The meeting was called to order at 6:30pm by Chainnan Colosimo and a quorum was
established.

Minutes for Correction/Approval: August 4, 2011
The following corrections were requested:
1. Bart Olson should be shown as City Administrator throughout minutes
2. Alderman Kot should be "In Attendance", rather than Olson
3. Funkhouser spelled incorrectly
4. Cost for weather warning sirens should be $20,000 each, not for 3 under Old
Business, also same paragraph, "committee agreed as soon...", next paragraph
should have space in"west side"
5. Item #3, 4th sentence, circle is misspelled
The minutes were then approved as amended on a motion by Kot and second by Spears.
Unanimous voice vote approval.
New Business:
1. PS 2011-24 Police Reports July August 2011
Alderman Kot noted an increase in overtime in the last couple months. Chief Hart said it
was related to manpower shortage, court appearances and officers in school.

Yorkville PD also provided assistance to Oswego during a recent case. Two officers
were assigned to the task force and Chief Hart said valuable experience is gained through
these types of investigations. By committee consensus, this item moves to the consent
agenda.
2. PS 2011-25 Computer/Server Replacement Update
Molly Schwartzkopf of Yorkville PD was present to discuss current computer and server
update issues. She said the computer system is very complex and it is very difficult to
replace just one component. They are working with KenCom on updates for radios and
MDT's in the squads, etc. When servers are upgraded,the in-car video cameras and
MDT's must be updated.
She had some preliminary estimates from Digital Patroller and said all Digital Patrollers
are out of warranty. In addition, 6 computer upgrades have been missed in the last 2
years. DP proposed that if the police department makes certain purchases, DP would
warranty part of the old systems until more money is found. The original quote was
$57,000 just for the DP system and it was reduced to $26,000 to work with the PD.
Upgrades for the T-1 connections for the State Police are also needed.
The server was last upgraded 5 years ago with old software being used. Ms.
Schwartzkopf said backups need to be improved as well.
Chairman Colosimo expressed concern for metadata for evidence. Ms. Schwartzkopf
said if the hard drive failed at this point, it would switch over to another drive. However,
a solution is needed for a comprehensive backup. There is currently no backup at a
secondary location and all servers are located downstairs. Monthly tape backups are kept
at a bank vault. Alderman Kot asked if the PD is in compliance with the backup process.
According to Molly, there is no official policy, however, a previous IT person developed
an unofficial policy of backups that is being done. Financial data, working data and
emails system are all captured on tape and are backed up.
Chairman Colosimo asked how much the desired system and maintenance would cost.
Ms. Schwartzkopf said there are many factors to determine the cost. Alderman
Funkhouser asked how critical the upgrade is. June 2012 is when the new dispatch center
and certain requirements become effective. Molly said a new system would be done in
phases and an estimate on the high end would be $146,000 with quotes changing rapidly.
She said much planning will be needed,but a firm number could be obtained in about a
month. Currently there is $6,000 in the budget according to Chief Hart and very few
grants are available.
When the system is purchased, Chairman Colosimo said there must be someone to
maintain it. He praised Ms. Schwarztkopf for the work she has done in going above and
beyond to oversee the computers. Chief Hart added that she uses personal time to keep
things running.

