Clerk Erickson called the roll : Ward 1 - Small - Present Jahp - Present Ward 2 - Radke - Present Fev - Present Ward 3 - Hayden - Present Pfister - Present Ward 4 - Bown - Present Fahrlander - Present A quorum was established _ Alderman Pfister moved to waive the reading of the August 10 , 1989 City Council. meeting , and approve them with the following corrections : 1 , Page 4 - "Streets & Alleys" , Paragraph 1 - Add roll call vote : Pfister - Aye. Fahrlander - Aye Bown - Ave Fey - Aye Hayden - Nay Small - Aye Radke - Nay Jahp - Nay Motion carried 5-3 ; and 2 . Page 4 - "Streets & Alleys" , Paragraph 2 , Line 2 , following " is" add , "feared it will be . Motion was seconded by Alderman Bown. Motion carried , Call. to Order Roll Call Minutes Approval Alderman Jahp moved to authorize payment of the Bills Approval bills as presented , seconded by Alderman Pfister . PLAN C:OMMTS(;TON REPORT - Alderman Radke reported Plan Commission on the August 16 , 1989 Plan Commission meeting . Regarding PC89-29 , there were a significant num- PC89-29/Hollingsworth ber of objectors to the Hollingsworth Rezoning . Approved Zoning They were informed they would be able to voi(-_e w/Conditions their objections at the Public Hearings at the Kendall County level . On recommendation by the Yorkville Plan Commission , Alderman Radke moved to approve the Zoning from A- 1 to R-3 of the Hollingsworth petition on Eldamain & River Road subject to the following conditions : Page 2 August 24 , 1989 1 ) No more than 31 lots to he in the subdivision ; 2 ) Curbs on the cul-de-sacs ; 3 ) A 60 ' easement for the roadway , and additional easements for utilities ; 4 ) No direct access to River Road; 5 ) Drainage easements for lots 15 & 16 ; 6 ) Reduce the knoll on Eldamain. Rd . for safe access ; and 7 ) Flood plain areas , and should be addressed . Motion was seconded by Alderman carried . soil testing Bown . Motion Alderman Radke moved to approve the Final Plat PC89-31 / Hatcher of the Hatcher Commercial Development on Route Final Plat App ' d . 47 , seconded by Alderman Hayden . Motion carried . ZONING BOARD OF APPEALS REPORT - Alderman Radke ZBA Report reported on the Zoning Board of Appeals meetings . Attorney Thomas Grant presented the Ivy Subdivi- sion Variance on Rt . 34 & Cannonball Trail . Alderman Fahrlander moved to grant the request for Variance for Ivy ' s Subdivision from the Yorkville Subdivision Control Ordinance Section 8 . 07 Street Lighting , Section 8 . 10 Sanitary Sewer , Section 8 . 11 Water, with the exception of Section 8 . 06 Sidewalks to be included on Rt . 34 & Cannonball Trail at the time they can be connected , and to require that it be included on the deeds and covenents . Motion was seconded by Alderman Hayden. Clerk called the roll : Radke - Aye Small_ - aye Fahrlander - Aye gown - Nay Fey - Nay Jahp - Aye Pfister - Nay Hayden - Aye Motion carried 5-3 . There was discussion regarding the road connecting with the existing road in the subdivision . Kyle & Martha Price and Loren Miller expressed their objections to the matter . Alderman Bown reminded the council of the requirement for sidewalks if they are within a mile of the school . ZBA89-6/Iyy ' G Subd Variance Granted Mrs . Arnold requested the floor in regards to ZBA89-3/Schneider John Schneider ' s request for W. Van Emmon Street W.VanEmmon/Vacation Vacation with regards to the soil , road bed , trees that would need to be removed, and a retain- Page 3 August 24 , 1989 ing wall that would be required if the vacation were granted . Mrs . Arnold ' s attorney, Mr . Cun- ningham requested a 10 ' easement for access to lot 2 . Alderman. Fey stated the chance of a through street was very slim, and he would like to see the street vacated . Attorney Kramer stated that a 3/4 positive vote, with no vote by the Mayor is required for granting the vacation . Mr . Schneider stated that he has submitted a petition signed by all of the neighbors for the vacation of W. Van Emmon, and that they wish to keep the traffic down in the area . Alderman Hayden moved to grant the W. Van Emmon CCPH-3/Schneider street vacation request by John Schneider , W. Van Emmon St . to the east boundary of Lot 3 , seconded by Referred to Comm. Alderman Pfister . Clerk called the roll : Hayden - Aye Jahp - Aye Bown - Nay Fahrlander - Nay Small - Nay Pfister - Aye Radke - Aye Fey - Nay Tie vote , 4 Ayes , 4 Nays . The matter was referred to the Council of the Whole committee meeting on August 31 , 1989 . ATTORNEY ' S REPORT - Attorney Kramer reported has been no decision received from the Tllinois Pollution Board regarding the radium variance . Attorney Kramer reported the Tax Levy will be ready for passage at the next City Council meeting . MAYOR ' S REPORT - on the resignation. of Robert Evans , Alderman Pfister moved to approve Mayor Davidson ' s appointment of Dave Smels:t.ey to the Recreation Board , seconded by Alderman Bown . Motion carried . CITY ENGINEER ' S REPORT - Engineer Klaas reported that the Engineering plans were received for Barry Nile ' s Foxfield ' s First Addition Final Plat that was approved subject to the engineering approval . Alderman Jahp moved to authorize Mayor Davidson to sign the EPA permits for Foxfield First Addition, seconded by Alderman Hayden. Motion carried . Radium