City Council Minutes 1984 05-10-84 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD ON MAY 10, 1984 AT
CITY HALL .
Mayor Davidson called the meeting to order at 8:00 p.m. and led the council
in the Pledge of Allegiance to the Flag .
Clerk Erickson called the roll as follows :

Ward 2 - Alderman Harker - Absent
Alderman Tilton - Absent
Ward 3 - Alderman Dollman - Present
Alderman Hayden - Present
Alderman Loebbaka - Present

A quorum was established .
Guests were Marci Rogers and Jim Olson.
Alderman Small moved to waived the reading of the minutes from the April
26, 1984 meeting, and approve them as presented, seconded by Alderman
Dollman. Motion carried 5-0 .
Alderman Harker arrived .
Alderman Dollman moved to authorize payment of the bills as presented,
seconded by Alderman Jahp . Roll call vote was taken as follows :

Motion carried 6-0 .
MAYOR'S REPORT - Mayor Davidson accepted the letter of resignation from
Alderman Tilton. He will be appointing a replacement for the position
within a month .
Mayor Davidson read a Proclamation setting aside May 18 & 19 , 1984 as
"POPPY PROGRAM DAYS" .
Alderman Hayden moved to approve Mayor Davidson's Committee Appointments
with the following changes :
1 . Delete Dollman from Plan Commission and add Jennings .
2 . Delete Jennings from School Community and add Dollman.
Alderman Harker seconded the motion. Motion carried 6-0. (***See attached
copy.
Alderman Hayden moved to approve Mayor Davidson's Commission Appointments
as follows :
1 . Business & Economic Development Commission will stay as they are
for the time being.
2 . Human Resource Commission - Reappoint Identa Austin as Chairman ,
Linda Petty and Bessie Lough for 3 year terms .
3 . Park Commission - Appoint Naydene Pierce for a 3 year term.
4 . Zoning Board of Appeals - Reappoint Delmar Becker and Appoint
Greg Huber for 5 year terms .
5. Plan Commission - Reappoint Lawrence Langland and Charles Beaudry
for 4 year terms .
6 . Library Board - Reappoint Marilyn Thompson, Jan Tronc and Joyce
Skinner for 3 year terms .
Alderman Jahp seconded the motion. Motion carried 6-0. (***See attached

Mayor Davidson reported that the City Employees will be appointed at the
next meeting .
Mayor Davidson reported that the crew is working on the water tower
cleaning and getting it ready for painting .
CITY CLERK - Clerk Erickson presented a petition for Side-yard Variance
on Worsley Street .
Alderman Harker moved to refer the petition to the Zoning Board of Appeals
to be scheduled for a public hearing and be back to the City Council by
the June 14 , 1984 meeting , seconded by Alderman Jahp . Motion carried 6-0 .

TREASURER'S REPORT - Alderman Hayden moved to approve the Treasurer's
Report as presented, seconded by Alderman Dollman. Clerk called the roll
as follows :

Motion carried .
Treasurer Loebbaka reported that the Working Cash Fund has been paid back
in full and there is no deficit in any account .
POLICE REPORT - Alderman Dollman moved to approve the Police Report as
presented , seconded by Alderman Jahp . Motion carried 6-0 .
PUBLIC WORKS REPORTS - Alderman Jahp moved to approve the Public Works
Reports as presented, seconded by Alderman Harker. Motion carried 6-0.
BEECHER BUILDING REPORT - Alderman Harker moved to approve the Beecher
Building Report and Recreational Director's Report as presented, seconded
by Alderman Jahp . Motion carried 6-0 .
PARK COMMISSION - Alderman Hayden moved to authorize payment of half of the
cost of $ 1750 for painting the tennis court light poles out of Land/Cash
Grant monies, the other half to be paid by the school district. Motion was
seconded by Alderman Dollman. Clerk called the roll as follows :