Chief Hart stated that in January 2013, the City must go to split band requirements or
face a $10,000 a day fine for being non-compliant.
Alderman Kot said staff should work with Administrator Olson to find funding. Mr.
Colosimo suggested the possibility of hiring a contractual contractor for this upgrade
project as they may have shortcuts or ideas to save money. Ms. Schwartzkopf was asked
to work with the current vendor, SPS, and to obtain quotes as well.
Chairman Colosimo suggested placing this item on the next month's agenda and Molly
was asked to look at updates and a possible company to build the infrastructure and
perform maintenance. She said SPS is currently performing maintenance.
In summary, Mr. Colosimo said certain deadlines must be met or a fine will be levied.
He will ask H. R. to research the possibility of a full-time IT person. This item will
return to Old Business for the October meeting.
3. PS 2011-26 Parking Restriction on Prairie Grass Lane
This is a proposal to restrict parking on Prairie Grass Lane between Hayden and Autumn
Creek Blvd. Chief Hart said this is similar to other restrictions near ballfields and he
strongly recommended this action. This is a main artery and the year-round restriction
will be beneficial for snow removal also. He said there are ongoing problems with
parking due to lack of parking lots at the fields. He said the Park District does not wish
to have the parking lots there. Alderman Spears said the Council can fail to approve new
parks that do not have adequate parking. This item will move to the consent agenda for
the next Council meeting.
Old Business:
1. PS 2011-16 Weather Warning Sirens
Chief Hart said the estimates were less than originally thought and costs for electrical
hookups must now be determined. It also must be decided where to place the towers for
a fall installation. Com Ed must also inspect the sites. Raintree and Grande Reserve will
then have siren coverage. Chief Hart recommended bringing this item back to Public
Safety next month in order to review all cost estimates.
Additional Business:
1. Alderman Kot mentioned the crosswalk area on Rt. 47 and noted that the signs are no
longer put up. He sees kids waiting to cross and drivers do not stop. He mentioned
permanent signs on poles as a possible solution. In view of the impending Rte. 47
improvements, Chairman Colosimo suggested waiting since IDOT will not reimburse the
City if signs are installed now and then taken down for construction. Mr. Kot said the
markings are no longer visible and feels action should be taken in the interim. Chief Hart
said he does not have manpower to place the temporary signs each day and the signs were
damaging the squad cars when placed in the back seats. He said they still conduct
enforcement. Mr. Colosimo said IDOT is responsible for painting even temporary

markings on the street. Alderman Kot said he will bring this matter up at Public Works
also and it was suggested to ask them to possibly re-paint the stripes.
2. Chairman Colosimo said that the Administration Committee determined that no vice-
chairman had been appointed for the committees. He appointed Alderman Kot as vice-
chairman for Public Safety. He said a new governing ordinance is also being worked
on.
There was no further business and a motion was made by Alderman Spears and seconded
by Alderman Kot to adjourn the meeting. Voice vote approval.

Please find enclosed the fine of$25.00 that you feel you must extract from homeowners
who pay their taxes.
I was totally surprised and horrified that you would even waste your time writing up this
ticket especially after I got home at 9:30PM and woke at 6AM to find this on my
windshield.
Can you please tell me who would be walking our streets between these hours? And
whom this would bother between those hours?
As I am sure you noticed we had a boat and another vehicle in our drive but was not
pulled all the way. Shame on us!, can't believe that you did not even write a warning.
We do not normally to this.
Maybe you need to keep your eyes out for the people who rob us instead of the people
who pay their taxes and don't break the law.

AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS, REGARDING THE PROHIBITION OF THE SALE, POSSESSION OR USE
OF SYNTHETIC CANNABIS AND OTHER SYNTHETIC ALTERNATIVE DRUGS
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home-rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and,
WHEREAS, the City has encountered products being sold at commercial businesses
within its corporate boundaries containing compounds originally designed as synthetic
alternatives (i.e., synthetic cannabinoids, synthetic stimulants and/or synthetic
psychedelic/hallucinogens) to prohibited controlled substances such as tetrahydrocannibol
(THC), cathinone, methcathinone, MDMA and MDEA; and
WHEREAS, the City finds that products containing such synthetic alternatives may be
purchased for recreational use currently as an alternative to otherwise regulated controlled
substances banned at the Federal and State levels; and
WHEREAS, the City finds that products containing synthetic cannabinoids, synthetic
stimulants and synthetic psychedelic/hallucinogens are particularly attractive to children and
young adults due to their availability in small packages at neighborhood stores at minimal costs,
as well as due to the naives being given to these substances which are intended to appeal to
children and young adults; and
WHEREAS, the Drug Enforcement Administration ("DEA") has determined that the
consumption of synthetic cannabinoids can have adverse health effects such as agitation, anxiety,
nausea, vomiting, tachycardia, elevated blood pressure, tremors, seizures, hallucinations,
paranoid behavior and non-responsiveness; and
WHEREAS, the DEA has determined that consumption of synthetic stimulants affect
alertness, and have been linked to severe psychotic episodes, increased heart rates, panic attacks,
and hallucinations; and
WHEREAS, the American Association of Poison Control Centers has reported 2,700
synthetic cannabinoid-related calls to poison control centers in 49 different states; and
WHEREAS, the City is also aware of fatal overdoses in other Illinois communities and
in other States, which are believed to have resulted from the users' consumption of synthetic
stimulants, cannabinoids or psychedelic/hallucinogens; and
WHEREAS, the City deems it necessary and desirable to prohibit the sale, delivery,
possession and use of products containing synthetic cannabinoids, synthetic stimulants and
synthetic psychedelic/hallucinogens in order to protect the public health, safety and welfare of
the citizens of the City.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section One: That the recitals set forth in the preamble are incorporated herein by
reference the same as if they were set forth herein verbatim and they are adopted as the findings
of the City Council of the United City of Yorkville.
Section Two: That Title 5, Chapter 3 of the Yorkville City Code, as amended, be and is
hereby amended by adding Section 5-3-12 to read as follows:
"5-3-12: Synthetic Alternative Drugs.
A. Definitions.
For purposes of this section, the following definitions shall apply unless the context
clearly indicates or requires different meaning:
(1) A product containing a synthetic alternative drug means any product containing a
synthetic cannabinoid, stimulant or psychedelic/hallucinogen, as those terms are defined herein
such as, but not limited to, the examples of brand names or identifiers listed in subsection
(2) Synthetic cannabinoid means any laboratory-created compound that functions similar
to the active ingredient in marijuana, tetrahydrocannabinol (THC), including, but not limited to,
any quantity of a natural or synthetic material, compound, mixture, preparation, substance and
their analog (including isomers, esters, ethers, salts, and salts of isomers) containing a
cannabinoid receptor agonist, such as:
• JWH-007 (1-pentyl-2-methyl-3-(1-naphthoyl)indole)
• JWH-015 ((2-Methyl-l-propyl-lH-indol-3-yl)-1-naphthalenylmethanone)
• JWH-018 (1-pentyl-3-(1-naphthoyl)indole)

