City Council Minutes 1983 03-10-83 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS , HELD AT CITY HALL
ON MARCH 10 , 1983.
Preceding the regular meeting , the candidates from Student Government
Day held their own "Mock City Council Meeting" . ( **See attached copy)
Mayor Thanepohn called the regular meeting to order at 8 : 00 P.M. and
led the council in the Pledge of Allegiance to the Flag.
Clerk Erickson called roll as follows :

Simmons - Absent
A quorum was established. Mayor Thanepohn reported that Alderman
Dollman is recouperating from a mild heart attack and Treasurer
Marilyn Merkel has had major surgery.
Alderman Jennings moved to waive the reading of the minutes from
the February 24 , 1983 meeting and to approve the minutes as presented,
seconded by Alderman Pierce . Motion carried 6-0.
The reading of the bills was waived. Alderman Tilton moved to
authorize payment of the bills presented, seconded by Alderman
Jennings . Roll call vote was taken as follows :

Motion carried 6-0 . Aldermen Dollman and Simmons were absent
from voting.
Alderman Jennings moved to approve the following three additional
bills and authorize them for payment :
1. Big T Family Restaurant - food for Student Government
Day - $69 .60
2 . James B. Clarage & Associates - architects fees
for the new library - $1036 . 00
3. Perkins Builders - Contractors fees for new library-
$9 ,637. 29
all to be paid from the General Fund. Motion was seconded by
Alderman Pierce . Roll call vote was taken as follows :

ATTORNEY' S REPORT - Alderman Beach moved to adopt RESOLUTION #91-1983
entitled "A RESOLUTION OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE
AUTHORIZING CONVEYANCE OF CERTAIN REAL ESTATE OF THE STATE OF ILLINOIS
IN DXCHANGE FOR LAND, PROPERTY AND MONEY" (re : new bridge) , seconded
by Alderman Pierce . Roll call vote was taken as follows :

Alderman Jennings moved to pass ORDINANCE #1983-6 entitled "AN
ORDINANCE REPEALING AN ORDINANCE RETAINING RETAILOCCUPATIONAL
TAX ACT , SERVICE OCCUPATION AND USE TAX IMPOSED UPON CERTAIN
FARM MACHINERY, seconded by Alderman Small. Roll call vote was taken
as follows :

MAYOR' S REPORT - Mayor Thanepohn reported on the meeting with the
County regarding Business & Economic Development which was very
encouraging for the future developments in the area.
CITY CLERK - Clerk Erickson reported the Revenue Sharing Public
Hearing is scheduled for Thursday , March 24 , 1983 at 7 : 30 P .M.
preceding the regular City Council meeting.
TREASURER - Alderman Tilton moved to approve the Treasurer ' s Report
as presented, seconded by Alderman Jennings . Motion carried 6-0 .

POLICE - Alderman Small moved to approve the Police Department reports
as presented , seconded by Alderman Pierce . Motion carried 6-0 .
ADMINISTRATIVE ASSISTANT - Alderman Jennings moved to approve the
reports of the Administrative Assistant , seconded by Alderman Small.
Motion carried 6-0 .
HUMAN RESOURCE COMMISSION - The next scheduled meeting will be March 21,
1983 at 7 : 30 P. M. at the Water Tower.
EMERGENCY MEDICAL SERVICE - Alderman Pierce reported that approximately
40 attended the EMS seminar held at the Beecher Building on March
5 , 1983.
KENDALL FAMILY & YOUTH SERVICES - Alderman Pierce reported that
approximately 224 families received butter & cheese that was distributed.
CITIZEN COMMENTS - Robert Davidson spoke to the council regarding Wild-
wood Subdivision land trust & owners . Attorney Dickson responded that
a copy of a letter showing Wildwood Farms , Inc. as beneficial owners
of the = tris!t,-will be in the Clerk 's office on file to comply with
State Statutes .
OLD BUSINESS - (Wildwood Subdivision) - Attorney Ingemunson , on behalf
of The Northern Trust representatives , agreed to remove reference
to water tower construction costs from the Annexation Agreement. The
costs will be negotiated with the owners at the time of development.
Attorney Dickson stated that the City was not obligated for construction
off-site or on-site regarding water & sewer and that any industrial
areas could not be developed as the present areas do not meet the fire
flowage needs at this time .
COMMITTEE REPORTS
BUILDING & ZONING - Administrative Assistant Madden reported that
building may well be on the upward trend according to reports by
lending institutions and real estate companies .
POLICE - Alderman Small reported on the March 3 , 1983 committee
meeting.
Officer Sibenaller has been appointed as Youth Officer.
Alderman Small moved to direct Attorney Dickson to draft a Resolution
regarding organizational structure of the Police Department in reference
to making the offices of Captain and Sergeant permanent , seconded by Alder-
man Pierce . Roll call vote was taken as follows :

FINANCE - Alderman Tilton reminded the committee chairmen to get

Policy for fiscal year 1983-84 , seconded by Alderman Jennings .

