Minutes for Correction or Approval: The minutes for October 18, 2011 were approved. The minutes for November 15, 2011 were approved. The minutes for January 17, 2012 were approved. New Business: 1% PW 2012-14 Monthly Water Reports for December 2011 and January 2012 - The committee approved the reports and moved this item to consent agenda. PW 2012-15 Parkway Tree Replacement Program 2012 - Mayor Golinski asked Mr. Dhuse if the city will have more requests this year because of the city taking out several trees. Mr. Dhuse said he doesn't think so because some weigh the cost of$150.00. If they do get the tree, the city plants it. Mr. Dhuse stated the program is running just like last year. This item was moved to consent. PW 2012-16 WaterSense Resolution- Mr. Olson said all the communities in Metro West are adopting WaterSense Resolution for water efficiency practices and to promote water conservation in the future. Mr. Olson said then the city can let the state and federal legislature know that the city knows what we are doing on this issue. Alderman Kot asked the difference between that and Energystar. Mr. Olson said it is a voluntary coalition of municipalities and governments to talk about ways to save water and promote it. Mr. Olson said it is not a mandate. Alderman Kot said it is a PR issue more than anything else. This item was moved to consent agenda. PW 2012-17 Bulk Salt Storage intergovernmental Agreement- Mr. Dhuse said the city will have excess salt with no place to store it. Mr. Dhuse said that Kendall County offered us this place to store the salt. Alderman Teeling asked where the city is holding the salt now. Mr. Dhuse stated it is at our shop now and between 500 and 600 tons is all we can hold and then no room for sand and gravel. Mr. Dhuse said it is 99 year lease term with a $250.00 a year maintenance fee. Alderman Teeling asked how much money the city will save storing this. Mr. Dhuse stated it will be about $65,000 and if you factor not having to purchase salt next year it will be around$85,000 and it will stay in MFT as unobligated funds for other projects. Alderman Milschewski asked if the funds from MFT can be used to pay for the $45,000. Mr. Dhuse stated he believes yes. Alderman Kot asked where does this physically get stored. Mr. Dhuse stated it is at the highway department on Route 47. Alderman Kot asked what is the city's and what is the county's. Mr. Dhuse said we know what our bucket holds and the ton is. Mr. Dhuse said that building was built big enough for all the cities to use eventually. Mayor Golinski stated he thinks it is a good investment. The city can now buy off season and get a big discount. Mr. Dhuse said the city can now take bulk deliveries. This item is moved to the consent agenda. PW 2012-18 Rush Copley Phase IA and Storm Retrofits -Mr. Sanderson said they are requesting a letter of credit reduction, split the letter of credits two separate projects and they would like acceptance on the Phase IA improvements. Mr. Sanderson stated the punch list items have been taken care of. Mr. Sanderson said the city supports the acceptance of the Phase IA improvements as well, it is a three fold request. This item will be moved to the consent agenda. PW 2012-19 Kendall Marketplace Improvements - Change Order#2 -Mr. Sanderson stated this has to do with the park. There was minor grading on the park to comply with the subdivision. He said before we were about to seed the park, the city discussed making it a baseball field. Mr. Sanderson said the seeding was put on hold, it is in front of the committee for consideration tonight. Mr. Sanderson said there is left over letter of credit money, which is where this money is coming from. This item will be moved to the consent agenda. PW 2012-20 Route 47 Improvements -Rt. 71 and Caton Farm Road- Mr. Sanderson said last fall Mr. Dhuse attended a meeting for project study group. Mr. Sanderson said they outlined several issues they wanted feedback from the city on. Mr. Sanderson discussed with the committee each item on the memo and what the city decided to make sure the committee was in agreement with staff s findings. The committee is in agreement with staff. This item is moved to the consent agenda. PW 2012-21 Route 47 and Cannonball Intersection Improvements -Bid Award - Mr. Sanderson stated bids were taken on this project last week. He stated the city is recommending the bid be awarded to the lowest bidder. Mr. Sanderson stated the money is from the letter of credit from the development. This item will be moved to consent agenda. PW 2012-22 Update of Progress of Windett Ridge Bond Call- Mr. Olson said he sent out two notice letters and both were returned to sender. Mr. Olson said that one insurance company merged with another. Mr. Olson said they obtained new addresses and sent out new notices. Mr. Olson said the city got letters back from the company and they are asking for more information on the bond call and how we came to our