City Council Minutes 1990 10-25-90 MINUTES OF' THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON OCT. 25, 1990 Mayor Davidson called the meeting to order at 7:30 p.m. Call to Order and led the Council in the Pledge of Allegiance. Roll was called: Ward 1 - Small - Present Jahp - Present Ward 2 - Fey - Present Ward 3 Akers - Absent Pfister - Present Ward 4 - Fahrlander - Present Bown - Present A quorum was established. Introduction of guests: Richard Speckman, Dick Selet�.ick, Guests Gail Fisher, Jim Detzler Joyce Brown, Attorney Tom Grant, Barry Niles, Pat Clark Minutes: Alderman Pfister made the motion to approve Minutes Approval the minutes of the Oct. 11 meeting; Alderman Fey gave the second. Voice vote carried. Bills: Alderman Pfister moved to approve the bills Bills Approval as presented for payment. Alderman Jahp gave the second. Roll was called: Pfister - Aye Fahrlander - Aye Fey - Aye Jahp - Aye Bown - Aye Small - Aye Motion carried. Appointment of Alderperson: Mayor Davidson presented Pat Clark Appointment Pat Clark for appointment to Ward 2. Ms. Clark was sworn in and was seated with the Council. The motion to approve the appointment was made by Alderman Bown; the second was given by Alderman Small. Voice vote carried. Citizen Comments: Mr. Jim Detzler, President of the Presentation of Plaque Village of Oswego, presented a plaque to the Mayor in from Oswego appreciation of the assistance from the City of Yorkville during the recent tornado. PLAN COMMISSION / ZONING BOARD OF APPEALS - Mayor Clarage Property Davidson stated that the Clarage property proposal will need to go back to committee on November 8. Prairie Park - Attorney Kramer presented the PUD agreement Prairie Park PUD noting one additional change; the duplex units would be treated either as townhouse or condo units and proper language to that effect had been added to prevent any future question of encroachment. Alderman Bown moved to approve the PUD agreement as presented instructing the Mayor & City Clerk to sign the same once passed. Page - ---------------- 2 October 25, 1990---- ------------------------------------------- - -------------------- The second was given by Alderman Jahp. Roll was called: Bown - Aye Fahrlander - Aye Pfister - Aye Jahp - Aye Small - Aye Clark - Aye Fey - Nay Motion carried. The final plat will be presented to the Plan Commission for recommendation. It will be back before the Council on December 13. Dan Kramer also noted the agreement regarding easements, roadways, etc. , resulting from discussions between the City, Mr. Niles, and St. Pat's; action to be taken at the next Council meeting. Conover - Mr. Conover is asking for preliminary plat Preliminary Plat -- approval. Alderman Bown made the motion to approve the Conover Subdivision preliminary plat contingent upon the additions and corrections as recommended and that they be listed on the final plat. Alderman Pfister seconded. Voice vote carried. ATTORNEY'S REPORT - Attorney Kramer presented the Stop Sign Ordinance ordinance to establish a stop sign for a 4-way stop at McHugh and Spring Street. Alderman Jahp made the motion to approve; Alderman Bown gave the second. Roll was called: Pfister - Aye Small - Aye Fahrlander - Aye Jahp - Aye Bown - Aye Clark - Aye Fey - Aye Motion carried. Regarding the Hanson well purchase -- Attorney Kramer noted that there was no further progress. Alderman Bown inquired about annexation on the North; Attorney Kramer stated that the city would have to force this issue. On the South there is no problem, just waiting for completion of documentation. Alderman Pfister noted the importance of getting the Gromark annexation completed; the Hughes and Brown properties are requesting annexation into the district and this is dependent on Gromark. Alderman Fey questioned the raises put into effect for County personnel when a 6-month notice is required for approval of any city increases. Attorney Kramer explained that it is legal difference in statute governing Counties as opposed to the statute governing cities and municipalities. MAYOR'S REPORT - -Mayor Davidson asked the Council to Sales Tax Review approve the hiring of George Bell to review the sales tax list to check for accuracy. Proposed cost - $480. Page 3 ----------------October-25.,1990 --------------------------------------------- ------- -- --------- Alderman Bown moveCi to approve the Mayor's proposal. The second was given by Alderman Pfister. The question of the time period involved was asked by Alderman Jahp; also, how far back in the records can the study go. The Mayor suggested that the motion be voted down and he would bring the issue back before the Council after further information can be gathered. Alderman Bairn withdrew hi's motion. The Mayor indicated he wanted to go into executive session after the regular meeting to discuss the possible acquisition of property. CITY CLERK - No report. Clerk's Report TREASURER'S REPORT - The audit is expected to be completed Treasurer's Report by Monday. CITY ENGINEER'S REPORT - Fran Klaas reported that the Engineer's Report minutes of the executive session held previously would be brought before the Council for approval by Luanne as soon as she was able to 'iattend again._ Other topics, would be discussed during the rest of the meeting. MISCELLANEOUS - Chief Diederich said that testing had Miscellaneous been completed and results of psychological evaluation wwould be back soon. The Mayor attended the 911 meeting and noted that the applications for director would be reviewed at the next committee meeting. KENDALL ECONOMIC DEVELOPMENT COMMISSION - Alderman Fey KCEDC Report attended the meeting during 'which budget was discussed; there is approximately a $4,000 cut from last year's total. The new Economic Commission Director was not able to attend; the Commission would be expected to pay one-half of the Administrative Aide's salary -- currently that would be $18,000 with a possible increase in six month's. The Mayor announced that Don Holt would continue as an advisor during the transitional period. TENNIS COURTS - Time to turn lights off for the season