Alderman Tilton called for an Executive Session regarding personnel
following the regular meeting.
STREETS & ALLEYS - Alderman Harker reported the E. Van Emmon Street
MFT Bid Opening Date is March 15 , 1983 at 10 :00 A.M.
HEALTH & SANITATION - Alderman Beach reported that the Committee meeting
scheduled for March 17 , 1983 for Health & Sanitation & Trees & Parks
committees is cancelled. The meeting will stay on the agenda for anyone
wishing to utilize the evening for a meeting.
LIGHTS TELEPHONE , GAS & CABLE TV - Alderman Pierce reported the Lions
Club wishes to purchase a sign to use for advertising Bingo and to
also use for display of other activities at the Beecher Building.
The matter was referred to committee for further discussion on
March 17 , 1983 .
LIBRARY BOARD - Alderman Jennings moved that on committee recommendation
the low bids of General Sales Co. of Aurora and Valley Office & Educational
Products of Aurora along with the additional items not bid on the Library

Dear Elden :
Under provisions of the City-State Agreement dated
December 19, 1980 and the Addendum to Agreement dated
January 13, 1983, title to the 2,582 square feet of
ci +y owned library property needed for the highway
improvement will be deeded to the State upon final
payment to the city of the engineering and construction
costs of the new library. Compensation by the State
for the city property will be an equivalent interest
in land (7,490 sq . ft. of the former Schneider Hardware
property ) plus the sum of $1 , 560.
Anticipating the new library will be completed in the
next three months , I am enclosing an original and
one copy of the following documents for your review
and approval :
1 . Quitclaim Deed for Parcel No. 3BA0004 to be
conveyed to the State. We will need a Municipal
Corporate Resolution prepared by the city authorizing
the conveyance and the authority for the Mayor
to sign and City Clerk to attest.
2. Receipt for Quitclaim Deed.

4. Commitment for Title Insurance prepared by Pioneer
National Title Insurance Company.
5. Proposed Quitclaim Deed from State of Illinois
conveying title to the city of Yorkville the 7,490
sq . ft. no longer needed for highway purposes .
Provided the above documents meet with city approval ,
executed copies of items 1 , 2, and 3 will be required
in order to secure title approval from the Attorney
General ' s office . For item 5 approval , please indicate
on the document "Approved as to Form" plus a signature.
Following receipt of the executed documents , it will take
us approximately two months to obtain title approval ,
process a warrant for $1 ,560 and execute our Quitclaim
Deed.
I am also enclosing a Temporary Construction Easement
covering the 7,490 sq . ft. of property to be quitclaimed
1-o the city. Since title will be in the name of the city,
this will allow the State and its contractor to use
the property for the duration of the highway improvement.

1. WAGES

1-a. The council may , because of prior experience accelerate
the duration of employment schedule for an individual
secretary upon the recommendation of the appropriate
Department Head.
1-b. For each accredited course , recommended by the
appropriate Department Head and approved by the appropriate
committee , an additional $5 .00 per month will be added to
the individuals base pay.
1 7c. All Secretaries shall receive a longevity incentive pay
(based on wage schedule attached) as follows :
a. After seven years service - 2% of amount A-1-F
b. After ten years service - 3% of amount A-1-F
c. After fifteen years service - 4% of amount A-1-F

2 . PERSONNEL POLICY
1. VACATION
A. Full-time Secretary employee will be entitled to the
following vacation time :
1. One ( 1) year through five (5) years -- 2 weeks

