City Council Minutes 1986 11-20-86 .p183 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY pF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, HELD AT CITY HALL ON NOVEMBER 20 , 1986 . Mayor Davidson called the meeting to order at 8 :00 Call to Order p.m. and led the council in the Pledge of Allegiance . Clerk Erickson called the roll as follows : Roll Call Ward 1 - Small - Present Jahp - Present Ward 2 - Radke - Present Thanepohn - Present Ward 3 - Pfister - Present Hayden - Absent (arrived at 8 : 05 p.m. ) Ward 4 - Jennings - Present Fahrlander - Present A quorum was established . Guests were Myrla Randall and Cindy Tio. Guests MINUTES - Alderman Jahp moved to waive the reading Minutes of the minutes from the October 23 , 1986 City Council meeting , and approve them with the follow- ing correction : Page 4 - Streets & Alleys - Paragraph 1 - Line 5 - Delete "month" and add "year" . Motion was seconded by Alderman Pfister . Motion carried . Alderman Jahp moved to authorize payment of the bills Bills as presented, to include the following additions : Debbie Robertson - 10 meetings - $ 150 . 00 Tri-County Scavenger - Nov . Service - $4 , 467 . 80 Richard Randall - Vision Ass ' t . - $ 187 . 00 Motion was seconded by Alderman Jennings . MAYOR ' S REPORT - MAyor Davidson reported he has Resignation - accepted the resignation of Police Chief , Richard R. Randall Randall , and stated that he is happy about the election turnout , but sorry to see him leaving the City . Mayor Davidson reported that he has accepted the Resignation - resignation of Police Secretary, Pauline Usry, P . Usry who is moving on to Kendall County in an admini- strative position. Page 2 November 20. 1986 Mayor Davidson presented Cindy Tio a plaque for Sesquicentennial her work in putting together the Sesquicentennial ServiceePlaqu history book. Gary Conover presented the Final Plat for Conover's Final Plat Countryside Unit 8 Annexation. Alderman Jennings Conover's moved to approve Conover ' s Countryside , Unit 8, Countryside final plat as submitted , seconded by Alderman Jahp . Unit 8 Clerk called the roll as follows : Hayden - Aye Jennings - Aye Pfister - Aye Thanepohn - Aye Fahrlander - Aye Radke - Aye Small - Aye Jahp - Aye Motion carried . f' ATTORNEY ' S REPORT - Attorney Kramer reported that no Northern Trust- letter of credit has been received to date from Letter of Credit Northern Trust Co . Attorney Kramer reported that responses have been Force Annexation coming in from those contacted about voluntary annexation in lieu of force annexation on N. Bridge St . , south of Rt . 34 . The responses are mixed, and it was suggested a meeting be scheduled in December to sit down with the representatives involved for discussion on the matter . The accessor is working out a tax chart that will show city vs . Kendall County . The meeting was scheduled for December 11 , 1986 at 7 : 00 p .m. Attorney Kramer will notify the parties involved . Alderman Pfister moved to approved and sign the Agreement - Fox agreement with Kendall County regarding the Fox Road Impvt . Road improvement at a cost of $8 , 000 per year , seconded by Alderman Small . City Clerk - Clerk Erickson reported that the Nov- P .C. Public ember 25 , 1986 Plan Commission meeting was cancelled Hearing - Shick due to her error in publication dates for the Public Petition Hearing on the Shick Petition to annex and zone . It will be republished and rescheduled for the December 23 , 1986 Plan Commission at 7 : 00 p .m. at City Hall . Clerk Erickson announced the election petitions for 1987 Election nomination for the upcoming April 7 , 1987 City Petitions election have not been received to date , but are Page 3 November 20, 1986 expected within the next week for distribution . TREASURER - Treasurer Huston reported that the Water Tower payouts for the water tower construction are ready, Payouts but need to be reviewed by Attorney Kramer before the checks can be issued . Treasurer Huston reported that more interest is to Sales Tax Info be received on sales tax, due to the law suit being settled . PUBLIC WORKS - Alderman Pfister moved to approve the Public Works Rpt . reports of the Public Works Department , seconded by Alderman Thanepohn. Motion carried . Director Johnson reported that the Fire Dept . will be doing hydrant testing on their own. POLICE - Alderman Hayden moved to approve the reports Police Dept . Rpt . of the Police Department , seconded by Alderman Thanepohn. Motion carried . Alderman Pfister moved to approve Mayor Davidson's App't. -Diederich appointment of Ron Diederich as Temporary Police Temporary Police Chief , until May 1 , 1987 , at a salary of $28 , 500, Chief seconded by Alderman Small . Motion