City Council Minutes 1990 11-15-90 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON NOVEMBER 15 , 1990 . Mayor Davidson called the meeting to order at 7 :30 p.m., and led the Council in the Pledge of Allegiance . Clerk Erickson called the roll : Ward 1 - Small - Present Jahp - Present Ward 2 - Fey - Absent (Arrived at 7 : 38 p .m. ) Clark - Present Ward 3 - Akers - Present Pfister - Present Ward 4 - Fahrlander - Absent (Arrived at 7 : 36 p .m. ) Bown - Present A quorum was established. Guests were Richard Speckman, Pennv Baird , Joe Gaesser , Carolyn Bown, Mary Pat Storm, Kathy Farren, and Joyce Brown . Call to Order Roll Call Guests Alderman Bown moved to waive the reading of the Minutes Approval minutes from the October 25 , 1990, and approve them as presented, seconded by Alderman Jahp. Motion carried. Alderman Fahrlander arrived at 7 : 36 p.m. Alderman Fey arrived at 7 : 38 p .m. Alderman Bown moved to authorize payment of the bills as presented, seconded by Alderman Small. . Clerk called the roll : Small - Aye Jahp - Aye Fey - Aye Clark - Aye Akers - Aye Pfister - Aye Bown - Aye Fahrlander - Ave Motion carried 8-0 . Al-d - Fahrlander Arr ' d A1d . Fey Arrived Bills Approval The Public Hearing regarding the Kendall County Public Hearing Animal Shelter Variance was postponed to later KC Animal Shelter in the meeting, due to the petitioner not being Variance present . PLAN COMMISSION - The next PIan Commission meet- ing is scheduled for November 21 , 1990 at 7 : 00 p.m. at the Kendall. County Board Room. Plan Commission Attorney Grant presented Mr . Clarage ' s revised Clarage P.U.D. Agreement . They are not requesting PUD Revision platting and the impact fees recently imposed by Ordinance do not apply to them. Engineer Klaas responded that it would not apply due to their petitioning before the ordinance was enacted . Alderman Bown moved to waive the Impact Fees for Clarage ' s PUD, based on the petition being --- initiated before passage of the ordinance , seconded by Alderman Akers . Clerk called the roll : Small - Ave Jahp - Ave Fey - Nay Clark - Aye Akers - Ave Pfister - Nay Bown - Aye Fahrlander - Aye Motion carried 6-2 . Alderman Bown moved to grant the Clarage Clarage PUD Zoning property at 214 W. River St . rezoning and Page 2 reclassification from R- 1 to R-3 , with a stipulation of a P -13 - D . if it contains more than one unit , and to recommend granting of variances as recommended by the Zoning Board of Appeals regarding : 1 ) Required lot width is reduced from 90 feet to 87 feet ; 2 ) Required front yard is reduced from 30 feet to 20 feet 6 inches ; 3 ) Guest parking shall be permitted in the required front yard , provided that said parking shall. be confined to parking spaces seven ( 7 ) and eight (8 ) as delineated on Conceptual Site Development Plan; 4 ) The construction & maintenance of a six (6 ) foot fence or wall around the entire perimiter of parcel- , and a ten ( 10 ) foot high fence must be provided along the southerly portion of the westerly line as delineated on the Conceptual Site Development Plan, according to specific design plans ; and to pass ORDI ANCF # 1990-27 entitled "ORDINANCE REZONING AND RECLASSIFYING REAL ESTATE AND APPROVING A PLANNED UNIT DEVELOPMENT (HELENJO CLARAGE) " , seconded by Alderman Small . Burnout on State Street The property i's to allow the extension of out house on State Street chance to sell the pro- lderman Pfister . Motion vote with Alderman Pfister Mavor Davidson stated: he will be knocking down Mill St . Demolition the chimney that is still standing at the house that was burned down on Mill Street . MAYOR ' S REPORT - Mayor Davidson announced the resignations from the Library Board of Sue Hayden and Mary Ellen Ellis . prove Mavor David- �lrierman Pfister moved to approve son ' s appointment of Robert Johnson of i20 Blackberry Lane to the Library Board to fill the term vacated by Mary Ellen Ellis , seconded by Alderman Bown. Extensions were filed with the state regarding the audit deadline . REPORTS - Alderman Pfister moved to accept the reports of the Public Works and Water Department , seconded by Alderman Jahp. Motion carried by voice vote. Alderman Bown moved to accept the reports of the Police Department , seconded by Alderman Pfister . Motion was carried by voice vote. PARK BOARD - Alderman Small reported the Gazebo Schedulin Park Board was approached about scheduling the gazebo in the city park . There was talk regard- ing initiation a program such as Kendall County uses