MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS , HELD AT CITY HALL ON
FEBRUARY 11 , 1982 .
Mayor Thanepohn called the meeting to order at 8 : 00 P. M. and led the
Council in the Pledge of Allegiance to the Flag .
Clerk Erickson called the roll as follows :

Jennings
Alderman York was absent from Ward 1 . A quorum was established .
The reading of the minutes from the January 28 , 1982 meeting was waived .
Alderman Harker moved to approved the minutes as presented , seconded
by Alderman Tilton . Motion carried 7-Om
Alderman Pierce noted that on the January 14 , 1982 minutes under
"School Community" that Kendall County does not have a Youth Advisory
Commission , but that Kendall Family & Youth Services does have a Youth
Advisory Commission .
The reading of the bills was waived . Alderman Tilton moved to authorize
payment of the bills presented , seconded by Alderman Jennings . Roll
call vote was taken as follows :

ATTORNEY ' S REPORT - Alderman Dollman moved to direct Attorney Dickson
to draft an ordinance approving the flood plain area plan & delineation
of the flood plain area , seconded by Alderman Simmons . Roll call vote
was taken as follows :

Alderman Dollman moved to pass ORDINANCE # 1982-4 Amending the
Alcoholic Liquor Ordinance to increase the following fees for a
six-month period :
Retail Class - Increased from $500 . 00 to $750. 00
Restaurant Class - Increased from $ 175 . 00 to $375 . 00
Package Class - Increased $250 . 00 to $500 . 00
Beer Class (Consumption on premises only) - $250 . 00 ( remains same)
Package Beer Class - $250 . 00 ( remains same)

Basic Building Code/1975 requiring regulation of the method of
driveway construction to prevent the extension of driveways into
street & gutter areas , seconded by Alderman Pierce. Roll call vote

Page 1 : Under Section 3 , last line , delete "motorcycles" .
Page 2 : Under Section 6 , Time of Payment . Change to read June 1
of each year . Delete provision for discount of $2 .00 for
advance payment .
Addition : The annual fees shall be increased $2 . 00 , if purchased
subsequent to June 30 of the year for which such license
is purchased .

CITY CLERK - Clerk reminded City Council that Economic Interest
Statements are due 4/30/82 .
Sealed Bids for the ' 60 GMC Panel Truck & ' 76 Pontiac at the Public
Works Department , will be received until 2/23/82 and opened at the
regular meeting 2/25/82 .
Alderman Harker moved to grant permission to the Easter Seals
Rehabilitation Center to hold its annual ''Tag Days" on May 21 . & 22 ,
1982 , seconded by Alderman Pierce. Motion carried 7-0 .
CITY TREASURER - Alderman Jennings moved to approve the Treasurer ' s
Report , seconded by Alderman Pierce. Motion carried 7-0 .
POLICE - Alderman Dollman moved to approve the Police Department
Reports , seconded by Alderman Jennings . Motion carried 7-0.
ADMINISTRATIVE ASSISTANT - Administrator Madden reported that he has
spoken with Stan Sarwark of Commonwealth Edison regarding the utility
tax the City has been paying on all of its own utilities . Attorney
Dickson has a copy of a resolution , that requests the city not have
to pay utility taxes , to study and make a recommendation on .
Administrator Madden was requested to direct a letter to Nagel
Excavating with carbon copy to Baxter & Woodman , Inc. ,engineers ,
commending them on the Beecher Building sewer project and saving
the city $ 1800 , by motion made by Alderman Dollman , seconded by
Alderman Jennings . Motion carried 7-0 .
BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Jennings
reported the February meeting had been cancelled .
PLAN COMMISSION - Alderman Simmons reported the next meeting will
be February 23 , 1982 .
PARK COMMISSION & TENNIS COURTS - Alderman Beach reported the next
meeting will be Tuesday , February 16 , 1982 at 6 : 30 P . M. at the
Water Tower.

