Chairperson Werderich called the meeting to order at 6:03 pm.
MINUTES FOR CORRECTION / APPROVAL
The minutes of the February 25, 2010 meeting were approved as submitted.
NEW BUSINESS: Mqw
1. PS 2010-06 Police Reports for February and March, 2010
Committeeman Spears what will happens with the vehicles that were supposed to
be replaced in 2008 and 2009. Chief Hart explained that the Police Department
has 3 vehicles for sale and is looking to replace 2 more this year. Additionally,
A: since some of the vehicles are older and should have been replaced, the Police
Department will need to add additional funds under maintenance for the next 2
years. He noted that the older the vehicle gets, the more costly the repairs are.
The request for 2 vehicles will be on the next agenda, if approved, they will be
purchased with capital funds.
2. PS 2010-07 Open Burning Ordinance- Discussion
Chairperson Werderich stated that Alderman Sutcliff asked him to put this item
on the agenda as a result of a resident letter. In summary, the letter states that the
resident's neighbor has an open pit for fires and the problem is that they leave the
fire burning unsupervised at the end of the night. The resident is suggesting that
the City amend the ordinance such that a person much supervise any fire that is
burning. Committeeman Plocher stated that in this particular situation, there is
more going on than just a complaint about open burning in that there is a neighbor
feud going on and the police have been called in the past. Chief Hart stated that
officers have responded there regarding the burning and have felt that there was
no issue. He stated that the police responded twice in one evening recently and
the first time the fire was already extinguished. The second time embers were

burning that the Sergeant extinguished. There was really nothing else that the
Police Department could do because embers could pick up again due to wind.
Committeemen Munns and Plocher expressed a desire to enforce the ordinance
already in place. Chief Hart stated that item#2 of the Open Burning Ordinance
could create confusion. He stated this is not normally an issue, but if the
committee wants more clarification he suggests clarifying the last sentence of that
item that states that "fire are conducted in such a manner so as not to constitute a
hazard or nuisance to persons or property". Ah�

Committeeman Spears stated that when this ordinance was worked on, fire rings
and fire pits were part of the language. She feels that the ordinance should be
changed because in this circumstance, the fire is held at the back of the property
line near the resident's carriage house and is left burning unattended. She feels
that language should be added that states that all fires should be extinguished
before persons depart. Committeeman Plocher feels that the more wording is
added, the more confusing the ordinance becomes. Chief Hart stated that he
understands both sides of this and feels that until this recent complaint, this matter
has not been an issue. The Police Department has only dealt with illegal fires in
the past such as burning leaves. Sgt. Delaney feels that leaving the ordinance as
vague as possible in order to allow the Police Department to use their judgment is
best, however, he does feel that some level of responsibility should be given to the
person having the fire. Chief Hart suggested adding language that the person
conducting the fire should use all means necessary to extinguish the fire before
leaving it unattended.
The ordinance will be re-written and brought back to the next agenda for review.
Chief Hart will also be sure that roll call training is conducted regarding public
nuisances.
3. PS 2010-08 KenCom Funding Agreement- Discussion
Committeeman Munns stated that KenCom had put $1.6395 million into their
budget, anything over that would have to be split by the other communities.
Additionally, there is a $.75 surcharge on phone bills for 911 services. KenCom
is seeking our agreement to a percentage of an unknown dollar amount. Chief
Hart stated that if the growth in the community stops, there would be no
additional funds needed, but if the growth picks up expenses will be incurred
based upon the number of CAD dispatches. Additionally, if another community
drops out of KenCom, then the remaining communities would have a bigger
portion of the expenses.
Chief Hart stated that Larry Nelson informed the group that any agency that does
not sign the agreement will not be part of KenCom. He explained that he cost
breakdown is 15% for fire agencies and 85% for police agencies. There are 4
police agencies that would split it based on the CAD incidents over a 3 year
period.

