Lynn Dubajic, YEDC (arr. 6:47pm)  The meet ing was called to order at 6:30pm by Chairman Gary Golinski. He welcomed  and thanked everyone for their attendance.  Minutes for Correction/Approval June 1, 2010  Two corrections were noted:  From the last page, Alderman Spears will be the new  liaison for the Cable Consortium.  Kryst i Noble’s name was misspelled on the 1 st page.  The minutes were then approved with these correctio ns.  Items Recommended by Plan Commission for Approval:  1.  PC 2010­07 Zoning Code Test Amendment Regarding Alcohol Manufacturing and  Microbreweries  This was part of Plan Co mmissio n Public Hearing fro m June 9 th .  The Commissio n  recommended approval o f the text amendment with changes.  They recommended that  the text amendment should allow for manufacturing of alcoho l in the M1 district and for  microbreweries to be special uses within the business district.  Other changes included  increasing the permitted yearly production from 5,000 to 15,000 barrels and also  removing the reference to “bars” in the definit io n of the microbreweries.  Alderman Werderich asked what determined the increase in quant it y.  Ms. Noble said she  suggested the recommended amount after conducting a survey o f other towns.  This item  will mo ve to the July 13 th Council consent agenda.  New Business  1. EDC 2010­24 Building Permit Report for May 2010  No comments 2  2.   EDC 2010­25 Building Inspections Report Summary for May 2010  Mr. Zabel said there was an average of 6 inspect ions a day in May and he is spending a  half day in the field.  Alderman Spears commented that she liked the term “re­inspection”  on the report.  3.   EDC 2010­26 Foreclosure Update  Ms. Noble said that she receives the data on the number of foreclosures from YEDC on a  mo nthly basis.  She noted that Yorkville has the highest number in comparison to  surrounding communit ies.  Alderman Golinski asked if there was a list of addresses for  pre­foreclosures and foreclosures.  The Cit y GIS emplo yee is also working on a layered  map of these houses.  Ms. Noble will send a list of addresses to the committee members.  4. EDC 2010­27 Integrated Transportation Plan Implementation Update  Laura Schraw reported that a grant applicat ion for ComEd was again open.  She said  matching funds cannot be used on this trail that is less than a mile from Rt. 47. She  suggested looked at the Kennedy Road area, but said that it would require so me  acquisit ion. The Kennedy Road trail would extend fro m Rt. 47 to Mill Street.  Alderman  Sutcliff noted that she had received emails about safety issues for that stretch of road.  Ms. Schraw said this grant application is due by August 31 st , but she said that if the Cit y  cannot match the funds, there is a 2­year penalt y from IDNR before another applicat ion  can be made.  Alderman Werderich said a clearer picture is needed, but the cash outlay o f  $220,000 of the $800,000 is very large for the Cit y.  He added that there are differing  opinio ns on the need for trails.  Chairman Golinski asked Laura to obtain more  information.  It was suggested by Ms. Noble that perhaps a meeting to discuss ITP issues could be held  prior to EDC from 6­6:30.  Committee members approved of this idea.  This matter will be discussed wit h EEI and then move to Park Board and Cit y Council.  Ms. Schraw noted that the grant money was just released in the prior week.  5.  EDC 2010­28 Zoning Commission Update  Kryst i Noble reported that the Commissio n is looking at adoption of the revised codes in  June of 2011.  The next meet ing will be held on July 28 th and the guest speaker will be  the person who writes the Illino is Land Use Law.  6.  EDC 2010­29 Building Code Update Committee  Paul Zabel and Kryst i Noble have been reviewing the Building Code.  There will be a  series of meet ings with a 3­phase approach:  assessment, review and adoption.  The  process is expected to be complete by July 2011.  The committee will meet on July 18. 3  Old Business  1. EDC 2010­23 Telecommunications Tower Fees  A survey o f surrounding towns was conducted by Kryst i Noble to obtain feedback on the  ent it lement process of these towers.  She said so me towns address this is a special use  while others use variance requests.  She said the City’s fees are consistent, but low in  some areas.  Overall, she said the fees vary widely depending on the approach used by  the municipalit y.  She said changing the fee structure could be an option.    Krysti said  there are both application fees and permit fees.  Structural and electrical reviews would  be done also.  Currently in the Cit y ordinance, an inspect ion and review is required.  More research 2.  