MINUTES FOR CORRECTION/APPROVAL The minutes of the April 29, 2010 meeting were approved with corrections to Item#1 under New Business. The first sentence of the paragraph should read"...Spears asked what will happen..." Another correction was noted on page 2, last paragraph, second sentence. It should read "He explained that the cost...." The minutes of the May 27, 2010 meeting were approved as submitted. NEW BUSINESS: PS 2010-16 Police Reports for June 2010 The report was approved by the committee and moved forward to the City Council's consent agenda. PS 2010-17 Ordinance Amending the City Code Regarding Microbrewery/Brew Pub Licenses After discussion, this item was approved by the committee and moved forward to the City Council's consent agenda. 1 OLD BUSINESS: PS 2010-11 Parfection Park—Discussion This was an informational item and after discussion it was decided by the committee that no further action would be taken on this matter. ADDITIONAL BUSINESS: The committee discussed the Crime Free Multi-Housing Program. The direction of the committee was to have the Police Department review the information and bring this item back to the committee with any additional information. PS 2010-19 Use of Electric Vehicles on City Streets After discussion, the committee directed staff to bring this item back to the committee. PS 2010-20 Filming Permits Alderman Werderich brought this to the committee because there is a group who will be filming a movie in Yorkville. He wanted the city to have an application in place. After some discussion, this item was moved forward to the City Council on the regular agenda. 1 PS 2010-21 Draft Ordinance Amending City Liquor Code Regarding Hotels Alderman Werderich reported that staff had questions about hotels/motels having a liquor license which this amendment addresses. After discussion, this item was approved 3-1 by the committee and was moved on to the City Council on the regular agenda. OLD BUSINESS: None. ADDITIONAL BUSINESS: None. NEW BUSINESS: PS 2010-22 Police Reports for September 2010 There were questions about truck enforcement which were explained by Chief Hart. The reports were approved by the committee and moved forward to the City Council's consent agenda. PS 2010-23 Omaha Drive Speed Concerns The committee discussed resident concerns about cars speeding on Omaha Drive in the vicinity of Grace Drive. The committee recommended that the Police Department conduct a traffic study of the area and bring the results back to the committee for further discussion. PS 2010-24 Motor Vehicle Towing Policy This was an informational item. The committee discussed developing a policy. No action was taken 1 PS 2010-25 Public Safety Committee Meeting Dates for 2011 The committee approved moving the meeting to Thursdays at 6:30 p.m. OLD BUSINESS: PS 2010-19 Use of Electric Vehicles on City Streets After discussion, the committee requested more information from City Administrator Olson. Direction was for staff to bring this item back to the committee at the November 22, 2101 meeting. ADDITIONAL BUSINESS: Alderman Spears brought up how the Police Department is understaffed and made the recommendation to hire officers as soon as possible. Chairman Colosimo asked to amend the agenda to move item#5 to the beginning of the agenda. New Business• (out of sequence). 5. PS 2011-19 Ordinance Authorizing the Collection of an Application Fee from Applicants to the Police and Fire Dispatch Bob Johnson from the Police and Fire Commission presented a proposed ordinance to collect a $25 fee from applicants to the Yorkville Fire and Police Departments. During the last testing cycle, there were over 200 applicants. The $25 fee is the cost to the Commission and comes from their budget. This year the Commission will test for both future Sergeants and police applicants. State law requires that police applicants be tested every 2 years and promotional exams are required every 3 years even if not hiring. Most communities already charge a fee and the County currently has a fee. Alderman Funkhouser moved and Alderman Spears seconded to move this ordinance to the Council consent agenda. Unanimous voice vote approval. 1 Citizen Comments: None Minutes for Correction/Approval: June 2, 2011 Three corrections were requested and will be made. Alderman Kot made a motion to approve the minutes as amended and Alderman Spears seconded. Unanimous voice vote approval. New Business cont. 1. PS 2011-15 Comprehensive Staffing Study—Police Department Deputy Chief Hilt said Chief Hart had spoken with a WIU professor to determine if there is a graduate student who could assist the Police Department with this study, however, no one is available at this time. Deputy Chief Hilt said current staffing levels do not allow for department personnel to undertake this study, but some statistics have been gathered from other departments. Presently there are 24 full time officers, which translates to 1.41 officers per 1,000 population, placing Yorkville on the low end of other department averages. Research is still being done and more information will be brought back to a future