The meeting was called to order by Chairman Gary Golinski at 6:30pm at which time he
welcomed all attendees.
Minutes for Correction/Approval July 6, 2010 and October 5, 2010
The minutes were approved as read.
Items Recommended by Plan Commission for Approval
1. PC 2010-12 Christofferson PUD Amendment for Rezoning
Ms. Barksdale-Noble recapped this item and said these 3 parcels on Van Emmon Road
were originally zoned for PUD R-2 duplex. A request was made for B-2 for business
district. The Plan Commission voted favorably with five conditions being requested.
There is no plan for the property at this time,but the purpose is to rezone and re-classify
the property. This item will move forward to the Council consent agenda.
2. PC 2010-13 Text Amendment for OTB
The petitioner for this amendment is Ultimate Sports Bar and they are seeking to identify
an off-track betting facility as a special use in a B-2 district. The amendment will contain
a definition of an OTB (Off-Track Betting) facility and will only allow the facility to be
no more than 45% of floor area in a restaurant. At a recent Plan Commission meeting, it
was approved 7-2.
Alderman Werderich voiced his opinion and said that he was not 100% supportive of this
as a text amendment when it proceeds to the regular Council agenda. 1
3. PC 2010-14 Special Use for OTB
The OTB petitioner, Hawthorne Race Course,has asked for special use approval for an
OTB facility within a B-2 district inside the Ultimate Sports Bar. Alderman Spears said
she previously had concerns about parking for the facility, however, that issue was
already addressed. Tenants at the Kendall Marketplace agreed to allow overflow parking
with a 15-day notice. It was also noted that there are 20 parking spaces in the strip mall
with additional parking in the back. Local businesses in the strip mall near the OTB are
in favor of this facility also. This item will appear on the Council regular agenda
December 14.
New Business
1. EDC 2010-38 Building Permit Report for September and October 2010
Paul Zabel reported a small number of homes being built in Autumn Creek. No further
discussion.
2. EDC 2010-39 Building Inspection Report Summary for September and October
2010
It was noted that a Senior Engineering Tech has been assisting in inspections. Alderman
Spears asked about the high proportion of inspection failures from TPI. Mr. Zabel said
he is working with TPI and contractors about issues resulting in these failures. It was
noted that TPI charges for a second inspection, however, the City does not. Using a local
contractor was discussed, however, it could be a conflict of interest and inconsistencies
could also result. Mr. Zabel will look at the possibility of other contractors and report to
the committee next month.
3. EDC 2010-40 Foreclosure Update for October and November 2010
Ms. Barksdale-Noble said that the auction properties remained consistent for August-
October. Bank-owned homes increased in September and October and pre-foreclosures
stayed the same between August and November.
4. EDC 2010-41 Economic Development Committee Meeting Dates for 2011
It was agreed that in 2011, the committee would continue to meet on the first Tuesday of
the month at 6:30pm. The only exception will be in April.
5. EDC 2010-42 AT&T License Agreement Renewal
This agreement with AT&T would extend the city's lease of parking spaces behind their
building at 116 E. Hydraulic for an additional 5 years to September 30, 2015. The City
Attorney has reviewed this agreement. This item will advance to the Council consent
agenda for a vote.
6. EDC 2010-43 Eldamain Road Reconstruction —Intergovernmental Agreement
The City Attorney has reviewed this agreement, however, the City will not have to pay
anything until the property develops. At that time, the city may choose to pass this cost
on to the developer. This will move to the Council consent agenda.

Old Business
1. EDC 2010-23 Telecommunications Tower Fees
Staff was asked to look at fee structures for these towers when building permits are
requested. The flat fee decided upon was $750 each for the tower and shelter. A $250
fee will be charged for antenna locators. Ms. Barksdale-Noble will draft the ordinance
changes and bring this back to the next EDC meeting.
2. EDC 2010-29 Building Code Update Committee—Status Report
This committee met for their kickoff meeting on July 19 and has met each month since.
Mr. Zabel recapped their discussions and it is anticipated that the committee will
complete their reviews by early 2011.
3. EDC 2010-28 Zoning Commission —Status Report
This commission has met since May and finished 7 chapters. The members reviewed
state statutes, PUD ordinance, interactive conservation design, overlay of downtown area,
and solar energy as an alternative source. They expect to be done by fall of 2011
according to Ms. Barksdale-Noble.
Additional Business
Chairman Golinski asked about the impact of loss of personnel from Community
Development and Mr. Olson said any specific projects may be outsourced. Map services
may be diminished and it was noted that the software must be purchased or have
licensing. In previous discussions, the City talked about allowing other municipalities to
hire City personnel for outsource work such as mapping. At this time, the market is
saturated for this type of work according to Mr. Olson.
There was no further business and the meeting was adjourned at 7:20pm.

