In these policies, there is no specific declaration that we can, for example, deny a building permit to a builder who owes the City hundreds of thousands of dollars within that development or neighboring development. This proposed code amendment, as written, would allow us to withhold the building permit until the builder settles all debt with the City. During staff review, it became apparent that a similar section would be useful for all other permits and licenses that the City issues . For instance, if a managing partner of a development company that owes the City a large debt wanted to open a liquor store, this proposal would allow us to reject the application. This proposal would not apply to emergency services provided by the Police Department or other life safety services that would include water, sewer or refuse services . Water, sewer and refuse service could still be terminated pursuant to the existing sections of the Code. Chapter 4 of the United City of Yorkville Code of Ordinances is hereby I amended by adding Section 1 -4-4 to read as follows : I " 144 : DEBTS DUE AND OWING THE CITY : Any person, partnership, corporation or other entity ("Debtor") owing any fine, penalty, cost, tax, user charge, fee, judgment, financial contractual obligation or any other debt to the City or any person, partnership, corporation or entity under the control of such Debtor, shall not be entitled to any City service, permit, license or other City action or approval unless that debt is paid in full . This section shall not prohibit any emergency City services to a Debtor such as from the Police Department, or life safety services such as water, sewer or refuse service. " Section 2. If any Section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 3. This Ordinance shall be in full force and effect upon its passage, approval, and publication as provided by law. Staff created the attached questionnaire soliciting input from over 20 municipalities throughout the region regarding permit fees, plan reviews, requirement for bond/insurance, etc. The attached table provides information gathered from the municipalities that responded to the survey. Research , Currently the City of Yorkville calculates tower fees at a flat rate of $ 750 . 00 . The fee for the accompanying equipment shelter is charged $ 650 . 00 , plus $ 0 . 20 per square foot of building. Plan Review fees vary, depending on the type of proposed construction; antenna collations may require a fee, while new tower construction typically will not need a plan review as structural engineering has been performed . Therefore, a typical 200 foot tall tower with an approximately 250 square foot equipment building would have a total building permit fee of $ 1 ,450 . 00 if constructed in the City of Yorkville. Upon evaluating the information gathered from the other municipalities, it is clear that there are no set standards for calculating telecommunication tower permit fees . Building permit fees vary widely and can be based on flat rate, project valuation, type of tower, or even number of pages of the plan. With regard to plan review requirement and fees, most of the municipalities surveyed do not charge for plan review or it is included in the permit application fee. Those that do charge a plan review few ranging from $40 . 00 to over $400 . 00, plus a fee per square footage. A majority of the municipalities do require telecommunication tower contractors be bonded and insured . At the lower end, the permit fee for a telecommunication tower in the municipalities surveyed can cost approximately $ 115 . 00 upwards to $ 6 ,000, not including plan review. Staff Comments , Comparatively, the City of Yorkville ' s permit fees for telecommunications towers are less than the average of the communities surveyed. Additionally, most other communities do require bonds and insurance for the contractors working on the project; however, Yorkville only requires it for work being performed on City-owned property. The Cell tower review will be a customized review of the normal Developer Services review. Reviews will be conducted by the Consultant Reviewers : ■ This is a voluntary program . You can still choose to submit your cell tower/antenna project under the normal process . ■ The cell tower/antennas will be reviewed by an outsourced Consultant Reviewer. ■ There will be a fee charged for the Consultant Reviewer building permit review. ■ We have identified 4 base variations of cell tower installations and have designated them prototypes . ■ Included herewith is a spreadsheet detailing the estimated costs of the 4 prototype antenna installations .