Motion carried 6-0 .
BEECHER BUILDING ADVISORY COMMITTEE - The proposed Day Care Center
representative is looking into the legalities of having it in the Beecher
Building .
The Lions Club has asked permission to install smoke eaters in the Beecher
Building. The Lions Club has also asked for a list of costs of
maintenance of the Beecher Building. The Treasurer was requested to gather
the information.
HUMAN RESOURCE COMMISSION - Alderman Loebbaka reported that letters have
been sent out for nominations for this years Humanitarian Award.
Alderman Loebbaka requested the press to announce that on May 31 , 1984 at
7-8 p.m., there will be an Accountability Session with the elected
officials of the City in the Daily Room at the Beecher Building.
LIBRARY BOARD - Alderman Hayden reported the next meeting will be May 14 ,
1984 for the election of officers .
YORKVILLE-BRISTOL SANITARY DISTRICT - Alderman Jahp reported the next
meeting is May 21 , 1984 at 7 : 00 p .m. at Dallas Ingemunson ' s office .
OLD BUSINESS - Alderman Loebbaka reported that he has contacted Xerox
regarding a new copier and has selected that company along with Toshiba,
Canon and A.B. Dick to bring copiers with the features the offices are
looking for, to leave for testing and comparison. They will begin to
arrive on Monday, May 14 , 1984 .
Alderman Hayden moved to authorize payment of half of the cost of $ 1750 or
$875 for the City's share in the cost of painting the tennis court's light
poles, the other $875 to be paid by the school district. Alderman Dollman
seconded the motion. Roll call vote was taken as follows :

COMMITTEE MEETINGS
BUILDING & ZONING- Alderman Hayden moved to approve the Foth Subdivision
upon recommendation by the Plan Commission, contingent on their
paying the appropriate filing fees , seconded by Alderman Jahp .
Alderman Dollman amended the motion to include a recorded written
easement to provide for use of the septic field by both lots, seconded byJahp
carried 6-0 .
Clerk called the roll on the motion to approve the Foth Subdivision
providing the appropriate filing fees are paid as follows :

Alderman Dollman moved to waive the permit fee of $25.00 for the Yorkville
School District # 115 , for the purpose of a storage shed addition, seconded
by Alderman Hayden. Roll call vote was taken as follows :

POLICE - Alderman Hayden reported there will be a committee meeting on May
17 , 1984 at 9 : 00 p .m. at the Water Tower .
Chief Randall reported that the Intergovernmental Agreement has been
rewritten and is being sent around for signatures .
Chief Randall commended Officers Siebenaller and Martin for their
assistance in spotting and helping aid persons out of the smoke-filled
building in the downtown area .
WATER - Alderman Loebbaka reported that there will be a committee meeting
on May 17 , 1984 at the Water Tower .
Alderman Loebbaka moved to authorize Baxter & Woodman engineering firm to
do the engineering study of methods of reducing the radium levels in our
water system, not to exceed $6400. The study will relate directly to our
own situation. Motion was seconded by Alderman Hayden. Roll call vote was
taken as follows :

Alderman Loebbaka moved to authorize Baxter & Woodman engineering firm to
do the engineering required for the 12" water main extension from Colonial
Parkway to Fox Industrial Park, the cost not to exceed $750 . Motion was
seconded by Alderman Jahp . Roll call vote was taken as follows :

UTILITIES - Alderman Jahp reported on the May 3, 1984 committee meeting.
Bob Burke submitted a written proposal on the Centrex telephone system.
The matter is being referred to the committee meeting on May 17. 1984 for
further discussion .
Also discussed, was additional lighting for Countryside Center Subdivision .
PUBLIC PROPERTY & BUILDINGS - Alderman Hayden reported that the committee
approved Mary Thomas ' request to put a memorial garden on the library
grounds .
Marci Rogers of the Woman ' s Club presented information and questions for
the City Council regarding the playground they wish to install at the new
library. The City Council requests that she bring back more detailed
plans , and in the meantime the City will check into the insurance coverage .

