City Council Minutes 1987 07-23-87 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON JULY 23, 1987. Mayor Davidson called the meeting to order at 8:00 p.m. and Call to Order led the Council in the Pledge of Allegiance. Clerk Erickson called the roll as follows: Roll Call Ward 1 - Small - Present Jahp - Present Ward 2 - Radke - Absent Thanepohn - Present Ward 3 - Pfister - Present Hayden - Present Ward 4 - Jennings - Present Fahrlander - Present A quorum was established. Guest was William Perkins. Guest Alderman Pfister moved to waive the minutes from the July 9, Minutes 1987 City Council meeting, and approve them as presented, seconded by Alderman Jahp. Motion carried. Alderman Pfister moved to authorize payment of the bills as Bills presented, seconded by Alderman Thanepohn. Clerk called the roll as follows: Small - Aye Jahp - Aye Thanepohn - Aye Pfister - Aye Hayden - Aye Jennings - Aye Fahrlander - Aye Motion carried 7-0. Alderman Radke was absent from the vote. ATTORNEY'S REPORT - Alderman Pfister moved to adopte RESOLUTION Resolution #87-150 #87-150 entitled "RESOLUTION APPROVING EMPLOYEE RETENTION Diederich AGREEMENT" (Ron Diederich-Police Dept.) , seconded by Alderman Small. Clerk called the Roll as follows: Jahp - Aye Thanepohn - Aye Pfister - Aye Hayden - Aye Jennings - Aye Fahrlander - Aye Small - Aye Motion carried 7-0. Alderman Radke was absent from the vote. Attorney Kramer reported that he met with Don Ament regarding Insurance Carrier the special endorsement insurance carrier for karate and tumbling and will receive a clarification soon. Attorney Kramer reported that he received a letter from Mrs. Recapture Rights Stark regarding St. Patrick's property and recapture rights. Stark Property He also received a letter from Dick Schiller regarding the Hold Harmless Agreement. Alderman Pfister moved to authorize Director Johnson to issue St. Patrick's Permit the building permit to St. Patrick's subject to the signing of E.P.A. permits, BOCA review and E.P.A. approval, seconded by Alderman Jahp. Clerk called the roll as follows: Thanepohn - Aye Pfister - Aye Hayden - Aye Jennings - Nay Fahrlander - Aye Small - Aye Jahp - Aye. Motion carried 6-1. Alderman Radke was absent from the vote. Attorney Kramer reported that the Permanent Injuction Order Hammon Injunction was received that prohibits Donald and CArol Hammon from Order extraction and removal of sand from the Rt. 34 property involved. MAYOR'S REPORT - City Clerk, Luanne Erickson, was appointed 1990 Census as the laison with the U.S. Dept. of Commerce regarding the Liaison 1990 Federal Census. Alderman Jahp moved to approve Mayor Davidson's appointment of Appointments - P.D. William Perkins and Glen Calvert as full-time patrolmen for W. Perkins the Yorkville Police Department, seconded by Alderman Hayden. G. Calvert Motion carried, with Alderman Pfister voting NAY. Page 2 July 23, 1987 CITY CLERK - Alderman Pfister moved to refer the following PC Referral petitions: PC87-32 - Horton PC87-32 - Brett Horton Petition to Rezone R-1 to R-2 - 2 lots - Liberty & E. Center; ZBA Referral ZBA87-2 - Brett Horton Petition for Variance for Lot Size ZBA87-2 - Horton Reduction - 2 lots - Liberty & E. Center; for Plan Commission Public-HEaring scheduled for August 19, 1987 and Zoning Board of Appeals Public Hearing scheduled for August 17, 1987. Motion was seconded by Alderman Jennings. Motion carried. TREASURER - Treasurer Huston reported that the Summary Balance Treas. Report Report for 1986-87 is almost ready. The auditor's management letter for the current audit has not been changed much from the previous year, as most things were already corrected. There is no need for a meeting with the City Council this year. There has been no reasoning found for the decrease in sales tax Sales Tax for the one month in question. Letters were went to the state regarding the matter. The $870 monthly deduction from the sales tax return will continue for 48 months. This if for reimbursement to Kendall County. PUBLIC WORKS REPORT - Alderman Pfister moved to approve the Public Works Rpt. reports of the Public Works Department, seconded by Alderman Jahp. Motion carried. PLAN COMMISSION - Alderman Thanepohn moved to approve the Plan Comm. Minutes minutes of the Plan Commission, seconded byAlderman Pfister. Motion carried. EMERGENCY BRISTOL-KENDALL MEDICAL SERVICE-Mayor Davidson reported that EMS Entrance he will