B. One week of vacation may be carried forward to the
next year. This is not cumulative.

3. SICK LEAVE
Each full-time employee shall receive one (1) sick leave day
per month , cumulative to ninety (90) days . TO BE USED FOR SICK
LEAVE ONLY. Any absence for more than three (3) consecutive
days may require a verification from your doctor.
4 . SCHOOLS AND CONFERENCES
A. Required Courses :
The City will pay all expenses including wages at "regular"
pay , travel , and tuition for any full-time employee enrolling
in required courses . Such expense must be approved by the
City Council prior to their incurrence .
B. Elective Courses :
The City may pay all expenses of an elective course. The
City Council must approve the course in advance of the
employee ' s enrollment. If_ approved, payment of one-half
of the tuition will be paid to the employee at the time of
her registration and the other one-half will be paid to the
employee upon evidence that the course has been satisfactorily
completed.
THE CITY COUNCIL will decide which courses are required and
which are elective.
5. ULT I FO RMS
Uniforms will be furnished by the City to all full-time employees .
All costs of such uniforms mast be approved by the appropriate
department heads in advance of their purchase.
6 . PERSONAL TIME OFF
Personal time away from the job may be granted at the discretion
of the appropriate department heads . The department head shall make
the judgment as to whether the time off is paid, unpaid, or whall
be made up.
7. DENTAL ASSISTANCE
A. Employee and dependents will receive the following Dental
Assistance.
1. Employee $100 .00 per year
Dependents 75 .00 per year
NOTE : An employee may opt to utilize an eligible coverage
for himself and/or his dependents , for one or more
individuals of his family.
B. Bills must be paid by employee , and employee will be reimbursed.

WAGE SCALE & PERSONNEL POLICY
1983
1. WAGES:
A. PATROLMAN
1. Duration of Employment Base Salary Per Month
a) 0 to 1 year $ 1,422.00
b) 1 to 2 years $ 1,590.00
c) 2 to 3 years $ 1,679.00
d) 3 years and beyond $ 1 ,782.00
e) Captain - $120.00 per month over base salary
f) Sergeant - $60.00 per month over base salary
2. Wages shall be awarded in the following manner: At the beginning
of each fiscal year (May 1st) , all employees of the Yorkville
Police Department will elevate to the newly approved base in each
individual's particular duration of employment (see schedule) .
Upon completion of a full year's employment, and on the employee's
anniversary date (date of employment) , the employee will accelerate
to the next level of time and wages as set forth in the Duration
of Employment Schedule.
3. The Council may, because of prior experience, accelerate the Duration
of Employment Schedule for an individual partrolman, upon the request
of the Chief of Police.
4. For each accredited police service course, recommended by the Chief
of Police and approved by the Police Committee, an additional five
($5.00) dollars per month may be added to the individual's base salary.
This paragraph is applicable to courses taken prior to May 1, 1983.
B. All Police Department employees shall receive a longevity incentive pay
as follows:
1. After 5 years service - 2% of amount in A-1-d
2. After 10 years service - 3% of amoung in A-1-d
3. After 15 years service - 4% of amount in A-1-d
4. After 20 years service - 5% of amount in A-1-d
Exception: Department heads will receive an agreed upon salary
with no longevity percentages involved.

2. VACATION:
Each full-time employee of the Yorkville Police Department shall be entitled
to the following vacation time:
a) One (1) year through five (5) years - 2 weeks vacation
b) Six (6) years through ten (10) years - 3 weeks vacation
c) After ten (10) years - 4 weeks vacation
3. PAID HOLIDAYS:
There shall be nine (9) paid holidays each year for all employees of the
Yorkville Police Department:
1. New Year's Eve Day
2. New Year's Day
3. Easter
4. Memorial Day
5. Independence Day
6. Labor Day
7. Veteran's Day
8. Thanksgiving Day
9. Christmas Day
4. SICK LEAVE:
Each full-time employee of the Yorkville Police Department shall be entitled
to paid sick leave at the rate of one (1) day per month cumulative to 120 days.
Sick leave may be used for sick leave only. Any absence from work for a period
of longer than three (3) consecutive days may require verification from a medical
doctor.
5. SCHOOLS AND CONFERENCES:
The policy governing employee attendance at schools and conferences has been
divided into two (2) areas: Required and Elective courses.
a) Required Courses - The City will pay all expenses including wages, travel,
and tuition for any full-time employee enrolling in a required course. Such
expense must be approved by the City Council prior to their incurrence.
b) Elective Courses - See attached Schedule "A", Academic Assistance -
City of Yorkville.
6. UNIFORMS:
Uniforms will be furnished by the City to .all full-time employees. All costs of
such uniforms must be approved by the City Council in advance of their purchase.

