City Council Minutes 1986 07-10-86 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY , ILLINOIS , HELD AT CITY
HALL ON JULY 10 , 1986 .
Mayor Davidson called the meeting to order at 8 : 00 Call to Order
p .m. and led the council in the Pledge of Allegiance .

Alderman Jahp introduced his father Cliff Jahp and Guests
his brother Dave Jahp .
Alderman Jennings moved to waive the reading of the P .H. Minutes-
Public Hearing regarding the joint agreement between Rt . 34 & Game
the City of Yorkville , Bristol Township , and the Farm Rd . Impvt .
State of Illinois for the improvement on Rt . 34 &
Game Farm Road , seconded by Alderman Hayden. Motion
carried .
Alderman Jahp moved to waive the reading of the Minutes
minutes from the June 26 , 1986 regular city council
meeting, seconded by Alderman Pfister . Motion carried.
BILLS - Alderman Small moved to authorize payment Bills
of the bills as presented , seconded by Alderman
Thanepohn. Clerk called the roll as follows :

MAYOR ' S REPORT - Mayor Davidson requested the press Sesquecentennial
the make it known to the public that there are more History Books
Sesquecentennial History books available at the
Kendall County Record , City offices , banks , and the
bakery downtown .
Alderman Radke read a Proclamation commending those Proclamation
who put their time and work into making the cele- Sesquecentennial
bration a big success . Thankyou
Mayor Davidson recommended that any profit from the Sesquecentennial
Sesquecentennial be donated to next year ' s fireworks Profit
for the July 4th celebration.
Mayor Davidson personally thanked all involved with Sesquecentennial
the success of the Sesquecentennial , and stated he Thankyou
was proud to be Mayor of Yorkville and had the
opportunity to work with everyone on the project .
Mayor Davidson reported that he received a request Zoning - Mini-
from Bob Lee regarding his recently zoned B-3 Warehouse
property , and the construction of a mini-warehouse
with M- 1 zoning on this particular property . It is
the concensus of the City Council that either a
petition for special use zoning , or a zoning change
be submitted to the Plan Commission. Alderman Small
felt it would be compatible . Alderman Hayden felt
the matter should be discussed at a committee meeting .
ATTORNEY ' S REPORT - Attorney Kramer stated that Tax Levy
everyone should be involved at the July 17 , 1986

committee meeting regarding the tax levy .
CITY CLERK - Clerk Erickson announced the bids for Squad Car Bids
the sale of the police squad car , and purchase of Sale
sewer pipe will be received and opened on August 25 ,
1986 at the City Offices .
TREASURER - Treasurer Huston reported that the Audit
auditors had about one day left , but they are going
to want to sit down with the finance chairman and
committee to go over the recommendations .
PUBLIC WORKS REPORT - Alderman Thanepohn reminded Hook-up Fees
the council that the hook-up fees for water & sewer Water/Sewer
should be studied .
Alderman Small moved to approve the reports of the
Public Works Department , seconded by Alderman Pfister .
Motion carried .
POLICE REPORT - Chief Randall reported that he was Sesquecentennial
both amazed and impressed at the lack of reports of Activity
reports over the 3-day Holiday Weekend , and that it
was equal to a normal average weekend .
Alderman Jennings moved to approve the reports of the
Police Department , seconded by Alderman Jahp . Motion
carried .
BEECHER BUILDING REPORT -Alderman Jahp moved to approve
the report of the Beecher Building , seconded by
Alderman Hayden. Motion carried.
RECREATION DEPARTMENT REPORT - Alderman Pfister moved to
approve the report of the Recreation Department ,
seconded by Alderman Jahp . Motion carried .
Alderman Pfister noted the new format for the report .
KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION -
Alderman Pfister reported the next meeting will be
held July 22 , 1986 at Oswego Village Hall , and the
August meeting will be the 19th in Newark.
HUMAN RESOURCE COMMISSION - Mayor Davidson reported
that Leone Olson wishes NOT to be reappointed to the
commission for another term.
Alderman Jennings reported the next meeting will be
July 21 , 1986 at 7 : 00 p .m. at the water tower .
BRISTOL-KENDALL EMS -Alderman Thanepohn reported the EMS Ambulance
new ambulance has arrived .
BRISTOL-KENDALL FIRE DISTRICT - Mayor Davidson 4th of July
reported he would like to see more community
involvement on the 4th of July , and would like to
have a July 4th committee to work with the Fire
Department in the future . Alderman Thanepohn
suggested the Human Resource Commission as a
possibility .
Chief Randall favored the idea of having a 2-day
celebration, but stated that 3 days was too long ,
and he also stated that coordination is extremely
important .
PARK COMMISSION - Alderman Jahp thanked Suzzette Heth Sesquecentennial
and the Park Commission for their part in the tug of Tug-of-war
war for the Sesquecentennial Celebration .