Subject: Foreclosure Update—2010 Summary
Attached is the monthly foreclosure report for December 2011 provided by the Yorkville
Economic Development Corporation (YEDC) for the cities of Yorkville, Plano, Oswego and
Montgomery in Kendall County, Illinois. The following tables summarize the trend in foreclosures
during various stages of the process including pre-foreclosure, bank-owned and auctioned properties for
the City of Yorkville throughout 2010.
Year-End Review
The number of auctioned properties in Yorkville remained relatively consistent during the first
quarter of 2010 averaging around 40 properties per month; however, there was a significant increase in
auctioned homes in April and then again in November. Although, bank-owned properties in Yorkville
were high throughout 2010, they were stable the majority of the year but increased by approximately
5.5% to 410 properties in October but fell slightly in November. Pre-foreclosure properties in Yorkville
showed the largest decline during the Yd and 0 quarter of 2010, averaging about 330 between January
and July. In August, pre-foreclosure properties decreasing by nearly 24% to 246, but began to rise
slightly by year's end.

Attached are the monthly foreclosure reports for January and February 2011 provided by the
Yorkville Economic Development Corporation (YEDC) for the cities of Yorkville, Plano, Oswego
and Montgomery in Kendall County, Illinois. The reports list the number of foreclosures during
various stages in the process including pre-foreclosure, bank-owned and auctioned properties for the
City of Yorkville since the beginning of the calendar year(refer to table below).
The number of auctioned properties remained level in the months of January and February.
No significant changes were observed in the number of bank-owned or pre-foreclosure properties in
Yorkville during this same time period, with each category slightly decreasing by less than 4%.
Overall, it appears the total inventory of foreclosed properties in Yorkville is beginning to "level-
out" after reaching a peak of 761 properties in December 2010.

At the request of Alderman Golinski, staff has placed this item on the EDC agenda for
discussion and to provide an overview of the TIF Assistance Application process in general.
In June 2010, representatives from Grainco FS, Inc., which owns several properties
within the downtown, approached city staff seeking Tax Increment Finance (TIF) assistance
funds for the demolition of buildings and site preparation in the amount of$104, 450.00 for three
properties located at 111-113 East Van Emmon Street.
Upon receipt of the application for TIF Assistance, the city staff and attorney reviewed
the provided real estate tax bills and contacted the Kendall Township Tax Assessor and Kendall
County Supervisor of Assessors to inquire about the impact to the assessed valuation of the
properties if the buildings were torn down. It was apparent that there would have been a major
negative impact on the TIF increment dollars generated for the overall district since the largest
portion of the assessed value of the Grainco FS property is based upon the value of the site
improvements (buildings), rather than the land. Brent Ericson, General Manager for Grainco FS,
was made aware of our findings and was told the city would be interested in approving an
agreement when they had secured a developer that was interested in redeveloping site.
Attached for your reference are copies of the TIF Assistance Application submitted by
Grainco Fs, Inc., 2010 Kendall County Real Estate Tax Bills for the Grainco properties, and
eligible redevelopment project costs as prescribed under the Illinois' TIF Act. Also included is
an aerial of the properties and photographs of the buildings on the site.

ELIGIBLE REDEVELOPMENT PROJECT COSTS.
Under the TIF Act, monies in the TIF Fund may nnl_v hi-. ?x_pended fnr the fnlln�zen� (fs
ILLS 5/11-74.4-3(q):
1. costs of studies, surveys, development plans, architectural, legal, financial,
administration of the redevelopment plan including staff; provided,
however:
a. No charge for professional services may be based on a percentage
of the tax increment collected; and,
b. No contract for professional services (except architectural and
engineering may extend beyond a period of three years).
2. annual administrative costs shall not include overhead or administrative
costs of the municipality which still would have been incurred had the
municipality not designated a TIF;
3. marketing of the redevelopment project area;
4. acquisition of land; demolition of buildings; site preparation; clearing and
grading of land; environmental clean up or environmental barrier;
S. rehabilitation, reconstruction, repair, remodeling of public or private
buildings, fixtures and leasehold improvements; and the cost of replacing
an existing public building if demolished to use the site for private
investment;
6. cost of construction of public works but not to include the cost of
construction of a new municipal building principally used for offices,
storage, vehicle storage, conference facilities unless as provided in 5.
above.
7. job training and retraining programs implemented by businesses within the
redevelopment project area;
S. financing costs related to issuance of obligations (issued by the
municipality) including interest accruing during construction but not
exceeding 36 months.
9. to the extent the municipality,by written agreement, accepts and approves
the same, all or a portion of a taxing district's capital costs resulting from
the redevelopment project necessarily incurred or to be incurred within a
taxing district in furtherance of the objectives of the redevelopment plan
and project;
10. a school district's increased costs attributable to housing units for which a
developer receives financial assistance due to a net increase in students, so
long as requested after July 1 and before September 30 of each year and
failure to do so with evidence of expenditures forfeits the right to
reimbursement for that year (the calculation of such costs is dependent
upon the mechanism of funding for a school district);
11. a public library district's increased costs due to housing units for which
the developer receives financial assistance and experiences an increase in
the number of patrons;
12. relocation costs to the extent a municipality determines that relocation
costs shall be paid or are required to be paid by state or federal law;
13. payment in lieu of taxes due to revenues which would have been received
had not the municipality acquired land in the redevelopment project area;
14. costs of job training provided that such costs are for persons employed by
employers located within the TIF and when incurred by a taxing district;
15. interest costs of a developer relating to a redevelopment project not
exceeding 30% of the total interest costs unless the project is new housing
units for low and very low-income households; and,
16. costs of day care for employees working for a business in a TIF, provided
that the TIF is located within a municipality with a population of more
than 100,000.

