City Council Minutes 1987 05-28-87 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY. ILLINOIS. HELD AT CITY HALL ON MAY 28 . 1987 . Mayor Davidson called the meeting to order at 8 : 00 Call to Order and led the council in the Pledge of Allegiance . Clerk Erickson called the roll . Present were : Roll Call Ward 1 - Small & Jahp Ward 2 - Thanepohn & Radke Ward 3 - Hayden & Pfister Ward 4 - Jennings & Fahrlander A quorum was established . Several guest were present representing Countryside Guests Center , Dr . Harold Sholle , and the press . Alderman Jennings moved to waive the reading of the Minutes minutes from the May 14 , 1987 meeting, and approve them as presented, seconded by Alderman Jahp. Motion carried . Alderman Jahp moved to authorize payment of the bills Bills as presented , seconded by Alderman Pfister . Motion carried . ATTORNEY ' S REPORT - Attorney Kramer reported the River St . Apts . Police Department has served notices to the tenants of the River Street apartments regarding the shutting off of water service if the delinquent bill is not paid by the owners of the building. Attorney Kramer reported that the old city records CS Center Apts. were researched regarding any information on the northeast corner of Countryside Center Subdivision that is zoned multi-family . In 1978 or 1979 it was subdivided into 8 lots , and a special plat approved , but it was not a P .U . D . There were specific plans for parking and landscaping. Attorney Kramer and Mayor Davidson will meet with Farmers Home Administration on May 29 , 1987 providing a meeting can be scheduled . Attorney Kramer further stated the property is zoned for multi-family use, and that no permit is needed other than building permits required , to put up apartments in that area. Attorney Kramer stated that the city has the right to object , but must be done by a governmental body with a rational basis . Alderman Jennings reported that he met with Country- side Center Homeowners regarding the issue, and at that meeting it was brought out that Barb 0-Donnell referred to two letters signed by Mayor Davidson, in 1986 . Mr . Stafford submitted copies of those two letters for review. The letters stated only that the property was zoned for apartments , and requested that further plans be submitted for review. Mr . Stafford stated he has a petition signed by 400 city residents objecting to low-income housing being put on the property . He also stated that Barb O ' Donnell surmised that if the citizens don' t want the project here , they will take it elsewhere to be constructed, but was under the impression from the two letters from Mayor Davidson that the city was backing the project . Mr . Stafford stated he would like to see a public hearing set up where all persons involved could lay out their ideas at one time for discussion. Mayor Davidson stated that it is only an assumption at this point that low-income housing is proposed for the specific area being it is a Federal group involved . Page 2 May 28, 1987 More information will be available following the meeting with the developer and financial representative . He can only speak for himself , and not the city council at this point . Mr . Stafford stated that rents will be subsidized by the state , and the project will begin with loan approval on June 30 , 1987 . Alderman Pfister responded that date cannot possibly be met due to procurement of an EPA permit for one thing . Mayor Davidson responded that the plans will most likely need a BOCA review, when submitted, which will also take some time . Alderman Jennings stated he did not feel there were 36 families in Yorkille who would qualify without bringing in families from outside the city limits , and if this were the case , there is not a need in Yorkville . Alderman Radke stated he felt a public hearing with Farmers Home Administration should be scheduled to hear all of the objections to the development . A citizen asked why Yorkville was sought where there is no need, economically, for this type of housing . Alderman Jennings responded that someone has to apply for this , and he would guess it was the owner of the property. Mayor Davidson and Alderman Jennings both stated the city council ' s responsibility is to represent their constituents . Alderman Hayden stated that he would reserve judgement since we now have two government subsidized apartment buildings for senior citizens , and there have been no problem with them, and they are very nice . Attorney Kramer will relay the outcome of the meeting with the financial backers , and developers to Alder- men Jennings & Fahrlander as soon as the meeting takes place . Alderman Pfister moved to rescind ORDINANCE #1987-5 Parking Ord. regarding parking, passed at the May 14 , 1987 city # 1987-5 - council meeting. Motion was seconded by Alderman Rescinded Hayden. Motion carried. Alderman Thanepohn moved to pass ORDINANCE #1987-6 ORD. 1987-6 - entitled "AN ORDINANCE PROVIDING FOR ' NO PARKING ' No-parking ZONES TO BE CREATED ON RIVER STREET AND KING STREET River & King IN THE UNITED CITY OF THE VILLAGE OF YORKVILLE; AND & Parking on FOR THE CREATION OF ' PARKING ' ZONES ON RIVER STREET River _IN THE UNITED CITY OF THE VILLAGE OF YORKVILLE. Motion was seconded by Alderman Hayden. Clerk called the roll as follows : Hayden - Aye Jennings - Aye Small - Aye Thanepohn - Aye Fahrlander - Aye Pfister - Aye Jahp - Aye Radke - Aye Motion carried . MAYOR ' S REPORT - Mayor Davidson proclaimed the week Proclamation of June 8 , 1987 as Lions Club Sight Saving Week in Lions Club - Yorkville. Davidson Adele Kastner to fill a vacant term to 1989 M. Hage and reappoint : Roberta Davidson to 1990 B . Sebby Marian Hage to 1990 Bruce Sebby to 1990 . Motion was seconded by Alderman Thanepohn. Motion carried. Alderman Radke moved to approve Mayor Davidson ' s Park Comm. Appt . appointment of Gary Bown as Chairman of the Park G . Bown - Chmn. Commission to serve to 1990, seconded by Alderman Small . Motion carried . Alderman Hayden moved to approve Mayor Davidson's ZBA Reapp't. reappointments of Les Henne and Tom Lindblom, both L. Henne to serve to 1992 on the Zoning Board of Appeals . T. Lindblom Motion was seconded by Alderman Thanepohn. Motion carried . Alderman Radke moved to approve Mayor Davidson ' s PC Reapp ' t . reappointment of Don Ament to the Plan Commission D. Ament to serve until 1991 , secondec by Alderman Hayden . Motion carried . Alderman Hayden moved to approve Mayor Davidson ' s Library Board appointments to the Library Board of Justine Jahp Appointments to fill a vacancy and serve to 1989 , and Mary Radke J . Jahp to fill a vacancy and serve to 1988 , and reappoint M. Radke & Jan Tronc , Joyce Skinner and Marian Manthei to serve Reappoint to 1990 . Motion was seconded by Alderman Pfister . J . Shick a public notice for public hearing regarding the Shick Annex & Zone Petition for Annexation & Zoning be disregarded due to misinformation in publication. PLAN COMMISSION - Alderman Radke reported on the May PC87-27 26 , 1987 Plan Commission meeting. Alderman Radke KC-Phillipp moved to approve the Plan Commission ' s recommendation Approved for approval of PC87-27 , Kendall County Petition to Rezone A-1 to R-1 , 3 . 305 acres by Leo & Vicki Phillipp on Legion Rd. , seconded by Alderman Hayden. Motion carried. Alderman Radke reported that PC87-28 , Kendall County PC87-28 Preliminary Plat by Tom Tanner on Rt . 71 ' s Timber KC-Tanner - Ridge Subdivision was discussed, and recommendations Pre.Plat were approved for the final plat . Timber Ridge A Comprehensive Plan map was presented for study by Comp. Plan Map the Plan Commission and City of Yorkville for recommendations . The Plan Commission was asked for suggestions regard- Stark Annex. ing the expiration of the annexation agreement for the Agreement Exp . Stark property . Discussion was held on the intersection of Walnut St . Intersection- Bristol Rd. & Rt . 47 . Walnut , Bristol Rt . 47 On recommendation by the Plan Commission, Alderman PC Change of Radke moved to change the meeting of the Plan Com- Meeting Date mission from the 3rd Tuesday, to the 3rd Wednesday of each month, beginning June 1 , 1987 . Page 4 May 28, 1987 KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - Mayor Davidson reported that two other businesses are looking at Yorkville for possible location. The meetings are the 3rd Tuesday of each month. HUMAN RESOURCES COMMISSION - Alderman Small reported Blood Drive the Blood Drive was held May 28, 1987 . BRISTOL-KENDALL EMERGENCY MEDICAL SERVICE - Alderman Jennings reported that day-time volunteers are badly needed. BRISTOL-KENDALL FIRE DISTRICT - The Pancake Breakfast will be held June 7 , 1987 at the fire barn. PARK COMMISSION - Alderman Fahrlander announced the next meeting is June 11 , 1987 at 6 : 15 p .m. at the Beecher Community Building. TENNIS COURTS - Alderman Jahp reported that he will set up a meeting with Mr . Storm. SCHOOL COMMUNITY - Alderman Jahp reported that he attended the May 26 , 1987 school board meeting and the new track was discussed & bids requested . Also, Mr. Sondgeroth has resigned and they are looking for a new principal to fill his vacated position . OLD BUSINESS - Alderman Jahp reported that he received a letter from IDOT District Engineer regarding an illegal drive on Route 126 . No action is needed by the City . COMMITTEE REPORTS BUILDING & ZONING - Attorney KRamer reported the pro- Proposed Rt . 