RECREATION BOARD - Alderman Bown reported
that Stormy Gray , Recreation Director , has
submitted her resignation effective May 1 ,
1990 .
The east diamond of the ball park at E . Van
Emmon Street will be taken down and the west
one repaired . No parking signs have been
requested for the street , and the matter
referred to the Police Chief .
Alderman Bown reported he will be getting
together with the Yorkville Women ' s Club
for discussion on the development of
recreational grounds to replace Shoestring
Park .
Volleyball has been added to the recreation
programs and new mats have been purchased _

MINUTES OF THE PUBLIC HEARING BEFORE THE CITY COUNCIL OF THE UNITED
CITY OF THE VILLAGE OF YORKVILT,F., KENDALL COUNTY, TLLINOTS . HELD AT
CITY HALL ON FEBRUARY 22 , 1990 .
Mayor Davidson called the Public Hearing to order at 7 : 45 , and stated
the purpose of the Public Hearing was to hear the petition by
,John Schneider and Dave Scarpetta to vacate a portion of W. Van
Emmon Street .
Clerk Erickson called the roll :

Radke - Absent Hayden - Absent Pfister - Present
Bown - Present Fahrlander - Present
Five members were present , and 3 members were absent .
Mr . Schneider presented his Petition and stated there was a 4-4
vote on the matter previously to vacate the street . Mr. Schneider
asked th6 City Council to postpone the vote until a full council.

Mr . Scarpetta stated that the City Council had requested previously
that the parties meet for negotiations , but that there were no
compromises on the part of Mrs . Arnold , and that she wanted to
leave the property as it is at present , and that there was no merit
in turning the lots as suggested by the petitioners . He further
stated that Mrs . Arnold wanted an easement , but that it was not
acceptable to him.
Mr . Schneider stated that he made several attempts to speak to
Mrs . Arnold ' s attorney .
Attorney Cunningham stated that he had personally talked with
Mr . Schneider and Mr . Scarpetta and that they were not willing
to compromise, and were not willing to give an easement .
He further stated it was unreasonable for the petitioners to
request turning the lots , and that Mrs . Arnold ' s property would
be depreciated and cause damage due to no ingress and egress to
the property if the street were vacated. They are objecting
to the vacation, but would agree to a motion to vacate
10 feet for an easement for ingress and egress to Block 22 , Lot
2 .
Attorney Cunningham asked that it be a matter of record that
he objected to Mayor Davidson chairing the Public Hearing , being
he is the former owner of the property in question.
Alderman Bown asked if it was feasible to vacate the street on
the contingent on the premise of purchasing 10 feet of
right-of-way. Attorney Cunningham responded that he didn ' t feel
that was a fair way of doing it , taking it away, and then having
to pay to get it back.
Mr . Scarpetta stated that Attorney Cunningham ' s meeting with him
was approximately 5 minutes immediately previous to the this
meeting.
Alderman Jahp asked for clarification of the Petition request .
Alderman Bown moved to place the Petition Request into the
record , with the minutes of the Public Hearing . Motion was
seconded by Alderman Fey. Motion carried .

Mr . Scarpetta stated that for the record, the initial intent
of the petitioners were to make improvements to the property .
Alderman Jahp moved to move to adjourn the Public Hearing back to the
regular City Council meeting at 8 ; 15 p.m. , seconded by Alderman

SCHOOL COMMUNITY - Mayor. Davidson reported that
he met with the Planning Committee of the
School District and other various entities ,
and that they seem to share many of the same
views on matters of importance .
Mayor Davidson reported that nothing has been
received from the state regarding the Game
Farm Property .
OLD BUSINESS - Mayor Davidson reported that
the City will hold a meeting with the south
side developers regarding extension of present
sewer mains .

FINANCE - Mayor Davidson reported that several. Interviews

Alderman Fey moved to authorize Attorney Kramer IMRF Res . - Mavor
to draft a resolution to allow Mayor Davidson
to participate in the IMRF program, seconded

Engineer Klaas reported that an advertisement
has been placed in the paper regarding the
hiring of a new Public Works Employee , and
applications are being submitted . The inter-
views will begin after March 6 or 7 , 1990 .

HEALTH & SANITATION - Mayor Davidson reported
the Kendall County Health Officer will be
looking into the matters of the burned out
homes in the city .

1990 Council of the Whole meeting , as represen-
tative will be present to talk abort recycling .

BUILDING & ZONING - There is an institute for
Planning Commission members sponsored by the
the state to be held in St . Charles . Costs
are being obtained at this time to see if it
is feasible to send members , and possibly to
send all members , and those of the City Council
who are also interested .

to write a letter to the Rockford group who
is interested in putting up additional Sr . Citi-

STREETS & ALLEYS - Regarding the street posting Street Posting

Engineer Klaas reported the bid opening for the Bids - Badger St .
Badger Street Bids in Fox Industrial Park will
be on March 21 , 1990 .

PUBLIC RELATIONS - Alderman Pfister reported City Golf Outing
the City Golf Outing will be May 3 , 1990 at
Cedardel. l . The printing is being done at the
present time , and the preliminary mailing
will be done sometime in the next week. The
rates remain the same .
POLICE - Alderman Jahp moved to refer the Additional Polic
matter of additional Police officers to the
Council of the Whole meeting on March 15 , 1990 ,
seconded by Alderman Fey . Motion carried .
EMERGENCY SERVICES & DISASTER - No report .
YBS BOARD - Alderman Pfister reported on the
February 19 , 1990 meeting of the board .
Official approval was received from the EPA
that the fee imposed by the YBSD is fair and
equitable_
The YBSD meets the criteria for the revolving
loan program.
The sewer extension on the south side of the
City was referred to the Council of the Whole
for direction from the Council .
The next meeting of the YBSD Board will
be March 19 , 1990 .

on the Plan Commission meeting of February 21 ,
1990 .
Mayor Davidson presented PC90-2 , and stated
that Bob Thomas ' s petition to Annex and Zone
to B-3 was approved by the Plan Commission.

due to Mr . Holland ' s attorney suffering a stroke . Richard Holland
Mayor Davidson reported that PC90-6 was PC90-6 Tab
presented to the Plan Commission for Zoning by Doetschman
Kendall County approximately 6 months ago. The
property is located on Route 71 , east of Route
47 . Alderman Pfister moved to table PC90-6 ,
Mr . Doetschman ' s petition to annex and zone to
R-2 , to the next meeting for City Council
recommendation . Motion was seconded by Alderman
Bown. Motion carried .
Mayor Davidson reported that PC90-7 was tabled PC90-7 Tabled
by the Plan Commission due to it ' s not being Davidson/Wheeler
contiguous at this time . Alderman Pfister
moved to table the Davidson/Wheeler Petition
No.PC90-7 to the next meeting , due to it ` s not
being contiguous to the City of Yorkville at

Mayor Davidson reported that the Kendall County PC90-9 Ref to CofW
petition to zone from A- 1 to R-3 by Stanley KC Zepelac
Zepelac_ was discussed by the Plan Commission, Bristol Woods
regarding the City water and sewer hookups
not being feasible . Mayor Davidson requested
time to talk to the City Council to discuss
a special- service area for the Bristol Woods
Subdivision. Alderman Bown moved to refer
the Zepelac Petition to the Council of the
Whole meeting on March l. , 1990 , seconded
by Alderman Fey. Motion carried .
Mayor Davidson reported that Barry Niles PC - Prel . Discussion
was in attendance at the Plan Commission Prairie Lands
for Preliminary Discussion regarding Prairie
Lands .