committee meeting. This is informational only at this time. 2. PS 2011-16 Weather Warning Sirens This item was also discussed at the last meeting and since that time the sirens were needed for a weather situation. Several Raintree residents said they did not hear the sirens and a test was going to be done for this subdivision. Deputy Chief Hilt also said a complaint was received from Grande Reserve and the siren was found to be faint in that area. The service firm for these sirens was called and an annual inspection will be performed. Chairman Colosimo asked that this item be placed on the agenda for a follow-up after the testing. It was also noted a siren was struck by a vehicle and it is not known if the repairs have been done yet. Alderman Spears said that a Bristol Bay citizen twice reported this area is not covered by a siren, with the closest one being near Mill Road. The resident was informed that 500 units must be in place before a siren will be installed. Ms. Spears recommended that the City speak with the developer. Mr. Olson said the developer is required to pay the impact fee when the subdivision is platted and the sirens are then installed. Autumn Creek and Bristol Bay were slated to receive coverage in 2010 at a cost of$30,000 each. Chairman Colosimo suggested it might be more cost-effective to have both installed at the same time. Locations need to be determined by the professionals. In a related matter, Alderman Kot inquired about the lightning siren located in one of the parks. Scott Sleezer said there is one in place at Riverfront Park and a portable unit is used at Bridge Park. He said the Parks Department is trying to work with the schools for additional units and that Bristol Bay needs one for the soccer program. Mr. Olson asked if this matter should be brought back to committee or taken directly to Council if there are available funds and sirens are needed. It was decided the matter should be sent to Council if money is available. 2 3. PS 2011-17 Police Reports for May 2011 Chairman Colosimo asked the first column "Incident Type"to be widened for readability. The mileage report will be available next month. The reports will move forward to the Council consent agenda on a motion by Alderman Kot and second by Alderman Funkhouser. Unanimous voice vote approval. 4. PS 2011-18 Parking Near Riemenschneider Park Parking issues at this location near McHugh and Hayden were previously discussed. Mr. Olson said a "no parking" sign is in place on Hayden and specifies hours and dates. There are no parking restrictions on McHugh, but Administrator Olson suggested allowing parking only on the park side so that people are not forced to cross the street. With less parking available, people will park farther into the subdivisions resulting in possible complaints. It was suggested to research possible parking at the SEC building and Mr. Sleezer and Ms. Laura Schraw may try to schedule a fall meeting with the owners to discuss. A hedgerow or fence was suggested to prevent persons from walking through a nearby natural area. Saturday parking restrictions when sports events are held and a possible parking lot were both also discussed. Restrictions were also suggested from Prairie Point to Hayden(adjacent to the park). If parking is restricted on one side, re-striping might be needed. Alderman Spears also questioned if the nearby Fire Department might have difficulty getting through on these streets when cars are parked here. The matter will be tabled until the next meeting on a motion by Funkhouser and second by Kot so more information can be gathered. Unanimous voice vote approval. Old Business: None Additional Business: 1. Alderman Kot noted there are no speed signs on Rosenwinkel(off Galena). This will be discussed at the next meeting and Mr. Sleezer will talk with the Public Works Director. 2. Lack of traffic control signs at Northland and Western was brought up by Alderman Funkhouser. He said he has received complaints from residents in his ward. 3. Alderman Kot questioned why pedestrian crossing signs are no longer being used. Cars were being damaged and officers were injured due to the heaviness of the signs. Limited manpower is also an issue. He said mixed messages are being sent since there was heavy enforcement at one time and now very limited. Alderman Funkhouser said an LED, solar-powered sign is used in Oswego and it is operated by a push-button system. Scott Sleezer will talk with Eric Dhuse to obtain exact costs of signs that are thought to be $200-250 per sign. The general agreement was that there should be signage particularly by the park on Rt. 47. 3 4. Chairman Colosimo discussed Elizabeth St. and said there used to be a sign "traffic from right does not stop". He suggested such a sign should be placed under the stop sign to help prevent near-miss accidents here. Mr. Olson will speak with the traffic engineer. 5. There are currently solicitors in the City and they are approaching houses posted with "no solicitor" signs. They have been rude to residents and have no license. Residents are encouraged to call police. Alderman Kot noted that DeKalb County had incidences of assaults and thefts by solicitors. 