Tennis Courts SCHOOL COMMUNITY - Meetings to discuss the referendum and School Community its impact on the schools are being held at individual locations with members of the Board in attendance at each one to answer questions. The Mayor announced Halloween trick or treat hours would be from 4:00 to 8:00 P.M. Alderman Small reminded the Council of "Red Ribbon Week" . Page 4 ----------------October-25,-1990 --------------------------------------------- ------- --- --------- ************************* CITY COUNCIL COMMITTEE REPORTS ************************* FINANCE - Alderman Jahp made a motion to approve the Levy Ordinance levy ordinance in the amount of $405,702.02. The second was given by Alderman Bown. It was noted that a major portion of the 5% increase would benefit the Library. Roll was called: Bown - Aye Fey - Aye Small - Aye Fahrlander - Aye Clark - Aye Pfister - Aye Jahp - Aye Motion carried. The Mayor announced that Joanne Ellertson would attend committee meetings beginning Nov. 1 for the purpose of taking minutes. PUBLIC PROPERTY & BUILDINGS - It was noted that all Library Repair repair work on the outside of the Library had been completed. HEALTH & SANITATION - No report from Alderman Fahrlander. Health & Sanitation Mayor Davidson stated that no new information was available on the restaurant south of town or on the house damaged by fire on State St. WATER - Alderman Pfister asked about progress on repair Well #3 Repair work on the Well #3 Building; Fran Klaas stated that all authorized repairs had been made but that there were areas needing work in the future. The sandblasting of the stem on the water tower will Sandblasting Charge cost $13,900. (sandblasting & painting) The Mayor Approval said that the situation had to be taken care of at once before the extreme cold weather was here. A second quote was obtained and was higher than the original. Alderman Pfister made the motion to approve the expenditure of $13,900 to have the work done on the stem; Alderman Bown gave the second. Roll was called: Pfister - Aye Small - Aye Bown - Aye Clark - Aye Fahrlander - Aye Jahp - Aye Fey - Aye Motion carried. Well #2 - Alderman Bown stated that the discussion in Abandon Well #2 committee favored the abandonment of the well. It has not been used for eight years and has been disconnected F from the city system; it should be sealed and the pump and materials removed. Alderman Jahp asked for a cost estimate; Mayor Davidson thought about $1,000. A lot of the work involved could be handled by city crews. Alderman Jahp made the motion to approve the sealing of well #2 at a maximum cost of $1,000; Alderman Fey gave the second. Page 5 October-25,-1990 -------------------------------------------- ---------------- - ------- --- --------- Roll was called: Small - Aye Jahp - Aye Pfister - Aye Fey - Aye Bown - Aye Clark - Aye Fahrlander - Aye Motion carried. BUILDING & ZONING / FUTURE PLANNING - Alderman Bown had no report on building- & zoning, but asked about the status of the codification. The Mayor stated that no further information had presented itself; a meeting had been scheduled but was canceled. STREETS - Alderman Fey said that the railroad tracks on Rt. 47 were again in need of repair. Mayor Davidson said that there was a bid on the salt 4hed Salt Shed Bid construction from Robert E. Lee; the amount was $30,560. Multi-Purpose Storage Fran Klaas gave two alternates: (1)carry the siding to Building ground elevation with an additional cost of $960; (2)replace the asphalt roof & mood siding as proposed in the original document to all steel at a reduction of $820. The Mayor added that the building would house all supplies, such as salt, asphalt, gravel, etc. Fran added that the money was available (street funds budgeted would not be fully used due to some repairs not being completed for reason of sewer problems. ) There is no comparative bid; Fran believes the proposal is in line with estimated costs. The building would be located behind the existing shed; it will open to the east. Alderman Jahp asked for Fran's opinion of the best structure design; Fran said he would prefer steel siding to come to ground level. Alderman Bown made the motion to approve an expenditure from the street fund up to $32,000 to construct a storage building on the present property with metal roof and metal sides going all the way to the ground. The second was given by Alderman Pfister. Roll was called: Fey - Aye Small - Aye Jahp - Aye Fahrlander - Nay Clark - Aye Bown - Aye Pfister - aye Motion carried. Fran Klaas said that Aurora Blacktop would pave Bristol Ave. next week. SEWERS - No report from Alderman Pfister. Mayor Davidson Clark to Serve on stated that Pat Clark would serve on the sewer committee Sewer Committee and with Alderman Pfister and with Alderman Bown on Building Building & Zoning & Zoning/Future Planning. ------- Page 6 ----------------October-?.5,October-25,-1990---- -------- POLICE - No report. PUBLIC RELATIONS - Alderman Pfister said that the Flags Installed flags purchased are all up. He also stated that some samples for City of Yorkville signs would be brought to committee soon. YBSD BOARD - Next meeting to be November 19 LIBRARY BOARD - Next meeting November 12; still short Library Board two members. Mayor Davidson said that he asked the Needs Two Members Library Board for three recommendations which he would then present to the Council; he should have in 30 days. CHAMBER OF COMMERCE - Next meeting to be November 20 at 7:30 A.M. ADDITIONAL BUSINESS - Alderman Jahp noted that during IBM Purchase Approved committee meeting the purchase of an IBM typewriter and interface had been discussed; he made the motion to approve the purchase of those items at a cost not to exceed $950. Alderman Fey gave the second. Roll was called: Clark - Aye Fahrlander - Nay Bown - Aye Jahp - Aye Small - Aye Fey - Aye Pfister - Aye Motion carried. Alderman Jahp offered favorable comments on the new ordinance books now in use. ADJOURNMENT - Mayor Davidson asked for a motion from Council to go into executive session at 9:00 for the purpose of discussing the purchase of property.
