The meeting was called to order at 6:30pm by Chairman Colosimo and a quorum was
established.

Minutes for Correction/Approval: October 6, 2011
The minutes were approved as read on a motion and second by Alderman Spears and
Alderman Kot, respectively. Unanimous voice vote approval.
New Business:
L PS 2011-30 Intergovernmental Agreement with BKFD for Weather Warning Siren
Fee
Chief Hart said there an electrical issue at the Bristol Bay site and it had to be re-located
instead to Bristol Kendall Fire Department property. This draft agreement would hold
BKFD harmless and all upkeep will be done by the Police Department. It will also grant
access to maintain the equipment and to remove the siren when it is outdated.
Police department personnel met on this date with the installation company, Fulton
Technologies, and toured all the sites. Some other locations will have to be moved also
and an additional agreement may be requested with the school district for a middle school
location. Alderman Spears noted some errors in the agreement.

A motion was then made by Alderman Kot and seconded by Alderman Spears to approve
this agreement as amended with the corrections. The agreement was unanimously
approved with a voice vote and this item will move to the next City Council consent
agenda.
2. PS 2011-31 Ordinance Regarding the Regulation of Fireworks
This amendment was discussed last month and City Council and Mayoral approval was
needed for a resolution to allow a fireworks display for the high school. The committee
had decided it would be more efficient to grant authority to the Police Chief to issue a
permit for any fireworks displays. The Ordinance was amended to give the Chief this
power.
Alderman Kot asked that the Council members be made aware of any such fireworks
displays approved. Chief Hart will notify Bart Olson and the Mayor and an email will be
sent to the Aldermen and department heads.
A motion was made by Alderman Funkhouser and seconded by Alderman Spears.
Unanimous voice vote approval.
3. PS 2011-32 Ordinance Prohibiting Public Urination or Defecation
Chief Hart said this offense constitutes a Disorderly Conduct charge and it must go
through the court system. A patrol officer suggested this go through adjudication instead,
so as not to bog down the courts. Naperville and other municipalities handle the offense
in this manner.
Alderman Kot moved and Alderman Spears seconded to approve the ordinance as
presented and then move to the consent agenda. Approved unanimously on a voice vote.
Chief Hart noted other ordinances will be reviewed for possible similar action.
4. PW 2011-57 Minimum Fines for Ordinance Violations
This item has also been presented to the Public Works and Administration Committees.
If an offense is not listed in the ordinance, the fine is at the discretion of the Hearing
Officer. Chairman Colosimo said the minimum fine for possession of drug paraphernalia
is $750 for the first offense as a State violation. Currently, the Hearing Officer could
charge a range of$0-750. He asked for input and said specific fines could be set for
more serious offenses.
Alderman Funkhouser addressed curfew and Chairman Colosimo said curfew offenses
can lead to more serious violations. Alderman Kot commented that he is OK with
leaving the fine up to the judge.
Yorkville's fine schedule is much different than that of Oswego according to Chief Hart.
It was decided to move this to Old Business for December for further discussion.

5. PS 2011-33 Public Safety Committee Meeting Schedule for 2012
It was decided to keep Thursday as the meeting night with a start time of 6:30pm.
Old Business:
1. PS 2011-25 Computer/Server Replacement Update
Chief Hart said there has been approval to buy some servers from the contingency fund.
He thanked the committee for their assistance in moving things along. Chairman
Colosimo inquired if final numbers for the costs had been obtained. The Chief said the
computer consultants said a virtual system could be purchased at a higher upfront cost of
$50,000-$60,000. The benefit is that this system would be more compatible in the future
and certain future upgrades would not be needed. Another factor in this purchase would
be if City Hall and the Police Department are still located close together in the future.
Alderman Funkhouser said the systems need to be separate,but should be able to
communicate with each other, in the event of computer failure. This item will be moved
to Old Business on the December agenda for further discussion.
Additional Business:
There was no additional business and the meeting was adjourned on a motion by Spears
and a second by Funkhouser. Meeting adjourned at 6:54pm.

Subject: Request for Class "B" Package Liquor Licenses—
Circle K
Summary
Request for liquor code amendment to allow additional Class "B" liquor licenses.
Differences between Class "B" and Class "B-1" Liquor Licenses
Per the city liquor code, there are currently two different types of package liquor licenses
allowed within city limits. A Class `B" Liquor License allows the license holder to sell
packaged beer, wine and liquor for off-premise consumption. A Class "B-1" Liquor License
allows the license holder to sell packaged beer and wine only for off-premise consumption.
Permitted hours of sale for both of these licenses are as follows:
Monday through Thursday 6:00 a.m. until 1:00 a.m.
Friday and Saturday 6:00 a.m. until 2:00 a.m.
Sunday 10:00 a.m. until 1:00 a.m.
Request from Current Class "B-1" License Holder
We have received a request to amend two current liquor licenses from Class "B-1" liquor
licenses to Class "B" liquor licenses for the Circle K gas stations located at 1421 N. Bridge
Street and 2001 S. Bridge Street. Per city code, there is a limit on the number of package liquor
licenses that can be issued. Currently, there is one Class `B" liquor license available and two
Class `B" licenses have been requested. Before a decision can be made as to whether to amend
these licenses, a liquor code amendment must be considered to decide if additional Class `B"
licenses will be made available under the city liquor code. If the decision is made to amend the
code, it does not guarantee that amended liquor licenses will be issued to this applicant. As with
all liquor applicants, the Liquor Commissioner will review the application and make the final
decision.
There are currently eight locations licensed for Class "B" Liquor Licenses and 7 locations
licensed for Class `B-1" Licenses. Attached is a list of the businesses that currently have
package liquor licenses. A draft ordinance amending the city code to increase the number of
Class "B" licenses is included. Approval of this ordinance will bring the total of Class `B"
licenses up to ten. The Class "B-1" licenses will remain at a total of seven.

