City Council Minutes 1987 01-22-87 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS , HELD AT CITY PALL ON JANUARY 22 , 1987 . In the absence of Mayor Davidson, Clerk Erickson Call to Order called the meeting to order at 8 : 00 p .m. and led the council in the Pledge of Allegiance . Clerk Erickson called the roll as follows : Roll Call Ward 1 - Small - Present Jahp - Present Ward 2 - Thanepohn - PResent Radke - Present Ward 3 - Pfister - Absent Hayden - Present Ward 4 - Fahrlander - Present Jennings - Present A quorum was established. Quorum Clerk Erickson asked for nominations for Mayor Mayor Pro-tem Pro-tem. Alderman Small moved to nominate Alderman Jennings as Mayor Pro-tem, seconded by Alderman Radke . Motion carried . MINUTES - Alderman Small moved to waive the reading Minutes of the minutes from the January 8 , 1987 city council meeting, and approve them with the following additions : 1 . to include the following discussion under the Attorney ' s Report - "Attorney Kramer reported that no response has been received from owners of the River Street apartments . He does not know if any repair activity has been initiated. There are new balconies on, but does not know the garbage status . Attorney Kramer stated that lawsuit against the owners for condemnation or public nuisance would be the only solution the City could take at this time . Alderman Hayden moved to authorize Attorney Kramer to initiate public nusiance and condemnation suits , if the situation is not taken care of by January 15 , 1987 , seconded by Alderman Thanepohn. Clerk called the roll as follows : Hayden - Aye Thanepohn - Aye Small - Aye Pfister - Aye Fahrlander - Aye Radke - Aye Jahp - Aye Jennings - Aye Motion carried. " 2 . Under "Library Board" - delete"water tower" and add "Library" . Motion was seconded by Alderman Jahp . Motion carried. BILLS - Alderman Hayden moved to authorize payment of BILLS the bills as presented, seconded by Alderman Thanepohn. Clerk ERickson called the roll as follows : Radke - Aye Jahp - Aye Thanepohn - Aye Fahrlander - Aye Small - Aye Motion carried. ATTORNEY ' S REPORT - Attorney Kramer reported that he , Easements Mayor Davidson, and Alderman Pfister met with the Wildwood Wildwood owners and signed the easement needed for the new electrical line to the water tower . Attorney Kramer reported that the Kendall County Easement Easement providing access to the new water tower Kendall Co . - site will be given in return for free water service . Water Tower Page 2 January 22 , 1987 Attorney Kramer reported that a letter was received Game Farm Rd, from IDOT regarding the Game Farm Road project . Project - Sewer Alderman Jahp moved to authorize Mayor Davidson to Inspections sign the agreement with IDOT providing the the City Agreement to conduct all sewer inspections at the City ' s cost , regarding the Game Farm Road project , seconded by Alderman Hayden. Motion carried . Attorney Kramer reported that the River St . apartment River St . Apts . owners have contacted him and indicated they will talk to Tri-County Scavenger regarding a second dumpster being put at the site , as well as screening of the garbage area. They claim they are rehabili- tating 3 of the apartments . Most of the balconies have been put on, but with untreated lumber . Attorney Kramer reported that new notices for more Annexations annexation representatives to be present for discussion, and there is a need for a third meeting for the remainder of them to be heard. Attorney Kramer requested a short executive session Executive Session to follow the regular meeting. MAYOR PRO-TEM - Mayor Pro-tem Jennings requested Mayor Davidson to have a sparkling Super Bowl Report upon his return. CITY CLERK - Alderman Hayden moved to refer the ZBA87-1 Variance Huber/Henne petition for variance on sidewalks Sidewalks to the Zoning Board of Appeals for a Public Hearing Huber/Henne scheduled for February 9 , 1987 at 7 : 00 p .m. at the City Hall , and the Kendall County petition by PC87-4 Zoning Halbesma Trust for Zoning to be referred to the Kendall Co. Plan Commission on January 27 , 1987 at 7 : 00 p .m. Halbesma Trust at City Hall . Motion was seconded by Alderman Jahp . Zoning Motion carried. Clerk Erickson reported the following petitions for Petitions Filed nomination for the April 7 , 1987 General Election 4/7/87 Election have been filed : Alderman Ward 1 - Larry Small Alderman Ward 2 - William Radke Alderman Ward 3 - Jim Hayden Mayor - Robert E . Davidson, Jr . Alderman Jahp moved to approve Resolution #87-148 Res . #87-148 