Tax Levy Resignation/B . Evans Recreation Board Foxfield 1st Add ' n . Engineering EPA Permits Page 4 Axa 11st 24 1989 Engineer Kiaas reported that Jones Cable Tv is Cable TV Franchise anxious to get a City Council vote on the fran- chise . Alderman Bown moved to submit for signatures , the amended copy of the ordinance Attorney Kramer has previously presented , and to atithor. ize the Mayor to sign . Alderman Fey stated that as chairman of the utilities committee he does not feel. it is a good move for the City . Attorney Kramer stated that if it isn ' t approved , it will fall back on the original franchise . Alderman Jahp moved to accept the Public Works PW & Water Reports and Water Reports submitted , seconded by Alder- man Bown.. Motion carried . KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - Alderman Fey reported on the August 15 , 1989 meeting of the commission . Discussions were held regarding their budget , and the doubling of the grant from tiie previous year . The next meeting is scheduled for September 19 , 1989 at 7 : 30 p .m. at the Kendall County office Building. TENNIS COURTS - Alderman Bown reported the tennis courts are again in operation . A new plywood information board is being made . SCHOOL COMMUNITY - Alderman Small reported there are budget problems involving their computer system . He reminded everyone they have until Angust 28 , 1989 to file their petition for the school board election . OLE) BTISTNESS - Alderman Hayden requested the Council think about flashing lights for the crossing guards . Alderman Radke stated there is a need to sit down with the Plan Commission and discuss the attendance problem. KCEDt Tennis-Courts Crossing Guard Lights PC Attendance Problem Page 5 Augiist 24 , 1989 Mayor Davidson asked that the City Council , the Yorkville Plan Commission, and the Yorkville School Board hold a dinner meeting to sit down and discuss mutual problems , and 'now to proceed with developers in the future . The dinner will be at the City ' s expense . ------------------------------COMMITTEE REPORTS------------------------ FINANCE - Mayor Davidson stated that he needs more clarification regarding negotiations in the Employee Manual before amendments are made . Mayor Davidson authorized the necessary repairs to the Public Works dump trucks . The next fiscal budget should include a new dump truck. ENgineer Klaas reported that notice rebidding of the 1975 Public Works Pickup has been made . In regards to the utility tax , Mayor Davidson wishes to wait and see how the City comes out on the radium problem before any cuts in revenue are made . PUBLIC PROPERTY & BUILDINGS - No report . TREES & PARKS - Alderman. Bown on the letter I rom Mary Ellen Commare regarding the girls softball program complaints . Alderman Bown reported on the Recreation Dep- artment meeting . The revised budget was presented . The contract for the backstops installation was let . HEALTH & SANITATION - No report . UTILITIES - Alderman Fey reported the infor- mation on the street lights will be forth coming . WATER - ENgineer Klaas reported that he has heard nothing regarding the Hanson property . Employee Manual. PW Works Dumptrucks PW Pickup Sale/Rebid Utility Tax/Radium Girls Softball Recreation Dept . Street Lights Hanson ProRert Alderman Hayden reported that the new water Water Structure structure schedule has been tentatively approved Schedule in regards to bi-monthly billing . UBLIC RELATIONS - No report . POLICE - Alderman Jahp announced that on the PD Training Policy August 31 , 1989 meeting , they will go over the training policy . Alderman Jahp reported the radio on squad #3 is Sgtted Radio out , and needs repair or replacement . Mayor Davidson read the Proclamation proclaiming Proclamation the week of August 28 thru September 1 , 1989 as School Open Safety "SCHOOL OPEN SAFETY WEEK" . Week EMERGENCY SERVICES & DISASTER - No report . YBS BOARD - Alderman Pfister reported that at YBS - Bills their August 21 , 1989 meeting , the board felt it Bi-monthly was an excellent idea to have bi-monthly billing . The board also authorized Mr . Pfister to sign YBS - EPA Permits the EPA permits for the river siphon . River Siphon The next meeting is scheduled for September 18 , 1. 989 . Mayor Davidson requested a meeting with Aldermen. River Siphon Pfister & Small regarding the financing of the river siphon for the next fiscal beget year. LIBRARY BOARD - The Library Board meeting place Li.brary Board for the September 11 , 1989 meeting will be :held at the Library due to a public hearing at the City Hall . Alderman Jahp reported on the August 14 , 1989 Library Board meeting . The Board thanked the City Council for the $4 , 000 for their budget . Page 7 August 24 . 1989 The board reported the flag has been stolen from outside the building . There were 3700 books cycled in the month of July , 1989 . $695 in bills were approved for payment . The board is still in need of an answer frorm the City Treasurer regarding the bill. payment vs . reimbursement . CHAMBER OF COMMERCE - Alderman Pfister announced the next Chamber of Commerce meeting is scheduled for September 19 , 1989 . ADDITIONAL BUSINESS - Alderman Jahp suggested everyone review the utility account delinquency lists provided for them by the City Clerk.
