City Council Minutes 1984 08-09-84 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY , ILLINOIS , HELD AT CITY HALL ON AUGUST 9 , 1984 . Mayor Davidson called the meeting to order at 8 :00 p.m. and led the council in the Pledge of Allegiance to the Flag . Clerk Erickson called the roll as follows : Ward 1 - Small - Present Jahp - Present Ward 2 - Harker - Present Barkley - Present Ward 3 - Dollman - Present Hayden - Absent Ward 4 - Jennings - Present Loebbaka - Present A quorum was established . MINUTES - Alderman Small moved to waive the reading of the minutes from the July 26 , 1984 meeting , correct the minutes as follows : Page 1 - Attorney ' s Report - Paragraph 1 - line 4 - delete " 19 , 1984" and , Page 2 - Finance - Paragraph 1 - line 2 - delete "$2500" and add "$ 1398" , and to approve said minutes with corrections , seconded by Alderman Jennings . Motion carried 7-0 . BILLS - Alderman Dollman moved to authorize payment of the bills as presented , seconded by Alderman Jahp . Clerk called the roll as follows : Small - Aye Loebbaka - Aye Jahp - Aye Dollman - Aye Jennings - Aye Harker - Aye Barkley - Aye Motion carried 7-0 . Alderman Hayden was absent from voting. MAYOR - Mayor Davidson reported that he and Captain Reuter have contacted the State Game Warden for more input into the situation at the Palmer Dam . There has been no word back on the water tower grant to date . CITY CLERK - Clerk Erickson presented a petition to rezone by the American Legion Post 489 , on behalf of John Conover , from A- 1 to B-3 , in Kendall County, within the City's one and one-half jurisdiction. Alderman Jennings moved to refer the petition to the Yorkville Plan Commission to be placed on their agenda on August 28 , 1984 , seconded by Alderman Barkley . Motion carried 7-0 . Alderman Hayden arrived at the meeting . Alderman Jennings moved to pass ORDINANCE /t84-8 entitled "AN ORDINANCE AMENDING AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE CREATING A SPECIAL PERMIT FOR HANDICAPPED PARKING AND GOVERNING ISSUANCE THEREOF DESIGNATED AS ORDINANCE NO . 1981-3" , seconded by Alderman Jahp . Clerk called the roll as follows : Jahp - Aye Barkley - Aye Small - Aye Dollman - Aye Jennings - Aye Loebbaka - Aye Hayden - Aye Harker - Aye Motion carried 8-0 . Page 2 August 9 , 1984 Alderman Small moved to pass ORDINANCE ##84-9 entitled "AN ORDINANCE TO IMPLEMENT THE FREEDOM OF INFORMATION ACT" , seconded by Alderman Loebbaka . Clerk Erickson reported that bid openings for the 1984 Street Maintenance Program will be August 31 , 1984 at 10 : 00 a .m . at the Water Tower . TREASURER - Alderman Jennings moved to approve the Treasurer's reports as presented , seconded by Alderman Small . Clerk called the roll as follows : Dollman - Aye Harker - Aye Hayden - Aye Jennings - Aye Barkley - Aye Small - Aye Loebbaka - Present Jahp - Aye Motion carried . POLICE REPORT - Alderman Jahp moved to approve the Police Department reports , seconded by Alderman Barkley . Motion carried . PUBLIC WORKS REPORTS - Alderman Barkley moved to approve the Public Works Department reports , seconded by Alderman Jennings . Motion carried . PLAN COMMISSION - The next meeting will be held August 28, 1984 at 7 : 30 p .m. at City Hall . BEECHER BUILDING ADVISORY COMMITTEE - Alderman Jennings moved to adopt the Beecher Building fees as submitted to be effective September 1 , 1984, seconded by Alderman Hayden. Clerk Erickson called the roll as follows : Hayden - Aye Jennings - Aye Harker - Aye Barkley - Aye Small - Aye Dollman - Aye Jahp - Aye Loebbaka - Aye Motion carried 8-0 . Alderman Hayden moved that bookings for the Beecher Building after September 1 , 1984 , be at the new rates , seconded by Alderman Small. Voice vote was taken with 8 ayes , 2 nays cast . Alderman Harker moved thatall events after September 1 , 1984 at the Beecher Building be on the new rates, seconded by Alderman Hayden. Clerk called the roll as follows : Dollman - Aye Loebbaka - Nay Barkley - Aye Small - Aye Harker - Aye Jennings - Aye Hayden - Aye Jahp - Nay Motion carried 5-3 . At the recent meeting, Suzzette Heth ' s job discription was reviewed . Results of the survey will be forwarded to the Committee for review. Mayor Davidson reported that Alderman Hayden will replace Alderman Small as representive for the council . HUMAN RESOURCE COMMISSION - Alderman Loebbaka reported the next meeting will be August 20 , 1984 at 7 : 30 p .m. at the water tower . KENDALL COUNTY EMERGENCY SERVICES & DISASTER - Mayor. Davidson reported that Alderman Jahp will replace Alderman Dollman as representative for the council . Page 3 August 9 , 1984 There will be no meeting in August . PARK COMMISSION - Alderman Harker reported the next meeting will be August 7 , 1984 at the Beecher Building . SENIOR COMMUNITY - Alderman Loebbaka attended a meeting with the Mayor on July 31 , 1984 along with Identa Austin and other senior citizen groups in the area . CITIZEN COMMENTS - Al Spera and Brian Mulhern introduced themselves as guests for the evening . Brian Mulhern expressed his concern regarding the sewer maintenance fee being an unfair fee. He was invited to attend a sewer committee meeting at the water tower on September 20 , 1984 , to discuss the matter in depth at that time . COMMITTEE