City Council Minutes 1983 08-11-83 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS , HELD AT CITY HALL
ON AUGUST 11, 1983 .
Mayor Davidson called the meeting to order at 8 :00 P.M. and led the
Council in the Pledge of Allegiance.
Clerk Erickson called the roll as follows :

A quorum was established.
Alderman Dollman moved to waive the reading of the minutes from the July
28 , 1983 meeting and approve them as presented, seconded by Alderman
Jennings . Motion carried 7-0 .
Alderman Jennings moved to waive the reading of the bills: and authorize
payment of bills presented, seconded by Alderman Loebbaka. Roll call
vote was taken as follows :

Motion carried 7-0 . Alderman Harker was absent from voting.
ATTORNEY - Attorney Kramer presented two recent pieces of legislation.
The first is a Labor Act which exempts any municipalities with 25 or
less full-time employees . This act will affect Yorkville in the future .
It excludes elected officials , department heads and commission members .
The second piece of legislation is the Freedom of Information Act
which provides for a central list for records that are available and where
they are located. The bill was referred to Alderman Jennings for study
with his committee .
Alderman Harker arrived at 8 : 10 P.M.
Attorney Kramer presented the Intergovernmental Police Service Agreement K
to be signed by Mayor Davidson and forwarded to the other Municipalities
for signatures . Montgomery was added to the agreement.
The Raffle Ordinance was referred to committee for further study by
motion of Alderman Jahp and second by Alderman Harker. Motion carried
8-0 . Meeting will be September 29 , 1983 at the Water Tower.
Attorney Kramer reported( that he received a counter claim suit from
Chicago Title requesting unvacation of the Street in question to
provide access to the lot due to a lost easement regarding Jeff Ellis '
lot on Madison St. The matter was referred to the Streets & Alleys
Committee for discussion.
The Solicitor' s Ordinance , with the four (4) changes incorporated
into it , is ready for the Mayor' s signature.
MAYOR' S REPORT - Alderman Harker moved to accept the resignation of
Administrative Assistant , Elden Madden , effective September 30 , 1983 ,
with regrets . Motion was seconded by Alderman Jennings . Motion carried
8-0 .
Alderman Jennings moved to accept the resignation of City Secretary ,
Marilyn Merkel , effective October 31, 1983 , with regrets . Motion was
seconded by Alderman Jahp. Motion carried 8-0 .
TREASURER - Alerman Jennings moved to approve the Treasurer' s Report
as presented, seconded by Alderman Loebakka. Roll call vote was
taken as follows :

PUBLIC WORKS DIRECTOR - Alderman Dollman moved to approve the reports of
the Public Works Department , seconded by Alderman Loebbaka. Motion carried
8-0 .
BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Small attended the
meeting on August 10 , 1983 . Discussion centered on the types of businesses
& industry they wished to attract to the area.
HUMAN RESOURCE COMMISSION - Alderman Loebbaka recognized the successful
job completed by the Human Resource Commission in the recent Blood Drive.
The next meeting will be August 15 , 1983 at 7 : 30 P.M.
PARK COMMISSION - Alderman Hayden reported the next meeting will
be August 23 , 1983 at the Water Tower Conference Room at 7 : 30 P.M.
Alderman Hayden reported that he has not been able to contact Dr. Scholle
to date regarding the work needed on the light poles .
Alderman Hayden reported that the rules for the tennis courts should
be more adequately enforced.
Discussion was held on the tennis court lights. It was suggested to
look into a 60 minute timer along with the regular timer , so that when
the courts are not in use the lights will be disengaged.
SENIOR COMMUNITY - Alderman Loebbaka reported that he met with a committee
and they expressed concern that their uses of the Beecher Building are
not covered by rules . The matter will be investigated.
OLD BUSINESS - Alderman Tilton will have a computer update meeting
at the Water Tower on August 18, 1983 at 8:00 P.M.
COMMITTEE REPORTS
BUILDING & ZONING - Alderman Hayden reported that a letter was
received from the Y-Mart regarding voluntary annexation . There will
be a meeting with the committee for discussion.
POLICE - Alderman Dollman moved that upon committee recommendation ,
the City advertise for bids for a new gas-fired, V-8, full-size ,
police squad car to be purchased, and for the sale of the 1980
Chevrolet Impala, bids to be received by the City Clerk ' s office
until September 20 , 1983 at 3 :00 P.M. and acted upon at the
September 22 , 1983 meeting. Motion was seconded by Alderman Jennings .

at a cost of $985 .00 , seconded by Alderman Loebbaka. Roll call vote

SEWER - Alderman Jennings reported that committee discussion was
held regarding imposing a sewer user fee by the City of Yorkville , but
due to the recent possibility of the Yorkville-Bristol Sanitary District
raising their rates , the committee has decided to no impose a City
User Fee at this time .
TREES & PARKS - The subject of Christmas decorations has been referred
back to committee for further discussion .
STREETS & ALLE+YS - Alderman Harker reported that bids will be received
until 10 : 30 P.M. on August 23 , for the Various Streets Maintenance
Program at the office of the City Clerk.

