City Council Minutes 1981 03-12-81 (R1 )
MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS HELD AT CITY HALL
ON MARCH 12 , 1981 .
Mayor Thanepohn called the meeting to order at 8 : 00 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Clerk Erickson called roll as follows :
Ward 1 - Wolff Ward 2 - Harker Ward 3 - Simmons
Beach Pierce
A quorum was established .
The reading of the minutes of the February 26 , 1981 meeting was waived .
Alderwoman Pierce moved to approve the minutes as presented , seconded
by Alderman Wolff . Motion carried 5-0 .
The reading of the bills was waived . Alderwoman Pierce moved to
authorize payment of the bills presented , seconded by Alderman
Beach . Roll call vote was taken as follows :
Harker - Aye Simmons - Aye Pierce - Aye Wolff - Aye
Beach - Aye
Motion carried 5-0 .
ATTORNEY - Attorney Dickson reported that he has drafted an Amendment
to the Liquor Ordinance , presently in the mail for review by Council ,
but suggested holding passage of the Ordinance until they were ready
to issue the license to the applicant .
Attorney Dickson reported that he has the title reports from the
two burned out homes in the City on W. Washington Street and Dickson
Court and Administrator Madden has seen to the hazardous conditions
by having the homes boarded up . Notices have been sent to the owners
asking for compliance to repair or demolition of the homes . If there
is no response within 15 days , suit will be filed by the City against
the owners .
MAYOR - Mayor Thanepohn requested an Executive Session immediately
following the last business item on the agenda for the purpose of
discussing the Kellet-Weis litigation .
Alderman Wolff moved to grant permission for Glen Davidson & Keith Mount
along with the Yorkville Sports Boosters and Walter Karkow , to use the
City Park and streets in the area Saturday , May Z , 19. rom 7 : 00 AM to
Noon for a 5 and a 10 mile foot race , seconded by Alderman Harker .
Motion carried 5-0 .
Mayor Thanepohn reported that the deed to the approximate 4 acres
of Game Farm land has been received and recorded .
Alderman Harker moved to approve Mayor Thanepohn ' s appointment of
Alderman Beach , to serve the remainder of the term vacated by Linda
Hanback to 1982 , to the Library Board , seconded by Alderwoman Pierce .
Motion carried 5-0 .
Mayor Thanepohn reported that the Ordinance will be enforced by
the Police Department regarding burning of leaves along City Streets
in Countryside Center and other areas of the City , due to the decaying
condition of the streets in the areas where leaves are being burned .
The press was also requested to cooperate in extending the information
through the news media .
CITY CLERK - Clerk Erickson reported that no bids were received
for the sale of the 1980 Chevrolet Impala Police Squad .
TREASURER - There has been a notice published regarding the Public
Hearing on Revenue Sharing scheduled for March 26 , 19R1 at 7 : 30 P . M .
preceding the regular City Council meeting .
POLICE - Alderman Wolff moved to approve the Police Department Report ,
seconded by Alderman Harker . Motion carried 5-0 .
ADMINISTRATIVE ASSISTANT TO THE MAYOR - Alderman Simmons moved to
approve the Department Reports , seconded by Alderman Beach . Motion
carried 5-0 .
PLAN COMMISSION - Alderman Simmons reported the next meeting is
March 24 , 1981 at 7 : 30 P . M . The Demetralis Pre-Annexation Conference
is scheduled for the agenda .

BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Mayor Thanepohn reported on
the March 10 , 1981 meeting . The Farmer ' s Market idea will be implement-
ed with the help of the farm & home extension advisors .
Representatives from the State Commerce Business and Economic Department
were present to discuss industrial and commercial development . The
industrial representative will be present at the next meeting for further
discussion .
COMMUNITY CENTER COMMITTEE - Alderman Wolff moved to refer the following
bills for- the Community Center building to committee for approval :

Architect , Leo Anderson 2 , 500 . 00
Motion was seconded by Alderman Beach . Motion carried 5-0 .
KENDALL FAMILY & YOUTH SERVICES - Alderman Harker reported on the Youth
Service Bureau to be set up by Kendall Family and Youth Services and
funded through monies allocated to the Kendall County Board . There will
be more information available on implementing the programs by April 1 , 1981 .
Mayor Thanepohn read a letter requesting theCity to sponsor 2 youths for
summer employment to be paid for by Kendall Family & Youth Services
program at $400 apiece . The matter was referred to Alderwoman Pierce
to present at a committee meeting .
OLD BUSINESS - ( SQUAD CAR BIDS) - Alderman Wolff moved that due to
not receiving any bids for the sale of the 1980 Chevrolet Impala
Police Squad , they award the bid of $2 , 526 . 00. to Paul l/endrick who
had submitted a bid previously and had not been withdrawn . Motion
was seconded by Alderwoman Pierce . Roll call vote was taken as
follows :

Motion carried 5-0 .
NEW BUSINESS- (WESTPHAL ' S INDUSTRIAL BONDS) - Attorney Grant requested the
City Council adopt a Resolution setting forth the statutory requirements
for the Revenue Bond Act , setting up an agreement for the City of
Yorkville to lend its name to the bond issue to finance the development
of Ron Westphal ' s Chevrolet building . Upon Attorney Dickson ' s review
and recommendation , Alderman Wolff moved to adopt the Resolution
authorizing the Mayor and City Clerk to execute the Memorandum of
Agreement , seconded by Alderman Harker . Roll call vote was taken as
follows :
Simmons - Aye Pierce - Aye Wolff - Aye ( #65- 1981 )

Motion carried 5-0 .

POLICE - Upon Committee Recommendation Alderman Wolff moved to accept
the Bid of Westphal Chevrolet for $8 , 454 . 43 and
authorize purchase of the 1981 Chevrolet Impala Police Squad , seconded
by Alderman Harker . Roll call vote was taken as follows :

Motion carried 5-0 .
SEWER - Alderman Harker referred the Memo from Administrative
Assistant Madden to the Committee Meeting on March 16 , 1981 for
discussion . ,
WATER - Alderman Wolff moved to waive the water permit fees for the
Beecher Community Building , seconded by Alderman Beach . Motion carried
5-0 .
STREETS & ALLEYS - Alderman Beach referred the request of I . D . O .T &
Burlington Northern for a building to house the railroad controls at
Rt . 47 and W . Hydraulic Street to the Committee meeting March 16 , 1981 .

YBS BOARD - Alderman Harker reported the next meeting will be March 16 ,
1981 .
Alderman Beach moved to adjourn the meeting to Executive Session ,
regarding litigation and personnel , seconded by Alderwoman Pierce .
Motion carried 5-0 . (approximately 8 : 45 P . M . )
Regular session was reconvened at approximately 9 : 30 P . M .
Alderman Beach moved to deny the Consent Order in regards to the
Kellett-Weis lawsuit , seconded by Alderman Simmons . Motion carried
5-0 . Attorney Dickson will convey the decision to Attorney Kramer .
Alderman Simmons moved to refer the following Beecher Building
bills to Merchant ' s National Bank with City Council recommendation
that they be paid :