Subject: Proposed Developer/Petitioner Deposit Account Form
In an ongoing effort to formalize the process and tracking of developer/petitioner deposit
accounts, staff has created the attached standardized form which we propose to include as part of the
development application. The form provides an explanation to the petitioner of why a deposit
account is needed; what the funds will be used to cover; how and when additional funds may be
request; and the process for requesting refunds of remaining balances. The form also serves as an
acknowledgement of financial responsibility for the applicant or an identified responsible party, and
giving notice that all City-related work on application's with deficient balances may stop unless
additional funds are received.
The attached form has also been reviewed by the City Attorney and Finance Director, and is
being provided as an informational item to the Economic Development Committee. Should you have
any questions; staff will be available at Monday night's meeting to discuss in greater detail.

Petitioner Deposit Account Fund:
It is the policy of the United City of Yorkville to require any petitioner seeking approval on a project or entitlement request to
establish a Petitioner Deposit Account Fund to cover all actual expenses occurred as a result of processing such applications and
requests. Typical requests requiring the establishment of a Petitioner Deposit Account Fund include, but are not limited to, plan
review of development approvals/engineering permits. Deposit account funds may also be used to cover costs for services related to
legal fees, engineering and other plan reviews, processing of other governmental applications, recording fees and other outside
coordination and consulting fees. Each fund account is established with an initial deposit based upon the estimated cost for services
provided in the INVOICE & WORKSHEET PETITION APPLICATION. This initial deposit is drawn against to pay for these
services related to the project or request. Periodically throughout the project review/approval process, the Financially Responsible
Party will receive an invoice reflecting the charges made against the account.At any time the balance of the fund account fall below
ten percent (10%) of the original deposit amount, the Financially Responsible Party will receive an invoice requesting additional
funds equal to one-hundred percent(100%)of the initial deposit if subsequent reviews/fees related to the project are required. In the
event that a deposit account is not immediately replenished,review by the administrative staff,consultants,boards and commissions
may be suspended until the account is fully replenished. If additional funds remain in the deposit account at the completion of the
project,the city will refund the balance to the Financially Responsible Party.A written request must be submitted by the Financially
Responsible Party to the city by the 15th of the month in order for the refund check to be processed and distributed by the 15th of the
following month. All refund checks will be made payable to the Financially Responsible Party and mailed to the address provided
when the account was established.

Staff has worked with the City Attorney to prepare a comprehensive fee schedule for all
zoning applications and petitions which codifies all City fees and deposits in a single ordinance. The
attached draft ordinance is complimentary to the proposed "Petitioner Deposit
Account/Acknowledgement of Financial Responsibility" form, and does not change any fees already
approved by the City Council in the various sections of the Code.
This draft ordinance is being provided as an informational item to the Economic
Development Committee at this time. Staff will be available to discuss this matter in greater detail
should the committee have any questions.

AN ORDINANCE AMENDING THE YORKVILLE CITY CODE
OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,ILLINOIS,
BY CODIFYING FEES AND DEPOSITS INTO THE YORKVILLE CITY CODE
BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville,
Kendall County, Illinois, as follows:
Section 1. That Title 10, Chapter 14, Section 10-14-9 of the Yorkville City Code, as
amended, is hereby amended to read as follows:
"10-14-9 FEES: All applications shall be accompanied by the
appropriate fees and deposits required by the Yorkville City Code.
Section 2. That Title 1, Chapter 7, Section 1-7-9B of the Yorkville City Code, as
amended, is hereby amended to read as follows:
`B. Fees:
1. An application for the following requests shall be accompanied by the
following fees:
a Annexation $250.00 plus $10.00 per acre

