City Council Minutes 1983 07-14-83 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON JULY 14, 1983 . Mayor Davidson called the meeting to order at 8 :00 P.M. and led the council in the Pledge of Allegiance. Clerk ERickson called the roll as follows : Ward 1 - Jahp - Present Small - Absent Ward 2 - Tilton - Absent Harker - Present Ward 3 - Dollman - Present Hayden - Present Ward 4 - Jennings - Present Loebbaka - Present A quorum was established. Alderman Harker moved to waive the minutes rom the June 23 , 1983 meeting and approve as presented, seconded by Alderman Jennings . Motion carried 6-0 . Alderman Jennings moved to authorize payment of the bills as presented, seconded by Alderman Jahp. Roll call vote was taken as follows : Jahp - Aye Harker - Aye Jennings - Aye Dollman - Aye Loebbaka - Aye Hayden - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. ATTORNEY ' S REPORT - Alderman Dollman moved to adopt RESOLUTION # 101-83 ,& authorizing the Mayor and City Clerk to sign , an intergovernmental AOLiC6/}e� agreement establishing a mobile team in-service training unit. Motion was seconded by Alderman Jennings . Roll call vote was taken as follows : Hayden - Aye Harker - Aye Jennings - Aye Dollman - Aye Loebbaka - Aye Jahp p Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Harker moved to recirculate the "Agreement fbr Intergovernmental Cooperative Police Services" to include the Village of Montgomery , seconded by Alderman Jahp. Roll call vote was taken as follows : Dollman - Aye Jahp - Aye Harker - Aye Loebbaka - Aye Hayden - Aye Jennings - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Discussion was held on amending the Water Ordinance of October 1974, Section 1 , to include the Director of Public Works . Attorney Kramer will get together with Public Works Director Johnson to discuss other changes to incorporate in one amendment. Attorney Kramer reported that liens will be filed on the properties of two water customers for seriously overdue water bills . A letter was read from Mr. Hayes of W. Kendall Drive in Countryside Center thanking the City and Centel Cable. TV for the attention given to the damage done on his property. The owners of the "McHugh Property" , Mr. & Mrs . Leon Brummel, were requested by letter to fill in the cistern in the pit and to board up or demolish the hazardous buildings on the property. Attorney Kramer reported that the Rights and Responsibilities of the Aldermen report was not completed to date . Alderman Jennings moved to authorize the City Collector to sign the liens against the properties for uncollected water accounts , seconded by Alderman Loebbaka. Motion carried 6-0 . MAYOR' S REPORT - Mayor Davidson received a request from ST. Patrick ' s Catholic Church regarding a raffle ordinance which the City does not have at present time . The matter was referred to the Future Planning Committee for further study. Attorney Kramer read the Proclamation of the Mayor and City Council for Appreciation to Bristol-Kendall Fire Department for the 4th of July preparations of parade and other activities . Alderman Jennings moved to approve the Proclamation , seconded by Alderman Harker. Motion carried 6-0 . Mayor Davidson reported that city sticker sales were running short from last year' s sales . Page 2 July 14 , 1983 CITY CLERK - Clerk reminded the council of the Annual Illinois Municipal League Conference to be held in Chicago, September 30 - October 3 , 1983. Reservations can be made through the Clerk BEFORE Auy-u �lst 1, 1983 . Alderman Jennings move4 to approve the request of the New Life Assembly c Church to hold it' s annual Festival of Praise on August 7 , 1983 from 5 :00 to 8 :00 p.m. in the Yorkville City Park , seconded by Alderman Jahp. Motion carried 6-0 . Clerk Erickson reported that a liquor license has been issued to Shar Corporation , known as "Azem"s FSmily Restaurant" , with $375 Restaurant Class fee & certificate of insurance being received. Licesnse is effective July 15 , 1983 . TREASURER - Alderman Harker moved to approve the Treasurer' s Report, seconded by Alderman Jennings . Roll call vote was taken as follows : Harker - Aye Jennings - Aye Hayden - Aye Dollman - Aye Jahp - Aye Loebbaka - Aye Motion carried 6-0 . Aldermen Small & Tilton were absent from voting. POLICE - Alderman Jennings moved to approve the Police Department reports , seconded by Alderman Jahp. 1Motion carried 6-0 . ADMINISTRATIVE ASSISTANT - Alderman Harker moved to approve the Water & Building Department reports , seconded by Alderman Loebbaka. Motion carried 6-0 . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Mayor Davidson reported he will set up a meeting the first part of August and notify the council of the date ,; time and place . HUMAN RESOURCE COMMISSION - Alderman Loebbaka reported there will be a Blood Drive on Tuesday , August 2 , 1983. TENNIS COURTS - Alderman Hayden reported that the Tennis Court Committee set up by the Cooperative Agreement was never established. It is to be composed of a member from the School , one from the City and a member from a group who funded the project. COMMITTEE REPORTS BUILDING & ZONING - Alderman Hayden reported there will be a meeting July 18 , 1983 at 5 :00 P.M. at the Water Tower. It was reported that Kendall County has approved the Yorkville Implement Dealership on the property south of Elizabeth Street. The proper water detention will be met. Alderman Hayden moved to waive the $10 fee for the sign requested for Kendall County Human Services at 505 S . Main Street, seconded by Alderman Dollman. Roll call vote was taken as follows : Hayden - Aye Dollman - Aye Jennings - Aye Jahp - Aye Loebbaka - Aye Harker - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Dollman ' s request to upgrade the building code regarding soundproofing of apartments was referred to the committee meeting August 4 , 1983 . Building Inspector Madden is requested to attend the meeting. POLICE - On committee recommendation , Alderman Dollman moved to expend up to the budgeted $100. 