City Council Minutes 1984 09-27-84 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON
`SEPTEMBER 27 , 1984 .
Mayor Davidson called the meeting to order at 8 :00 p.m. and led the council
in the Pledge of Allegiance to the Flag .
Clerk Erickson called the roll as follows :
Ward 1 - Small - Present
Jahp - Present
Ward 2 - Barkley - Present
Harker - Absent (arrived later )
Ward 3 - Dollman - Present
Hayden - Present
Ward 4 - Loebbaka - Present
Jennings - Present
A quorum was established .
Guests included 3 Boy Scouts who were working in their badges, and
residents objecting to the Petition by the American Legion Post 489
requesting rezoning of a parcel of property on Route 34 that lies south of
their subdivision .
Alderman Dollman moved to waive the reading of the September 13, 1984
minutes and approve minutes with the following addition :
Page 1 - Mayor ' s Report - Line 3 , add "Motion carried" .
Alderman Jennings seconded the motion. Motion carried .
ATTORNEY ' S REPORT - Attorney Kramer reported the Tri-County Scavenger
report is being studied and will be brought back to the next meeting .
Alderman Dollman moved to adopt RESOLUTION # 1984-119 entitled "A RESOLUTION
APPROVING FINAL PAYOUT ON YORKVILLE PUBLIC LIBRARY", that authorizes
payment to Perkins Builders in the amount of $3, 719.50 and to James B.
Clarage in the amount of $620 . 00 . Motion was seconded by Alderman Hayden.
Clerk called the roll as follows :

Motion carried 7-0 .
Attorney Kramer explained the pending Getto case vs . several munipalities ,
claiming that utility taxes were overcollected by municipalities . The
amounts affecting the City of Yorkville are $2, 426.79-Illinois Bell
Telephone , $ 1820 . 00-Northern Illinois Gas . An answer will be prepared by
October 15 , 1984 , but Attorney Kramer would like to find out more
information at the Illinois Municipal League Conference regarding what
other municipalities are doing . The municipalities will not be required
to pay any money out of their funds , but the utility companies involved
will reduce the amount over a period of approximately 3 years , from the
franchise fees . Discussion will be held at the October 4 , 1984 meeting .
Alderman Harker arrived .
Attorney Kramer reported that the judge has dismissed the suit regarding
the end of Madison Street , being an appeal had not been filed .
MAYOR ' S REPORT - Mayor Davidson made public apology to Suzzette Heth for
requesting reports at the September 13, 1984 meeting that had been
received , or were not yet due .
Mayor Davidson read a proclamation declaring October 12 & 13 , 1984 as
Lions Candy Day , to help the visually handicapped .
CITY CLERK - Clerk Erickson reported that the majority of the bills were
ready to be mailed out and a time account was kept. From the time the
meter reading books were received from the Public Works crew until the
bills were stamped it took 15 actual hours with the aid of the computer ,
13 being computer work , and 2 hours of manual work , in comparison of 2
weeks of 5-6 hours a day spent on doing the water bills manually
previously. The problems with the computer were almost eliminated with
this billing, but will take another one or two billings to have it
perfected .