BEECHER COMMUNITY CENTER - Alderman Dollman reported that commitments
need to be made regarding the Beecher Building requests submitted .
Administrative Assistant Madden will calculate the cost per day for the
individual rooms regarding utilities and janitor service , but the City
Council will make the decision on the fees charged . Administrative
Assistant will be in charge of scheduling of the building . A copy
of the Beecher Community Center Advisory Committee ' s guidelines is
attached regarding scheduling . Administrative Assistant will check
into the possibility of having free utilities .

HUMAN RESOURCE COMMISSION - Alderman ' k rea the minutes from the
February 1 , 1982 meeting and announced the next meeting will be
March 15 , 1982 at the Water Tower.
SCHOOL COMMUNITY - Alderman Tilton reported that Suzzette Heth , Park
Director is handling the Youth Advisory Commission ' s sledding party
for 7- 12th grade students scheduled for February 14 , 1982 from 2-4 P .M.
at Harris Forest Preserve Hill . School busses can be used for Youth
Advisory Committee activities .
A letter was received from the Illinois Department of Conservation
regarding the approval of the athletic field concept plan . They are
concerned , however , with the proposed football field being half on
IDOC property and half on school district property in regards to the
40-year lease . Feasibility of aligning the football field so that
it doesn ' t cross the drain line now located at about the 10 yard line
of the plan .
KENDALL COUNTY EMERGENCY SERVICES & DISASTER -Alderman Pierce reported
there will be a meeting on February 18 , 1982 regarding tornado spotting
at the Kendall County Board meeting room at 7 : 00 P. M .
KENDALL FAMILY & YOUTH SERVICES - Alderman Pierce reported that the
LEAP program will begin within the next week.
The Dept . of Agriculture has allocated Kendall County 870 lbs . of
cheese that has been in storage and to be dispersed throughout the
U . S . A committee has been set up to determine the eligible recipients .
It will be dispensed then from City Hall .
COMMITTEE REPORTS
FINANCE - Alderman Jennings reported on the February 4 , 1982 committee
meeting . Policy f.,r Council members attendance at conventions & con-
ferences & costs incurred when they fail to attend was discussed .
Alderman Jennings moved to direct Attorney Dickson to draft a Resolution
requiring costs/incurred by the individual for conferences or conven -
tions when the individual fails to attend , be paid for by the individual .
Motion was seconded by Alderman Tilton . Motion carried 7-0 .
Department Heads were requested to pass the information for wage
negotiation meetings to their employees as follows :
March 16 , 1982 - Public Works - 7 : 30 P . M.
Police Dept . - 8 : 30 P .M .
EMERGENCY SERVICES & DISASTER - Alderman Beach reminded the Council
of the regularly scheduled committee meeting on February 18 , 1982 .
TREES & PARKS - Alderman Beach reminded the Council of the regularly
scheduled committee meeting on February 18 , 1982 .
FUTURE PLANNING - Alderman Pierce reminded the Council of the regularly
scheduled committee meeting on March 4 , 1982 .
HEALTH & SANITATION - Alderman Pierce reminded the Council of the
regularly scheduled committee meeting on March 4 , 1982 .
WATER - Alderman Tilton reported the final recommendations have been
received from Baxter & Woodman , Inc . This will be discussed at the
February 18 , 1982 committee meeting at 7 : 30 P .M . at the Water Tower
and final recommendations by committee to the City Council will be
given at the February 25 , 1982 meeting . All City Council members
will be sent copies of the report .
LIBRARY BOARD - Alderman Beach reported that February 22 , 1982 will
be the next meeting at 7 : 30 P. M . The City Auditor & Library Board

Finance Committee met February 1 , 1982 and as a result there may be
some action on the request to have the City Treasurer pay bills for
the library board .
YBS BOARD - Alderman Jennings reported the next meeting will be
February 15 , 1982 .

by Alderman Dollman . Motion carried 7-0.