3-3-6: NUMBER OF LICENSES:
A. No limitation shall be in effect within the city as to the maximum number of liquor license
holders, except with reference to: (Ord. 2008-59, 7-8-2008)
1. Number Of Licenses For Classes Al Through A4: Holders of classes Al through A4 which
shall not exceed the number of three (3) licenses issued at any given time in an area commencing
at the intersection of the center line of Route 47, also known as Bridge Street, and the center line
of Van Emmon Street, and running thence west along the center line of Van Emmon Street to the
alley; thence in a northerly direction parallel to the center line of said Route 47 to the south bank
of the Fox River; thence easterly along the south bank of the Fox River to a point which
intersects with the center line of Heustis Street extended; thence along said east line extended in
a southerly direction and along the center line of said Heustis Street until said line intersects the
center line of Van Emmon Street; thence west along the center line of Van Emmon Street to the
intersection of the center line of Route 47; thence westerly along the center line of Van Emmon
Street to a point 100 feet westerly of the easterly line of Route 47; thence southerly parallel with
Route 47 (the same being Bridge Street) to the point of intersection of the center line of
Washington Street; thence easterly along the center line of Washington Street to a point 100 feet
easterly of the easterly line of Route 47, the same being Bridge Street thence northerly parallel
with the easterly line of Route 47 to its intersection with the center line of Van Emmon Street;
thence westerly along the center line of Van Emmon Street to the place of beginning. In any
event, it shall be unlawful to sell or offer for sale at retail any alcoholic liquor within any
residential portion of the city . (Ord. 2011-42, 8-9-2011)
2. Additional Retail Type Licenses Issued: The liquor control commissioner shall further have a
right to issue up to a total of two (2) additional retail type licenses inclusive of any of the four (4)
existing retail class licenses, in areas outside the above designated downtown area and outside of
any residential area subject to approval of the city council, in order to provide for the orderly
growth of the city with respect to additional territories being developed and annexed within the
city. No licenses in excess of two (2) additional class Al through A4 licenses, inclusive, shall be
issued outside of the downtown area without amendment of this section by the city council. (Ord.

3. Maximum Number Of Package (Class B And B1) Liquor Licenses: There shall be no more
than ten e (10 -9) class B liquor licenses at any one time. There shall be no more than seven
(7) class B1 liquor licenses at any one time. (Ord. 2011-12, 4-12-2011)
4. Number Of Licenses Required In A Shopping Center: There shall be permitted not more than
any one liquor license of any package (B or B 1) class in any shopping center up to one hundred
thousand (100,000) square feet of gross building floor area. There will be available one
additional liquor license of said package class for those shopping centers in excess of one
hundred thousand (100,000) square feet of gross building floor area upon approval of the liquor

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE,KENDALL COUNTY,ILLINOIS PROVIDING FOR LIQUOR CONTROL
WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality pursuant
to the Constitution of the State of Illinois of 1970 and with such powers as granted to it by law;
WHEREAS, the Liquor Control Act of 1934, 235 ILCS 511-1, et seq., (the "Liquor Control
Act") sets forth a comprehensive system for the regulation of the sale and distribution of liquor within
the state of Illinois, and grants broad powers to municipalities with regard to local retail licenses; and
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City
of Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 3, Chapter 3, Section 6 (A)(3) of the United City of Yorkville Code of
Ordinances is hereby amended by deleting paragraph 3 in its entirety and replacing it with the following:
3. Maximum Number of Package (Class B And B 1) Liquor Licenses: There shall be no more
than ten (10) class B liquor licenses at any one time. There shall be no more than seven (7)
class B 1 liquor licenses at any one time.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval, and

AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL
COUNTY,ILLINOIS, ESTABLISHING MINIMUM FINES FOR
ORDINANCE VIOLATIONS
WHEREAS, the United City of Yorkville (the "City") is a duly organized and
validly existing non home-rule municipality created in accordance with the Constitution
of the State of Illinois of 1970 and the laws of the State; and,
WHEREAS, pursuant to Section 5/1-2-1 of the Illinois Municipal Code (65 ILCS
5/1-2-1) the City may make all rules and regulations proper or necessary to carry into
effect the powers granted to the City with such fines or penalties as may be deemed
proper.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That Title 1, Chapter 4, Section 1-4-1 of the Yorkville City Code, as
amended,be and is hereby amended to read as follows:
"1-4-1 GENERAL PENALTY
A. Whenever in this code an act or omission is prohibited or declared to be
unlawful or an offense or a violation of this code, or whenever in this code
the doing of an act is required or the failure is declared to be unlawful or
an offense or a violation of this code, where no specific penalty is
provided therefor, the violation of any such provision of this code is
hereby declared to be an offense and shall be punishable by a fine of not
less than seventy fivefifty dollars ($ 9950.00) and not to exceed seven
hundred fifty dollars ($750.00). Each day any violation of any provision
of this code or of any ordinance shall continue shall constitute a separate
offense.
B. The minimum and maximum monetary penalty for violations of the
following code sections or offenses shall be as follows:
