City Council Minutes 1990 05-24-90 MINUTES OF THE REGULAR MEETING OF 'CHE CITY COUNCIL OF THE UNITED CITX OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT THE KENDALL COUNTY BOARD ROOM, 110 W. RIDGE ST. . ON MAY 24 . 1990. Following the Student Government Day Mock City Council meeting , Mayor Davidson called the meeting to order at approximately 7 : 45 p.m. , and led the Council in the Pledge of Allegiance. Clerk Erickson called the roll : Ward 1 - Small - Present Jahp - Present Ward 2 - Radke - Present Fey - Present Ward 3 - Pfister - Present Hayden - Present Ward 4 - Fahrlander - Present Bown - Present A quorum was established . Student Govt . Da Mock CC Meetinig Call to Order Regular CC Meeting Roll C Alderman Bown, seconded by Alderman Pfister , Minutes Approval moved to waive the reading of the minutes from the May 10 , 1990 City Council meeting , and approve them as presented. Motion carried. Alderman Pfister moved to authorize payment of . the bills as presented , seconded by Alderman Jahp . Clerk called the roll : Radke - Aye Bown - Aye Fey - Aye Fahrlander - Aye Jahp - Aye Small - Aye Bown - Aye Hayden - Aye Motion carried . PLAN COMMISSION - Alderman Hayden moved to annex the Growmark property on the N/E corner of Route 71 & 47 , and to grant M-1 zoning. Motion was seconded by Alderman Fey. Clerk Erickson called the roll as follows : Small - Aye Radke - Aye Pfister - Aye Jahp - Aye Fahrlander. - Aye Fey - Aye Bown - Aye Hayden - Aye Motion carried . Alderman Radke moved to annex the Richard Holland property on Route 34 , east of Route 47 , and grant B-3 zoning. Motion was seconded by Alderman Small . Clerk Erickson called the roll : Fey - Aye Small - Aye Fahrlander - Aye Bown - Aye Jahp - Aye Hayden - Aye Pfister - Aye Radke - Aye Motion carried. Bills Approval Annex Growmark M-1 Zoning Annex R. Holland Page 2 May 24 , 1990 Don Hausler commented on the Holland Annexation regarding the parking and rear year setback variances that will be brought back before the respective boards and at the proper. times . There has been no feed back regarding the vacation of Jackson Street in regards to the Prairie Park Subdivision. It was reported that the YBSD objection was noted in regards to the Helenjo Clarage . The Plan Commission did not look on it favorably , and suggested going from 4 to 3 units . Alderman Pfister stated that R-3 zoning is not acceptable to the Yorkville- Bristol Sanitary District . CITIZEN COMMENTS - Jim Ward a Spring Street resident spoke regarding his son being almost hit by a car at the intersection of E. Spring & Colton Street , and stated that a stop sign is needed at that location . He also asked that cross walksk be painted on when the street is resurfaced. Alderman Hayden moved to refer the Spring & Colton 4-way stop request to the Council of the Whole meeting on May 31 , 1990 at approx- imately 7 : 30 p.m. Mr. Brandon addressed the council and stated that in regards tothe Route 47 & W. Van Emmon stairs that are in need of repair, he is not able to afford the $9 , 000 cost , which re- presents half of the full cost to be shared by the City. The matter was referred to Engineer Klaas who will bring the matter before the Council of the Whole on May 31 , 1990 at 8 : 00 P.M. MAYOR ' S REPORT - Mayor Davidson accepted the resignation of Dave Greiter from the Plan Commission. Mayor Davidson accepted the resignation of resignation of Ann Luciano Scheffran from the Library Board. Vacation Jackson Street H. Clarage YBSD Objection Citizen Comment E. Luciano Scheffran Alderman Pfister moved to approve the appoint- PC Appointment ment of Ann Luciano Scheffran to the Plan A. Luciano Scheffran Commission to fill the term vacated by Dave Greiter, seconded by Alderman Bown. Motion carried. Page 3 Mayor Davidson reported the School Board had voted down the City ' s proposal for a cash donation from developers for their education fund , and will hold another referendum in November . To proceed with the matter without the school board ' s approval would not justify the need for the funds to the developers . Mayor Davidson presented Bob Fleckinger of the Public Works Department a plaque for 10 years of service to the City of Yorkville. CITY ADMINISTRATOR/ENGINEER - Engineer Klaas reported that the Radium Variance has been granted, but to date he has no real specifics on the matter . Alderman Hayden moved to pass ORDINANCE # 1990-17 entitled "ORDINANCE REGULATING ISSUANCE AND COMPLETION OF BUILDING PERMITS" , seconded by Alderman Bown. Clerk Erickson called the roll : Bown - Aye Fey - Nay Radke - Aye Small - Aye Hayden - Aye Pfister - Nay Fahrlanderk - Nay Jahp - Aye Motion carried 5-3 . Alderman Fey stated he feels the ordinance just passed is too restrictive . Alderman Bown moved to pass ORDINANCE # 1990-18 regarding R-2 Duplex Zoning, seconded by Alderman Pfister . Clerk Erickson called the roll : Radke - Aye Pfister - Ave Hayden - Aye Fey - Aye Bown - Aye Fahrlander - Aye Jahp - Aye Small -Aye Motion carried . May 24 . 