City Council Minutes 1982 09-09-82 (201) MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE ,KENDALL COUNTY, ILLINOIS , HELD AT CITY HALL ON SEPTEMBER 9 , 1982 . Mayor Thanepohn called the meeting to order following the Public Hearing regarding the proposed tax levy, and then led the council in the Pledge of Allegiance to the flag. Clerk Erickson called roll as follows : Ward 1 - Beach - Present Small - Present Ward 2 - Tilton - Present Harker - Present Ward 3 - Dollman - Present Pierce Present Ward 4 - Simmons - Present Jennings - Present A quorum was established. Alderman Jennings moved to waive the reading of the minutes from the August 26 , 1982 meeting and approve them as presented , seconded by Alderman Tilton . Motion carried 8-0 . Alderman Dollman moved to with hold the following two bills and refer them to committee for study : Revenue Sharing Fund - Leo Anderson - $2 ,275 .00 Perkins Builders , Inc. - $2 ,680 .53 Motion was seconded by Alderman Jennings . Motion carried 8-0 . Alderman Jennings moved to authorize payment of the bills presented with the exception of those under "Revenue Sharing Fund" totaling $4 ,955 .53 from Leo Anderson & Perkins Builders , Inc . , seconded by Alderman Simmons . Roll call vote was taken as follows : Beach - Aye Jennings - Aye Harker - Aye Small - Aye Pierce - Aye Simmons - Aye Tilton - Aye Dollman - Aye Motion carried 8-0 . ATTORNEY ' S REPORT - Alderman Harker moved to adopt RESOLUTION #89-1982 Accepting A Gift of One Acre of Land from James Stark for General Municipal Purposes , seconded by Alderman Beach. Roll call vote was taken as follows : Dollman - Aye Pierce - Aye Simmons - Aye Beach - Aye Jennings - Aye Tilton - Aye Harker - Aye Small - Aye Motion carried 8-0 . Alderman Dollman moved to pass ORDINANCE #1982-14 Reclassifying Property from B-3 to M-L Upon Petition of F.W. Witt & Company , Inc. , seconded by Alderman Simmons . Roll call vote was taken as follows : Small - Aye Beach - Aye Harker - Aye Jennings - Aye Pierce - Aye Simmons - Aye Dollman - Aye Tilton - Aye Motion carried 8-0 . Attorney Dickson reported that the burned-out home on Dickson Court in Countryside Center should be resolved in 2 weeks . Attorney Dickson is looking into other ways of pursuing the matter of the burned-out home on W. Washington St. Alderman Tilton moved to adopt RESOLUTION #90-1982 , Authorizing the Mayor and Clerk of the United City of the Village of Yorkville to enter into an Intergovernmental Cooperative Agreement with Yorkville Community Unit School District No. 115 Concerning the Development , Control , Maintenance and Future Regulation of Leased Property from Illinois Depart- ment of Conservation . Motion was seconded by Alderman Jennings . Roll call vote was taken as follows : Harker - Aye Jennings - Aye Tilton - Aye Pierce - Aye Small - Aye Beach - Nay Simmons - Aye Dollman - Aye Motion carried 7-1. MAYOR' S REPORT - Alderman Harker moved to approve Mayor Thanepohn ' s appointment of Nancy Baird as Chairman , Beth Hage and Sharon Henry as members of the water tower logo judging team , seconded by Alderman Pierce . (202) Page 2 September 9 , 1982 Mayor Thanepohn read the VFW Buddy Poppy Day Proclam.ati.On.. , Alderman Harker moved to grant permission to the VFW to hold Buddy Poppy Days on September 24 & 25 , 1982 , seconded by Alderman Dollman . Motion carried 8-0 , Alderman Tilton moved to authorize Mayor Thanepohn to work with the school in determining the engineering firm to be used to develop the specifi- cations and submitting the specifications for bidding for rough grading of the game farm/school property involved in the athletic field complex . Motion was seconded by Alderman Jennings . Frank Wellwerts , Engineer for Baxter & Woodman , Inc . submitted their proposal to the City Council for the engineering and specifications for the athletic field complex as follows : 1 . Additional surveys and information on topo maps $1 , 200 . 00 2 . Meetings with city & school architects to define perimeters 300 .00 3 . Prepare preliminary rough grading plan and make on site analysis of the storm water drainage needs 2 ,000 .00 4 . Review preliminary grading and drainage with city 300 .00 staff & school board architect 5 . Prepare final plans specifications and bidding docu- ments 1 ,700.00 Total Bid $5 ,500 .00 Completed plans will indicate final grades necessary for drainage control with compatibility to existing and proposed facilities , but will not include finished grading for individual facilities . Mayor Thanepohn read a letter from Jean Mount of the Sports Boosters stating that the organization is willing to help with the proposed athletic field complex in any way they can . TREASURER' S REPORT - Alderman Tilton moved to approve the Treasurer' s Report , Seconded by Alderman Simmons . POLICE REPORT - Alderman Pierce moved to approve the Police Report , seconded by Alderman Small . Motion carried 8-0 , ADMINISTRATIVE ASSISTANT ' S REPORT - Alderman Harker moved to approve the Administrative Assistant ' s reports , seconded by Alderman Dollman. Motion carried 8-0 . EMERGENCY MEDICAL SERVICE - Alderman Pierce reported that an education seminar is planned for October. KENDALL COUNTY EMERGENCY SERVICES & DISASTER - Alderman Small reported the next meeting will be Thursday , September 16 , 1982 . KENDALL FAMILY & YOUTH SERVICES - Alderman . Pierce reported that KFYS will co-sponsor Human Services Day with Kendall County Alive & Well group on September 25 , 1982 from 9 : 30 to 4 : 00 P.M. at the Beecher Building. SCHOOL COMMUNITY - Alderman Tilton reported that the school has reduced season passes available for athletic events . CITIZEN COMMENTS - Tom Muerder requested the city to take a close look at the unfinished home on Dickson Ct . The matter will be referred to the public health officer for suggestions . OLD BUSINESS - Mayor Thanepohn reminded the council of Wildwood Sub- division meeting on September 16 , 1982 . COMMITTEE REPORTS WATER - Alderman Simmons reported that publication has been made for sealed bids for the repainting of the interior and exterior metal surfaces of the water tower to be received by the City Clerk and opened at 9 :00 a.m. , September 21 , 1982 . (203) Page 3 September 9 , 1982 EMERGENCY SERVICES & DISASTER - John Taylor presented the emergency disaster plan booklet to the city. The next meeting is scheduled for September 30 , 1982 at 8 :00 P.M. at the Water Tower . PUBLIC PROPERTY & BUILDINGS - Alderman Dollman reported the next committee meeting will be September16 , 1982 at 7 : 30 P.M. at the WaterTower. Motion carried 8-0 . HEALTH & SANITATION - Alderman Beach reported that the jiffy johns will be removed by October 1 , 1982 . Alderman Beach read Chief Randall ' s report on the weed problem update . The committee will study the need to establish a method to get earlier action on the weed problems in the future . YBS BOARD - Alderman Jennings reported the next meeting will be September 13 , 1982 . Mayor Thanepohn thanked all the aldermen who voted for the levy. Given 3..nder my hand and seal at Yorkville, Illinois this day of .. , 19 1°` a ilix P/ J• The Kendall County Record is a newspaper as defined in Act—Chapter 100, Sections 1 and 5, Illinois Revised Statutes. jl * INTERGOVERNMENTAL COOPERATIVE AGREEMENT In accordance with the declaration in Section 10 of Article VII of the Constitution and the Intergovernmental Cooperative Act, the UNITED CITY OF THE VILLAGE OF YORKVILLE ("City" herein) and YORKVILLE COMMUNITY UNIT SCHOOL DISTRICT NO. 115 (" School District" herein) , the parties , agree as follows : WITNESSETH: WHEREAS , property adjacent to Somonauk Street and Game Farm Road in the United City of the Village of Yorkville is used tor City and School District purposes , and the City has leased adjacent acreage from the Illinois Department of Conservation; and WHEREAS , the parties hereto are interested in developing a Yorkville Community Center , Athletic Fields and School Complex thereon; and WHEREAS , it is desirable to set forth an outline of the proposed undertakings , cooperation and responsibilities and financing and operating allocations : NOW, THEREFORE, the City and the School District enter into the following agreements: 1 . 0 DEVELOPMENT OF RECREATIONAL AREAS The City and School District hereby agree to develop the property described upon Exhibit "A" attached hereto and made a part hereof leased from the Illinois Department of Conservation , in accordance with the Development Plan attached hereto as Exhibit "F3" and made a part hereof . 2 . 0 TERM OF THIS AGREEMENT This Agreement and the rights and obligations of the parties shall be coextensive with the term of the Lease attached as Exhibit "A" hereto and made a part hereof. 3 . 0 ENGINEERING AND CONSTRUCTION COSTS OF DEVELOPMENT (a) All plans , basic engineering and initial construction costs for the entire site shall be shared equally by the School District and City. These shall include earth moving and grading. The shared cost of seeding or sodding for the entire site shall include the swale , but exclude the football field . After the site work is completed, (b) The School District shall bear the entire expense of onsite inspection , engineering and construction of any costs directly related to the football field , track and appurtenances that exceed the initial and basic costs in paragraph 3 .0 (a) . These costs shall also include bleachers, grandstands and necessary fencing in relation thereto. (c) The School District and City shall share equally the costs of inspection and the construction phase of engineering , as well as total construction costs for any concession buildings. (d) The School District and City shall share equally the costs of inspection and construction phase engineering, as well as total construction costs for the parking areas west of -2 the proposed football field (excluding existing parking areas and those presently under construction adjacent to the Beecher Community Building and Yorkville Public Library) together with all baseball and soccer fields, as shown upon Exhibit "B" . (e) Selection of all engineers, surveyors and professional help shall be mutually agreed upon by the parties involved. 