carried . Richard Randall thanked the City Council for their support over his 18 1 /2 years of service to the City of Yorkville . PLAN COMMISSION - Alderman Fahrlander reported on the Plan Commission October 28, 1986 meeting of the Plan Commission. Discussion was held on the agenda items of Conover ' s Final Plat being approved, Rick Johnson ' s Petition for Kendall County Zoning being denied, and the Huber/ Henne Preapplication Conference . Clerk Erickson was requested to draft a letter to R. Johnson - Rick Johnson, with copy to Kendall County, request- Kendall Co. ing him to bring his revised application to the Petition/Zoning next Plan Commission meeting on December 23 , 1986 . BEECHER BUILDING - Alderman Jennings moved to approve Beecher Bldg. the report of the Beecher Building , seconded by Report Alderman Jahp . Motion carried . RECREATION DEPARTMENT - Alderman Jennings moved to Recreation Dept . approve the report of the Recreation Department , Report seconded b Alderman Small . Motion carried . Page 4 November 20, 1986 KENDALL COUNTY ECONOMIC DEVELOPMENT COMMISSION - Mayor Davidson reported the meeting had been cancelled and rescheduled to November 25 , 1986 . HUMAN RESOURCE COMMISSION - Alderman Jennings re- HRC - Blood Drive ported that discussion at the recent meeting was regarding the Blood Drive scheduled for Tuesday , December 9 , 1986 . The December meeting has been cancelled. The committee is still short one member . PARK COMMISSION - Alderman Jahp reported that dis- cussion was held regarding the 3 teen dances scheduled, the convention in Peoria to be attended by S . Heth, and the shelter to be put on the property. There will be Santa Calling on December 18 , 1986 , and a Karate Seminar is scheduled . Steve Bridge will be having a men ' s open gym program. Storage and concessions was also discussed . The next meeting is scheduled for December 15 , 1986 at 6 : 00 p.m. COMMITTEE REPORTS FUTURE PLANNING - Alderman Thanepohn announced the next meeting is scheduled for December 4 , 1986 at 8 : 30 p.m. at the water tower . POLICE - Alderman Jennings announced a committee meeting for Wednesday , November 26 , 1986 at 7 : 00 p.m. at the water tower . All aldermen are requested to be present . Alderman Jennings reported that 2 part-time persons Police Dept . will be hired in lieu of a full-time secretary at Secretary the Police Department . One has been chosen, and Debbie Robertson will fill in for the other part- time position until it can be filled . Alderman Jennings reported on the November 10 & 11 , 1986 Police Committee meetings . YORKVILLE EMERGENCY SERVICES & DISASTER - Alderman Kendall Co. Small reported that the Kendall County Disaster Emergency Dis- Plans should be available in approximately 60 days . aster Plans WATER - Alderman Jahp scheduled a committee meeting for December 4 , 1986 to follow the sewer meeting . Discussion will be held on a monetary amount in regards to sending the Kane County Water Association attorney to Washington D .C . in regards to the radium Page 5 November 20, 1986 issue , Well 1/3 pump , T&R Construction ' s Bill regar ding the augered lines of water tower project , City of Yorkville input for the Batavia meeting regarding the radium problem, Letter of Intent with ISOclear , and a letter from Engineering Enterprises certifying that materials are stored on site for the water tower project . Alderman Jahp reported the water tower construction is progressing nicely. )JTILITIES - Alderman Fahrlander reported that Centel Centel Cable TV has changed their rates . PUBLIC PROPERTY & BUILDINGS - Alderman Small reported the December 11 , 1986 meeting is cancelled . FINANCE - Alderman Hayden reported on the November 6 , 1986 meeting. More information is needed on the Engineering Enterprises bill in question. Officials salaries were also discussed . A letter will be going to employees stating that insurance costs are up, and negotiations will be gin in January. Alderman Hayden announced the next meeting is November 26 , 1986 at 7 : 30 p .m. Treasurer Huston has been requested to attend . Alderman Hayden moved to designate Treasure Huston as trustee for IMRF , seconded by Alderman Jahp . Motion carried . SEWER - Alderman Pfister reported that Missing ' s sewer problem was discussed at the October 30 , 1986 meeting. On committee recommendation, Alderman Pfister moved Res . #1986-146 to adopt RESOLUTION l#1986-146 entitled "RESOLUTION Sanitary Sewer ESTABLISHING CITY SANITARY SEWER MAINTENANCE POLICY" , Maint . Policy seconded By Alderman Small . Alderman Pfister amended the original motion to include the inserting the word "structural" preced- ing the word "obstruction" , on page 3 , section 10-a , line 2 , seconded by Alderman Small . Alderman Jennings stated he is not in favor of the resolution, due to there being 24 miles of sewer the city has to maintain at present , many of which are in need of rehabilition , and accepting another 12 additional miles of lateral sewer lines is not prudent at this time . He further stated that lateral lines have always been the responsibility of the property owner in the past , and should stick to that Page 6 November 20, 1986 policy. Alderman Pfister stated that according to the SSES study, only a small portion of the sewer lines are in need of rehabilitation and maintenance at this time . Alderman Jennings stated that he feels it prudent to rehabilitate what we have to do already, before adding new lines for responsibility. Clerk called called the roll for the amendment as follows : Hayden - Aye Jennings - Nay Thanepohn - Aye Small - Aye Pfister - Aye Fahrlander - Aye Radke - Nay Jahp - Aye Motion carried 6-2 . Attorney Kramer will redo the Resolution to include the amendment before signing . Alderman Pfister reported that Pipeliner ' s Ltd. has SSES just about completed most of the SSES work . Alderman Pfister reported that a letter was received Extension of from Pipeliners , Ltd . requesting extension of their Contract -Pipe- contract . liners Alderman Pfister cancelled the Public Relations meeting scheduled for December 4 , 1986 , and added a sewer committee meeting in its place at 7 : 00 p.m. HEALTH & SANITATION On committee recommendation, Alderman Radke moved to Tri-County approve the requested rate increase of 55 cents per Scavenger household , effective January 1 , 1987 , by Tri-County Rate Increase Scavenger Service, seconded by Alderman Hayden. Page 7 November 20, 1986 It was recommended that Attorney Kramer send a River St . Apts . letter to the River St . Apartments regarding Garbage Service City policy that over 2 units is commercial property and garbage service is not provided by the City , along with the request that the garbage area be fenced in as required by the BOCA Code . It was recommended that Attorney Kramer notify the River St . Apartments that the City is in agreement regarding their plumber putting in indi- River St . Apts . vidual water shut-offs and meters for each unit , Water Meters at their expense , but subject to City inspection. The committee felt that the present BOCA Code was ,Housing Ordinance sufficient regarding the proposed Housing Ordinance . STREETS & ALLEYS - Alderman Thanepohn moved to IDOT - MFT approve the recommended Change Order in the 1986 Change Order MFT Street Maintenance Program, in the amount of 86 St . Maint . $3 , 245 .40, seconded by Alderman Jahp. Clerk called the roll as follows : Jennings - Aye Small - Aye Jahp - Aye Pfister - Aye Fahrlander - Aye Hayden - Aye Thanepohn - Aye Radke - Aye Motion carried . Alderman Jennings reported that representatives of Pavement Mgmt . Donahue & Associates were present at the November 6 , 1986 meeting to give a presentation regarding the pavement management program. The cost to Yorkville would be approximately $ 15 , 500 . Alderman Jennings moved to do the storm sewer at Storm Sewer W. Washington & Main St . done , at a cost not to ex- W. Wash. /Main ceed $3700 , seconded by Alderman Radke . Alderman PFister asked that the engineers take a look River St . at the area of W. River St . on the bridge over the dam. TREES & PARKS - Alderman Radke moved to allow the Sports Boosters Sports Boosters to have a sign in the City Park Sign-City Park for a period of 6 months , and at the end of that period be reviewed . Page 8 November 20, 1986 PUBLIC RELATIONS - Alderman Pfister reported that the Daniel Hatcher Memorial Center now has a physical therapy center . Alderman Pfister reported that he has ordered plaques at a cost of $405 plus shipping costs . Alderman Pfister reported that he sent for a packet of ideas for economic development for the area . YBS BOARD - Alderman Pfister announced the next meeting is December 15 , 1986 . CHAMBER OF COMMERCE - Alderman Pfister reported that the Chamber ' s Retail Professional Service and Manufacturing is now an active committee . Mike Hitzemann gave a report on his conference in Minne- sota he recently attended with Alderman Thanepohn. Monday, November 24 , 1986 , at 9 : 00 a .m. is the formal Sign Dedication dedication of the sign at Rt . 34 & 47 . ADDITIONAL BUSINESS - Alderman Pfister reported he Light Pole - had a letter to the city regarding the city provid- City Policy ing a light pole for in front of Dr . Kritzberg ' s at cost , but that the city will not maintain the light as it is on private property. Mayor Davidson is to draft a letter informing them of the City ' s policy.