Chief Hart stated that the Communication Center project for 2011 is projected to
cost $10,000.00 - $15,000.00 which is inexpensive for a Dispatch Center as they
typically cost hundreds of thousands of dollars. His concern is that all tax dollars
go to the county and that Yorkville creates $1.25 million dollars of tax revenue
from businesses and public safety sales tax. Furthermore, he is concerned that
that County Board states that the deal is with KenCom, yet KenCom states that
the deal is with the County Board. At this point, our options are signing the
agreement under protest before the deadline or partnering with Oswego to create
our own Communication Center at a cost of million dollars to start and
$700,000.00 a year split cost.
Chief Hart stated that the Public Safety Sales Tax was passed by the county and
was explained as funds to be used for the 911 center.
Chairperson Werderich stated that this item needs to go to the City Council as
soon as possible under the Public Safety Agenda because of the deadline.
Furthermore, he asked Chief Hart and Committeeman Munns to be ready to make
a presentation to the City Council regarding what our options are. Committeeman
Munns stated that he does not think the City should publicize the fact that we
have other options. Committeeman Plocher suggests discussing the matter in
Executive Session under Contract Negotiations. Committeeman Spears stated the
problem is that the County is aware of the City's budget situation and can use that
against us.
Chief Hart explained that there seems to be no dialogue between the County
Board and the KenCom Board. Some of the board members were scheduled to
speak at Oswego Village Board meetings but backed out twice.
Chief Hart also explained that the Village of Oswego has been making changes to
the way they dispatch for some time now. Certain items are not reported to
KenCom so that CAD incidents are not created, they report those items to their 24
hour Records Department. Therefore, if growth in the area continues, he feels
that Yorkville will be responsible for the largest portion of the cost to KenCom
because all our incidents and actions are reported through KenCom.
Chairperson Werderich asked if the $.75 surcharge could be funneled here. Chief
Hart stated that it goes into a county general fund and can be used for the jail,
courthouse, etc.
Chairperson Werderich asked Chief Hart to do more investigation into what
Oswego does.
This item will be presented to City Council at their next meeting.

1. PS 2010-04 Committee Liaisons

Committeeman Spears -
Would like to discuss problems at Parfection Park. Chairperson Werderich stated that
he was planning to discuss this item this evening.
A resident's husband is a Police Officer in Aurora and in COP Unit. The unit targets
landlords, rentals, etc. She was happy to find out that the City of Yorkville has does
this for over 15+ years and that our Lieutenant trained this particular Aurora officer.
The Aurora officer does have some projects that they do that he is willing to share
with us, perhaps our Police Department could spend some time with him.
Chairperson Werderich-
A resident on Greenbriar has property that backs up to Parfection Park's driving
range. The resident was unable to attend today's meeting so this item will be put on
the next agenda. Paul Zabel has been out there to investigate and has prepared a
response. Chief Hart asked if an extra watch was in order. Chairperson Werderich
stated that it's not really a police issue as the problem is golf balls in people's yard
therefore, it's more an issue for Building and Zoning. Committeeman Spears stated
that similar issues have come up in the past, but the golf course was there before the
houses were developed. Committeeman Plocher agrees. Chief Hart stated that
Parfection Park has been good about working with the residents in the past.

Minutes for Correction/Approval: January 27, 2011
The Chairman's title in the minutes was incorrectly stated as Chairwoman. The minutes
were then approved with this change.
New Business:

Chief Hart commented the reports reflected nothing outside the norm.
3. PS 2011-08 Request for Package Liquor License—Rt. 47& Cannonball Trail
This is a new license request and Chief Hart did not feel it would have a negative impact
The committee consensus was also favorable and this item will move forward to the
consent agenda.
4. PS 2011-09 Request to Sell 2003 Ford Crown Victoria (M11)
Chief Hart said this vehicle was too expensive to maintain and recommended selling the
car and applying the money towards another vehicle. The committee agreed and this
item will move forward to the consent agenda.
In additional New Business not on the agenda, Chief Hart said the Mayor had asked the
Police Department to explore the feasibility of an animal shelter. She asked him to gather
costs etc., and that that the item be brought to this committee for discussion. The
suggestion resulted from a letter written by a school class that had concerns about the
County shelter. It was questioned how the proposal would be funded.
Chairman Werderich said it could be pursued through the committee or be moved
directly to the Council. However, he suggested that more Mayoral direction is needed
prior to further discussion or research. Chief Hart will gather some information for
discussion prior to the next meeting. Alderman Spears asked that the record show that
the Police Department is currently short 9 officers and research such as this would require
resources. Due to this, she requested that research time be limited. This item will be
formally placed under New Business for the next meeting. Alderman Spears also
reminded the committee that the County already has a facility
Old Business:
1. PS 2011-05 Speed Limit on Country Hills Drive
Chairman Werderich said no further info had been received from concerned citizens and
this item will be tabled at this time. He thought no further action would be necessary.
Additional Business:
Alderman Munns related to the committee that a person saying he was a repossessor had
come to his home the night before stating he was going to repossess Mr. Munns' vehicle.
Deputy Chief Delaney said legitimate repossessors will provide the PD with their
repossession ID and license and also their destination address. Mr. Munns said he filed a
police report as it was not a legitimate repossession. "0",

The Special Olympics Illinois Polar Plunge was held on Sunday, March 6, 2011, at Loon
Lake in Silver Springs State Park, Yorkville. 282 individuals braved the cold to take the
plunge. They raised $95,315 to date to benefit Special Olympics Illinois athletes.
Barry Groesch, retired Yorkville Police officer, and Cindy Brittenham and Lisa
Schillinger of the Yorkville Citizen's Police Alumni were awesome! They did a fantastic
job of preparing the plunge site at Silver Springs State Park and the parking at the
Kendall County Fairgrounds. Barry, Cindy and Lisa are a pleasure to work with
throughout the year as members of the Polar plunge Committee. Their organization and
access to needed equipment, supplies and volunteers were instrumental in the success of
the event.
Thank you SO MUCH for allowing your staff and alumni police academy volunteers to
make the 2011 Special Olympics Polar Plunge a success. We hope to work with the
Yorkville Police Department at the 2012 Plunge. Your continued support of our Special
Olympics programs for individuals with intellectual disabilities is greatly appreciated.

My name is Mitchell Goodale and I am currently a student a Waubonsee Community College in Sugar
Grove. I am working towards a major in Criminal Justice.
On April 23'x, I participated in a ride-along with Officer Tim Kolowski as part of an assignment for my
Introduction to Criminal Justice class. During our patrol,we responded to a possible overdose and a
suspicious circumstance.We also, followed up on an investigation to pick up evidence and conducted a
few traffic stops. It was a great experience to ride with Officer Kolowski. I learned many things from
observing him and speaking with him about the important things he does for not only the department,
but the community, as well.

My name is Jordan Hagemann and I am a student at Waubonsee Community College in Sugar
Grove, Illinois. I am majoring in Criminal Justice.
On March 10, I interviewed Officer Ray Mikolasek who is assigned as the School Resource
Officer at Yorkville High School as part of an assignment for my Juvenile Justice class. During
our conversation, Officer Mikolasek shared many things about his job. He told me that he liked
working a normal hour shift. Also that he was glad that he gets to see his family more. It was a
great experience to interview Officer Mikolasek. I learned many things from our conversation
about the important work he does for your department and the school.

