New Business
1. EDC 2011-37 Building Permit Report for August 2011
Alderman Funkhouser noted the permits seemed to be trending up slightly.
2. EDC 2011-38 Building Inspection Report Summary for August 2011
Per committee request, Ms. Barksdale-Noble said she included the B&F inspection
report.
3. EDC 2011-39 Amendment to the Intergovernmental Agreement Between the United
City of Yorkville and the Bristol Kendall Fire Protection District
Ms. Barksdale-Noble said BKFD also provided input for this agreement and the
amendment will apply to the fee sheet. When the building codes were amended, it
included operational permits and false alarm fees and this agreement will serve to
memorialize this action. It will move forward to City Council and a Public Hearing is not
needed. A draft ordinance was also included.
Alderman Funkhouser asked if the$25 operational permit fee was typical. This fee will 1
cover administrative and paper costs and Ms. Barksdale-Noble said it is a one-time fee.
It will apply to all new or existing businesses that fall into any one of six categories noted
in a memo from her.
This item moves forward to the Council consent agenda.
4. EDC 2011-40 Autumn Creek—PUD Amendment& Re-subdivision of Plzase 1
Final Plat
Ms. Barksdale-Noble gave an overview of this item. In the previous year, the Autumn
Creek ordinance was amended and there was language stating the City would reconsider
a re-plat of townhomes to single family. Pulte has done an analysis of the market trends
to determine the types of homes appropriate for the current market and as a result, have
re-platted their lots. Originally there were 24 multi-family lots with 107 units and 31
single family lots are now proposed reducing the density by 30%.
There was also a requirement for a fiscal impact analysis. Staff was provided with 2010
tax year information about the SSA. Pulte will be required to front fund the SSA in the
amount of$1.8 million. Consequently, there is no negative impact to future
homeowners. Homeowner association fees will also not have a negative impact due to
there-platting. A 1% decrease is expected in each home contribution. According to
Peter Raphael, in order to reduce the density, a portion of the bond has to be pre-paid and
these payments will be made at the time the plats are recorded.
Alderman Teeling asked how Pulte would accomplish decreased homeowner assessment
with fewer people. Pulte will contribute money for this since there is not as much
demand for townhomes and there will be more contributors with single-family homes.
Alderman Funkhouser asked if new products would be available with the new lots.
According to Mr. Daab a new ranch product may be introduced. Ms. Teeling said it is
more advantageous to see some building occurring rather than nothing. She also asked if
this would also take place in Bristol Bay, however, it is not known at this time.
This item will also go to Plan Commission for a Public Hearing in November and then
move forward to City Council.

Additional Business
Mayor Golinski discussed the `Jail of the Dead" at the former jail. He has toured it and
he thinks it is worthwhile project and will attract people downtown. Ms. Teeling also
said proceeds help with expenses there. Some windows have been replaced, painting
has been done and the building has been cleaned. Electrical work will be done and the
drama club is assisting with the theatrical portion. The Fire Department has also
approved the facility. Volunteers are needed according to Mayor Golinski.
There was no further business and the meeting adjourned at 6:50pm.