Alderman Hayden moved to direct Attorney Kramer to draft a letter to the
Yorkville Lions Club be permitted to install smoke filters with the
following provisions :
1 . That the building inspector inspects the installation of the
filters .
2 . That if the Lions Club removed the filters , any damage done is
to be repaired by the Lions Club .
3 . That if they are to be removed the city be able to buy them at
fair market value .
Alderman Dollman seconded the motion. Motion carried 6-0.
FINANCE - Alderman Small presented a letter from PLS Microsystems regarding
a savings of $650, for early payment of the software agreement for the
communications modem to their offices. The purpose would be in saving time
in tracking down any future problems, by being able to transmit over the
lines rather than having a representative come out to check personally .
The agreements and contracts will be looked into.
Alderman Small moved to add the following to section 15, which deals with
payroll clarifications :
1 . Paychecks will be issued no later than 3 : 00 p .m. on payday .
2 . The last day of the month paycheck will include the schooling
and overtime amounts for the current month.
3 . Insurance reimbursement checks will only be issued on paydays
with the paychecks .
4 . No checks will be distributed to individuals . All checks will
will be issued to Department Heads for distribution to
employees .
5 . All dental and vision assistance must be given to the City
Treasurer by April 15 of the current fiscal year .
6 . All of the above will apply unless extraordinary circumstances
prevent them from occurring .
Motion was seconded by Alderman Harker .
Alderman Hayden amended the motion that vacation pay will be paid at the
treasurer ' s discretion. Motion died for want of a second .
Roll call vote was taken on the original motion.

HEALTH & SANITATION - Alderman Dollman moved to pass ORDINANCE NO. 1984-6
entitled "BEING AN ORDINANCE AMENDING ORDINANCE NOS. 8-1975 AND 11- 1978,
CONCERNING THE PROCEDURES FOR THE ADVERTISEMENT, BIDDING, AND AWARDING OF
CONTRACTS FOR THE UNITED CITY OF THE VILLAGE OF YORKVILLE, ILLINOIS",
seconded by Alderman Jahp. This provides for three changes as follows :
1 . Contracts for public improvements up to $4 , 000 do not necessitate
the bidding procedures .
2 . Contracts for labor , services , work, purchase or lease of
materials , equipment or supplies , EXCLUDING public improvement
contracts in excess of $ 10, 000 shall provide for competitive
bidding .
3 . In satisfaction of existing contract or agreements with supplier
or vendors of services , equipment , materials , or work performed,
no competitive bidding is required.

quire approximately 105 H . P. , and looking into the future , a 10 stage
bowl assembly requires 114 H . P. ( should you want to allow for any
future water level recession) , and an 11 stage bowl assembly almost
125 H . P. The submersible motor size would have to be at least 125
H . P. Due to the relatively low extra cost to furnish the 150 H . P .
submersible motor and controls , we would recommend installing the
larger motor.
Installing this larger pump would also require larger power cable and
flat cable for the motor, and probably new motor controls . The pump
should also be lowered an additional 50 ' .

Dear Dr. Scholle:
With respect to the tennis courts, it is the understanding of the City
Council that an agreement has been reached by all of the parties
involved concerning the payment for lighting on the tennis courts. It
is our further understanding that the school district will provide a
letter by its authorized representative stating that the City will be .
granted priority use of the tennis courts during periods when lights
Ag are required for organized activities sponsored by the city. We would
ask that you send that letter to Mayor Robert E. Davidson, Jr. , at
City Hall at your convenience.

LETTER OF UNDERSTANDING
To: Yorkville Community School District #115
NOW COMES the United City of the Village of Yorkville by its duly
authorized agent, and said City does hereby agree that the City will
pay for all light expense charges for the use of the tennis courts
adjacent to the Yorkville Community High School property, so long as
the City of Yorkville receives a right of priority of using said
tennis courts when lights are in effect for organized group activities
at the request of the City.
The United City of the Village of Yorkville further agrees as
follows:
1. That the City shall comply with this agreement unless giving
notice in writing to the school district on or before April
15 of any calendar year that it does not intend to pay for
the lights for the coming tennis season's use.
2. That the City and the school district shall cooperate in
providing a meter and switch system for use on said lights
so that each party can accurately determine the usage of
electricity for operation of the tennis courts.