19 Cash Donation - Bldg. Education 10 yr. Service Plaque B. Fleckinger Radium Variance Granted Ord. 1990-17 Passed B1dg.Permits Issue & Complete Ord. 1990-18 Passed R-2 Duplex Zoning Alderman Bown moved to authorize Mayor Davidson IDOT Improvement to sign the IDOT letter regarding improvements Authorization on Route 34 , seconded by Alderman Fey. Motion Route 34 carried . PUBLIC WORKS REPORT - Alderman Jahp moved to Public Works Rpt . accept the report of the Public Works Department , seconded by Alderman Bown. Motion carried . WATER REPORT - Alderman Bown moved to accept Water Report the report of the Water Department , seconded by Alderman Jahp . Motion carried. Alderman Pfister reported that Well. #3 needs Well #3 Repairs �e Page 4 May 24 , 1990 to be looked at regarding repairs . KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - KCEDC Alderman Fey reported the recent meeting was held at the new Plano City Hall , and that a demographic report was presented. They are running well under their budget . Alderman Fey moved to support Mayor Davidson ' s thoughts regarding good budgeting for the KCEDC by Mr . Holt , and have him remain in the position of director . Motion was seconded by Alderman Bown. Motion carried . BKFD - The annual pancake breakfast will be held on June 3 , 1990 . SCHOOL COMMUNITY - Alderman Bown reported the School Community board voted not to go with the graded school center . They also voted not to cut any school programs . The next meeting will be June 11 , 1990 . OLD BUSINESS - Attorney Kramer reported that Richard Holland has concerns regarding the variances they will be requesting , and also recapture agreements . Alderman Radke reported that he has found no vacation of Jackson Street on record to date . Alderman Hayden asked when the Route 47 no parking signs will be going up. Health Ins . Alderman Jahp reported the request for increase Pay Increase Denied for the Mayor, City Clerk, and City Treasurer Mayor , Clerk & Treas . was denied . Alderman Radke moved to refer the salary increase requests of the Mayor City Clerk and City Treas- urer to Committee for further discussion , seconded by Alderman Pfister . Motion carried with Alderman Bown voting Nay . Page 5 May 24 , 1990 Alderman Bown moved to enter into a contract with -Audit Contract Sikich & Gardner for the 1989-90 Fiscal Budget Sikich & Gardner Audit in the amount of $ 12 , 500 , seconded by Alderman Jahp. Clerk Erickson called the roll : Pfister - Nay Bown - Aye Fahrlander - Nay Fey - Nay Hayden - Abstain Small - Aye Radke - Aye Jahp - Aye Motion carried 4-3 with one abstention. PUBLIC PROPERTY & BUILDINGS reported that at the recent meeting, no parking on the were discussed . BUILDING & ZONING - It was reported the Holland annexation will need a public hearing before the City Council as soon as the matters at hand are ironed out . _FUTURE PLANNING - Alderman Radke reported that Codification he has completed the codification review and there are approximatly 30 corrections . The matter was referred to the June 7 , 1990 Council of the Whole . STREETS & ALLEYS - No report . SEWERS - Mayor Davidson reported there are some irrate citizens regarding residential sewer backups . The City needs assistance regarding the press to have citizens call if their systems seem at all sluggish before heavy rains occur to possibly prevent backup problems , or to establish problem areas . PUBLIC RELATIONS - Alderman Pfister requested purchasing new city signs with the golf outing profits at a near future Council of the Whole meeting. -POLICE .- No report . Y.BSD BOARD - Alderman Pfister reported on the &-wer Rarkispa Golf Outing Profits Revolving Loan - YBSD Page 6 the 2 . 8 million revolving loan. LIBRARY BOARD - Alderman Hayden reported the board reached a positive point , and expended $ 10 , 000 for new books . CHAMBER OF COMMERCE - Mayor Davidson reported the Chamber of Commerce discussed thoughts regarding enhancement of the downtown area at their recent meeting. The City will be invited to attend a meeting to discuss the matter further . May 24 . 19 Library Board Downtown Enhancement ADDITIONAL BUSINESS - Alderman Fey moved moved Thank Kendall Count authorize Mayor Davidson to send a letter to Use of Board Room Kendall County thanking them for the use of their Board Room for tonight ' s meeting, seconded by Alderman Pfister . Motion carried . Alderman Hayden brought the Neisen flooding problem on E. Somonauk St . at Route 47 before the council . Alderman Pfister stated that with the amounts of heavy rains that fell , there was really not much that could be done with situations like that .