REPORTS BUILDING & ZONING - Alderman Jennings reported on the August 2, 1984 committee meeting. The swimming pool and fence ordinances were discussed, and given to committee members to review and report back to the committee with their recommendations . Attorney Kramer is checking into parcels of land that are surrounded by the city corporate limits and eligible for annexation . The next meeting will be August 16 , 1984 at 7 : 00 p .m . at the water tower . POLICE - Alderman Harker moved to pass ORDINANCE #84- 10 entitled "AN ORDINANCE PROVIDING FOR 'NO PARKING' ALONG GAME FARM ROAD", seconded by Alderman Jahp . Alderman Jahp withdrew his second to the motion . Alderman Harker moved to pass ORDINANCE. #84- 10 entitled "AN ORDINANCE PROVIDING FOR 'NO PARKING' ALONG GAME FARM ROAD' to include, following "No Parking" zone the words "whether a vehicle is occupied or not". Motion was seconded by Alderman Dollman . Clerk Erickson called the roll as follows : Barkley - Aye Loebbaka - Aye Harker - Aye Hayden - Aye Small - Aye Jahp - Aye Dollman - Aye Jennings - Aye Motion carried 8-0 . PUBLIC PROPERTY & BUILDINGS - Alderman Hayden reported that the committee recommended that the James Clarage payment of $430 be held off until state approval for the building has been received . The air-conditioner at the library is now working . FINANCE - Alderman Small presented the Tax Levy Ordinance for Fiscal May 1 , 1984 to April 30 , 1985 , showing the amount to be collected from the tax levy to be the sum of $240,663.88, a drop of approximately $ 10, 000 from last year . There will be a special meeting to adopt the Tax Levy on September 6 , 1984 at 8: 00 p.m. The scheduled committee meeting will be held following the special meeting . Page 4 August 9 , 1984 Alderman Small moved to adopt RESOLUTION # 1984-118 entitled "RESOLUTION FOR EMPLOYER PAID (PICKED UP) EMPLOYEE COMTRIBUTIONS" (IMRF), seconded by Alderman Jennings . Clerk called the roll as follows : Jahp - Aye Barkley - Aye Small - Aye Dollman - Aye Jennings - Aye Loebbaka - Aye Hayden - Aye Harker - Aye Motion carried 8-0 . SEWER - Alderman Jahp announced the next meeting will be September 20, 1984 . Alderman Jahp moved to adopt "A RESOLUTION APPROVING A SEWER LINE INSTALLATION AND OVERSIZE LINE AGREEMENT" (RE : John Conover ) . Discussion followed regarding a letter of approval from John Conover. Alderman Jahp withdrew his motion . Alderman Loebbaka moved to refer the resolution back to committee meeting to be held August 16 , 1984 at 7 : 00 p.m. at the water tower for further discussion , seconded by Alderman Jahp . Motion carried . TREES & PARKS - Alderman Harker reported that discussion was held on job descriptions and signs at the Palmer dam at the August 2 , 1984 meeting . Director Johnson reported that two signs have been installed at the Palmer dam to date . STREETS & ALLEYS - Alderman Jennings reported on the August 2, 1984 committee meeting. Any city projects will be held off on Game Farm Road until the state is finished with their extensive work to be done in that area . Alderman Jennings moved to pass ORDINANCE # 1984- 11 entitled "AN ORDINANCE REPEALING ORDINANCE 1985-4 CREATING A 'NO PARKING' AREA" (in front of 226 S. Bridge Street where the mailbox used to be). Alderman Hayden seconded the motion . Clerk Erickson called the roll as follows : Dollman - Aye Harker - Aye Hayden - Aye Jennings - Aye Barkley - Aye Small - Aye Loebbaka - Aye Jahp - Aye Motion carried 8-0 . Aldeman Jennings moved to pass ORDINANCE # 1984-12 entitled "AN ORDINANCE ESTABLISHING THE INSTALLATION OF A STOP SIGN AT WEST STREET AND WEST CENTER STREET", seconded by Alderman Hayden. Clerk Erickson called the roll as follows : Hayden - Aye Jennings - Aye Harker - Aye Barkley - Aye Small - Aye Dollman - Aye Jahp - Aye Loebbaka - Aye Motion carried 8-0 . Alderman Jennings moved to authorize payment of $3, 000 and not more than $ 5 , 000 of MFT funds for working with the Kendall County Highway Department in repairing of Fox Road , seconded by Alderman Small . Clerk Erickson called the roll as follows : Harker - Aye Barkley - Aye Jennings - Aye Jahp - Aye Loebbaka - Aye Hayden - Aye Dollman - Aye Small - Aye Motion carried 8-0 . HEALTH & SANITATION - There will be a meeting on August 16, 1984 at 9: 00 p.m. to discuss the garbage contract. Attorney Kramer is asked to be present . Page 5 August 9 , 1984 Alderman Loebbaka moved to pass ORDINANCE 11984- 13 regarding adoption of the Kendall County Health Department's Food Service Ordinance, with the following changes : Page 1 - Par . A - delete "%" and add "points" following 70 . Page 2 - Par . B - change date from August 8 to August 9 . Alderman Jennings seconded the motion. Clerk Erickson called the roll as follows : Dollman - Nay Loebbaka - Aye Barkley - Aye Small - Nay Harker - Aye Jennings - Aye Hayden - Aye Jahp - Aye Motion carried 6-2 . LIBRARY BOARD - Alderman Hayden reported the next meeting will be August 13 , 1984 at the Yorkville Public Library . YBS BOARD - Alderman Jahp reported the next meeting will be September 17 , 1984 at 7 : 00 p .m. at Dallas Ingemunson ' s office at 7 : 00 p .m. CHAMBER OF COMMERCE - Alderman Barkley thanked Sandy Waclaw & Jean Mahaney for their work on the new Chamber of Commerce booklet.
