City Council Minutes 1990 09-13-90 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON SEPTEMBER 13, 1990. Mayor Davidson called the meeting to order and led the Council Call to Order in the Pledge of Allegiance. Clerk Erickson called the roll: Ward 1 - Small - Present Roll Call Jahp - Present Ward 2 - Radke - Absent Fey - Absent ' (Arrived @7:50 P.M.) Ward 3 - Pfister - Absent Akers - Present Ward 4 - Bown - Present Fahrlander - Present A quorum was established. Quorum Guests introduced themselves as Elden Madden, Lawrence Langland, Gttests Howard Johnson, Bob Lee, and members of the press. Alderman Jahp moved to waive the reading of the minutes from Minutes Approval the August 23, 1990 City Council meeting, and approve'them as presented, seconded by Alderman Akers. Motion carried. Alderman Bown moved to authorized payment of the bills as presented, seconded by Alderman Jahp. Clerk Erickson called the roll: Jahp - Aye Fey - Aye' Akers - Aye Bown - Aye Small - Aye Fahrlander - Aye Motion carried. Alderman Jahp questioned whether all questions had received answered in regards to Nelson Pottinger's bill, preceding the vote. ATTORNEY'S REPORT - Alderman Bown moved to pass ORDINANCE #1990-2T entitled "ORDINANCE ANNEXING PROPERTIES TO THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS", by Richard Huston at 509 E. Spring St. , zoned R-2,seconded by Alderman Small. Attorney Kramer stated there was no annexation aggreement to accompany this single lot annexation. Voice vote was taken. Motion carried. Alderman Bown moved to authorize the Mayor and City Clerk to execute ordinance with IDOT regarding encroachment and no parking, seconded by Alderman Jahp. Clerk Erickson called the roll: Bown - Aye Fahrlander Aye Akers - Aye Jahp - Aye Small - Aye Fey - Aye' Motion carried. Bills Approval Pottinger Bill Ord.1990-21 R. Huston Annexatio 509 E. Spring St. R-2 Zoning Ord. 1990-22 IDOT Improvement Encroachment No Parking Alderman Bown moved to adjourn the regular meeting to the Adjourn to P.H. the Public HEaring scheduled to hear the variance request by McDonald's Variance McDonald's.for a sign variance, seconded by Alderman Fey. The RE: Sign meeting was adjourned at 7:47 to the Public Hearing. Motion carried. ------------------------------------------------------------------------------------ MINUTES OF THE PUBLIC HEARING HELD BEFORE THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, ON SEPTEMBER 13, 1990 at 7:45 P.M. , AND ACTUALLY CONVENED AT 7:47 P.M. Mayor Davidson called the Public HEaring to Order and stated the purpose of the hearing was to hear the petition request for Variance from the Sign Ordinance by McDonald's,for 108 sq. ft. of signage with flood lights on the ground. There were no objectors present. There was no one present to present the petition on behalf of McDonald's. Alderman Jahp stated that sign variances had been granted to the other two fast food premises in the past. Alderman Bown requested that the petitioner be informed of of the positioning of the sign by a new development to the Alderman Bown moved to adjourn the Public Hearing at 7:53 meeting. , seconded by Alderman Fey. P.M. , back to the regular Erickson, City Clerk --------------------------------- Page 2 The regular meeting was reconvened at 7:53. No action was taken regarding the Public Hearing. ATTORNEY'S REPORT CON"T. - Attorney Kramer reported that a closing on the Hanson property should be by the next week. He will need a check from the City at that time. Attorney Kramer announced that he will have the tentative Tax Levy Ordinance by the next meeting, to be passed in October. PLAN COMMISSION REPORT - Alderman Akers moved to table action regarding the Clarage Rezoning, seconded by Alderman Small. Motion carried. (Insert)***** Discussion was held regarding the Lee Rezoning from R-1 to M-1. The exact location of the property in question was pointed out by Mr. Lee. He feels that M-1 is the best use for the property. There were no objectors at the Public Hearing from any of the adjacent property owners. Also, that marketable M-1 property is not available in Yorkville. In answer to Alderman Bown's question as to what Mr. Lee plans for development of the property, Mr. Lee stated he has nothing in mind. Mr. Lee further stated that he is forced to address, and take care of the run-off situation, but he does not believe the problem comes from his property, and that anything he does will be an improvement to the area. There was discrepancy stated by Mr. Langland and Mr. Madden regarding the situation on Elizabeth Street and north of there, and the run-off situation, and that his development had not helped the situation. Engineer Klaas addressed the issue stating the excessive water was due to 300 acres of land draining into that area east and g6uth. --- of Fox Industrial Park. Mr. Madden addressed the comprehensive plan, and the low density residential for that area, and whether a new plan had been adopted for M-1 in the area. Mr. Johnson is a resident on one side of where the water comes' thru to Elizabeth Street, and stated that you can't change the past, but help can be met in the future. Mr. Madden stated that engineering had been done for the entire area at one time for a potential developer, Kissel, by Baxter & Woodman engineering firm. Engineer Klaas stated that the zoning was the issue at hand. Alderman Akers moved to grant the Lee Rezoning from R-1 to M-1, seconded by Alderman Bown. More discussion followed retention of water. Clerk Erickson called the roll: Bown -,Aye Fey - Nay Fahrlander - Nay Jahp - Nay Small - Nay Akers - Aye Motion defeated 2-4. A two minute recess was given. The meeting was reconvened. ------------------- September 13, 1990 Hanson Property Tent. Tax Levy Ord. Clarage Rezoning Tabled Lee Rezoning Denied (Insert) - Alderman Jahp moved to bring the Lee Rezoning back to the table for a vote, seconded by Alderman Bown. Motion carried. MAYOR'S REPORT - Mayor Davidson announced the resignation of Resignation - M. Radke Mary Radke from the Library Board, He will appoint a replace- Library Board ment at the next City Council meeting. Mayor DAvidson announced the verbal, with written confirmation Resignation - W. Radke to follow, resignation from Bill Radke as Alderman in Ward 2. Alderman Ward 2 PAGE 3 September 13. 