EDC 2010­35 Building Inspection Report Summary for June –August 2010  It was noted that City emplo yee Dee does spot survey reviews and checks setbacks and  elevations.   There were several re­inspections and Mr. Zabel said his department does  charge for these.  3.  EDC 2010­36 Foreclosure Update for July –September 2010  Ms. Barksdale­Noble reviewed this report for the committee and said September had the  highest bank­owned properties so far this year.  She said auct ions and pre­foreclosures  remained steady.  Some banks were processing so many foreclosures that some details  were being overlooked.  As a result, many discrepancies were found and so me states  were asked to stop the process. 2  4. EDC 2010­37 Ordinance Amending the Code of Ordinances Adding a Prohibition  of Service to Debtors of the City  Bart Olson explained this ordinance and said that there are similar prohibit io ns in the  subdivisio n control ordinance.   The ordinance states that if deposits are not paid or debt  is owed to the Cit y, annexation agreements would not be considered from that developer.  It would apply to debt on exist ing developments or foreclosure properties.   However, it  does not apply to police or fire, water, sewer or garbage service  This item will mo ve forward to Council on the consent agenda.  Old Business  1. EDC 2010­23 Telecommunications Tower Fees  Kryst i did research on what other communit ies are charging for cell towers.  She  researched 20 towers in the area and found there are no set standards.  The Cit y current ly  charges a flat rate of $750, a $650 fee for the shelt er, plus 20 cents per square foot of a  building.  A typical 200­foot tower would cost $1450.  She said Yorkville is currently  below the average of most communit ies and the average cost in her survey was $3,000  for a permit.  A plan review is done for exist ing towers only, since new towers have their  own engineering.  She said there were many ways o f charging the various fees and asked the committee for  their input.  She said there could be an increase and it could be charged as a  flat rate,  review fees could be included and the structure could be charged by t ype of tower.  Ms. Sutcliff favored a rate of about $5,000 per tower.  Chairman Golinski reco mmended  a flat fee on the square footage and also a plan review fee.  He suggested the City fees  should be comparable to Kendall Count y.  Kryst i recommended a flat fee of $500 for the  review fee, but she will research what Kendall Count y charges and bring back a range to  be considered.  Additional Business  There was no further business and the meet ing was adjourned at 7:02pm. The following table and graph illustrates the trend in foreclosures during various stages of the process including pre-foreclosure, bank-owned and auctioned properties for the City of Yorkville since May 2010. Similar to last month’s report, the number of auctioned and pre-foreclosure properties remained relatively consistent since August. However, the number of bank-owned properties in Yorkville increased by approximately 5.5% to 410 properties in October. Table 1. Barksdale-Noble, AICP Community Development Name Department 1 At the October EDC meeting, staff presented research from various municipalities throughout the region regarding building permit fees for telecommunication (cell) towers. Although it was noted that the methodology for calculating telecommunication towers permit fee varied widely, Yorkville’s permit fees were less than the average fee assessed among the communities surveyed (see attached). Therefore, it was the consensus of the committee for staff to prepare recommendations for increasing telecommunication tower permits fees. The committee also requested staff provide a comparison of the recommended permit fee increase with telecommunication tower permit fees of surrounding municipalities to ensure our fees remain competitive. Staff Recommendations: Upon review of the current schedule of fees associated with new telecommunication tower building permits, staff recommends the following: PERMIT TYPE CURRENT FEE PROPOSED NEW FEE Telecommunication Tower $750.00 No change Equipment Shelter $650.00 + $0.20/sq. ft. $750.00 flat fee Fence $50.00 No change Antenna None $250.00/each As proposed, the fees for the telecommunication tower and fence permit will remain the same. However, the new fee structure establishes a flat fee for equipment sh elters at $750.00 and proposes a $250.00 fee per antenna. It is staff’s opinion that a flat rate for equipment shelter fees simplifies the permit calculation, and results in a net increase of approximately $50 per shelter since the average equipment shelter is roughly 200 to 250 square feet. Staff also