4 . 0 SWIMMING POOL, ICE RINK AND FUTURE TENNIS COURTS Construction and maintenance costs for swimming pool facilities, tennis courts, and ice rinks, as illustrated upon Exhibit "B" , are not part of this Agreement. 5 . 0 MAINTENANCE The School District shall be responsible for all costs of maintenance of the football field, track , bleachers , lights and appurtenances thereto. Costs of maintenance for the parking area to be constructed west of the football field and the track area shall be shared equally by the School District and the City. The City shall be solely responsible for the maintenance of all of the balance of the property described upon Exhibit "A" , except the facilities described in Paragraph 4 . 0 herein. 6 . 0 USAGE The City will be permitted to use the football field and track upon such conditions as the School District and City : hall determine to be sufficient , but subject to the understanding that the School District will be reasonable in its authorization for use conditioned upon adequate protection for and reimbursement of any damages resulting from such usage. The -3- 1 School District will be permitted to use the balance of the property described upon Exhibit "A" upon such conditions as the City and School District shall determine to be sufficient, but subject to the understanding that the City will be reasonable in its authorization for use conditioned upon adequate protection for and reimbursement for any damage resulting from such usage. It is further understood that control and primary responsibility of the football field, track and adjacent areas shall vest with the School District, and that primary responsibility for control and usage of the balance of the property described upon Exhibit "A" shall remain with the City, it being the intention of the parties that maximum use of the facilities within Exhibit "A" be available to the school student for school activities and the members of the Community in general . 7 . 0 TIME OF CONSTRUCTION Preparatory engineering work, grading and filling, seeding or sodding shall be undertaken in 1982 . Construction of baseball fields shall be completed in 1983 . 8 . 0 REGULATION The Corporate Authorities of the City and the School District will work cooperatively to provide maximum use of the facilities described upon Exhibit "B" , subject to reasonable protection for repair of damage resulting from any usage of the premises by persons present by virtue of the programs or activities maintained by the City and School District. All baseball and soccer fields described upon Exhibit "B" shall be -4- subject to rules and regulations concerning usage jointly adopted by the City and School District. 9 . 0 FEES AND CHARGES Contributions from civic and support booster groups will be sought for the purpose of completion of the facilities described upon Exhibit "B" , with the privilege of such donors being given to designate specific uses of gifts that are mutually acceptable. All fees collected by the City Park Commission for park sponsored activities will be retained by the City to defray expenses of such activities. All fees collected by the School District for school sponsored activities will be retained by the School Dsitrict to defray expenses of such activities. 10 . 0 INSURANCE The City will continue insurance coverages required by the Lease with the Department of Conservation. The School District shall insure that its agents and employees are insured while involved with activities on the leased land. If School District agents and employees are required by the insurer to be added to the coverage provided by the City, all additional premium expense shall be paid by the School District. 11. 0 DEPARTMENT OF CONSERVATION LEASE The City agrees to secure the necessary approval of the Illinois Department of Conservation for the intended usage and participation of the School District in such usage of the premises described upon Exhibit "A" , as required by the City ' s -5- Lease with the Illinois Department of Conservation . The City further agrees not to cancel the Lease Agreement with the Illinois Department of Conservation without first securing the approval of the School District. 12 . 0 RESPONSIBILITY OF THE PARTIES Nothing contained herein shall be construed as delegating or authorizing the expenditure of any public monies or the delegation of any authority by any person or persons in any manner not permitted by law , it being expressly understood that the expenditure of all monies by either the City or the School District shall only be done in such manner as the City Council or School District Board shall specifically authorize.
