Minutes for Correction/Approval: November 3 , 2009 The minutes were approved as read. Items Recommended by Plan Commission for Approval: None New Business: 1. EDC 2009-53 Building Permit Report for October 2009 There was no discussion. 2. EDC 2009-54 Building Department Inspection Report Summary for October 2009 Alderman Spears commented that the inspection report she had previously requested looked good and was easy to read. Old Business : 1. EDC 2009-44 Building Code Update Discussion Paul Zabel, City Code Official, said the purpose of the meeting was to share thoughts on the new building codes being considered for adoption. He introduced the guests present at the meeting and Bernie Arends began the discussion by showing 2 videos. One video demonstrated activated sprinklers extinguishing a sprinkler-protected room versus an unprotected room. The other video showed an older home that was retro-fitted with a sprinkler system. 1 Alderman Werderich asked about the various notification systems for alarms. They are alarm services such as ADT, bell inside house that is amplified through the ductwork, horn strobe outside the house and outside bell ringer. Mr. Arends said the preferred method is the alarm agency. Mr. Arends said that the cost of sprinklers in Yorkville is $ 1 .60 to $2.00 per square foot with a total cost of about $5,000 for a 3 ,000 sq. ft. home. There is an additional cost of $2,500 for a pump and tank if your home has a well. A 3,000 sq. ft. home can be piped in 3 days. A sprinkler system only uses approximately 15 gallons of water versus 250 gallons from the Fire Department. In a typical situation, only 1 sprinkler is activated at one time and is activated by heat. A typical Fire Department response time in Yorkville is 4-5 minutes. Mr. Arends gave statistics relating to home fires and the number/spacing of hydrants needed on a street where houses have sprinklers. He said that Sugar Grove had recently lowered their insurance rating by requiring sprinklers in all new commercial buildings. Cheryl Lee of CL Design Build, which is an energy star builder since 2000 and a certified green professional, also shared her thoughts. She related her experience with cellulose insulation and said they build homes above and beyond what the codes require. She said the cellulose provides a good seal with the wall and is a recycled newspaper product mixed with borax for mold-retardancy. Their siding is a fiber cement material (non- flammable product). She said if sprinklers are mandated, they should be phased in. She has built one home with a sprinkler system, but most people prefer the monitored security system. Alderman Werderich asked Ms. Lee' s opinion of sprinkler systems and she replied that it costs her a much greater amount of money. She added that it could affect home sales for senior citizens or the first time homebuyer. Alderman Werderich commented that the sprinkler issue is a balancing act between saving lives versus the dollar burden. He said if there is a code requiring sprinklers, there should not be incentives or offer incentives only if the homeowner wishes to go beyond the code. Looking at another incentive, Alderman Spears said reduced inspection fees could be offered. Steven Gregory of Northern IL Homebuilder Association and other organizations, shared his opinion on sprinklers. He provided information about electrical standards and energy conservation. He said the 2009 code is an improvement over the 2006 code. Mr. Gregory said that while the population has increased, home fires have decreased partly due to better techniques of home-building. He advocated the idea of allowing the homeowner to make the choice to have a sprinkler system. Fire Chief Hitzemann said a 1 -inch sprinkler pipe is adequate in Yorkville and will provide a more than adequate pressure. He also recommended copper pipe. Mr. Arends added that the way people live today brings more fire risk to their homes—using more plastic and other combustible material in the homes. Alderman Golinski asked about the cost of retro-fitting an older home with a sprinkler 2 system. There are many variables that affect the cost. Mr. Gregory said a system he installed in the 1990's cost over $20,000. Ms. Lee said she had installed a retro-fit four years ago at a cost of $5 minimum, per square foot. While insurance companies offer discounts for sprinkler-installed homes, the payback takes many years. Gladstone Homes representative Adam Dontz said he realized the Aldermen were there to represent their constituents the best they could. He said builders mark up whatever systems they place into their homes. He said he is the only active builder in Grande Reserve and he has not sold a home there in over a year. Competition is going to be more fierce due to the economy and he said it must be determined what the market will support at this time Mr. Dontz said he would like to volunteer his time along with Mr. Zabel and others to form an ad hoc committee and look at the entire code. He suggested bi-weekly meetings. He said inspection fees may need to be reduced and he wants to