SESQUECENTENNIAL COMMITTEE - Alderman Radke extended Sesquecentennial
a special thank-you to Harlan Johnson for all the Thankyou
time he spent getting the Sesquecentennial together .
Alderman Radke requested Treasurer Huston to be
present at the July 15 , 1986 committee meeting and
to present a financial report of the Sesquecentennial .
Mayor Davidson commended the Director Johnson, Miff Commend
Mikkelson, Chuck Smith , Eric Doede , Greg Millen , Public Works
Roger Knell , and Todd Mikkelson, for an outstanding
job behind the scenes in making the Sesquecentenial
a success . Also , to Debbie Robertson for her time
spent selling the history books over the weekend .
BEECHER BUILDING ADVISORY COMMITTEE - Alderman Radke
announced the next meeting will be July 21 , 1986 .
OLD BUSINESS - Alderman Fahrlander asked if weed Weed
violation notices have been sent out . Director
Johnson responded that they had been sent out the
previous Tuesday .
NEW BUSINESS - Alderman Hayden asked the status on Fox Industrial
the streets in Fox Industrial Park. Mayor Davidson Park Streets
stated the developers have not gotten back with the
city regarding the matter .
Alderman Hayden reported that Tom Morgannegg has River St . Apts .
expressed his concern for the conditions of the
River Street apartments , and that he mentioned
possible lawsuit . Attorney Kramer will write a
letter to Mr . Morganegg explaining the city ' s
position.
,COMMITTEE REPORTS
BUILDING & ZONING - Alderman Fahrlander announced a R . Lee Zoning
committee meeting for July 16 , 1986 at 7 : 30 p .m. at
the water tower conference room, to discuss Bob Lee ' s
zoning question, and force annexation for certain Force Annexation
parcels adjacent to the city . Mr . Conover will be
informed of the meeting , also . Conover
FUTURE PLANNING - Alderman Thanepohn announced a Codification
meeting for July 16 , 1986 at 6 : 30 p .m. at the water
tower to discuss codification with a representative
of Sterling Codifiers to be present .
POLICE - Alderman Jennings moved to purchase a 4- Motion Withdrawn
channel radio for the police department , at a
cost of $ 1069 , without installation, seconded by
Alderman Small . Alderman Jennings withdrew his
motion, Alderman Small withdrew his second .
Alderman Jennings moved to purchase a 4-channel 4-channel Radio
for the police department from Signal 3 Systems Police Dept .
at a cost of $ 1 , 466 . 77 , including installation.
Alderman Small seconded the motion . Clerk called

Alderman Jennings referred the matter of traffic on E . Main &
E. Main St . & McHugh Road , with recommendations for McHugh -
stop signs , to the Streets & Alley ' s committee Stop Sign

meeting on August 7 , 1986 .
WATER - Alderman Jahp moved to authorize Baxter & Engineers -
Woodman , Inc . to be the engineering firm, on a time Radium Var .
and materials basis , for the radium matter and
variance , seconded by Alderman Pfister . Motion
carried .
Alderman Jahp reported that in the near future a Well #3 Pump
decision will have to be made on lowering the pump
in Well #3 . Baxter & Woodman, Inc . will be advising
on any alternatives to the matter .
PUBLIC PROPERTY & BUILDINGS - Alderman Small reported Beecher Bldg .
on the status of the Beecher Building roof . The Roof
Council desires to have labor supplied as well as
materials , in the repair of the building . Alderman
Jahp stated that , if the City were to furnish the labor
there would possibly be no course for action in the
future . The matter was referred to committee for
discussion at the meeting July 16 , 1986 at 8 : 30 p .m. at
the water tower . Attorney Kramer stated there was a
5-year statute of limitations from the date of the
waiver of completion.
FINANCE - Alderman Hayden reported there was a public Utility Tax
hearing held before the regular meeting , regarding Increase
the pending utility tax increase . Two citizens
were present stating their objections to a tax
increase .
Aldeman Hayden moved to bring the motion from the
June 26 , 1986 meeting off the table , seconded by
Alderman Thanepohn. Motion carried .
The motion to increase the utility tax from 4% to
5% is now on the floor for discussion.
Alderman Hayden stated it was suggested in the
public hearing that a sunset clause be put on the
tax increase , to have it automatically dropped in
a specified amount of time , although he has second
thoughts on this procedure . He would also like to
see it increase beginning in September to realize
more revenue , sooner .
Attorney Kramer stated that the utilities have
requested implementation be with their calendar year ,
on January 1st , or a calendar quarter .
Alderman Fahrlander stated he is against the tax
increase, and when the utility rates go up , the revenue
will also go up . Alderman Radke responded that the
fixed costs also, go up accordingly.
Alderman Pfister stated that history has shown that
lowering a tax is not that easy to do .
Alderman Hayden moved to amend the original motion that
the utility tax increase take effect on October 1 , 1986 ,
seconded by Alderman Thanepohn .
Alderman Jennings amended the original motion that
should it be passed , 12 months from the date it is to
take effect it is either renewed , or automatically drops
back to 4% , seconded by Alderman Jahp .
Alderman PFister amended the original motion that the
utility tax increase not take effect until January 1 , 1987 ,
seconded by Alderman Fahrlander .