This is Mayella Alegria, a student at Waubonsee Community College in Sugar Grove, Illinois. I
major in Criminal Justice and part of a class project was to participate in a ride-along, and you
guys were kind enough to help me with that.
I got the pleasure to ride with Officer Chris Hayes on March 22,2011, from the hours of 800 to
1200. While on the ride along Officer Hayes definitely gave me some insight on the life of a
police officer as well as some of the responsibilities that I never really was aware of. He
explained about some of the issues about heavy trucks and their damage to roadways and how to
weight trucks to make sure they do not exceed the weight capacity.
Most importantly I learned how much police really do,which is also more than I was aware of. I
learned that police officers usually arrive at any accident, crime, and fire scenes way before
anyone else (fire fighters, ambulance, ect.) so it can definitely be said that fire fighters should not
get all the glory,police officers should. I appreciate and look at police officers with a new found
perspective and a great deal of respect thanks to my experience in the ride-along.
Thanks for your time in reading this,because I truly appreciate that I was able to ride along with
Officer Hayes and hope my thanks can be forwarded to him as well. You guys are great, keep
doing what you're doing!

AND COMMUNICATIONS BOARD
May 24, 2007
WHEREAS,the voters of Kendall County have approved the development of an
Enhanced 9-1-1 (E-9-1-1)Emergency Telephone Service, and;
WHEREAS,the County of Kendall as well as each unit of local government therein
dealing with emergency services, viz. The County of Kendall, the City of Plano,the United City
of Yorkville, the Village of Oswego, the Village of Newark, Lisbon-Seward Fire Protection
District,Newark Fire Protection District, Little Rock-Fox Fire Protection District,Bristol-
Kendall Fire Protection District and Oswego Fire Protection District, have an interest in the
creation and operation of a communications system to dispatch and communicate regarding the
usual and customary functions of said bodies dealing with police, fire and emergency medical
services(EMS)functions and;
WHEREAS,the County of Kendall is willing to provide the physical location for such
system and to provide the costs of operations necessary therefore in excess of that provided by
the telephone surcharge imposed upon users within the County, and;
WHEREAS, To the extent permitted under 50 ILCS 750,the Emergency Telephone
Systems Act,the KenCom Executive Board shall direct the disbursement of all 9-1-1 surcharge
funds collected.
IT IS HEREBY AGREED AS FOLLOWS:
1. That the County of Kendall shall appoint a board, hereinafter called the KenCom
Executive Board to perform the following functions:
a. Create and operate an Enhanced 9-1-1 Emergency Telephone System as

provided by 50 ILCS 750, the Emergency Telephone Systems Act.
b. Operate a conventional dispatch system for police, fire and EMS services.
c. Employ such persons necessary to effectuate the above.
d. Determine from time to time the surcharge rate to be charged and recommend
any changes thereto to the County Board.
2. That the board to be appointed shall consist of twelve members who shall have the
following qualifications:
a. All members shall have the ability or experience to administer the E-9-1-1
Service, under the Statute.
b. One member shall be the Sheriff of Kendall County. The Alternate for the
Sheriff shall be the Chief Deputy. The alternate will serve in the absence of
the Sheriff.
c. One member and one alternate shall be appointed by the Chairman of the
County Board with the advice and consent of the County Board and shall be a
County Board Member. The alternate will serve in the absence of the primary
member.
d. One member and one alternate from each of the four municipalities of the City
of Plano,the United City of Yorkville, the Village of Oswego, and the Village
of Newark shall be appointed by the City/Village Mayor/President; and
approved by the Chairman of the County Board with the advice and consent
of the County Board.
The Chairman of the County Board shall approve such persons and alternates
from the respective municipalities as designated by the Mayor or Village

President, and shall be Alderman, Trustees,Mayors or Village Presidents. The
alternates will serve in the absence of the primary member.
e. One member and one alternate from each of the five Fire Protection Districts
of Lisbon-Seward,Newark, Little Rock-Fox, Bristol-Kendall, and Oswego
shall be appointed by the President of the Fire Protection District with the
advice and consent of the Fire Protection District Board of Trustees and
approved by the Chairman of the County Board with the advice and consent
of the County Board. The primary Fire Protection District member shall be a
Trustee of the respective Fire Protection District.
The alternates will serve in the absence of the primary member. Alternates
shall be a trustee or chief officer of the respective Fire Protection District.
f. One member shall be a Member-At-Large who is a registered voter of Kendall
County who shall be appointed by the Chairman of the County Board with the
advice and consent of the County Board.
g. Only one person from each governmental agency and the member-at-large
represented by this agreement may cast a vote. Alternates may only vote in the
absence of the member appointed to the KenCom Executive Board. When the
member is present,the alternate may not vote nor may they constitute a
member for purpose of determination of a quorum.
3. All actions taken by the KenCom Executive Board will follow procedures established
in Roberts Rules of Order, except that a veto of any action may occur as follows:
a. By the Member representing the County Board
b. By two of the four members representing the four cities and villages.
c. By three of the five members representing the Fire Protection Districts.