identify the cost of every line item. He said right now a foreclosure home can be purchased for half that of a new construction. People must be able to buy homes here to generate sales tax to support the community. Alderman Werderich asked if there any urgency to passing the new building code. There is no timeline now, but Mr. Zabel said the current rating of 5 with ISO will not improve without adopting the new code. The City can be re-evaluated by request and Chief Hitzemann said the City is close to being rated 4. This improved rating would provide better insurance premiums for residential. The City currently uses the 2000 building code and Mr. Dontz suggested perhaps the City could adopt 2003 or 2006 to achieve the ISO rating of 4. This could also keep the cost of housing down and allow more time to examine the code. Mr. Arends said the advantage of the 2009 code is that life safety codes that were mandated by the State. Fire Chief Hitzemann then addressed the committee and presented some fire statistics. He also discussed the use of cellulose joists in "green" homes. He said new houses need sprinklers to prevent the heat from reaching those joists because they are failing before they burn. He cannot send firefighters into new homes due to that danger. Mr. Gregory added that burn-through is a big problem with the glued trusses. Hitzemann suggested not using them above unprotected space. Rich Guerard of Wyndham Deerpoint said the market is relentless at this time and he said the fire sprinkler system is not a perceived value to the buyer. He said builders also cannot afford the sprinklers at this time and they are not realizing any profits right now. He said appraisers will not place a value on sprinkler systems in homes. Sales are being lost to other towns, therefore having an impact on the community as a whole. In summary, Chairman Golinski said this process is a balancing act and a sound decision will require all the facts. This discussion will come back to this committee next month to form a commission. Minutes for Correction/Approval none Items Recommended by Plan Commission for Approval: None New Business 1. EDC 2010-01 Building Permit Report for November 2009 A new format was presented that included the previous year information, which had been requested. 2. EDC 2010-02 Building Department Inspection Report Summary for November 2009 Alderman Spears commented that she preferred the previous format report and said that the abbreviations were unclear. Aldermen Werderich agreed. Mr. Zabel said the explanation was on the last page and the report is more detailed. 3. EDC 2010-03 Title 8, Chapter 10 Code Amendment Regarding Building Permit Fees Travis Miller said this is a revision and some language (ICCI) had been stricken as recommended by staff. This will not require a Public Hearing. Alderman Spears asked if the fees would be changed and they will not. This item will move to consent agenda. 4. EDC 2010-04 Zoning Code Amendment Discussion Regarding Pawnshops Alderman Munns had inquired as to whether or not pawnshops were a permitted use in the City. The City does allow these and he asked that pawnshops be removed. After a I brief discussion, the committee consensus was that it should be included since it is a legitimate business. Mr. Miller said the Zoning Commission had discussed this in August and decided it was a unique retail use and should be permitted. Ms. Spears asked about the "Commercial & Research Lab" and asked if Heartland Blood Center would be included in that category. The answer was unclear at this time and there was no further action. Old Business I. EDC 2009-42 Sign Ordinance Amendment — Off-Premise Sponsorship Sign Provisions Mr. Olson said there were three policy options included in the packets. The original policy from the Park Board allowed a sign anywhere in the City. When considered by the Zoning Board of Appeals, they felt it was not restrictive enough and asked that only 5-6 banners be allowed. The Park Board had asked for 5-6 banners and a backstop sign. Travis Miller added that at the ZBA meeting the Park Board recommendation was deemed too broad. The backstop request was not deliberated at the ZBA meeting and Mr. Olson later asked that it be included. The staff recommendation was that it be moved forward to City Council with this inclusion. Chairman Golinski added that the backstop ad had been in place for many years. Mr. Olson said this aspect had already been written in the sponsorship agreements and generates significant revenue. The committee agreed to this change and it will move to the City Council consent agenda. 