recommends a separate fee for antennas as most, if not all, cell towers allow for collocation of several wireless providers antennas. Currently, the City has no standardized fee for the installation of additi onal antennas on existing cell towers. Therefore, under the proposed new schedule of fees the typical building permit for a new 200-foot tall tower with antenna, fence and an approximately 250 square foot equipment shelter would increase from about $1,500.00 to $1,800.00. This represents a 17% increase in building permit fees for new cell tower construction. Staff is not proposing a separate plan review fee at this time, as plans for new towers are required by the Federal Communications Commission (FCC) to have structural engineering review performed by a licensed professional prior to building permit submittal. Furthermore, most communities surveyed do not charge for plan reviews or it is included in the permit application fee. Memorandum To: Economic Development Committee From: Krysti J. Barksdale-Noble, Community Development Director CC: Bart Olson, City Administrator Date: October 29, 2010 Subject: Telecommunications Tower Building Permit Fees 2 Surrounding Municipalities: Attached to this memorandum is a table that illustrates building permit fees for telecommunication towers in nearby municipalities which ranges from $550 (Kendall County) to $4,000 (Joliet). Although the proposed new building permit fee of $1,800 is higher than the County (as is the current fee), staff is confident that the permit fees will not discourage future construction of towers within the community since tower location is dictated by such considerations as gap in coverage, population density and local topography. If the EDC is in agreement with the staff’s recommendations, a draft ordinance of the proposed amendments to the building permit fee schedule will be provided at the next meeting for consideration. mmittee (BCUC) held it s kick­off meet ing on July 19,  2010 and has met consistent ly over the past several mo nths. During that time, the BCUC has  reviewed, discussed, and voted on amendments to the fo llowing five (5) of the ten (10) codes  proposed for adoption:  1. 2009 International Fuel Gas Code  2. 2009 International Energy Conservation Code (IL Energy Efficient Building Act)  3. 2009 International Plumbing Code/Illino is Plumbing Code (recent version)  4. 2009 International Mechanical Code  5. 2009 International Property Maintenance Code  The Co mmittee is current ly reviewing the 2009 versio ns of the International Fire Code  and the International Residential Code. Discussion will cont inue on these proposed code  adoptions, which includes provisio ns regarding fire suppressio n (sprinkler) systems in various  building t ypes, at the next BCUC meet ing on November 15th. After completing the review o f  these proposed codes, the remaining codes for consideration will be the 2009 International  Building Code, 2009 International Exist ing Building Code and the 2008 National Electrical  Code.  Staff anticipates the BCUC will complete the review process in early 2011. The proposed Since the Zoning Co mmissio n reconvened its regular mo nthly meeting schedule this past  spring, staff has began a complete review o f the current zoning code and began the process o f  working with the Co mmissio n to draft proposed revisio ns. To date, the Zoning Co mmissio n has  make comprehensive updates to the structure and content of the zoning code and proposed  amendments to the administrative and enforcement aspects to bring it more in line wit h the  actual pract ices and processes of the Cit y.  Substant ial revisio ns have been proposed to not only the purpose, interpretation and general  provisio ns o f the zoning ordinance, but also the permitted and special uses, dimensio nal/bulk  requirements and zoning district categories. Staff ant icipates the remainder of 2010 and early  2011 will be devoted to draft ing the proposed new chapters of the zoning code such as the:  Conservation Design District, Historic Downtown Overlay District, Route 47 Overlay District  and Alternative Energy Systems chapter.  The edit ing and formatting o f the final draft will most likely occur in the spring of 2011. At  the conclusio n of this process, staff expects a final written assessment report prepared by the  Zoning Co mmissio n will be submitted to the EDC in early summer 2011 alo ng wit h a  recommendation for adoption o f the new zoning ordinance. The Cit y Council will then conduct a  public hearing so licit ing cit izen comments prior to voting on adopting the proposed revisio ns.  Fo llowing adoption of the zoning ordinance, staff will prepare a handout and an informational  meet