It is further agreed, however, that any veto exercised hereunder may be
overridden by an affirmation vote of eight(8)members of the KenCorn Executive
Board.
4. That in design of the E9-1-1 System, a backup or secondary Public Safety Answering
Point(PSAP)is necessary. The parties hereto agree that such PSAP shall be designed
within the constraints of the primary 9-1-1 telephone service provider for Kendall
County.
5. In design of the E-9-1-1 System, the parties agree, within design constraints of the
primary 9-1-1 telephone service provider for Kendall County, all lines coming from
the respective four cities and villages to the Central PSAP, including all future
annexations to said cities and villages shall be grouped to permit exclusion from the
System if in the future any of said cities or villages should choose to operate
independent of the countywide system
6. That each of the municipalities or fire protection districts hereto may, by giving 1,460
days notice to the Chairman of the County Board, withdraw from KenCorn providing
that compliance be made with 83 Illinois Administrative Code,Part 725. Said notice
shall be in writing and signed by the President of the Fire Protection District or the
Mayor or Village President of the municipality.
7. Members of the KenCorn Executive Board may only be removed by the Chairman of
the County Board with the advice and consent of the Mayor or Village President of a
city or village, or President of the Board of Trustees of the Fire Protection District
who appointed the member to the Board.
The parties do further agree that upon request by the Mayor, Village President, or Fire
Protection District President, any such respective member will be removed. Any

vacancy on the KenCom Executive Board must be filled within 90 days, or the
County Board Chairman will appoint a member from that unit of local government
who meets the same qualifications as set forth above.
8. That the KenCom Executive Board as appointed hereunder shall meet and organize in
accordance with the rules of organization in Robert's Rules of Order, including but
not limited to the election of a President, Secretary and such other officers as the
Board may deem from time to time necessary. It is expressly agreed, however,that
all members of the KenCom Executive Board as hereinabove structured shall be
eligible for the office of President except for the Sheriff of Kendall County.
9. That the parties expressly acknowledge that protocols may differ for dispatch
between units of local government and the County. It is the intent of this Agreement
that central dispatch shall accommodate the individual needs of all parties to this
Agreement to the extent standardization requirements of the Illinois Commerce
Commission permit.
10. Upon creation of this KenCom Executive Board there is simultaneously created an
Operations Board hereafter referred to as Operations Board. The purpose of the
Operations Board is to coordinate, monitor and oversee the actual operation of all
communications under the jurisdiction of the KenCom Executive Board subject only
to policy being established by KenCom Executive Board. The members of the
Operations Board shall be determined from time to time by the units of local
government who are signatories to this Agreement, or as approved by the Executive
Board. The Operations Board shall contain representatives from each unit of local
government. Such members shall be persons who work on a day to day basis with the
users of the E-9-1-1 system. Such membership of the Operations Board is allocated