conclusions. Mr. Olson said the time line is up in the air at this point. Mr. Olson said it could be 60-90 days,but he is not optimistic that will happen it could be years from now. Old Business: PW 2011-65 Kennedy Road Shared Use Path-ITEP Bike Path Grant Ms. Dubajic stated that the Push For The Path will be a non-profit 5016. Ms. Dubajic said the purpose of this is to raise the funds of the shortfall of the Kennedy Road 1.7 project, which the city has a 1.4 million grant. Ms. Dubajic said the individuals that donate will have a tax write off. The funds raised can only be used for the Kennedy Road project. Ms. Dubajic explained they are going to find 100 people in the area willing to donate $1,000 a piece. Ms. Dubajic said they will have a team leader power of one button and all that donate under them will get a button as well. She stated that will raise 100,000 and it will have a time restraint on the donations, which will be July 5, 2012, which is the 3 year anniversary of Darlene's passing. Ms. Dubajic said she personally believes they will end up with more than 100,000. She stated it is her goal to come to council next week with at least 20 commitments. Ms. Dubajic said there is a Push for the Path website, which is being redone this week, as well as a Facebook page. Ms. Dubajic said there will be golf outings for this as well. Ms. Dubajic said she is asking the committee to consider to have a positive recommendation to move this item to full council for a vote. Ms. Dubajic said there will be a presentation made to city council next week. Ms. Dubajic said Nicor is also interested in helping. Alderman Kot stated this was talked about at the last meeting and he is all for it and appreciates what Ms. Dubajic is doing. Alderman Kot stated that is all still a promise. Alderman Kot is concerned this is a project that is five years down the road and doesn't know if the momentum will continue to be there for this cause. Ms. Dubajic said she will give the city the money as it is needed. Ms. Dubajic said the dollars should remain in the account for non-profit so it can raise the interest. Alderman Teeling stated there are other communities that have done this and been very successful and have contacted the city willing to help. Alderman Teeling said these other communities have raise a lot of money and accomplished it. Ms. Dubajic said Yorkville has a great community full of people that want to get involved and she believes this is a feel good story that the residents will get behind and you will see the dollars coming in. Alderman Kot requested a copy of the non for profit before we vote on it. Ms. Dubajic said she will get them a copy. Alderman Kot stated he is open minded about this, but would like to see the documentation first. He said he is for a full council vote on Tuesday. The committee agreed to take this for a full council vote next week. Additional Business: Alderman Milschewski said Septran contacted her questioning where IDOT is going to begin construction and when. Alderman Kot said as soon as we know, we need to get that information out to the public. Mr. Olson said the details are still being worked on and as soon as he knows anything he will let them know. Alderman Milschewski asked about Nicolson property and the vehicles that are there. She stated the semi has been there for over 30 days and she asked that to be looked into it again. Description. This item shall consist of furnishing rock salt (sodium chloride) in bins or stockpiles at location designated in the Proposal. Materials. Rock salt will be measured by the metric ton (ton). Basis of Payment. Materials. The materials, control, quality, sampling, testing, inspection and storage of material shall conform to the specific requirements of the Standard Specifications for Road and Bridge Construction adopted by the Department of Transportation. Bituminous Patching Mixtures. The material supplier or contractor may furnish any of the following Bituminous Patching Mixtures listed in the individual Group for which the award was made. Group II — Bituminous Patching Mixture (Proprietary) Serial No. M-120-07: Bituminous Premix for Maintenance Use - Optimix, Sylcrete, UPM, QPR-2000, EZ Street, SMP - Proprietary Sources Serial No. M-133-96: Bituminous Premix for Maintenance Use, Instant Road Repair - Proprietary Placing of Bituminous Patching Mixture. All holes and depressions in the existing surface which exceed %" in depth shall be repaired by removal of all loose and defective material and replaced with the specified Bituminous Patching Mixture. The material shall be compacted to produce a tight surface conforming to the adjacent area. Method of Measurement. Bituminous patching mixture will be measured for payment in metric tons (tons). This work will be paid for at the contract unit price per metric ton (ton) for BITUMINOUS PATCHING MIXTURE (GROUP 1); BITUMINOUS PATCHING MIXTURE (GROUP 11); When bids are taken F.O. B. trucks at the mixing