The minutes from the last meeting (October 28, 2010) were approved as submitted. PC 2011 -06 Worsley-Gawne Lane—Lots 4-6 Worsley's Addition Rezoning Request: Ms. Noble opened the discussion by stating that Attorney Dan Kramer, representing the applicants—Verne Henne and Steven and Dawn Friel—for rezoning of three lots being consolidated and re-subdivided into two and the re-zoning would be from R-1 to R-2. Mr. Kramer added that basically it's an old infield parcel on East Main Street and the alleys shown on the board don't exist; it's just weeds. He said one of the questions that was raised was how would the houses be oriented? One of them would be oriented East on Worsley and one would be oriented West towards Gawne. Mr. Kramer thought they should take Ms. Noble's idea and combine a preliminary and final plat and formally plat it. You can put your easements and set-back lines on and it's a lot easier. Overall, it's a nice split of some old property cleaned up. Some neighbors called him concerned that someone may be planning multi-family buildings because of the "R-2" zoning. He explained that actually they were bigger lots than any of them and they were happy about that. The second issue they were worried about was septic and he told them they would be hooked up to city sewer and water. Ms. Noble had some general comments and questions—was Mr. Kramer aware that: the city had already put in the water and sewer lines in that area? (Affirmative) there was a document recorded in 2008 giving the 25' easement for Mr. Friel and that the city would waive any future water and sewer hookup fees for the property? (Affirmative) That still stands. She told him city staff is not opposed to the rezoning because of the existing zoning in the area and the existing uses of adjacent land uses of R-2. She then asked Mr. Kramer if he had a plan of any of the houses to be built. Mr. Kramer said they would be more likely than not"ranches," and not two-story. Mr. Sanderson then asked Ms.Noble when is it be appropriate for them to submit their site plan, for example, a confirmed one showing where the water service is going to be connected to the sewer service. Is that something that should be done for the final plat as approved and executed in this case or with the building permits? Ms. Noble said it was determined that the NE corner would be the appropriate connection. Mr. Kramer agreed and said they would have no problem submitting those before sign-off on final plat. Mr. Sanderson then stated that it would be helpful to confirm some things: As far the review of the plat itself, there were just had some very minor technical issues. Mr. Kramer said he sees Mr. Jim Olson, his surveyor, must not have looked at the most current certificates and Mr. Kramer already contacted him to change those. Mr. Sanderson said that was the only comment they had on the plat, and the only other comment would be on the site plan. Mr. Kramer said they would do that by the next Plan Commission meeting, Wed,Nov. 9, 2011. PC 2011-09 Autumn Creek—Phase I Resubdivision: Regarding the engineering comments submitted 10/26/11 on the re-submittal, Brad Sanderson questioned cost above-and-beyond what was already estimated and bonded. - landscape plans need lot numbers on the actual plans. No further comments on the final plat. Mr. Marx said YBSD plans have been submitted and no comments have been received so he will give them a call. Ms. Noble then talked generally about her comments which mainly dealt with the annexation portion. In reviewing the annexation agreement, she noted there is a requirement that the developer would adhere to the anti-monotony policy for elevations of buildings as it relates to the fagade materials. She then wondered if the product change from"town-home"to "single family"would affect the Land Cash donation. Mr. Olson said it should because, theoretically, the population should go down. Mr. Marx asked if it was an up-front fee or a paid out permit. Ms. Noble said it's per permit. The land donation and school donation is usually done out front. For the permits, you're looking at $2,900 for single-family per unit for Parks when it's pulled. The school district is usually negotiated with the developer and they've been on-board. Ms. Noble asked if there were going to be new HOA requirements for this section and Mr. Marx said it will most likely be the same HOA. Ms. Noble had some questions on the final plat: Addresses for the original annexation agreement—staff will have to re-address this location(names of streets won't change, just the lots). There were a few lots—Lots 8, 11, 12, and 155 (which are now unbuildable)that will become common areas that will be maintained by the HOA. She then asked if there are any paths proposed. Mr. Marx answered there is one that goes through but none that go around the pond area. Ms. Noble then said she would get them these comments by next week if they would like to re-submit prior to Plan Commission (November 9, 2011)to include in the packet, which will go out November 4. If they cannot get them to her, they can bring them to Plan Commission. Her goal is when they go to City Council for approval,they have the revised plan—not subject to revisions—no conditions. In conclusion, regarding the SSA, Ms.Noble said she had reached out to Peter Raphael to find out what the current pre-payment amount would be for the bond and was told that because Peter was actually working for the City and not Pulte, Mr. Marx could not request it. Mr. Raphael is working with David Taussing &Assoc. to get the SSA numbers for the City. Meeting adjourned. Based upon my review, I have the following comments: General R-2 One-Family Residence District Zoning Comments: • Section 10-6C-1 and 10-6C-2 of the Yorkville Zoning Ordinance lists all the permitted and special uses, respectively, for the R-2 One-Family Residence District. Further, all uses allowed as permitted and special uses in the R-1 One-Family Residence District as also allowed as permitted and special uses in the R-2 District. • Section 10-613-2: Special Uses in the R-1 One-Family Residence District identifies "[fjilling of holes, pits or lowlands with noncombustible material free from refuse and food wastes" as an allowable use by special use permit in accordance with the