7. PERSONAL TIME OFF:
Personal time away from the job will be granted at the discretion of the
department head. The department head shall make judgment as to whether
the time off is paid, not paid, or shall be made up.
8. MISCELLANEOUS BENEFITS:
A. Dental Assistance:
1) Employees and dependents will be eligible for Dental Assistance at
the rate of $100.00 per year maximum for employee and $75.00 maximum
per year for each dependent.
2) Bills must be paid by the employee, and the employee will be reimbursed.
Reimbursement requests must be approved by the Chief of Police.
Note: An employee may opt to utilize an eligible coverage for him-
self and/or his dependents for one or more individuals of his
family.
B. Vision Assistance:
1) Employees and dependents will be eligible for Vision Assistance at
the rate of $100.00 per year maximum for employee and $75.00 maximum
per year for each dependent.
2) Bills must be paid by the employee, and the employee will be reimbursed.
Reimbursement requests must be approved by the Chief of Police.
Note: An employee may opt to utilize an eligible coverage for him-
self and/or his dependents for one or more individuals of his
family.

SCHEDULE "A"
ACADEMIC ASSISTANCE - CITY OF YORKVILLE
ASSOCIATE IN ARTS/SCIENCE
An employee of the City of Yorkville who has obtained an Associate's Degree
or the equivalent thereof in semester hours or quarter hours shall receive an increase
of 2% of his base salary as incentive pay from the City of Yorkville for educational
assistance.
BACHELOR OF ARTS/SCIENCE
An employee of the City of Yorkville who has obtained a Bachelor's Degree
or the equivalent thereof in semester hours or quarter hours shall receive an increase
of 4% of his base salary as incentive pay from the City of Yorkville for educational
assistance.
MASTER OF ARTS/SCIENCE
An employee of the City of Yorkville who has obtained a Master's Degree
shall receive 5% of his base salary as incentive pay from the City of Yorkville
for educational assistance.

All Community Colleges, Colleges and Universities must be accredited by one
or more of the following:
*The International Accrediting Commission for Schools, Colleges and
Theological Seminaries
*The National Council for Accreditation of Teacher Education
*The Illinois State Board of Education
*The North Central Association of Colleges and Schools
Colleges and Universities that are accredited by other Accrediting Commissions
outside the State of Illinois will qualify for academic assistance.

B. 12 to 24 months 1,490.00
C. 24 to 36 months 1,612.00
D. 36 and beyond 1,745.00
E. PUBLIC WORKS FOREMAN $100.00 per month over Base Salary
F. Part-time help
1-a. The council may, because of prior experience, accelerate the 1-A-1
schedule for any employee upon recommendation of the Director of Public
Works.
1-b. For each accredited course, recommended by the Director and approved by
the Council, to receive $5.00 per month added to the employee base pay.
B. All Public Works Department regular employees receive longevity as
follows:
1. After 5 years service - 2% of amount A-1-D, i.e. $34 .90
2. After 10 years service - 3% of amount A-1-D, i.e. 52.35
3. After 15 years service - 4% of amount A-1-D, i.e. 69.80
4. After 20 years service - 5% of amount A-1-D, i.e. 87 .25
Exception: Department Heads will receive an agreed
upon salary with no longevity involved.
PERSONNEL POLICY
1. VACATION
A. Full-time Public Works employees are entitled to the following
vacation time:
1. One (1) year through five (5) years -- 2 weeks
2. Six (6) years through ten (10) years -- 3 weeks
3. Ten (10) years and beyond 4 weeks
B. One week of vacation may be carried forward to next year.
This is not cumulative.

3. SICK LEAVE
Each full-time employee shall receive one (1) sick leave day per. month,
cumulative to ninety (90) days. TO BE USED FOR SICK LEAVE ONLY. Any
absence for more than three (3) consecutive days may require a
verification from your doctor.
4. SCHOOLS AND CONFERENCES
A. Required Courses:
The City will pay all expenses including wages at "regular" pay,
travel, and tuition for any full-time employee enrolling in required
courses. Such expense must be approved by the City Council prior to
their incurrence.
B. Elective Courses:
The City may pay all expenses of an elective course. The City
Council must approve the course in advance of the employee's
enrollment. If approved, payment of one-half of the tuition will be
paid to the employee at the time of his registration and the other
one-half will be paid to the employee upon evidence that the course
has been satisfactorily completed.
THE CITY COUNCIL will decide which courses are required and which
are elective.
5. UNIFORMS
Uniforms will be furnished by the City to all full-time employees. All
costs must be approved by the Director of Public Works in advance of
their purchase.