plant a hauling differential of $ per ton- mile haul from mixing plant to location designated in the proposal will be used to determine the low bid. Round trip distance shall be used to calculate the hauling differential to be used to compare bids. Bidders are required to fill in the location of the plant from where they propose to supply the patching mixture, on the material proposal form. State of Illinois Department of Transportation Division of Highways Springfield SPECIFICATIONS FOR BITUMINOUS PREMIX FOR MAINTENANCE USE PROPRIETARY MIXES Serial Number: M 120- 10 1 . DESCRIPTION . The patching material shall be composed of a mineral aggregate, plant-mixed with a liquid asphalt and chemical additives from the suppliers of the proprietary mixtures. The bituminous material shall be capable of coating wet aggregates without stripping, and shall be available in various grades so that one such grade will enable a stockpile to remain pliable and workable at a temperature of -26 °C (A 5 °F). The patching material shall be capable of maintaining adhesive qualities in patched areas which are damp or wet at time of application , and also after remaining in an uncovered stockpile for up to twelve ( 12) months. 2. MATERIALS. Control of the materials shall be in accordance with the general requirements of Section 106 of the current Standard Specifications for Road and Bridge Construction. If required, a five kilogram (ten-pound) sample of the mineral aggregate and one-liter (one-quart) sample of the liquid asphalt shall be submitted to the Bureau of Materials and Physical Research , 126 East Ash Street, Springfield , Illinois, for performing the tests specified herein. (a) Aggregate All Coarse Aggregate used in the proprietary mixtures shall consist of crushed stone of Class B quality or better as defined in Article 1004.01 (a) & (b) of the above cited Standard Specifications. (b) Bituminous Materials The bituminous material shall be a formulation of the liquid asphalt blend prepared under the supervision of the proprietary mix supplier. Two-hundred grams of the air-dried aggregate passing the 12.5 mm ('/z-inch) sieve and retained on the 4.75 mm (No. 4) sieve shall be combined with 6.3 percent, by weight, UPM liquid asphalt and mixed in a hemispherical metal dish with a stiff spatula for three to five minutes or until a uniform coating is obtained. Twenty-five grams of this material shall be immediately place in an oven at 60 °C ± 3 °C (140 OF ± 5 °F) , for eighteen to twenty-four hours, after which it shall be thoroughly mixed and allowed to cool to room temperature. The sample shall then be immersed in water at a temperature of 49 °C ± 3 °C (120 OF ± 5 °F), and maintained at this temperature for twenty-four hours. At the end of this period, the area of the aggregate remaining coated shall be determined visually while the sample is still immersed in water. Surface coating of at least 90 percent must be retained on the aggregate. A test similar to the above using MC-250 shall be made for comparison. (2) Stripping Test: Wet Aggregate. Two-hundred grams of the aggregate passing the 12.5 mm (Y2-inch) sieve and retained on the 4.75 mm (No. 4) sieve shall be immersed in water for twenty-four hours and the excess water drained off, leaving the aggregate surface wet. This aggregate shall be combined with 6.3 percent, by weight, UPM liquid asphalt and mixed in a hemispherical metal dish with a stiff liquid spatula for three to five minutes or until a uniform coating is obtained. Twenty-five grams of this material shall be immediately place in an oven at 60 °C ± 3 °C (140 OF t 5 °F), for eighteen to twenty-four hours, after which it shall be thoroughly mixed and allowed to cool to room temperature. The sample shall then be immersed in water at a temperature of 49 °C ± 3 °C ( 120 OF ± 5 °F), and maintained at this temperature for twenty-four hours. At the end of this period , the area of the aggregate remaining coated shall be determined visually while the sample is still immersed in water. In estimating the percentage of area remaining coated, any thin or translucent area shall not be considered as being coated Proprietary mixes, Sylcrete EV, Sylcrete VA, Optimix, QPR-2000, EZ Street, SMP, Sakrete All Weather, and Proline shall meet the following stripping tests. (1 ) Place 50 grams of cold mix into a beaker containing 400 ml of boiling distilled water. Bring back to boiling and boil for 3 minutes with constant stirring at 1 revolution per second . At the end of 3 minutes, remove the beaker from the heat source and immediately decant the water. Empty the wet mix onto a paper towel and examine. The retained coating shall not be less than 95 percent. (2) AASHTO T 182-06 Coating and Stripping of Bitumen-Aggregate Mixtures. 