Appointment as a member or alternate to the KenCom Operations Board shall be made
by the units of local government being served by KenCom, and approved by the KenCom
Executive Board.
The statutory responsibility of the Emergency Telephone Systems Board(ETSB)
shall, upon ratification of this Agreement by all participating units of local government,
be assumed by the KenCom Executive Board. Thereafter,the KenCom Executive Board
shall delegate to the Operations Board the responsibility of the planning, design and
operation of the E-9-1-1 system. It is the intention of this Agreement that the KenCom
Executive Board shall continue to operate as the fiscal and policy oversight Board for the
E-9-1-1 system.
As part of the fiscal responsibility of the KenCom Executive Board, a 9-1-1
surcharge budget shall be prepared and approved by the Board. The KenCom Operations

board shall review and authorize payment of bills as they become due, on a monthly
basis, as long as they are a part of the approved budget. At the quarterly meeting of the
KenCom Executive Board, a report will be presented by the Board's appointed Treasurer,
listing all bills paid for their review and approval.
The Parties hereto further expressly agree that the Director of Communications
shall be selected by the KenCom Executive Board and that fiscal and policy jurisdiction
shall be executed by the KenCom Executive Board. It is further agreed that the employed
Director of Communications shall not be an appointed member of the KenCom Executive
Board.
11. Any unit of local government hereunder may hereafter choose to operate dispatch locally
providing all E-9-1-1 dispatch shall continue under the auspices and operation of
KenCom.
12. That the parties hereto agree that this Agreement shall be reviewed annually from the
date that this agreement is signed by all parties.
13.No compensations shall be paid to any member of the KenCom Executive Board for
official duties as a member of the KenCom Executive Board.
14. The Kendall County Emergency Phone Service and Communications Board shall comply
with and be subject to the Open Meetings Act and the Freedom of Information Act. The
Executive Board shall meet quarterly and shall comply with the statutes of the State of
Illinois regarding meetings.
15. If any provision of this Agreement is held to be invalid, that provision shall be stricken
from this Agreement and the remaining provisions shall continue in full force and effect
to the fullest extent possible.

Subject: Parking restrictions on E Millbrook Circle
Alderwoman Teeling asked for this item to be placed on the agenda. Several residents in
the Colonies section of Grande Reserve have contacted her to request parking restrictions on
various streets in that area, because of the narrow road width. Most of the roads in this section
are private roads (map attached). For the private roads, the residents would have to convince the
HOA board to place no parking signs along the private roadways and then sign an agreement
with the City allowing us to enforce the signs. For the roads which are private (East Millbrook
Circle, Preston), the City could place no parking signs along one side of the street to improve
traffic flow through the subdivision. If this is desired, the City Engineer has recommended the
west side of East Millbrook Circle should be restricted because there are more intersections with
cul-de-sacs on this side; doing so would improve intersection sight distance.

Subject: Parking restrictions Autumn Creek Blvd near park
Alderwoman Teeling requested this agenda item. She has been contacted by several
residents that have encountered children crossing Autumn Creek Boulevard near Green's Filling
Station Park. When we encountered the same problem at Bristol Station Park in Whispering
Meadows, we decided to restrict parking on the streets adjacent to the park, on the side of the
street that was not adjacent to the park. Further, this restriction was only in place from 5-8pm in
April through August (baseball season!). A similar restriction could be imposed on Autumn
Creek Boulevard between Prairie Grass Lane and Crimson Lane (map attached).
Staff seeks direction from the committee on the parking restriction shown.

This item was last discussed in September 2010. At that meeting, the committee was in
favor of allowing golf carts to operate on public roads, as allowed by current state law. In
general, golf carts are allowed to operate on public roads that are less than 35 mph and cross
roads of higher speeds if the municipality allows it by ordinance and posts signs on all City
streets entering areas where it is allowed. In September, the committee was interested in
receiving the cost estimates for the signs and the total cost of the signs for installing them
throughout the City. Public Works Director Dhuse and Community Development Director
Noble have estimated the cost of the signs at $100 per sign and have prepared a sample
schematic for the Kylyn's Ridge and Fox Hill subdivisions. At an average cost of$200 to $500
per subdivision the total budget for this program would be somewhere between$5,000 and
$10,000 for initial installation. If the committee is still interested in permitting golf carts on City
streets, the staff can prepare a more detailed analysis of the costs associated with the program.