Over the past several meetings in as many months, City staff has presented various aspects of
consideration for review and potential revision to the impact fees for development within the
community. The impetus of this discussion stemmed from economic hardships experienced by
the building community and in an effort by the City to spur development.
Previous memorandums from Staff examined the Building Permit Fees, City and Non-City
Impact or Transition Fees, and Land-Cash Donations. While Building Permit Fees affect all
construction within the city, Impact or Transition Fees and Land-Cash Donations potentially
affect only new home development. At the direction of the EDC, staff will propose reducing the
municipal building from $5,509 per unit to $1,759 per unit; and also recommend not reducing
building permit fees or utility connection fees as the City's cost of service has not decreased nor
do we believe will these strategies will significantly stimulate housing development.
Based upon this, and the final direction of the EDC, staff has continued to evaluate the current
Land-Cash Donation policy as a means to comprehensively address the impact fee reduction
debate which affects all proposed and under construction residential development within the
City.
Land-Cash Donations
As detailed previously, the City's land-cash ordinance establishes the fair-market value
for any parcel of residential land as a means of determining the per acre fee for cash-in-lieu of
park land donations. Currently, Yorkville's land-cash value is $101,000 per acre for a residential
development. The land-cash value has not been re-evaluated since its most recent amendment in
2006—during the height of the housing boom.
Yorkville's land-cash value is comparable to other local municipalities which range
between $80,000/acre on the low end and upwards to nearly $140,000/acre. Although other
communities, such as Plainfield and Oswego, have preliminarily discussed revising their Land-
Cash Donation requirements, however no community has formally revised or reduced its acre-
valuation in response to stimulate development.
Options for Land-Cash Donation Revision
Should the EDC want to explore revisions to the current Land-Cash Donation Ordinance,
staff has considered the following options for discussion:
1. Development Based Approach — this option proposes that each development is
considered on a case-by-case basis for a consideration in reduction of Land-Cash
Donation whereby the developer provides their own study of the land value based upon
comparable sales and other physical attributes of similarly undeveloped/developed land
(location, current infrastructure, topography, size). This approach is also consistent with

the language of the original Land-Cash Ordinance adopted in 1977 (Ord. ) which states in
Section 1, paragraph C subsection I "In the event of any such objection the developer
shall submit an appraisal showing the 'fair market value" of such improved land in the
area of his development or other evidence thereof and final determination of said `fair
market value"per acre of such improved land shall be made by the City Council based
upon such information submitted by the subdivider or developer and from other sources
which may be submitted to the City Council by the School District or others. " (Refer to
attached).
• Pros — This option would allow require the developer to undertake the
upfront cost of funding the land value study and provide specific data to
consider when evaluating the requested Land-Cash Donation reduction.
• Cons - This will require each development to amend their annexation
and/or development agreements individually and potentially have a great
disparity in land-cash valuations for various developments throughout the
City.
2. Time Limited Reduction with Incremental Increase — this option would require the City
to conduct the initial land appraisal study to determine the current "Fair Market Value"
for and acre of land within Yorkville. If the findings result in a decrease from the present
$101,000/acre, and ordinance could be passed reducing the valuation for a set period of
time (e.g., 2 years) for Land-Cash Donation at which time the Fair Market Value would
incrementally increase a certain percentage a year (i.e., 25% per year for 4 years) until it
fully restores to the current $101,000/acre.
• Pros — This would not require the City to permanently reduce its Land-Cash
Donation to a level that far below other surround communities, thereby
jeopardizing future funding for park developments. This option would also
require only one (1) land appraisal over at least a five (5) year duration.
• Cons - This option requires the front funding of an appraisal by the City which
could cost upwards of tens of thousands of dollars. This option may prove
difficult to administer as it would require the yearly review and calibration of the
land-cash valuation with the potential for the same development to have multiple
Land-Cash contribution valuations at any given time during its construction.
3. No change — this option proposes to keep the "Fair Market Value" at its present
$101,000/acre amount.
• Pros—This option requires no recalculation to Land-Cash Donations of current or
future developments, or amendments to already approved annexation agreements.
• Cons — May potentially prolong the stall in development entitled property within
the City.
Staff is seeking input for the committee to see if there is enough interest to pursue any of the
options mentioned-above. I will be available at Tuesday night's meeting to discuss the
information provided in this memo in greater detail.