for the forest preserve. Delene Drew, Budget Officer gave an accounting to the Park Board regarding receipts and expen- ditures , and it was well received. Attorney Kramer will review the Land-Cash Ordinance regarding moving and securing a baseball area , and whether the funds can be used for that purpose . SCHOOL COMMUNITY REPORT - Alderman Bown reported there will be a meeting on December 4 , 1990 at 7 : 30 p .m. regarding graded center program for further discussion. Chief Di.ederich has plans worked regarding traffic control for the football, game in Yorkville at 1 : 30 on Saturday . Land-Cash Ord. PUBLIC PROPERTY & BUILDINGS - Mayor Davidson requested an Executive Session to follow the regular meeting regarding possible acquisition of property. HEALTH & SANITATION_ - No report . UTILITIES - Alderman Akers asked about new subdivision cable TV service . Attorney Kramer responded that the original agreement stted that service would be given to all areas within a specified number of years . Control was taken away fromthe municipalities when it was deregulated . Attorney Kramers will invite Jones cable Tv representative to a Council of the Whole meeting on December 6 , 1990 for further discus- sion. WATER - Attorney Kramer reported the Hanson property is with the sellers attorney at present . Engineer Klaas reported the chlorination of the Fox Road water main will. be November 17 , 1990 . Mai The water tower inside painting will be finished Water Tower Inside as soon as the insulation is completed . Painting BUILDING & ZONING - No report . FUTURE PLANNING- Attorney Kramer will mention it to Mr . Radke when he sees him. STREETS - Alderman Akers requested the other aldermen to look at the Somonauk & Liberty Street conditions . SEWERS - Alderman Pfister asked if manhole covers were orders yet , and Engineer Klaas responded they had not been ordered . POLICE - Chief Diederich reported that the candidates for the police officer position have completed their psycological and physical testing . Codification Police Officer AIderman Pfister moved to approve the appoint- Appoint J . ikemire ment , on the recommendation of Chief. Diederich, PD Patrolman of Jerry Ikemire to the position of patrolman, to take the place Bill Perkins vacated . Motion was seconded by Alderman Fahrlander . Motion carried by voice vote . Page 5 Alderman Bown moved to amend the liquor ordinance regarding the Not-for-profit clubs , from a full- uniformed police officer to a uniformed security person, for crowds over 250 , for a period of 6 months . Motion was seconded by Alderman Akers . Clerk Erickson called the roll : Fey - Aye Jahp - Nay Clark - Aye Akers - Aye Pfister - Aye Bown - Aye Small - Aye Fahrlander - Aye Motion carried 7-1 . PUBLIC RELATIONS - No report . YBSD BOARD - Alderman Pfister reported the next meeting is scheduled for November 19 , 1990 . November 1 Amend Liquor Ord. YBSD Board LIBRARY BOARD - Alderman Jahp reported on the November 12 , 1990 meeting . He thanked the city Library Board crew on behalf of the Library Board for work they did at the library staining and caulking. Mary Ellen Ellis resigned after 15 years of service to the Yorkville Library Board . The next meeting is December 10, 1990 at 7 : 00 p.m. CHAMBER OF COMMERCE - The next meeting of the Chamber is November 21 , 1990 at 7 : 30 a .m. ADDITIONAL BUSINESS_ - Alderman Fey reported the Stop Signs @ stop signs on Center Parkway and Countryside Center Pkwy. Parkway are not visible after dark. Countryside Pkwy. Engineer Klaas responded to a question on the contents of A-3 street surface being chip & seal . At 308 Heustis St . , there is a vehicle on saw horses , and a second vehicle has joined it recently. Chief Diederich will look into the matter . Alderman Bown moved to adjourn into Executive Adj . to Executive Session at 9 : 30 p.m. , and to allow a 15 minute Session Property break to clear the city hall of guests , seconded Acquisition by Alderman Fey. Motion carried by voice vote. The regular meeting was reconvened at 10 : 10 Reg.Meeting p .m. Reconvened Alderman Bown moved to relay to the seller that Property Acquisition the City of Yorkville is not interested in Negotiations negotiating further on the Hart Building, and Sustained thank them for their consideration and time , seconded by Alderman Akers . Alderman Fey moved to amend the motion to delete "Hart Building" and acid "property considered in the purchase" , seconded by Alderman Bown. Motion on the amendment carried by voice vote .