47 posed annexation final plats will be ready in two Annexations weeks , and they will be able to proceed with the matter . The next meeting is June 9 , 1987 at 7 : 00 p .m. at the water tower . FINANCE - Alderman Small reported on the May 20 , 1987 Negotiations negotiations meeting with city employees . There will be a meeting to finalize the matter on June 3 , 1987 beginning at 7 : 00 p .m. at the water tower . Alderman Hayden will continue to review the bank statements for Treasurer Huston. POLICE - Alderman Hayden reported onthe May 21 , 1987 committee meeting. The committee recommended hiring a part-time officer , with replacement of full time officer to be discussed after final negotiations . Replacing the scanner in Police Chief ' s office at approximatley $155 .00 approved . The amount of work the Public Works Dept . should do on the radio tower was also discussed . The next meeting is June 18 , 1987 at 7 : 00 p .m. at the water tower . Officer Groesch has completed his 4th year of employment and entered into his next pay level . Page 5 May 28, 1987 WATER - Alderman Jahp reported that Don Schwegel , the city ' s primary engineer , is now president of Baxter & Woodman, Inc . The painting of the new water tower has been delayed Water Tower due to the high humidity. Painting The next meeting will be June 4 , 1987 at 7 : 00 p .m. at water tower . STREETS & ALLEYS - Alderman Thanepohn moved to adopt Res . # 1987-149 RESOLUTION # 1987- 149 appropriating $55 , 000 of MFT MFT-$55 , 000 funds for the 1987 street maintenance work, seconded St . Maint . by Alderman Jennings . Clerk called the roll as follows : Radke - Aye Hayden - Aye Jennings - Aye Small - Aye Pfister - Aye Fahrlander - Aye Thanepohn - Aye Jahp - Aye Motion carried . Alderman Thanepohn moved to instruct Baxter & FIP - Borings Woodman to do borings in Fox Industrial Park. Mayor Davidson announced he will be meeting with Mr . Peterson of IDOT and Al Gunderson of Baxter & Woodman, Inc . regarding borings in Fox Industrial Park. Alderman Thanepohn then withdrew his motion. Alderman Thanepohn moved to appropriate funds , not W. Van Emmon to exceed $200,No srelo)cate a utility pole on W.Van Relocate Utility Emmon Street , secondeeby Alderman Radke . Alderman Thanepohn announced the next meeting will be June 4 , 1987 at the water tower . The City of Yorkville was not represented at the IDOT Rt . 34 & IDOT Rt . 34 & Game Farm Rd . Preconstruction meeting Game Farm Rd. held recently due to miscommunications . Preconstruction Director Johnson reported that bids were let , Meeting a bid accepted, and an invoice received for 95% of the cost . He will give the bill to Treasurer Huston to present to the Streets & Alleys committee meeting for further discussion. PUBLIC PROPERTY & BUILDINGS - Alderman Jennings Joint Meeting announced a joint meeting with the Beecher Building CC & Beecher Advisory Committee on June 15 , 1987 . Attorney Bldg. Comm. Kramer ' s presence is requested . TREES & PARKS - Alderman Jennings announced the next meeting will be June 1- , 1987 at 7 : 00 p .m. at the water tower . SEWER - Alderman Pfister reported the heavy rains in ~ the past week have shown the impact of the work done in the past year . There was an invlow problem on Elizabeth Street that Elizabeth St . Public Works repaired . Sewer Inflow Page 6 May 28 , 1987 YBSD BOARD - Alderman Pfister announced the next meeting will be June 8, 1987 at 7 : 00 p.m at Dallas Ingemunson ' s office . There will be a joint meeting between the City Joint Meeting Council and the Yorkville-Bristol Sanitary District CC & YBSD on July 22 , 1987 . LIBRARY BOARD - Alderman Fahrlander announced the Library Board ^change of the Library Board ' s meeting on Monday , Change of Meeting June 8th, to Monday June 1st . Date CHAMBER OF COMMERCE - Alderman Pfister announced the next meeting is June 16 , 1987 . The Chamber has been working on the community guide Community Guide which Alderman Pfister has reported to be a big task.