Alderman Jahp stated that everything we do costs money
and if the City Council does not realize it soon, they
are going to have a problem in the future .

Clerk called the roll on the motion to raise the
utility tax from 4% to 5% , to take effect October 1 ,
1986 as follows :

Motion carried 5-3 .
SEWER - Alderman Pfister announced a meeting for July Sewer Mains &
15 , 1986 to establish legalities and costs , and to Laterals
view tapes of the main sewers and laterals if
available .
Alderman Pfister reported that Don Schwegel
attended their recent meeting for discussion
on the SSES .
Alderman Pfister moved to advertise for bids SSES Bids
regarding sanitary sewer inflow in conjunction with
the SSES , at an estimated cost of $60 , 000 , seconded
by Alderman Jahp . Motion carried .
Alderman Pfister moved that Attorney Kramer prepare Sanitary Sewer
an Ordinance specifying use of public funds for Inflow - Private
private property removal of inflow through the Property
sanitary sewer system, specifically the disconnec-
tion of downspouts and perimeter tiles , seconded by
Alderman Hayden. This regards properties that
were originally hooked up legally before the EPA
ruled they were illegal . Motion carried .
Alderman Pfister moved to have Attorney Kramer draw Easements &
up the legal descriptions for the property easements Agreements
along with a legal agreement between the City of w/Grainco
Yorkville and Grainco , to include 3 commercial water
hookups and 3 commercial sewer hookups , along with
$ 1500 for the property acquisition. Motion was
seconded by Alderman Small . Alderman Pfister noted
the site can also be used for a second river crossing .

the cost of the water meters from the hookups ,

3 commercial sewer hookups , along with $ 1500 for
property acquisition, as follows :

HEALTH & SANITATION - Mayor Davidson reported that Housing Ord .
a Kendall Co. meeting is scheduled for August 4 , 1986 ,
but they are hoping to change it to the last week
of July , regarding the Housing Ordinance . Plano ,
Oswego, Newark & Lisbon have also been invited.
Mayor Davidson reported that he will contact Tri-Co . Garbage Problem
Scavenger regarding Mr . Morganegg ' s complaint to
find out the status of the River St . Apartments
contracts .
STREETS & ALLEYS - Alderman Thanepohn moved to Quinsey &
contract with Aurora Blacktop to lay an A-2 coat Somonauk St .
to Quinsey & Somonauk Streets at a cost not to Surfacing
exceed $4 , 900 , seconded by Alderman Pfister . Clerk
called the roll as follows :

YBS BOARD - Alderman Pfister announced the next
meeting will be July 21 , 1986 at 7 : 00 p .m. at Dallas
Ingemunson ' s office .
LIBRARY BOARD - Mayor Davidson will attend the meeting
on July 14 , 1986 for Alderman Small .
CHAMBER OF COMMERCE - Alderman Pfister announced the
breakfast meeting is July 22 , 1986 at the Williamsburg

ADDITIONAL BUSINESS - Alderman Fahrlander asked what Utility Tax
would happen regarding the utility tax if revenue
sharing were to be continued . Attorney Kramer
responded the ordinance increasing the tax increase
can always be rescinded .
Alderman Thanepohn asked about the status of the Non-Compliance
non-compliance zoning of the properties on Rt . Zoning
47 . The matter will be discussed at the Building &
Zoning meeting.