1990 Mayor Davidson proclaimed September 22, 1990 as Proclamation - Am. Business "AMERICAN BUSINESS WOMEN'S DAY" in the City of Yorkville. Women's Day CITY TREASURER'S REPORT - Treasurer Huston reported that Treasurer's Report Budget Officer Drew mad met with the Recreation Department Recreation Dept. regarding their budget requirements, and hopes to add it to the report in the near future. Alderman Jahp moved to accept the Budget Report, seconded by Alderman Small. Motion carried. PUBLIC. WORKS & WATER REPORT - Alderman Bown moved to Public Works & Water Reports accept the Public Works and Water reports, seconded by Alderman Small. Motion carried. POLICE REPORT - Alderman Fey moved to accept the reports Police Dept. Report of the Police Department, seconded by Alderman Bown. Motion carried. BEECHER BUILDING REPORT - Alderman Small moved to accept Beecher Bldg. Report the report of the Beecher Building, seconded by Alderman Bown. Motion carried. Mayor Davidson asked about the possibility of showing the daily usage per room on the report. BUILDING REPORT - Alderman Bown moved to accept the Building Report, seconded by Alderman Jahp. Motion carried. Building Report SCHOOL COMMUNITY REPORT - It was reported that a committee School Referendum of two was formed to address the referendum issue and provide the public with information on why the funds are needed. OLD BUSINESS - Alderman Jahp stated that the only problem he had with the census count was the 60 some vacant units, as there didn't seem to be that many vacant in Yorkville. The rest of the count seems to match pretty much what the pre-census count was reported at being by the City Clerk. COMMITTEE REPORTS FINANCE - Alderman Jahp moved to authorize purchase of a back up power pack for the Utility Billing Computer not to exceed $600, seconded by Alderman Bown. Clerk Erickson called the Roll: Fahrlander - Aye Small - Aye Bown - Aye Jahp - Aye Akers - Aye Fey - Aye Motion carried. PUBLIC PROPERTY & BUILDINGS - No report. HEALTH & SANITATION - Alderman Fahrlander stated he would like to discuss going to bid for the garbage contract at the next Committee of the Whole meeting. UTILITIES - No report. WATER - Alderman Jahp moved to authorize purchase of materials from Water Products not to exceed $10,500, for the Jackson Street water main extension project, seconded by Alderman Fey. Clerk Erickson called the roll: Akers - Aye Bown - Aye Small - Aye Fey - Aye Jahp - Aye Fahrlander - Aye Motion carried. Census Computer Power Back-up Garbage Contract Bids Jackson St. Extension Materials BUILDING & ZONING/FUTURE PLANNING - Mayor Davidson Comprehensive Plan announced there will be discussion on the Comprehensive Plan, the past and the future issues of the Plan Commission at their next meeting on September 19, 1990. PAGE 4 September 13, 1990 The codification will be brought to the next committee meeting. Codification STREETS - Alderman Akers moved to ratify entering into a Ratify - Contract contract with Aurora Blacktop, Inc. for the Bristol & ABT/Dolph & Bristol St. Dolph Street improvements at a cost of $31,405.00. Motion was seconded by Alderman Bown. Clerk Erickson called the roll: Fahrlander - Aye Jahp - Aye Bown - Aye Fey - Aye Small - Aye Akers - Aye Motion carried. SEWERS - Mayor Davidson reported there has been no activity Sump Pumps regarding the sump pumps. Engineer Klaas will be bringing the new sewer ordinance for New Sewer Ordinance to the committee meeting for review. It must be approved before the state will give any funds from the revolving loan program. POLICE - Chief Diederich reported that he has been testing the new applicants for police office, and that he will be bringing forth a recommendation very soon. PUBLIC RELATIONS - No report. YBSD BOARD k The next meeting will be September 17, 1990. LIBRARY BOARD - Alderman Jahp reported that the board worked on policy changes at their recent meeting. Alderman Jahp moved to authorize expenditure of $2,551.00 to double stain the library building, to be done by Jon Walters. Clerk Erickson called the roll: Fahrlander - Aye Akers - Aye Bown - Aye Fey - Aye Small - Aye Jahp - Aye ' Motion carried. Alderman Akers asked if Mr. Walters provides a Certificate of Insurance, and it was stated he had. ADDITIONAL BUSINESS - Alderman Jahp commented as a citizen that he is an advocate of bringing manufacturing and buiness to Yorkville for tax base purposes, and has mixed emotions regarding the earlier debate on M-1 zoning earlier in the meeting. St. Patrick's Parrish policing request was referred back to committee for further discussion. Attorney Kramer was requested to be present. There needs to be a meeting date set regarding the Kendall County Jail. They are requesting the waiving of building permits for the project.
