City Council Minutes 1982 08-12-82 (195 ) MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE ,KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON AUGUST 12 , 1982 .^ Mayor Thanepohn called the meeting to order at 8 : 00 P.M. and led the Council in the Pledge of Allegiance to the Flag . Clerk ERickson called the roll as follows : Ward 1 - Small - Present Beach - Present Ward 2 - Harker - Present Tilton - Present Ward 3 - Pierce - Present Dollman - Present Ward 4 - Simmons - Present Jennings - Present A quorum was established . Alderman Jennings moved to waive the reading of the minutes from the July 22 , 1982 meeting and approve same , seconded by Alderman Small . Motion carried 8-0 . Alderman Dollman moved to waive the reading of and authorize payment of the bills presented , seconded by Alderman Jennings . Roll call vote was taken as follows : Pierce - Aye Beach - Aye Tilton - Aye Small - Aye Harker - Aye Simmons - Aye Dollman - Aye Jennings - Aye Motion carried 8-0 . ATTORNEY ' S REPORT - Attorney Dickson reported on his findings regarding the question on parliamentary rules relating to motions to reconsider. Attorney Dickson checked "ROBERTS RULES OF ORDER" and action cannot be reconsidered if the motion wasn ' t made by one who voted with the majority and the motion to reconsider has to be at the same meeting or the next meeting . The majority can moveto rescind action of prior meetings as long as there has not been any change in position of the action. If the majority of council should vote to rescind the motion tonight there would need to be a notification at this council meeting that at the next council meeting the matter would be brought up to rescind the motion involving the action taken previously. It could be done tonight with a 2/3 vote of council. MAYOR' S REPORT - Mayor Thanepohn reported that he and some of the council members attended the informational meeting with the county regarding the City' s request that the property be properly rezoned. He passed out copies of the Resolution passed by the County Board concerning the matter . (**see attached copy) CITY CLERK - Clerk Erickson presented F.W. Witt Company, Inc . petition to rezone from B-3 non-conforming to M-1 for the purpose of constructing an addition consisting of one warehouse and loading dock at 1106 S. Bridge St . Alderman Harker moved to refer the Petition to the Plan Commission for Public Hearing sheduled for Tuesday, August 24 , 1982 at 7 : 30 P.M. with regular meeting to follow for consideration , seconded by Alderman Dollman. Motion carried 8-0 . Clerk Erickson read a letter from Garland S. Edwards , President of the Yorkville Lions Club thanking Administrative Assistant Madden , Mayor Thanepohn , the Alderpersons and a special thanks to the mainten- ance employees for their help and assistance . TREASURER - Alderman Tilton moved to approve the Treasurer ' s Report as presented , seconded by Alderman Pierce . Motion carried 8-0 . Alderman Dollman moved to have the water department secretary furnish an annual comparison report showing the approximate revenue generated by the water rate increase . Motion was seconded by Alderman Harker . Motion carried 8-0 . POLICE - Alderman Harker moved to approve the Police Department Reports , seconded by Alderman Dollman . Motion carried 8-0 . ADMINISTRATIVE ASSISTANT - Alderman Harker moved to approve the Water , Streets & Building Reports , seconded by Alderman Small. Motion carried 8-0 . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - The seminar Administrative Assistant Madden was scheduled to attend at Triton College on August 17 , 1982 was cancelled . (196) Page 2 August 12 , 1982 PARK COMMISSION - Mayor Thanepohn reported that he received a resignation from commission member , Mark Johnson , and he will have an appointment to fill the vacancy in the near future . KENDALL FAMILY & YOUTH SERVICES - Alderman Pierce reported on the Career Workshop meeting September 29 , 1982 at the Beecher Building. Ruth Johnson is coordinator of the workshop. SCHOOL COMMUNITY - Alderman Tilton reported they are finished shooting the topo for the athletic field complex. SENIOR CITIZENS - The nutrition site is open 5 days a week now. COMMITTEE REPORTS WATER - Alderman Simmons read the engineering proposals from Baxter & Woodman , Inc . regarding both the I-beam structure at Pumphouse #3 and the sandblasting , plug welding and repainting of the water tower inside and outside . Alderman Simmons moved to authorize Baxter & Woodman , Inc . to proceed with 1) plans , specifications , contract documents & cost estimate including preliminary field invetigations not to exceed $3 ,000 in fees for the structural I-beam repair work to be done in Pumphouse #3 ; 2) sandblasting, possible plug welding and repainting (inside & outside) of the water elevated water storage tank , prepare constract documents and specifications for bidding , engineering services , advertisement & recommendation for award of contract , periodic resident engineering and inspection not to exceed $4 ,000 as per proposal (***see attached copies) . Motion was seconded by Alderman Harker. Roll call vote was taken as follows : Simmons - Aye Harker - Aye Jennings - Aye Dollman - Aye Small - Aye Pierce - Aye Tilton - Aye Beach - Aye Motion carried 8-0 . POLICE - Alderman Small reported that Alderman Tilton and Chief Randall attended a seminar recently. The police department may be getting 3-wheel motorcycle to use as to the feasibility of possible purchase . PUBLIC PROPERTY & BUILDINGS - Alderman Dollman reported that he has received a proposal of $1922 from Hinsdale Nurseries for trees of various kinds . FUTURE PLANNING - Alderman Tilton reported that he has not received the 2nd questionaire back from several council members and must have them to prepare for the August 19 , 1982 meeting. FINANCE - Alderman Tilton reported that the Tax Levy Ordinance is due on Tuesday, September 14 , 1982 for filing at the Kendall County Clerk' s office . It must be passed by City Council on September 9 , 1982 meeting or before . There will be a Finance meeting following the City Council meeting on August 26 , 1982 . STREETS & ALLEYS - Alderman Harker moved to adopt Resolution #87-1982 for Improvement by Municipality under the Illinois Highway Code for the proposed Van Emmon Street improvement (Section 82-00009-00-FP) 250 ft. east of Bridge St. ( Ill . Rt. 47) to 650 ft. east of Bridge St. (Ill . Rt. 47) . Motion was seconded by Alderman Pierce . Roll call vote was taken as follows : Small - Aye Dollman - Aye Pierce - Aye Harker - Aye Simmons - Aye Beach - Aye Tilton - Aye Jennings - Aye Motion carried 8-0 . Proper copies will be forwarded for IDOT approval. Alderman Harker reported on a letter written by Baxter & Woodman , Inc . , consulting engineers for the city to Aurora Blacktop , Inc . regarding repair work needed on the 1981 Van Emmon project , during the one year warranty period . There will be a committee meeting August 17 , 1982 at the Water Tower at 8 : 00 P.M. to discuss West Washington Street, Countryside Center Streets & E . Fox Street.