DRIVING UNDER THE INFLUENCE
ILLINOIS VEHICLE CODE
11-501
I . Purpose
A. This draft establishes guidelines to be followed in
enforcement action on the charge of driving under the
influence of alcohol , other drug, or combination there
of. IVC 11-501
B. These guidelines are not to be interpreted as an order
and may change as circumstances and case law arises.
II . Procedure
A. Arrest
1 . Observation of violator and subsequent stop.
2. Place subject under arrest for driving under the in-
fluence, in violation of IVC Sec. 11-501a.
3. Complete the Illinois Citation and Complaint. The
citation will be completed before requesting the
subject to submit to any chemical test or tests.
B. Implied Consent
1 . Read request to submit which is printed on the reverse
side of the alcohol/drug influence report. This warning
is applicable only to violations committed on public
highways.
2. Fill in date, time and place of request.
3. Following the above warning, the arrested subject will
be requested to submit to a test or tests. If the sub-
ject wishes to contact an attorney or other person be-
fore agreeing or refusing to submit, the subject will
be allowed a reasonable period of time to do so. The
existing circumstances will determine the time period
that is reasonable.
4. See Department Guidelines for testing procedures.

C. Refusal to submit to test
1 . A report of refusal will be completed in connection
with a violation committed on a public highway sub-
sequent to the occurrence of any of the following.
a. Subject refuses to submit .
b. Subject refuses to submit to a test at the time of
request; subsequently expresses a desire to submit
and then refuses to complete a test .
c. Subject agrees to submit , completes a breath test ,
but refuses a blood or urine test as required.
2. The report of refusal does not need to be completed
immediatly following the refusal .
D. Alcohol and/or Drug Influence Report
1 . An alcohol and/or drug influence report will be comp-
leted by the arresting officer subsequent to any arrest
for a violation of IVC Sec. 11-501a
2. The influence report is to be completed as soon as
practical following completion of the citation
3. See Department Guidelines for procedure.
4. Officers discretion to fill out form at the scene,
police station or Kendall County jail .
E. Completion of arrest
1 . Follow bonding procedures which are;
a. $200.00
b. $100.00 and drivers license
c. Recog or NTA if desirable

11-501
I . Purpose
A. This draft establishes guidelines to be followed in
enforcement action on the charge of driving under the
influence of alcohol , drug, or combination thereof.
B. These guidelines are not to be interpreted as an order
and may change as circumstances and case law arises.
II . Procedure
A. Performance Tests
1 . Balance test
a. Violator is to walk heel to toe (one in front of
the other) for at least six (6) steps, turn about-
face and return six (6) steps.
b. A straight line should be provided, such as tape on
the floor, or any available straight line as long as
the line is clear of obstructions (ice, grease, water
etc. )
2. Walking test
a. May be observed at the same time the balance test is
be completed or
b. Retest following steps in 1 ,a&b.
3. Turning test
a. Observe violator in previous two tests for this
evaluation.

4. Finger to Nose test
a. Violator standing straight, hands to side.
b. Heels together at 45 degree angle.
c. Head tilted back slightly.
d. Extend both arms out to side of body, shoulder height.
e. Close eyes.
f. With right index finger, touch tip of nose.
g. With left index finger, touch tip of nose.
B. Influence form
1 . Fill out effect of alcohol/drug box, sign form and witness
if available.
2. Read Miranda warning which is printed on the reverse side
of the Influence report form. Have violator sign same. If
violator refuses to sign enter 'REFUSED' on signiture line.
3. Proceed with questions if applicable.
C. General Report
1 . Use General Report form as narrative to describe the details
of the incident.

IMPLIED CONSENT
ILLINOIS VEHICLE CODE
11-501 . 1
I . Purpose
A. This draft establishes guidelines to be followed in
implementing the provisions of the Implied Consent
Law. IVC Sec. 11-501 . 1
B. These guidelines are not to be interpreted as an order
and may change as circumstances and case law arises.
II . Submission to test
A. If the arrested person agrees to submit, the arresting
officer will make arrangements for the appropriate test
or tests.
III . Requesting test or tests
A. Breath test - Submission to a breath test will be requested
unless;
1 . Transporting the arrested subject to an instrument
location is impractical due to his/her physical condition
2. At the time of arrest, there is reason to believe that
the arrested subject is under the influence of drugs
or a combination of drugs and alcohol .
3. The arrested subject is physically unable to complete
a breath test.
B. Blood test - Submission to a blood test will be requested;
1 . When submission to a breath test is not requested for
reasons stated above.
2. When the results of the breath test lead to the presump-
tion that the arrested subject is under the influence of
drugs or a combination of alcohol and drugs.