ORDINANCE AMENDING
UNITED CITY OF YORKVILLE LAND CASH ORDINANCE No. 96-3,2003-12,2004-22
and 2005-37
WHEREAS, the United City of Yorkville, after careful consideration by the Mayor and
City Council has determined it necessary to amend Land Cash Ordinance No. 1993-3 and No.
2003-12 (Section 1.C.5--Fair Market Value)to reflect a substantial increase in the fair market
value of improved residential real estate based upon a study prepared by a certified appraiser;
and,
WHEREAS, the United City of Yorkville, after careful consideration by the Mayor and
City Council has determined that it is in the best interests of the community to amend Land Cash
Ordinance No. 1996-3 and No. 2003-12 (Section 1.C.5--Fair Market Value), and to the extent
that Ordinance No. 2004-22 and Ordinance No. 2005-37 amended Section 1.C.5--Fair Market
Value, to amend that Ordinance as well.
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE UNITED CITY OF YORKVILLE,upon Motion duly made, seconded and approved by a
majority of those so voting that:
1. Section 1.C.5,Fair Market Value of the Land Cash Ordinance 1996-3 and 2003-
12 are amended to reflect that the"Fair Market Value"for any parcel of
residential real property shall be deemed to be one hundred and one thousand
dollars and 00/100 per acre($101,000 acre)based upon the study by Thompson
Appraisals dated August 10, 2006.
2. The Land Cash Valuation Analysis and Report prepared by Thompson Appraisals
dated August 10, 2006 is incorporated by reference herein.
3. To the extent that Ordinance 2005-37 has previously amended said Section 1.C.5,
this Ordinance shall supercede 2005-37 beginning with the affective date of this
Ordinance until such time as Section 1.C.5 may be amended in the future.
4. Any Ordinance or parts thereof that conflict with the provisions of this Ordinance
are hereby repealed to the extent of such conflict.
5. The various parts, sections, clauses of this Ordinance are hereby declared to be
severable. If any part sentence, paragraph section, or clause is adjudged
unconstitutional or invalid by a Court of competent jurisdiction,the remainder of
the Ordinance shall not be affected thereby.

AN ORDINANCE FOR THE CITY OF YORKVILLE
TO PROVIDE FOR DEDICATIONS OF PARK LAND,
SCHOOL SITES OR FUNDS OR ITS EQUIVALENT IN LIEU THEREOF
WHEREAS, in recent years the City of Yorkville has experienced a rapid
population increase due principally to the subdivision and planned unit
development of vacant land within the jurisdiction of the City; and
WHEREAS, a planning study has indicated that such population growth will
accelerate during the next ten years resulting in the rapid disappearance of
available land and the marked increase in land values; and
WHEREAS, the City has found that healthful, productive community life
depends in part on the availability of recreational and park space and adequate
school facilities; and
WHEREAS, it is hereby found and determined that the public interest,
convenience, health, welfare and safety requires that a minimum of 6.5 acres of
land for each 1,000 persons residing within this City be devoted to park and
recreational purposes; and
WHEREAS, it is hereby found and determined that the public interest,
convenience, health, welfare and safety require the establishment of school sites
within the City in accordance with the following criteria which is consistent with
the minimum site recommendations of the Office of the State Superintendent of
the Illinois Office of Education and the School Districts operating within the
jurisdiction of the City:
600-capacity elementary schools on eleven (11) acres of land. (Illinois Office of
Education Standards-minimum of five (5) acres plus an additional acre for each
100 pupils of predicted enrollment).
750-capacity junior high schools on twenty-eight (28) acres of land. (Illinois
Office of Education Standards -minimum of twenty (20) acres plus an additional
acre for each 100 pupils of predicted enrollment or an appropriate number of
acres per 100 pupils of predicted enrollment).
1,500-capacity high school schools on forty-five (45) acres of land. (Illinois Office
of Education Standards -minimum of thirty (30) acres plus an additional acre for
each 100 pupils of predicted enrollment); and
WHEREAS, demographic studies of the residential portions of a proposed
subdivision or planned unit development can be readily and scientifically
conducted to determine the number of elementary and secondary school-age
children and adults to be generated therefrom, and provide a method whereby the
required dedications of land directly attributable to the activity of the
sub-divider-developer and the proposed subdivision or planned development may
be calculated; and
WHEREAS, it has been found and determined that the location of park and
recreation and school sites to serve the immediate and future needs of residents
and children of each new subdivision, mobile home park, or planned unit
development is just as essential to proper land development as are streets, water,
sewers and sidewalks, and to that end the City of Yorkville has determined that
the dedication of land for park and recreation and school sites or cash
contributions in lieu of actual land dedication (where the latter is deemed
impractical) or a combination of both, shall be required of each subdivider, or
developer of a planned unit development.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, as follows:
SECTION 1
Dedication of Park Lands and School Sites or
For Payments of Fees in Lieu Thereof
As a condition of approval of a final plat of subdivision, or of a final plat of a
planned unit development, each subdivider or developer will be required to
dedicate land for park and recreational purposes and land for school sites, to serve
the immediate and future needs of the residents of the development, or cash
contribution in lieu of actual land dedication or a combination of both at the option
of the City, in accordance with the following criteria and formula:
A. Criteria for Requiring Park and Recreation Land Dedication.
1. Requirement and Population Ratio.
The ultimate density of a proposed development shall bear directly upon the
amount of land required for dedication. The total requirement shall be 6.5
acres of land per 1,000 of ultimate population in accordance with the following
classifications:

2. Credit for Private Open Spaces and Recreation Areas.
When subdividers or developers provide their own open space for recreation
areas and facilities, it has the effect of reducing the demand for local public
recreational services. Depending on the size of the development a portion of
the park and recreation area in subdivisions or planned unit developments
may, at the option of the City Council, be provided in the form of
``semi-private"* open space in lieu of dedicated "public" open space. The
extent of same shall be determined by the City Council based upon the needs
of the projected residents, and in conformance to the total park and recreation
land for the general area.
* A semi-private open space would be described as a "mini-park area" within a
development and used primarily by the residents of that development.

In general, a substitution of semi-private open space for dedicated parks will
imply a substantially higher degree of improvement and the installation of
recreational facilities, including equipment by the developer as part of his
obligation. Detailed plans of such areas, including specifications of facilities
to be installed must be approved by the City, and before any credit is given
for private recreation areas, the subdivider or developer must guarantee that
those semi-private recreation areas will be permanently maintained for such
use by the execution of the appropriate legal documents. Private "swimming
clubs" are included in this provision. A copy of "Suggested Criteria for
Swimming Pool Development" as adopted by the Yorkville City Council shall
be used for the guidance of the developer. When an adjustment for private
recreation areas is warranted, it will be necessary to compute the total park
land dedication that would have been required from the subdivision or
planned unit development and then subtract the credit to be given.
B. Criteria for Requiring School Site Dedication.
1. Requirement and Population Ratio.
The ultimate number of students to be generated by a subdivision or planned
unit development shall bear directly upon the amount of land required to be
dedicated for school sites. The land dedication requirement shall be
determined by obtaining the ratio of: (a) estimated children to be served in
each such school classification over the (b) maximum recommended number
of students to be served in each such school classification as stated herein,
and then applying such ratio to the (c) said minimum recommended number
of acres for a school site of each such school classification as stated herein.
The product thereof shall be the acres of land deemed needed to have
sufficient land for school sites to serve the estimated increased children in
each such school classification.
2. School Classifications and Size of School Site.
School classifications and size of school sites within the City shall be
determined in accordance with the following criteria:

3. Location.
The Comprehensive School Plan and/or the appropriate standards adopted by
the affected School District shall be used as a guideline in locating sites. A
large map of the school district, identifying the general vicinity planned for
future school sites will be located in the school district's office.

