A RESOLUTION AUTHORIZING AN ALTERNATIVE METHOD OF SALE OF
SURPLUS PROPERTY OWNED BY THE UNITED CITY OF YORKVILLE
(201 West Hydraulic Avenue)
Whereas, the United City of Yorkville(the "City") is a duly organized and
validly existing non home-rule municipality created in accordance with the Constitution
of the State of Illinois of 1970 and the laws of the State; and,
Whereas, the surplus property of the City legally described as:
The Westerly 49 feet, 9 3/ inches of Lot 1 (Measured along the South line) and the
Easterly 50 feet, 2.25 inches of Lot 2 (Measured along the South line) in Block 8
of Blacks Addition to the Village of Yorkville, in the Village of Yorkville,
Kendall County, Illinois (the "Subject Property")
and commonly known as 201 West Hydraulic Avenue was the former United
States Post Office. The Subject Property is zoned in the B-2 General Business
District which permits commercial and office uses and is improved with a
building of approximately 4,200 square feet; and,
Whereas, pursuant to section 11-76-2 of the Illinois Municipal Code (65 ILCS
11-76-2) the City adopted an ordinance seeking bids for the sale of the Subject Property
and received no bids for the purchase of the Subject Property; and,
Whereas, The City desires to sell the Subject Property pursuant to Section 11-76-
4.2 of the Illinois Municipal Code (65 ILCS 11-76-4.2) by the City Administrator or its
listing with a local licensed real estate agency; and,
Whereas, The City meets the requirements of Section 11-76-4.2 to be able to use
this alternative method for the sale of surplus property.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That the sale of the Subject Property is hereby authorized to be
pursuant to Section 11-76-4.2 of the Illinois Municipal Code by the City Administrator or
the listing of the Subject Property with a local licensed real estate agency subject to the
terms of this Resolution.
Section 2. The terms of the sale shall include the future plans for redevelopment
and the time to commence and complete its redevelopment. The City Council may
accept any offer or bid determined by them to be in the best interest of the City by a vote
of three-fourths of the corporate authorities then holding office. No sale shall be
conducted until at least 30 days after the date of the first publication.

Section 3. This Resolution shall be in full force and effect upon its passage and
approval as provided by law including its publication in a local newspaper once each
week for three successive weeks.