Alderman Harker reported that Perkins Builders will do the Sidewalk
job on the east side of Bridge Street in the downtown area.
Alderman Harker reported that the curb job on Van Emmon Street (West)
is completed between S . Main & State Streets .
HEALTH & SANITATION - Alderman Jennings reported that the weed problem
areas were discussed at the August 4, 1983 committee meeting. Officer
Millen will compile a list of those who have been notified.
LIGHTS , TELEPHONE , GAS & CABLE TV - Alderman Jahp reported on the
August 4 , 1983 committee meeting with Bill Pennington of Centel Cable
TV. Notice has been published in the Kendall County Record requesting
property owners to water the sod that was put down by Centel Cable TV.
LIBRARY BOARD - Alderman Hayden reported there were problems with
the telephones at the new library. Administrative Assistant, Madden ,
reported that he talked with Commonwealth Edison and there will be
no charge for the lights and air-conditioning, but will be a charge
for the heating bill. In talking with Illinois Bell Telephone , he was
told to get in touch with them after the strike is settled.
YBS BOARD - Alderman Jahp reported that there will be a meeting on
August 15 , 1983 at 7 :00 P.M. at Dallas Ingemunson' s office .

AGREEMENT FOR INTERGOVERNMENTAL
COOPERATIVE POLICE SERVICE
This agreement, made and entered into this day of
1983, by and between the political subdivisions of the State of Illinois,
who are signatories hereto.
WHEREAS, these political subdivisions of the State of Illinois have
determined that there is aneed for law enforcement personnel to cross
jurisdictional lines to preserve the peace, in order to increase their
ability to preserve the safety and welfare of the entire area; and
WHEREAS, said political subdivisions have determined that, in certain
situations, the use of police officers to perform police duties outside of
the territorial limits of the city or village where such officers are legally
employed, may be desirable and necessary in order to protect the health,
safety and welfare of the public; and
WHEREAS, the political subdivisions of the State of Illinois are
authorized by Public Law under Article VII , Section 10, of the Illinois
Constitution of 1970, Chapter 127, Sections 741-748 of the Illinois Revised
Statutes, Chapter 85, Sections 1601-1606 of the Illinois Revised Statutes
(1981 ) and Chapter 24, Section 1-4-8 and Section 11-1-2.1 of the Illinois
Revised Statutes which authorize and/or encourage intergovernmental mutual
aid as well as cooperative agreements with respect to police powers,
NOW, THEREFORE, the parties hereto do agree as follows :
1 . Emergency Aid
When the need for investigative police assistance exists within
the boundaries of any of the parties hereto, the party or parties shall
notify the other party or parties to this agreement of such need for
enforcement assistance. Assistance may be rendered by all of the parties
to this agreement pursuant to the provisions of this agreement.
2. Execution
Upon execution of this agreement, the parties hereto shall
designate an appropriate official in each jurisdiction to participate in
the development of an operational plan. The parties shall meet at least

annually to review and, if necessary, to propose amendments to this plan.
Any proposed amendments to this agreement shall not be effective until
approved in writing by all parties to this agreement.
3. Authorization
Intergovernmental Police Service and Assistance may be provided
between and among parties to this agreement during times of emergency or
necessary investigative police work, when mutual aid would best serve the
interests of participating parties to this agreement and the residents of
the respective cities and villages.
4. Power and Authority
a. Each participating party to this agreement does hereby
authorize and direct its Chief of Police or his designee to render and
request mutual police aid to and from other participating parties to this
agreement to the extent of available personnel and equipment not required
for adequate protection of the agency rendering aid. The judgment of the
Chief of Police or his designee of the agency rendering aid, as to the
amount of personnel and equipment available, shall be final .
b. Police officers who shall be commanded by their superior
authority to maintain the peace or perform police duties outside the terri-
torial limits of the city or village which regularly employs such officers
shall be under the direction and authority of the Chief of Police or his
designee of the member city or village requesting aid. Such officers shall ,
in turn, be under the direction and authority of the local commanding police
officer of the city or village to which they are called to perform police
duties, and shall be peace officers thereof. They shall have all responsibilities
and authority of police and peace officers as provided by law, including the
power of arrest.
5. Compensation
a. Cooperative police service and assistance shall be rendered
without charge to parties of this agreement during the normal conduct of
police business, except that a full accounting of such services shall be
maintained by the designated officials from the jurisdictions, as outlined
in paragraph 2 of this agreement, and an accurate tabulation of exchanged

services with related costs shall be provided to all parties to this
agreement annually.
b. Specific requests for renumeration due to unusual burdensome
costs incurred in the performance of mutual aid, shall be submitted by the
assisting city or village to that city or village receiving such assistance.
6. Liability
a. All wage and disability payments, insurance costs, pension
and workmen's compensation claims, damage to equipment and clothing and
medical expense shall be paid by the city or village regularly employing
such police officer.
b. No participant hereto shall , under any circumstances, claim
any loss or damage by reason of an assisting or receiving city or village's
failure to effectively combat or handle a police problem. in its territory or
in the assisted's territory.
7. Rules and Regulations
The police chiefs of the participating cities and villages shall
establish rules and regulations for giving and receiving aid. A copy thereof
shall be filed with the Clerk of each member city and village. The rules and
regulations may be revised and amended from time to time by those police
chiefs and a copy of each revision or amendment shall be filed with the clerk
of each member city and village. These rules and regulations shall be binding
upon each of the participants and violation thereof, at the option of a
majority of the other participants, shall result in loss of the rights and
privileges of the violator under this agreement.
8. Agreement
This agreement shall be in full effect and legally binding upon
and at such time as signed and certified by participating cities and villages.
The City of Yorkville will retain the original signed agreement and will
be responsible for circulating such agreement among the parties of this
agreement for purposes of signature and record.
This agreement shall remain in full force and effect until partic-
ipating cities or villages withdraw from this agreement. Any participating
city or village may withdraw from this agreement at any time, at its option,
by resolution of its Board or,Council . Copies of such resolutions shall be
filed with the Clerk of each ity and village within thirty (30) days of passage.