C. Criteria for Requiring a Contribution in Lieu of Park and School Sites.
Where the development is small and the resulting site is too small to be
practical or when the available land is inappropriate for park and recreational
purpose or a school site, the City shall require the subdivider or developer to pay a
cash contribution in lieu of the land dedication required. The word small in this
section is defined as a total number of proposed dwelling units that will produce
less than the maximum number of students for one school of each school
classification as set forth in Section 2.
School Classifications and Size of School Site. The cash contributions in lieu of
park and recreation land dedication shall be held in trust by the City, or other
public body designated by the City, solely for the acquisition of park and
recreation land as hereinbefore classified, which will be available to serve the
immediate or future needs of the residents of that subdivision or development or
for the improvement of other existing local park and recreation land which already
serves such needs. The cash contributions in lieu of school sites shall be held ir_
trust by the City, or other public body designated by the City, solely for use in the
acquisition of land for a school site to serve the immediate or future needs of
children from that subdivision or development or for the improvement or
expansion to any existing school site which already serves such needs, but not for
the construction of any school buildings or additions thereto. If any portion of a
cash contribution in lieu of park and recreation land dedication, or cash
contribution in lieu of school site is not expended for the purposes set forth herein
within ten years from the date of receipt, it shall be refunded to the developer who
made such contribution.
1. Fair Market Value.
The cash contributions in lieu of land shall be based on the "fair market
value" of the acres of land in the area improved that otherwise would have
been dedicated as park and recreation and school sites. It has been
determined that the present "fair market value" of such improved land in
and surrounding the City is$15,000.00 per acre and such figure shall be used
in making any calculation herein unless the subdivider or developer files a
written objection thereto. In the event of any such objection the developer
shall submit an appraisal showing the "fair market value" of such improved
land in the area of his development or other evidence thereof and final
determination of said "fair market value" per acre of such improved land
shall be made by the City Council based upon such information submitted by
the subdivider or developer and from other sources which may be submitted
to the City Council by the School District or others.
2. Criteria for Requiring Dedication and a Fee.
There will be situations in subdivisions or planned unit developments when a
combination of land dedication and a contribution in lieu of land are both
necessary. These occasions will arise when:
(a) Only a portion of the land to be developed is proposed as the location for
a park or school site. That portion of the land within the subdivision falling
within the park or school location shall be dedicated as a site as aforesaid,
and a cash contribution in lieu thereof shall be required for any additional
land that would have been required to be dedicated;
(b) A major part of the local park or recreation site or school site has already
been acquired and only a small portion of land is needed from the
development to complete the site. The remaining portions shall be required

