City Council Minutes 1983 05-26-83 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS, HELD AT CITY HALL ON MAY 26 , 1983. Mayor Davidson called the meeting to order at 8 :00 P .M. and led the Council in the Pledge of Allegiance . Clerk Erickson called roll as follows : Ward 1 - Small - Present Ward 3 - Hayden - Present Jahp - Present Dollman - Absent Ward 2 - Harker - Present Ward 4 - Loebbaka - Present Tilton - Present Jennings - Present A quorum was established. Alderman Jennings moved to waive the reading of the minutes from the May 12 , 1983 meeting, and approve minutes as presented, seconded by Alderman Small . Motion carried 7-0 . ATTORNEY ' S REPORT - Attorney Kramer reported on the City' s rights and procedures regarding demolition of property. There is the common law nuisance theory with voluntary compliance by property owners . Also, there is a State Statute in conjunction with the Health Dept. to demolish by the City and then file lien against the property owner for expenses incurred. Attorney Kramer reported that "reasonable distance" was the question regarding the sewer problem and would require a legal decision through process of the courts . MAYOR' S REPORT - Alderman Jennings mbved to approve Mayor Davidson' s appointment of Tom Burgholzer as CoardiA4krof the Kendall County Emergency Services & Disaster , seconded by Alderman Harker. Motion carried 7-0 . BRISTOL-KENDALL FIRE DISTRICT - Alderman Harker reported that the new 3000 gallon tanker is due in any day. Work is being gone on a plan to utilize when the bridge construction is in the process . There will be a fire equipment and ambulance equipment on both sides of the bridge . CITIZEN COMMENTS - Jim Olson of the Lions Club presented the City with a plaque for 3rd place in the Governor' s Hometown Awards , for the Lions Club swimming pool. OLD BUSINESS - Alderman Jennings moved to reconsider the motion made at the City Council meeting of May 12 , 1983 , as follows : "Alderman Jennings moved to approve Mayor Davidson ' s appointments to the following Commissions for the City of Yorkville , seconded by Alderman Harker : Business &Economic Development - 3 year term - Rodney Olson Al Rabe and reappoint - Sue Thanepohn Human Resource Commission - 3 year term - Leone Olson (Reappointment) Leo Sebby Park Commission - 3 year term - Joyce Ward (Reappointment) . Bob McNelis Candy Barkley Zoning Borad of Appeals - 5 year term - Martin Behrens (Reappointment) James Mauser Plan Commission - 4 year term - Jerry Groner Bert Erickson George Stewart Harlan Johnson Library Board - 3 year term - Martin Behrens (Reappointment) Mary Olson due to the appointments not meeting the Sandy iirementstof the Ordinances . Motion was seconded by Alderman Small. Motion carried 7-0 . Attorney Kramer stated that in such a case there are three alternatives. They are to reconsider the entire motion , voluntary tender of resignation , and amending of the Ordinance . NEW BUSINESS - Ron Cobb spoke to the Council regarding Badger Street deterioration in Fox Industrial Park and zoning violations . Discussion followed. A date will be set for a meeting between the developers and the City. Alderman Harker will set up the meeting with appropriate representatives and advise City Council of the time and date. Page 2 May 26 , 1983 Mayor Davidson and Administrative Assistant Madden will attend a pre- construction meeting regarding the new bridge at Ottawa' s IDDT on May 27 , 1983. Alderman Harker reported on the meeting with George Bell and Kendall County Board member Lee Hill regarding the drainage area south of Elizabeth Street. Alderman Harker moved to authorize Attorney Kramer to draft a resolution requesting the Kendall County Board to delay their decision to be made June 14 , 1983 , on the property south of Elizabeth Street where the farm equipment sales building is to be erected, so that the city may have the opportunity to look into the overall development plan of the property. Motion was seconded by Alderman Jennings seconded the motion. Motion carried 7-0 . Mayor Davidson stated that he received a letter of resignation from the Library Board from Alderman Jennings . Alderman Jennings moved to accept the resignation of Alderman Jennings as a voting member of the Library Board and to approve the appointment of James Hayden as a voting member of the Library Board to serve out the term until 1985 . Alderman Hayden seconded the motion. Motion carried 7-0 . COMMITTEE REPORTS WATER - Alderman Loebakka reported that a short letter will be put into the next water bills with explaination regarding the increase water rates . POLICE - Alderman Harker reported there will be a meeting June 6 , 1983 at the Water Tower ,between the Police Committee , Chief and Mayor of Yorkville and Plano' s Mayor and Safety Committee regarding Call Forwarding. Chief Randall reported there will be a Bike Rodeo & Registration on June 4 , 1983 and again on June 11 , 1983, with Sargeant Millen and Officer Sibenaller in charge. Chief Randall reported that the civil liability suit against two officers has been settled and dismissed in Chicago on May 17 , 1983. PUBLIC PROPERTY & BUILDINGS - Discussion was held regarding the cost of half ($17 ,000) the cost of the parking lot west of the football field. It will be further discussed at the committee meeting on JUne 2 , 1983 . FINANCE - Alderman Small reported that in accordance with the 1983-84 Personnel Policy of the Police Department, and following review by Alderman Tilton , Chief Randall and Officers Barna, Kennedy & Calvert have qualified for academic assistance, retroactive to May 1 , 1983. STREETS & ALLEYS - Alderman Harker reported that E. Van Emmon Street project is waiting on the concrete workers to finish. HEALTH & SANITATION - Alderman Jennings moved to pass ORDINANCE #1983-9 entitled "AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE DECLARING CERTAIN WEEDS , ETC. , A NUISANCE , REGULATING THE HEIGHT THEREOF , AND PRESCRIBING PENALTIES FOR FAILURE TO CONTROL" , seconded by Alderman Harker. Roll call vote was taken as follows : Hayden - Aye Loebbaka - Aye Small - Aye Jennings - Aye Harker - Aye Jahp - Aye Tilton - Aye Motion carried 7-0 . LIGHTS , TELEPHONE , GAS & CABLE TV - Administrative Assistant Madden reported that the superintendent of the Cable TV Co. will get in touch with Mr. MIdden ahead of time to set up a time to walk the line to check on the yards that will need repair. LIBRARY BOARD - Their meetings are the 2nd Monday of the mtnth , the next meeting being June 13 , 1983. Alderman Jennings moved to adjourn the meeting , seconded by Alderman Jahp. Motion carried 7-0 .