6. Deputy Chief Hilt reported the July 4th festivities went smoothly. 7. A sexual predator rumor was discussed by Deputy Chief Schwartzkopf and he clarified the incident. There was no further business and the meeting was adjourned on a motion by Kot and second by Funkhouser. Unanimous voice vote approval. Meeting adjourned at 7:25pm. Per city code, there is a limit on the number of Class "A" and Class "G" liquor licenses that are available. Both of these liquor categories are full. Before any new Class "A" or Class "G" licenses can be issued, City Council will need to decide if the city liquor code should be amended to increase the number of liquor licenses available. If the decision is made to amend the code, it does not guarantee that a liquor license will be issued to this applicant. OJ's Tap and Kendall Pub are both located in the downtown area. Stonefire Restaurant and Fox River Lanes are located outside of the downtown area. Should the City Council decide to approve an ordinance amending the liquor code, it will bring the total of Class "A" licenses up to five. Regarding the Glass "G"–Beer Garden/Patio licenses, the city code allows for a total of seven licenses. City Council approval of an increase in this classification will bring the total of beer garden/patio licenses up to eight. Along with the request for the amendments to the Class A and Class G categories, this applicant is also looking at holding a Catering Class liquor license to provide liquor for another business located in the downtown area. To provide for this use, an amendment to the Catering License definition would need to be considered. For your consideration attached are red-lined and clean versions of the sections of the liquor code which would be affected by this request. 3-3-6: NUMBER OF LICENSES: A. Under the current liquor code, the code only allows for these licenses to be issued from May 1 through October 31. Section 3-3-4-5,paragraph D states that"it shall be unlawful for any outdoor liquor license holder to sell or offer for sale any alcoholic liquor, including beer or wine between November 1 and April 30 of any year". The liquor license holder asked if the code could be amended to allow outdoor liquor sales at other times during the year. The license holder said that they had patrons who had left their business during the month of April when the weather was nice, because they preferred to eat outdoors. Staff recommendation is to remove paragraph D from the liquor code, so that there is not a prohibition on outdoor liquor sales between November 1 and April 30. At the City Council meeting, it was stated that the residents of the Colonies neighborhood were originally concerned about parking within the cul-de-sacs off of E Millbrook Circle, and not concerned about parking on E Millbrook Circle. The reason stated for the tabling was that this ordinance would have no impact on the resident's concerns. While true, the ordinance is still recommended by staff for approval because of the right-of-way width, future buildout and traffic patterns of the area. At full buildout, parking on both sides of the road will prevent safe and smooth traffic flow in both directions. Therefore, we are recommending the restriction still be approved by City Council. The residents' concern about parking in the cul-de-sacs must be handled by their HOA, as the cul-de-sacs are private streets. Several residents in the Colonies section of Grande Reserve have contacted her to request parking restrictions on various streets in that area, because of the narrow road width. Most of the roads in this section are private roads (map attached). For the private roads, the residents would have to convince the HOA board to place no parking signs along the private roadways and then sign an agreement with the City allowing us to enforce the signs. For the roads which are private (East Millbrook Circle, Preston), the City could place no parking signs along one side of the street to improve traffic flow through the subdivision. If this is desired, the City Engineer has recommended the west side of East Millbrook Circle should be restricted because there are more intersections with cul-de-sacs on this side; doing so would improve intersection sight distance. n , Yr` �•/rte. jy in-- 1 . . Ordinance No. 2011- AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY, ILLINOIS REGULATING ON-STREET PARKING NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. Title 6, Chapter 2, Section 2, of the United City of Yorkville Code of Ordinances is hereby amended by adding the following: 6-2-2: PARKING PROHIBITED ON DESIGNATED STREETS: E. MILL BROOK CIRCLE A "no parking"zone shall be created on the west side of East Mill Brook Circle between Blackhawk Boulevard and Preston Drive. Section 2. If any Section, subsection, sentence, clause, phrase or portion of this Chapter is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof Section 3. This Ordinance shall be in full force and effect upon its passage, approval, and publication as provided by law.