entitled "A RESOLUTION SETTING 1987 CITY COUNCIL City Council MEETING DATES" , seconded by Alderman Thanepohn. Meeting Dates Motion carried. TREASURER - Treasurer Huston announced that the Budget budget work should be done soon. POLICE - Acting Chief Diederich reported that he Kendall Co. attended the Kendall County sheriff ' s meeting, and Sheriff ' s they are expecting work any day that the jail will Meeting be shut down. PLAN COMMISSION - Alderman Fahrlander announced the next meeting is schedule for January 27 , 1987 , at 7 : 00 p .m. at City Hall . Attorney Kramer is requested to request Kendall County to defer action on the Hammen Petition for Gravel & Sand Mining until the City Council can have time to study the matter more thoroughly. Alderman Small moved to authorize Attorney Kramer to Request to K.C. draft a request letter to Kendall County asking them Defer Action - to defer action on the Hammon Petition for Zoning for Hammon Petition Page 3 January 22 , 1987 Gravel & Sand Mining , until the City Council has a chance to discuss the matter in depth, seconded by Alderman Hayden. Motion carried. ZONING BOARD OF APPEALS - Alderman Fahrlander ZBA announced there will be a Zoning Board of Appeals Huber/Henne meeting scheduled for February 9 , 1987 regarding the Huber/Henne request for Variance regarding Sidewalks . _HUMAN RESOURCE COMMISSION - Alderman Jennings Blood Drive reported the recent Blood Drive had lower parti- cipation than usual . The next meeting of the commission is scheduled for February 11 ; 1987 at the water tower . KENDALL COUNTY EMERGENCY SERVICES & DISASTER - Acting Chief Diederich reported that he met with K.C. ESDA John Taylor , and received a copy of the old emergency plan dated 1976 . The new copies will take more time to prepare as the format has been changed. BRISTOL KENDALL EMS - Alderman Thanepohn reported BK EMS the new ambulance is now in service. PARK COMMISSION - Alderman Jahp reported on the January 12 , 1987 meeting which Attorney Kramer also attended. There were 25 calls to Santa Calling. Ken Mandle will check with KFC regarding the funds to be dispursed for the recent promotional that the 4 Park Commission has not received to date. Suzzette Heth received no response from the Public Works Dept . regading Christmas decorations . The old and new programs were discussed . Liability insurance will be looked into regarding a fishing contest and also skating at the old JayCees pond. Attorney Kramer will check into the Land/Cash Grant regarding Land/Cash Grant the Park funds . Suzzette is checking with the Sr . Citizens for use of their van for small trips . Projects include trying to get a storage shed and concession stand, and a bike trail on the property . The next meeting will be February 9 , 1987 at 6 : 15 p.m. Any Council members are welcome at the meetings . Attorney Kramer reported the ice skating pond is a Ice Skating Pond really big issue with the Park Commission. Alderman Pfister has an agreement with the YBSD Board to allow such usage , but request responsibility of the safety sign as to ice thickness . Our insurance company will cover the use. Public Works will need to shovel the area . Alderman Hayden moved to authorize Attorney Kramer to draft an Intergovern- Intergovernmental mental Agreement regarding the ice skating pond , Agreement - Pond seconded by Alderman Jahp. Motion carried. OLD BUSINESS - Alderman Hayden questioned if the aµber/Henne Huber/Henne Petition was under the Subdivision Subdivision Control Ordinance , and Land Cash Ordinance . Attorney Kramer stated they are subject under both ordinances , and that the drawings include drainage easements . COMMITTEE REPORTS BUILDING & ZONING - Alderman Fahrlander reported on the January 15 , 1987 committee meeting. Discussion T. Shick - was held regarding Ted Shick being about to recapture Water Main Page 4 January 22 , 1987 the costs of the water main. Also, under discussion pewer Main for Mr . Shick was that extension of sewer main should not be to the east side of Rt . 47 , but to the west side . The cost will be approximately $40 , 000 , and the developer will pay for the engineering costs , as well as for the boring under Rt . 