2. The annexation—weather warning siren fee in subsection lb above shall fund
a weather warning siren system payable at the earlier of the time of final plat
approval for the portion of the property subject to a particular final plat, or at
the time of building permit issuance if the property is not subdivided.
3. In the event that annexation application and zoning district amendment are
filed at the same time, only one per acre fee shall be charged to the applicant"
Section 3. That Title 1, Chapter 7, Section 1-7-9 of the Yorkville City Code, as amended,
is hereby amended by adding subsection C to read as follows:
"C. Deposits: An application requesting an action listed in B.1 above shall be
accompanied by the following deposit:
1. Outside Consultant and Third Party Costs Deposit
Less than 2 acres $1,000.00
Over 2 acres and less than 10 acres $2,500.00
Over 10 acres $5,000.00
2. The deposited funds shall be held in escrow and used for legal, land planning,
zoning, environmental or other consultant services provided to the City not
otherwise covered by required fees and for administrative processing costs
consisting of the following:
a. Publication of legal notice for each hearing
b. Postage for sending or the cost for posting required notices
c. Any cost incurred by the City payable to a third party required for the
processing, review or approval of the application, including but not
limited to, additional copying or exhibit costs, court reporter fees if a
court reporter is deemed necessary, and document recording fees.
3. At any time the balance of the deposit shall fall below ten percent (10%) of
the original deposit amount, the applicant shall receive an invoice requesting
additional funds equal to one hundred percent (100%) of the initial deposit if
subsequent fees related to the project are required.
4. In the event that a deposit account is depleted and not replenished all further
review, consideration or approval shall be suspended until the account is
replenished.
5. Unused funds shall be refunded to the applicant upon written request by the
applicant to the City by the 15th of the month in order for the refund check to
be processed and distributed by the 15th of the following month. All refund
checks shall be made payable to the applicant and mailed to the address
provided when the deposit was established unless otherwise advised in writing
by the applicant to the Community Development Director.

6. Payment to all consultants retained by the City in any capacity connected with
the application shall be based on agreements with those consultants approved
by the City.
7. At no time shall there be any transfer of funds directly from any applicant to
any consultant. All payments to consultants shall be executed only under their
agreements with the City and developers shall be only invoiced directly by the
City."
Section 4. This Ordinance shall be in full force and effect upon its passage, approval,
and publication as provided by law.

Subject: Telecommunications Tower Building Permit Fees
At the October EDC meeting, staff presented research from various municipalities
throughout the region regarding building permit fees for telecommunication (cell) towers.
Although it was noted that the methodology for calculating telecommunication towers permit fee
varied widely, Yorkville's permit fees were less than the average fee assessed among the
communities surveyed (see attached). Therefore, it was the consensus of the committee for staff
to prepare recommendations for increasing telecommunication tower permits fees. The
committee also requested staff provide a comparison of the recommended permit fee increase
with telecommunication tower permit fees of surrounding municipalities to ensure our fees
remain competitive.
Staff Recommendations:
Upon review of the current schedule of fees associated with new telecommunication
tower building permits, staff recommends the following:

As proposed, the fees for the telecommunication tower and fence permit will remain the
same. However, the new fee structure establishes a flat fee for equipment shelters at $750.00 and
proposes a $250.00 fee per antenna. It is staff's opinion that a flat rate for equipment shelter fees
simplifies the permit calculation, and results in a net increase of approximately $50 per shelter
since the average equipment shelter is roughly 200 to 250 square feet. Staff also recommends a
separate fee for antennas as most, if not all, cell towers allow for collocation of several wireless
providers antennas. Currently, the City has no standardized fee for the installation of additional
antennas on existing cell towers.
Therefore, under the proposed new schedule of fees the typical building permit for a new
200-foot tall tower with antenna, fence and an approximately 250 square foot equipment shelter
would increase from about $1,500.00 to $1,800.00. This represents a 17% increase in building
permit fees for new cell tower construction. Staff is not proposing a separate plan review fee at
this time, as plans for new towers are required by the Federal Communications Commission
(FCC) to have structural engineering review performed by a licensed professional prior to
building permit submittal. Furthermore, most communities surveyed do not charge for plan
reviews or it is included in the permit application fee.

Surrounding Municipalities:
Attached to this memorandum is a table that illustrates building permit fees for
telecommunication towers in nearby municipalities which ranges from $550 (Kendall County) to
$4,000 (Joliet). Although the proposed new building permit fee of $1,800 is higher than the
County (as is the current fee), staff is confident that the permit fees will not discourage future
construction of towers within the community since tower location is dictated by such
considerations as gap in coverage, population density and local topography.
If the EDC is in agreement with the staff s recommendations, a draft ordinance of
the proposed amendments to the building permit fee schedule will be provided at the next
meeting for consideration.