be meeting with the Board of Directors regarding the entrance to the EMS property in regards to accidents at that location. They will work together with the state in getting a safer entrance to the facility. PARK COMMISSION - Alderman Fahrlander reported the next meeting will be August 10, 1987 at 6: 15 p.m. at the Beecher Building. TENNIS COURTS - Alderman Jahp reported that he received an Tennis Courts estimate regarding the resurfacing of the tennis courts Resurfacing from Aurora Blacktop for $17,500 for 2" of new asphalt, $8500 -9000 ro sandfill and painting it green. SCHOOL COMMUNITY - Alderman Jahp reported that a School School Board Meeting Board Meeting was held on July 20, 1987 regarding the increase in the school budget. A Special School Board meeting is scheduled for July 27, 1987. COMMITTEE REPORTS WATER - Alderman Jahp moved to authorize Mayor Davidson to sign St. Patrick's St. Patrick's E.P.A. Motion carried. -61-6"q ))t - -- BUILDING & ZONING - Alderman Small announced there was a meet- Wildwood Property ing on July 14, 1987 regarding the Wildwood Property development, and the next meeting is scheduled for August 12, 1987. McFarland's car wash to be located on the Stark property will McFarland Carwash also be on the agenda. Alderman Small requested that ariel maps of just the city limits be kept at the City Hall for committee meetings. STREETS & ALLEYS - Alderman Thanepohn reported that two bids Petersen Sidewalk Bids were received for Calvin Peterson's sidewalk replacement on King/W. Center Street. Alderman Thanepohn moved to accept the low bid from Dan Wilson of $4,473.04 (2,024 sq. ft. @ $2.21 per Sq. ft.) , with the city to pay 1 of the 2 of the total amount. (Mr. Petersen requested to do i of the project this year and i next year) , Motion seconded by Alderman Pfister. Clerk called the roll as follows: Hayden - Nay Jennings - Nay Jahp - Nay Fahrlander - Aye Small - Aye Thanepohn - Aye Pfister - Aye Motion carried4/-3, Page 3 July 23, 1987 SEWERS - Alderman Pfister reported that the Wildwood devel- Wildwood Density opers have met with the City and there is talk of a reduction in density of the development, along with storm water retention. The City isto obtain a study of the capacity of the sanitary sewer lines. Alderman Pfister moved to B&W-Sanitary Sewer Study authorize Baxter & Woodman, Inc. to do a study of the Sanitary Sewer Line Capacity for a cost not to exceed $2,500. Motion was seconded by Alderman Jennings. Clerk called the roll as follows: Jennings - Aye Fahrlander - Nay Small - Aye Jahp - Aye Thanepohn - Aye Pfister - Aye Hayden - Aye Motion carried 6-1. Alderman Radke was absent from the vote. PUBLIC RELATIONS - Alderman Pfister thanked Attorney Kramer Resolution for drafting the resolution to be used for those who serve City Service serve the city. FINANCE - Alderman Small reported that Tax Levy Discussion Tax Levy was held at the July 13, 1987 committee meeting. Attorney Kramer is to have the tax levy ready for the City Council by the end of the month. The regularly scheduled meeting of the Finance committee on July 30,1987 is cancelled, and rescheduled for July 29, 1987 at 8:00 p.m. at City Hall. YBSD BOARD - Alderman Pfister reported that the board passed YBSD Budget their annual budget oat their recent meeting. There was a joint YBSD/City Council meeting held on July 22, 1987. Discussion was held regarding the intergovernmental agreement, and the subject of no user fees being charged to the City. LIBRARY BOARD - Alderman Fahrlander reported that the carpeting Carpet - Library in the library needs resolving. The next meeting is August 10, 1987 at 7:00 p.m. at the library. CHAMBER OF COMMERCE - Alderman Pfister reported that the Chamber of Commerce Chambers reader packet for new residents of the city was discussed, and thanked Pam Hitzmann for the time and work put in on the project. Alderman Pfister announced that J.T. Johnson is in charge of Chamber Golf Outing of the Chamber's Golf Outing on July 30, 1987. ADDITIONAL BUSINESS - Attorney Kramer reported that a Beecher Bldg. Line Item Beecher Building separate line item in regards to the budget required a referendum. Alderman Jennings requested that Mayor Davidson give thought Beecher Bldg. Full-time to a full-time Beecher Building Employee to oversee the Employee building. Alderman Jahp moved to adjourn the meeting, seconded by Adjournment Alderman Pfister.