47 . Mr . Shick will be getting back to the city . The pre-annexation discussion with Kyle Price would Pre-annexation be to B-3 zoning. He was offered free water hookup , K. Price and in exchange the City will received easements for sewer and water . Mr . Price has verbally agreed to the offer . The same offer was made to Fred Dollman for a free Pre-annexation water hookup in exchange for water and sewer ease- F. Dollman ments , along with annexation and B-3 zoning. The owner is requesting a liquor license should there be a restaurant in the building in the future . The City is agreeable to this arrangement . Dr . McCauslin has been offered the same free water Pre-annexation. hookup in exchange for water and sewer easements , Dr . McCauslin along with annexation and B-3 zoning. Dr . McCauslin has verbally agreed to this arrangement . Attorney Kramer is working on annexation agreements for Kyle Price , Fred Dollman, and Dr . McCauslin. The next pre-annexation meeting is scheduled for February 4 , 1987 at 6 : 30 p .m. at the water tower . FUTURE PLANNING - Alderman Thanepohn reported on the Downtown Business January 14 , 1987 meeting. Discussion was held re- District garding the downtown business district relative to Parking parking and the financial aspects . POLICE - Alderman Small reported that the employee 4mployee Manual manual was discussed regading police department Police Dept . requests for changes due to the 10 hour shifts . Committee recommended hiring of a ninth man and Hiring Employee referred it to the Finance Committee for their input . Alderman Small moved to expend up to $ 1500 to P.D. Bldg. insulate the new addition to the police department , Insulation and hire Robert E. Lee Builders to do the job, seconded by Alderman Thanepohn. Clerk called the roll as follows : Hayden - Aye Small - Aye Fahrlander - Aye Thanepohn - Aye Radke - Aye Jahp - Aye Motion carried . Committee recommended purchase of a new squad car New Sauad in fiscal 87/88 year and have 3 instead of 2 fully marked cars , and to begin a rebuild program in 88/89 fiscal year . It was explained that longevity is not a factor in the Police Chief ' s salary . The question of officers working as security guards Officers for the private sector was referred to Finance Private Sector Committee for discussion along with the insurance Security Guards carrier information. YORKVILLE EMERGENCY SERVICES & DISASTER - Alderman Small reported that there was no meeting due to lack Page 5 January 22 , 1987 of agenda. WATER - Alderman Jahp announced there will be a meeting on January 29 , 1987 at the water tower . Alderman Jahp moved to approve Change Order A-1 , Water Tower CBI Na-Con, Inc . , to extend the contract completion Extend Contracts times for Items 4 , 5 , 6 & 7 to June 12 , 1987 , and CBI Na-con, Inc . Items 8 & 9 to June , 30 , 1987 . Motion was seconded by Alderman Thanepohn. Motion carried. UTILITIES - Alderman Fahrlander announced a meeting scheduled for January 29 , 1987 at the wate tower . PUBLIC PROPERTY & BUILDINGS - Alderman Small moved to authorize Mayor Davidson to sign the agreement Kane Co. Nutri- with the Kane County Nutrition Program for the tion Program Elderly, seconded by Alderman Hayden. Motion carried .Agreement FINANCE - Alderman Hayden announced February 5 , 1987 Preliminary Wage will begin the Preliminary Wage Negotiations meeting. Negotiations A schedule will be handed out to employees at a later date . SEWER - There will be a meeting January 29 , 1987 at 8 : 00 p .m. at the water tower . HEALTH & SANITATION - Alderman Radke reported the February 5 , 1987 meeting is cancelled due to lack of agenda . ,STREETS & ALLEYS - Alderman Thanepohn reported that W. Van Emmon - replies have been received regarding the West Van One-way Emmon One-Way Street problem. That and parking on River and King Streets will be on the agenda for the February 5 , 1987 meeting at 7 : 30 p .m. --,j,IBRARY BOARD, - Alderman Small reported on the January 12 , 1987 meeting. There is a problem with a run in the carpeting in the loft , and the company has been contacted regarding the matter . Director Johnson stated that he will check further into the matter of raising sidewalks in lieu of replacing them, and see if it can ' t be done to the section that needs to be redone at the Library building. Director Johnson will be moving the ground lights into the grassy area when better weather arrives . There is a problem with the gutter on the back side of the building . The plastic that was placed around the trees needs to be removed. Income tax forms are available at the library . YBS BOARD - Alderman Jennings announced the next meeting will be February 16 , 1987 at 7 : 00 p.m. at Dallas Ingemunson ' s office . Alderman Thanepohn moved to adjourn into Executive Executive Session Session to discuss litigation at 9 : 02 p .m. , seconded Litigation by Alderman Radke .