provisions of Section 10-14-6 Special Uses of the Yorkville Zoning Ordinance. • Section 10-6C-3-D of the Yorkville Zoning Ordinance requires lots sizes for special uses shall not be less than two (2) acres. The subject property's overall area is approximately 47 acres, with the portion south of Fox Road and east of Pavilion Road being approximately 26 acres and the portion north of Fox Road being approximately 20.5 acres. Evergreen Farms Estates Annexation Agreement Comments: • Ordinance No. 2006-72 approves and authorizes the execution of the Evergreen Farms Estates Annexation Agreement. • Article VII: Excavation, Grading and Preparation of the Property for Development of the Evergreen Farm Estates Annexation Agreement states the following: "Owner shall have the right,following Preliminary Plan approval and prior to obtaining approval of final engineering drawings and prior to approval of a Final Plat of Subdivision Plat, to undertake demolition of structures, excavation, preliminary grading work,filing and soil stockpiling on the Property in preparation for the development of the Property on submittal of a grading plan and soil erosion and sedimentation control plan to the City, which plans shall be reasonably satisfactory to the City Engineer. Such work shall be undertaken at Owner's sole risk and without injury to the property of surrounding property owners. The Owner shall comply with the City's Soil Erosion and Sediment Control Ordinance. " • Preliminary Plan approval has not been granted for the Evergreen Farm Estates development and the proposed filing and soil stockpiling on the property is not in preparation for the development of the property for a residential land use. • Article XIV: Continuation of Current Uses of the Evergreen Farm Estates Annexation Agreement allows for portions of the property are presently being used for farming and general agricultural uses and shall be permitted to continue. Site Plan Comments: • A Grading Plan and Soil Erosion and Sedimentation Control Plan are required to be submitted to the City's engineering consultant for review and permit approval to ensure compliance with Title 8, Chapter 13: Soil Erosion and Sedimentation Control of the Yorkville Municipal Code. • Proposed Temporary Entrances to the property on the north side of Fox Road and south side of Fox Road will need to be permitted through Kendall County's Highway Department. Staff is concerned that the proposed two (2) construction entrances off of Fox Road may be too close. • Please provide general information with regards to anticipated truckloads per day and per peak hour, truck traffic, hours of operations, truck template illustrating truck maneuverability into and out of proposed temporary construction access points. • Please provide additional details regarding proposed alternate field entrance off of Pavilion Road. • Please confirm no temporary or permanent buildings and/or structures will be erected on the property during the proposed operation. • Please verify if the property or the areas designated for temporary fill stockpile be secured with fencing or other method of protection. • Please confirm construction traffic will be limited to Fox Road and will not utilize Pavilion Road to access the property. • A Street Cleaning deposit shall be established with the City of Yorkville in the amount of $5,000.00 as part of the soil erosion and sedimentation control plan approval and grading permit issuance. ENMARC & Associates,LLC Comments: • Staff notes in a correspondence prepared by ENMARC & Associates, LLC, dated January 25, 2012, that the Illinois Department of Transportation (IDOT) will have the responsibility of completing the necessary environmental assessments and analysis to certify which soils generated from the Rte. 47 reconstruction project are non-special waste requiring transportation and disposal to a landfill and which soils are certified as "uncontaminated"per the Illinois Environmental Protection Agency(IEPA)regulations. • Staff understands that the Evergreen Farm Estates site will only receive the certified "uncontaminated" or clean soil as regulated by the Illinois Environmental Protection Agency's requirements. Prior to completion of any reconstruction of any ROW owned by the State, the Illinois Department of Transportation contracts the completion of a Preliminary Environmental Site Assessment (PESA) of the entire roadway to be subject to reconstruction and identifies any Recognized Environmental Conditions (REC's) on properties adjacent to said ROW. Based upon the results of the PESA, IDOT subsequently completes a PSI (Preliminary Site Investigation) which consists of the actual quantification of the REC's through sampling and analysis of the ROW in areas where excavation is to occur. Subsequently, ]DOT then defines boundaries of impacted zones in which the soils generated from reconstruction activities are quantified as non-special waste requiring transportation and disposal at a Subtitle D Landfill. With the regards to the soils outside of the delineated impact zones, these materials are typically certified by IDOT as "uncontaminated" soil pursuant to the new CCDD requirements (PA 96-1416, as amended by PA 97-137), and subject the agreement established between the Illinois EPA and IDOT. Per this agreement, the IEPA recognizes this methodology of "uncontaminated" soil determination established by IDOT for highway projects,to be acceptable for purposes of establishing soils as "clean". Presently, uncontaminated soils are established by IDOT as those meeting the requirements of 35 IAC Part 742 (Tier Approach for Corrective Action Cleanup objectives, TACO) for residential properties, or those meeting the background standards established for major metropolitan statistical areas (which includes Kendall County). Under PA 1416, the IEPA has developed new regulations that are presently under review by the Illinois Pollution Control Board and proposed for adoption by July 31, 2012. Under the proposed regulations, the IEPA has established clean soil standards, which basically follow TACO and which IDOT has been considering (since the development of the proposed regulations) to further assess and delineate between"uncontaminated"soils and"contaminated"soil zones under their PSI protocol.
