaas reported that approximately 17 applications were received for the Budget Director part time position available in the City. Alderman Small moved to authorize the City to advertise for a new Public Works Employee, seconded by Alderman Bown. Alderman Jahp moved to amend the motion to not advertise until a job description is available, seconded by Alderman Bown. Motion carried on a voice vote for the amendment . Motion carried on the amended motion to adver- tise for a new Public Works mployee. as soon a job description is available . POLICE REPORT - Alderman the reports of the Police by Alderman Bown. Motion Jahp moved to approve Department , seconded carried . PUBLIC WORKS & WATER - Alderman Jahp moved to accept the Public Works and Water reports , seconded by Alderman Bown. Motion carried. Mayor Davidson requested the radium levels be included on the reports . Engineer Klaas directed to the press the need for positive publicity regarding the NI-Gas meter readers who are now also reading the City ' s water meters as they are receiving some hassle from the resident . He also asked that the residents be advised that City and YBSD billing will be on one, bill in most cases . BUILDING DEPARTMENT REPORT - Alderman Bown moved to accept the report of the Building Department , seconded by Alderman Fey . Motion carried . RECREATION BOARD - alderman Bown announced Recreation Board the next meeting will be Monday, February 12 , 1990 , and the preliminary budget will be on the agenda . KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - KCEDC Meeting Alderman Fey announced the next meeting will be February 20 , 1990 at 7 : 30 p .m. at the Kendall County Office Building . BKFD - The fire department will be painting the Fire Hydrants fire hydrants . SCHOOL COMMUNITY - Mayor Davidson met with Mr _ Storm regarding the waiving of the utility tax for the school district _ In return the school district may take over the tennis courts e.le.ctical bills . COMMITTEE REPORTS ----------------------------------------------- FINANCE - Alderman Bown asked if there was any Med . Ins . Rates reason for the 21 % increase in the medical insurance rates . ENgineer Klaas responded that it was still less that the industrial standard_ Alderman Small moved to have a resolution drafted allowing the elected position of the present Mayor of the United City of the Village of Yorkville to participate in the IMRF plan, seconded by Alderman Bown . 171 41 m Alderman Fey amended the m3 o table the matter until further discussion was held , seconded by Alderman Hayden . The amendment was carried by voice vote , with Alderman Small voting Nay . The amended motion to allow the elected position of the present Mayor of Yorkville to participate in IMRF was tabled for further discussion was carried by voice vote , with Alderman Small voting Nay . Alderman Small moved to increase Attorney Kramer ' s Salary to $9000 , retroactive to ,Ianuary 1 , 1990 , seconded by Alderman .Tahp . BUILDING & ZONING - Mayor Davidson requested the entire city council be present at the February 22 , 1990 City Council meeting when the Schneider/Scarpetta W. Van Emmon Street Vacation comes before the Council for a public hearing . Asle D � Alderman Bown about the enforcement policy regarding the burned out home on State Street . Attorney Kramer stated that the enforcement powers lie with the Kendall County health officer . The matter was referred to committee for further discussion. FUTURE PLANNING - No report . STREETS & ALLEYS - Alderman Fahrlander asked about the status of the Van Emmon Sidewalk . IDOT says the state maintains the driving lanes , and the City all the appurtenances and facilities outside . SEWERS - Mayor Davidson reported that the YBSD has submitted their annual report . PUBLIC RELATIONS - Mayor Davidson reported the plans are in the making for the City ' s Golf Outing . Alderman Bown reported that a City plaque was presented to Odin Christian on his retire- ment . POLICE - Chief Diederich requested a time slot at the March 15 , 1990 Council of the Whole Meeting for some matters he would like to discuss . EMERGENCY SERVICES & DISASTER - No report . YBSD BOARD - The next meeting is February 19 , 1990 . ,LIBRARY BOARD - Alderman Bown announced the next meeting is February 13 , 1990 at 7 : 00 p .m.