by dedication, and a cash contribution in lieu thereof shall be required.
D. Density Formula.
The attached table, marked as Table No. 1, the same being an Estimated
Ultimate Population Per Dwelling Unit, is generally indicative of current and short
range projected trends in family size for new construction and shall be used in
calculating the amount of required dedication of acres of land or the cash
contributions in lieu thereof unless a written objection is filed thereto by the
subdivider or developer.
In the event a subdivider or developer files a written objection to the Table of
Estimated Ultimate Population Per Dwelling Unit, attached hereto, he shall
submit his own demographic study showing the estimated additional population to
be generated from the subdivision or planned unit development and in that event
final determination of the density formula to be used in such calculations shall be
made by the City Council, based upon such demographic information submitted
by the subdivider or developer and from other sources which may be submitted to
the City Council by the School District or others. It is recognized that population
density, age distribution and local conditions change over the years, and the
specific formula for the dedication of land, or the payment of fees in lieu thereof,
as stated herein is subject to periodic review and amendment if necessary.
E. Reservation of Additional Land.
Where the School District's comprehensive plan or the standards of the City call
for a larger amount of park and recreational land or school sites in a particular
subdivision or planned unit development than the developer is required to
dedicate, the land needed beyond the developer's contribution shall be reserved
for subsequent purchase by the City or other public body designated by the City,
provided that such acquisition is made within one year from the date of approval of
the final plat.
F. Combining with Adjoining Developments.
Where the subdivision or planned unit development is less than 40 acres, public
open space or a school site which is to be dedicated should, where possible, be
combined with dedications from adjoining developments in order to produce
usable recreation areas or school sites without hard_ ship on a particular developer.
G. Topography and Grading.
The slope, topography and geology of the dedicated site as well as its
surrounding must be suitable for its intended purposes. Grading on sites
dedicated for park and recreational uses shall not differ greatly from surrounding
land.
H. Improved Sites.
All sites shall be dedicated in a condition ready for full service of electrical,
water, sewer and streets (including enclosed drainage and curb and gutter) as
applicable to the location of the site, or acceptable provision made therefor. The
sidewalks and trees normally included within the definition of "improved" sites
may be deleted due to the delay time between dedication of any such school site
and construction of school facilities thereon.
I. Time of Conveyance or Payment.
The subdivider or developer shall convey to the respective school districts the
land required under this agreement within thirty days after any subdivision plat or
final plat of a planned unit development is recorded in the County Clerk's office, or
a conditional use permit is granted by the City Council. All improvements shall be
completed within such time as required by the City. A subdivider, developer or
builder shall make each cash contribution required under this ordinance directly at
the Administrative Offices of the School District wherein the development,
subdivision or building is located. Said School District shall issue a receipt as
evidence of said payment. The City will not issue the Certificate of Occupancy to
the subdivider, developer, or builder without said receipt of payment.
SECTION 2
The dedications of land or cash contributions in lieu thereof required by this
Ordinance shall also be required as a condition to the annexation of any land to the
City and provisions therefor shall be incorporated in any pre-annexation
agreement governing such land.
SECTION 3
This Ordinance shall be applicable only to building lots, as defined by the
present Building Code and Zoning Ordinance, created by a division of an existing
tract or parcel of land or by platting subsequent to the effective date of this
Ordinance.
SECTION 4
If any provisions of this Ordinance, or the application thereof to any person or
circumstances, is declared invalid by a court of competent jurisdiction, such
partial invalidity shall not affect other provisions or applications of this Ordinance,
which can be given effect without the invalid provision or application thereof, and
to this extent the provisions of this Ordinance are declared to be coverable.
SECTION 5
That this Ordinance shall be in full force and effect from and after its passage as
provided by law and shall be published in pamphlet form by authority of the City
Council of the City of Yorkville.

Subject: Ordinance for ComEd
We are requesting that ComEd not release the electrical services on any change of
occupancy on any commercial occupancy. The current ordinance requires that anytime an
existing occupancy is changed, the new occupant must come to City Hall and fill out the
Certificate of Occupancy Change form and get an inspection by the City of Yorkville and the
Kendall Bristol Fire Department. We are asking that ComEd not release the services until the
occupant obtains a Certificate of Occupancy and we are able to make an inspection of the
location, business type, and zoning, prior to the release of electrical services.

AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL
COUNTY,ILLINOIS, REQUIRING THE ISSUANCE OF A CERTIFICATE OF
OCCUPANCY PRIOR TO THE TRANSFER OF ELECTRIC UTILITY SERVICE
FOR A NEW OR DIFFERENT BUSINESS USE
WHEREAS, the United City of Yorkville (the "City") is a duly organized and
validly existing non home-rule municipality created in accordance with the Constitution
of the State of Illinois of 1970 and the laws of the State; and,
WHEREAS, pursuant to Section 5/11-30-4 of the Illinois Municipal Code (65
ILCS 5/11-30-4) the City may adopt rules and regulations for the construction, alteration,
maintenance and occupancy of all property, buildings and structures in the City and in
addition pursuant to its powers to protect the public's health, welfare and safety this
Ordinance is adopted.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That Title 8, Chapter 2, Section 8-2-2 of the Yorkville City Code, as
amended,be and is hereby amended by adding subsection C to read as follows:
"C. Whenever a certificate of occupancy for a business use is required pursuant to
Section 10-14-4A of this City Code, it shall be unlawful for a public electric utility
service provider in the City to transfer the electrical service to a new or different business
customer without receiving notice from the City that the City has issued a certificate of
occupancy for the building or portion thereof to be occupied by that business customer's
use."
Section 2. This Ordinance shall be in full force and effect upon its passage,
approval, and publication as provided by law.