RECREATION DEPARTMENT REPORT - Alderman Small moved to approve the
report of the Recreation Department, seconded by Alderman Jennings. Motion
carried .
BEECHER BUILDING REPORT - Alderman Small moved to approve the report of the
Beecher Building Coordinator , seconded by Alderman Barkley .
PLAN COMMISSION - Alderman Jennings reported on the September 25, 1984
meeting. The Fencing Ordinance & Swimming Pool Ordinance were discussed,
along with the non-conforming B-2 zoning along S . Bridge St . (Rt . 47 ) .
The American Legion ' s petition to rezone will be covered under Building &
Zoning .
HUMAN RESOURCE COMMISSION - Alderman Loebbaka reported on the September 17 ,
1984 meeting. Discussed was income tax help, the Sesquecentennial , and the
blood drive that brought in 90 units of blood .
KENDALL COUNTY EMERGENCY SERVICES & DISASTER - Alderman Jahp reported on
the September 20 , 1984 meeting he attended on hazardous materials control .
A letter was received from Kendall County that effective 12/31 /84, they
will no longer be paying the electric bill for the emergency siren. The
matter will be discussed at the next committee meeting. The siren is
owned by the county, and placed on city property .
TENNIS COURTS - Alderman Hayden reported that the lights on the tennis
courts have been adjusted , but the light bulbs are still out .
COMMITTEE REPORTS
BUILDING & ZONING - Alderman Jennings reported on the September 18, 1984
meeting , regarding the American Legion Post 489 ' s Petition to Rezone and
the adjacent property owners .
Alderman Jennings moved to send a letter to the Kendall County Board
stating the City Council recommends denial of the Petition of the American
Legion Post #489 to rezone a parcel of land from A- 1 to B-3 , within the
mile and a half jurisdiction of the City of Yorkville , motion seconded by
Alderman Loebbaka . Roll call vote was taken as follows :

Small - Aye Jahp - Aye Hayden - Aye
Harker - Aye Dollman - Aye
Motion carried 8-0 .
POLICE - Chief Randall expressed his feelings on his recent attendance of
11 weeks of management training at the FBI Training Academy .
WATER - Alderman Loebbaka announced a meeting for October 4, 1984 at 8: 00
p .m. at the water tower .
Alderman Loebbaka stated the water tower weill be painted on the inside
only. The tower will be drained for approximately 3 days .
UTILITIES - Alderman Barkley called a meeting for October 4, 1984 at 8: 00
p .m. at the water tower .
Centel Cable was notified to have a representative present , but no acknow-
ledgment has been received to date .
Director Johnson will request a representative of Centrex to be present ,
also .
FINANCE - Alderman Small reported on the September 20, 1984 meeting.
Discussed was the taxing process of the library and how it relates to the
city process .
The purchase of additional fire-proof filing cabinets was discussed .
There is a Revenue Sharing Handicapped Report to be completed by the City

Treasurer and submitted by October 15 , 1984 to the State of Illinois .
Vacation policy was discussed , after which Alderman Small put together a
clarification to be reviewed , and any comments forwarded .
HEALTH & SANITATION - Alderman Loebbaka moved to amend the Restaurant
Food & Sanitation Ordinance with the following additions :
1 . The Health and Sanitation Committee can close a business for
three or more days if it received a score below 70 points for
the consecutive inspections by the Kendall County Health
n j Officer .
2 . Authority and responsibility for the Cit Lof Yorkville
representatives are defined for such a closing as well as
instructions for the business owner to obtain a hearing.
Motion was seconded by Alderman Jahp . Roll call vote was taken as follows :

Motion carried 6-2 .
Alderman Loebbaka requested the Clerk to make copies of the inspection
notices upon receival from the Kendall County Health Officer .
STREETS & ALLEYS - Alderman Jennings announced the next committee meeting
will be held October 4 , 1984 at 7 : 30 p .m.
Alderman Jennings reported the Aurora Blacktop Street Maintenance Program
was approved by IDOT and will begin by approximately next week.
YBS BOARD - Alderman Jahp announced the next meeting will be October 15 ,
1984 at Dallas Ingemunson ' s office at 7 : 00 p .m.
No decision was made on getting together with the city regarding the SSES
Grant .
CHAMBER OF COMMERCE - Alderman. Barkley reported that the Crime Stoppers are
in need of volunteers . Anyone interested is to get in touch with Rick
Doetschman .
The Chamber of Commerce would like to get together with other organizations
to install entrance signs to the City , to be possibly worked in with
conjunction of the Sesquecentennialf .
The Chamber of Commerce voted to donate to the City' s Halloween party to be
held at the Beecher Building with Suzzette Heth in charge of it .
Alderman Jennings moved to adjourn the meeting, seconded by Alderman Jahp .