3. INSPECTION . The Engineer or his authorized representative shall have access at any time to all parts of the plant in order to verify weights or proportions and quality of materials used in the preparation of the mixture. The manufacturer shall afford such facilities as may be required for making inspection at the plant and for collecting and forwarding samples of the ingredient materials and bituminous mixture to the Department. 3 i 4. PLANT AND EQUIPMENT. Storage facilities and all equipment used in the preparation of the mixture shall be approved by the Department. An approved drier shall be available for surface drying the aggregate when needed . The materials for individual batches shall be measured accurately, either by volume or weight, by approved methods and equipment. A batch type mixer of approved design and capacity shall be used in mixing the ingredient materials. However, approval for the use of a continuous mixer will be given if it can be shown that satisfactory results will be obtained. 5. PREPARATION OF MIXTURE. The aggregate and Optimix, or QPR-2000, or Sylcrete, or UPM , or EZ Street, or SMP liquid asphalt shall be proportioned into the mixer and mixed for at least 30 seconds or until a uniformly coated mixture is obtained. The liquid asphalt shall be heated to a temperature of 93 °C ± 28 °C (200° F ± 50° F), at the time of mixing , and in accordance with the instructions of proprietary mix supplier. When necessary to heat the aggregates, the aggregates should not be heated to more than 68 °C (155 °F). 6. COMPOSITION OF MIXTURE. Background and Update This item was last discussed by the Public Works Committee at the February meeting. At that time, staff reported that both bond call letters were returned to the City(incorrect address), but that we have found the current companies and addresses and resent the letters. We received the attached letter from Traveler's this past week. As expected, their initial contact with us was not positive. Obviously, we disagree with their reasons for denial and will be studying all options available to the City. For purposes of those future actions, it would be best to minimize discussion in a public forum. We still have not received a response from the second bond company. Completion of improvements Staff is aware that the HOA for the subdivision would like to give their input on which improvements in the subdivision are completed, if the City gains access to bond funds. As stated at the last meeting, whichever improvements get completed is a policy decision for the City Council. It would be my recommendation that we ask the HOA for input prior to making a decision. It would also be my recommendation to hold that conversation when we have gained access to the bond funds (could be months or years from now). The claim by the United City of Yorkville(the"Town")is respectfully denied because it is not timely. The bond referenced above states in part that, [I]f[Wiseman-Hughes Enterprises("Wiseman")]shall complete [the subdivision improvements] in accordance with the plans and specifications prepared by within 2 year(s)period from the date thereof-,and shall indemnify and save harmless the Town from all costs and damages which it may suffer by reason of failure to do so,and fully reimburse and repay the Obligee any outlay and expense which it may incur in making good any such default,then this obligation shall be null and void,otherwise to remain in full force and effect. The bond also states that 2.Legal proceedings for recovery hereunder may not be brought unless begun within twelve(12)months from the date of the discovery of the act or omission of[Wiseman]on account of which claim is made. These paragraphs read together mean that the Town must file a lawsuit within twelve months from the date the Town discovers the act or omission by Wiseman that constitutes a breach of Wiseman's bonded obligations. One of Wiseman's bonded obligations was to complete the work within two years from the date listed on the plans and specifications. If Wiseman did not complete the work within that time, it would constitute a breach of Wiseman's obligations which would start the twelve-month period for the Town to file a lawsuit. I also made this request of Wiseman,who subsequently sent me a copy of the page of the plans that lists the date the plans were created, and also dates of revisions to the plans. The earliest date listed on this page is January 25, 2001, and the latest date is January 16,2006(stating"revised per client). As a point of reference, the bond referenced above is dated May 30,2003. Assuming that the latest date listed on the plans,January 16,2006, is the date from which Wiseman's two-year time period to complete the work began,Wiseman's bonded obligation was to complete the work by January 16,2008. The Town then had twelve months starting on January 16, 2008 (i.e.,until January 16,2009)to make a claim for Wiseman's failure to complete the improvements. The Town's letter to Gulf Insurance Company stating that Wiseman has not completed the improvements is dated February 1,2012,which is over three years after the Town's time to make a claim expired.