(3) Synthetic stimulant means any compound that mimics the effects of any federally
controlled Schedule I substance such as cathinone, methcathinone, MDMA and MDEA,
including, but not limited to, any quantity of a natural or synthetic material, compound, mixture,
preparation, substance and their analog (including salts, isomers, and salts of isomers) containing
substances which have a stimulant effect on the central nervous system, such as:
• 3-Fluoromethcathinone
• 4-Fluoromethcathinone (other name: flephedrone)
• 3,4-Methylenedioxymethcathinone (other name: methylone, MDMC)
• 3,4-Methylenedioxypyrovalerone (other name: MDPV)
• 4-Methylmethcathinon (other names: mephedrone, 4-MMC)
• 4-Methoxymethcathinone (other names: methedrone,bk-PMMA, PMMC)
• 4-Ethylmethcathinone (other name: 4-EMC)
• Ethcathinone
• Beta-keto-N-methylbenzodioxyolylpropylamine (other names: butylone, bk-
MBDB)
• Napthylpyrovalerone (other names: naphyrone, NRG-1)
• N,N-dimethylcathinone (other name: metamfepramone)
• Alpha-pyrrolidinopropiophenone (other name: alpha-PPP)
• 4-methoxy-alpha-pyrrolidinopropiophenone (other name: MOPPP)
• 3,4-methylenedioxy-alpha-pyrrolidinopropiophenone (other name: MDPPP)
• Alpha-pyrrolidinovalerophenone (other name: alpha-PVP)
• 6,7-kihydro-5H-indeno(5,6-d)-1,3-dioxal-6-amine) (other name: MDAI)
• Any compound that is structurally derived from 2-amino-l-phenyl-l-propanone
by modification or substitution in any of the following ways:

• in the phenyl ring to any extent with alkyl, alkoxy, alkylenedioxy, haloalkyl,
or halide substituents, whether or not further substituted in the phenyl ring by
one or more other univalent substituents;
• at the 3-position with an alkyl substituent;
• at the nitrogen atom with alkyl, dialkyl,benzyl, or methoxybenzyl groups;
• or by inclusion of the nitrogen atom in a cyclic structure.
(4) Synthetic psychedelic/hallucinogen means any compound that mimics the effects
of any federally controlled Schedule I substance, including but not limited to, any
quantity of a natural or synthetic material, compound, mixture, preparation,
substance and their analog (including salts, isomers, esters, ethers and salts of
isomers) containing substances which have a psychedelic/hallucinogenic effect on
the central nervous system and/or brain, such as:
• 2-(2,5-Dimethoxy-4-ethylphenyl)ethanamine (2C-E);
• 2-(2,5-dimethoxy-4-methylphenyl)ethanamine (2C-D);
• 2-(4-Chloro-2,5-dimethoxyphenyl)ethanamine (2C-C);
• 2-(4-Iodo-2,5-dimethoxyphenyl)ethanamine (2C-I);
• 2-(4-(Ethylthio)-2,5-dimethoxyphenyl)ethanamine (2C-T-2);
• 2-(4-(Isopropylthio)-2,5-dimethoxyphenyl)ethanamine (2C-T-4);
• 2-(2,5-Dimethoxyphenyl)ethanamine (2C-H);
• 2-(2,5-Dimethoxy-4-nitro-phenyl)ethanamine (2C-N);
• 2-(2,5-Dimethoxy-4-(n)-propylphenyl)ethanamine (2C-P).
B. Sale or Delivery. It shall be unlawful for any person to sell, offer for sale or deliver any
product containing a synthetic cannabinoid, stimulant or psychedelic/hallucinogen.
C. Possession. It shall be unlawful for any person to knowingly possess a product containing a
synthetic cannabinoid, stimulant or psychedelic/hallucinogen.
D. Use. It shall be unlawful for any person to be under the influence of a synthetic cannabinoid,
stimulant or psychedelic/hallucinogen.
E. Penalties. The first time within a 12 month period any person is found to be in violation of
this Section shall be punished by a minimum fine of not less than five hundred dollars ($500.)
nor more than seven hundred fifty dollars ($750.) or if found in violation for a second or
subsequent violation within a 12 month period shall be punished by a fine of seven hundred fifty
dollars ($750.) Each violation of this section, or everyday a violation continues to exist, shall
constitute a new and separate violation."
Section Three: That this Ordinance shall be in full force and effect upon its passage,
approval, and publication as provided by law.

Section Four: That all ordinances or parts of ordinances thereof in conflict herewith are
hereby repealed to the extent of any such conflict.
Section Five: That any Section or provision of this ordinance that is construed to be
invalid or void shall not affect the remaining sections or provisions which shall remain in full
force and effect thereafter.

The city received a request for a fireworks display permit. Per section 5-3-11 of the city code,
"pursuant to a resolution, the Mayor and City Council may issue a permit for the discharge of
such fireworks and for pyrotechnical displays". Details of this request will be provided at the
meeting.
5-3-11: FIREWORKS:
A. Definitions:
CONSUMER FIREWORKS: Those fireworks that must comply with the construction, chemical
composition, and labeling regulations of the U.S. consumer products safety commission, as set
forth in 16 CFR parts 1500 and 1507, and classified as fireworks UN0336 or UN0337 by the
United States department of transportation under 49 CFR 172.101.
"Consumer fireworks" shall not include snake or glowworm pellets; smoke devices; trick
noisemakers known as "party poppers", "booby traps", "snappers", "trick matches", "cigarette
loads", and "auto burglar alarms"; sparklers, toy pistols, toy canes, toy guns, or other devices in
which paper or plastic caps containing twenty-five hundredths (25/,00) grain or less of explosive
compound are used, provided they are so constructed that the hand cannot come in contact with
the cap when in place for the explosion; and toy pistol paper or plastic caps that contain less than
twenty hundredths (20/,00) grain of explosive mixture.
DISPLAY FIREWORKS: 1.3G or special effects fireworks or as further defined in the
pyrotechnic distributor and operator licensing act3.
1.3G FIREWORKS: Those fireworks used for professional outdoor displays and classified as
fireworks UN0333, UN0334, or UN0335 by the United States department of transportation under
49 CFR 172.101.
B. Fireworks Prohibited: It shall be unlawful for any person to sell, keep, expose for sale, loan or
give away any 1.3G fireworks, consumer fireworks, or display fireworks, anywhere in the city.
C. Possession Of Fireworks: It shall be unlawful for any person to possess or to discharge
anywhere in the city any 1.3G fireworks, consumer fireworks, or display fireworks; provided,
however, that pursuant to a resolution the mayor and city council may issue a permit for the
discharge of such fireworks and for pyrotechnical displays.
D. Permitted Fireworks: The sale and use of snake or glowworm pellets; smoke devices; trick