00 for call forwarding , retroactive to May 1 , 1983 , and to look into again in September. Motion was seconded by Alderman Loebbaka. Roll call vote was taken as follows : Hayden - Aye Harker - Aye Jahp - Aye Loebbaka - Aye Jennings - Aye Dollman - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. PUBLIC PROPERTY & BUILDINGS - The meeting; scheduled for July 21, 1983 is at 8 :00 P.M. FUTURE PLANNING - The meeting scheduled for July 21 , 1983 is cancelled. STREETS & ALLEYS - Alderman Harker reported on the committee meeting held June 27, 1983 at 5 :00 P.M. A letter has since been received from Baxter & Wooman , Inc. , regarding Badger, Wolf & Beaver streets =: in Fox Industrial Park, and the committee will relate the contents of the letter to Mr. Henning and Mr. McEachern. Page 3 July 14 , 1983 Alderman Harker reported on the July 7 , 1983 meeting. Alderman Harker moved that the Public Works Department install a sewer extension from the west side of Heustis Street north of the railroad tracks to the catch basin at an approximate cost of $2 ,000 . Motion was seconded by Alderman Hayden. Roll call vote was taken as follows : Loebbaka - Aye Jahp - Aye Harker - Aye Hayden - Aye Dollman - Aye Jennings - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Harker moved to have the Public Works Department prepare & grade W. Van Emmon Street between S . Main & State Streets for Perkins Builders to put in a curb and the Public Works Department to finish the street, at a cost of approximately $2 ,500 . Motion was seconded by Alderman Jahp. Roll call vote was taken as follows : Jahp - Aye Jennings - Aye Harker - Aye Loebbaka - Aye Hayden - Aye Dollman - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Harker moved to replace approximately 55 ft. of sidewalk on the east side of Bridge Street in front of the Kendall County Record, old Title Co. Building , and Dr. Dickson ' s office , one-half to be paid by the city and one-half to be paid by the property owners ,at, approxi- mate cost of $1,000 . Second was made by Alderman Jennings . Roll call vote was taken as follows : Dollman - Aye Hayden - Aye Jahp - Aye Loebbaka - Aye Jennings - Aye Harker - Aye Motion carried 6-0 . Alderman Tilton & Small were absent from voting. Alderman Harker moved to adopt RESOLUTION #102-83 , a supplemental resolution for improvement by municipality under the Illinois Highway Code for W. Van Emmon Street appropriating an additional $20 ,000 from MFT funds , seconded by Alderman Jennings . Roll call vote was taken as follows : Jahp - Aye Harker - Aye Jennings - Aye Hayden - Aye Loebbaka - Aye Dollman - Aye Motion carried 6-0. Aldermen Tilton & Small were absent from voting. Alderman Harker moved to approve the municipal request for expenditure of MFT funds for W. Van Emmon Street , previously authorized by IDOT, in the amount of $15 ,343.00 . Motion was seconded by Alderman Dollman. Roll call vote was taken as follows : Harker - Aye Hayden - Aye Jahp - Aye Dollman - Aye Jennings - Aye Loebbaka - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Harker moved to approve the request for approval of change in plans for extra drainage under the street on the W. Van Emmon Street project , seconded by Alderman Dollman. Roll call vote was taken as follows : Jennings - Aye Loebbaka - Aye Harker - Aye Dollman - Aye Hayden - Aye Jahp - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Harker moved to authorize expenditure of $78 ,000 to Aurora Blacktop , holding back 5% , seconded by Alderman Hayden . Alderman Harker amended his motion to include "with IDOT approval" , seconded by Alderman Hayden. Roll call vote was taken as follows : Loebbaka - Aye Dollman - Aye Harker - Aye Jahp - Aye Jennings - Aye Hayden - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Attorney Kramer was requested to draft an ordinance renaming the 500 Block of W. Van Emmon St. to W. Madison Court. Quincy Road will be discussed at the July 21, 1983 committee meeting. HEALTH & SANITATION - Alderman Jennings reported that one weed mowing proposal was received from McNelis Tree Service at $37. 50 per hour. Alderman Jennings moved to accept the weed mowing proposal of McNelis Tree Service for $ 37. 50 per hour, as needed, provided that it included repairs to his equipment in the hourly rate . Motion was seconded by Alderman Dollman. Roll call vote was taken as follows : Jennings - Aye Harker - Aye Loebakka - Aye Dollman - Aye Hayden - Aye Jahp - Aye Motion carried 6-0 . Page 4 July 14, 1983 LIGHTS , TELEPHONE , GAS & CABLE TV - Alderman Jennings reported that Mr. Pennington of Centel Cable TV has seen to replacing almost all of the sod and favorable comments have been received by residents ,in Country- side Center. LIBRARY BOARD - Alderman Hayden moved to authorize payment for moving and installation of the telephone at the Yorkville Public Library , seconded by Alderman Jennings . Roll call vote was taken as follows : Dollman - Aye Harker - Aye Jennings - Aye Jahp - Aye Loebbaka - Aye Hayden - Aye Motion carried 6-0 . Aldermen Tilton & Small were absent from voting. Alderman Hayden reported that there has been a one-third increase in library activity since moving into the new building. Alderman Hayden reported that the loft plans will be discussed at the next Public Property & Buildings committee meeting. YBS BOARD - The next meeting will be July 18, 1983 at 7 :00 P.M. at Dallas Ingemunson ' s office . HEALTH & SANITATION (CON ' T. ) - Alderman Jahp was requested to get in touch with Mr. McNelis in regards to the acceptance of the weed mowing proposal. It was also requested to notify the Public Works Department when weed cutting is to be done and the location at which it is to be done , by both Mr. McNelis and the Police Department. Alderman Jennings is also to be notified. Alderman Harker moved to adjourn the meeting, seconded by Alderman Jahp.