C. Urine test - Submission to a urine test will be requested;
1 . In addition to a blood test if drugs are involved.
2. When a breath or blood test is not possible.
IV. Conducting tests
A. Breath test
1 . Breath tests must be conducted by a licensed breath
analysis instrument operator in accordance with Illinois
Department of Public Health rules. (Revised Jan. 1 , 1982,
Section 6, Standards for the operation of approved breath
analysis instruments)
2. Whenever practical , subjects arrested by Yorkville Police
personnel will be tested on the Illinois State Police main-
tained instrument located at the Kendall County Jail .
3. Whenever practical , tests performed on subjects arrested
by Yorkville Police personnel will be conducted by Yorkville
Police Breath Analysis Instrument Operators.
B. Blood test
1 . Blood samples must be collected in the presence of the
arresting officer or other representative of the Yorkville
Police Department who can authenticate the sample.
2. Blood samples must be collected by a physician licensed to
pratice medicine, by a registered nurse, or by a trained
phlebotomist acting under the direction of a licensed
physician.
3. Blood collection must comply with IDPH rules , Section 11 ,
Standards and procedures for withdrawing of blood and/or
urine samples for chemical analysis of alcohol or other
drug combination.
4. Blood sample collection may be obtained at any medical
facility or laboratory approved by IDPH. Blood samples
cannot be collected without a physician's order.
5. Area hospital emergency rooms should be utilized first.
6. You should obtain two vials of blood.
7. Area hospitals have viles , labels and stoppers (anticoagulant)
on hand.
8. Take the vials of blood directly form the collecting attendant.
9. Make sure all the information required on the labels is affixed
including your signature and ID number.

C. Urine test
1 . Urine samples must be collected in the presence of the
arresting officer or a representative of the Yorkville
Police Department who can authenticate the sample. The
officer must be of the same sex as the subject under-
going the testing.
2. The specimen must be collected in a manner to preserve
the dignity of the individual and to insure the integrity
of the sample.
3. Urine samples may be collected by the arresting officer
or representative if desired or the subject may be taken
to any area medical facility for collection .
4. Procedure
a. The accused should empty his/her bladder and the urine
be discarded. One-half hour later the accused should
again be requested to void the bladder and the specimen
be collected in a clean , dry container and dispensed in
approximately equal volumes directly into two contain-
ers . The containers should be closed with inert stoppers .
b. Each container should he appropriately and securely
labeled with the required information including the
arresting officers signature and ID number .
c. The urine sample will be mailed or taken directly to ;

D. Detail information
1 . The original report of the analysis will be returned by the
laboratory to the submitting agency only.
2. When utilizing a medical facility , it is recommended the
arresting officer suply a copy of IDPH rules to insure
procedure compliance.
3. For urine tests on females it is recommended the accused
be transported •to an area medical facility for specimen
collection.
4. In most cases ,a urine test should accompany a blood test
and would be collected at a medical facility thereby
making the collection of a urine sample by the arresting
officer highly unlikely.
E. Additional tests
1 . The person tested may have a physician , or a qualified
technician , chemist , registered nurse , or other qualified
persn of their own choosing administer a chemical test or
tests in addition to any administered at the direction of
the arresting officer. The failure or inability to obtain
an additional test by a person will not preclude the ad-
mission of evidence relating to the test or tests taken
at the direction of the arresting officer.
2. If the person desires additional tests and is to be
released on bond , it will be the responsibility of
the person to obtain the tests.
3. If the person desires additional tests and is to be
incarcerated , it will be the responsibility of the
incarcerating institution to make arrangements for
the appropriate test or tests.