2. EDC 2009-44 Building Code Update — Committee Formulation A committee recommendation was presented and includes representation from various groups. Ultimately, the members will be appointed by the Mayor. A Chamber representative was also suggested. Alderman Spears suggested that a homebuilder be included along with someone from the Fire Sprinkler Association due to previous concerns about fire suppression systems. However, Mayor Burd thought the Association member should be a consultant. Chairman Golinski said there is already someone from the fire department. Alderman Werderich suggested a member of the insurance industry be included, but later withdrew that suggestion, opting to invite them as needed. A realtor was also mentioned. Alderman Spears volunteered to serve on this committee as well. This item will move to the January 26`1' Council meeting. Additional Business City Administrator Olson thanked Travis Miller for his years of service to the City, since this would be his last week of employment. Committee members expressed their thanks as well. Mr. Miller offered his assistance for any questions after he leaves. There was no further business and the meeting was adjourned at 7 :OOpm. They also suggested that the petitioner and discuss with the adjacent landowner future parking lot connections to allow traffic to have better ingress/egress from the parking lot, and for Staff to be aware of this request for future permitting and site plan review. The Plan Commission reviewed the following standards when preparing the recommendation to approve: Special Use Standards (10-14-6 of Zoning Ordinance) F. Standards: No special use shall be recommended by the Plan Commission unless said Commission shall find that: 1 . The establishment, maintenance or operation of the special use will not be unreasonably detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the neighborhood. 3. The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 4. Adequate utilities, access roads, drainage or other necessary facilities have been or are being provided. 5 . Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets. 6. The special use shall in all other respects conform to the applicable regulations of the district in which it is located, except as such regulations may in each instance be modified by the City Council pursuant to the recommendations of the Plan Commission. (Ord. 1973-56A, 3-28-74) Staff Comments and Recommendations • Staff recommends approval of the special use for a daycare on this property. • The petitioner has indicated to Staff and Plan Commission that if special use in granted, the petitioner would purchase the entire building. The renovation plan indicates the possibility of adding 3 additional tenants which would have to meet their respective parking requirements. The current parking lot provides enough spaces for this special use, but shall be re-evaluated if another tenant applies for a permit. Step 3: Park Board planning meeting: The Park Board makes recommendations on any park sites included in residential developments. The Park Board planning meeting is the 4th Thursday of each month at 7:00 p.m. at the Parks and Recreation Office at 201 W. Hydraulic Street. Step 4: Plan Commission: The Plan Commission meets the 2nd Wednesday of each month at 7:00 p.m. in the Yorkville public library at 902 Game Farm Road. The Plan Commission will make a recommendation for the City Council's consideration. The Plan Commission consists of 10 members appointed by the Mayor. A public hearing will be held at this time for the Annexation Agreement and/or Rezoning request or Special Use request. Sandwich board style signs are permitted as a portable sign under the sign code. This means that they can only be placed outside of the business for fourteen days in a row, five times per year(with a $50 permit for each fourteen day period). The Mayor is requesting a moratorium on the restriction of these signs (which would allow businesses to use sandwich board signs without a permit, and without a maximum timefi-ame). Alderman Golinski had been contacted by another business owner about the differences in the sign code between a temporary banner and a temporary sign (pictures attached). In our current sign code, temporary signs are limited to 16 square feet,but temporary banners are limited to 32 square feet. The particular business owner felt that temporary banners were considered an inferior product (as far as aesthetics)but were allowed to be larger than temporary signs, and requested a change in the sign code. A nano-brewery is a brewery that makes very small batches of beer or other alcoholic beverages. In some cases, the actual brewing equipment can be as large as a medium sized room (think Rock Bottom Brewery in Warrenville or Emmett' s Ale House in Oswego) or small enough to fit on a pallet (think home brewing, with a keg small enough to fit in a fridge). This business owner is researching the state health code and liquor code requirements to permit this use, and expects to have those requirements satisfied without change. The City code does not permit the creation of alcoholic beverages within any zoning code, nor does it list it as a special use within the zoning code. However, the M-1 zoning district (which this particular business is zoned as) does permit "beverages — non-alcoholic" as a permitted use within the M- 1 zoning district. So, it would seem that the original zoning code (circa 1973) contemplated the difference between alcoholic and non-alcoholic beverages, accommodated non-alcoholic beverages and chose not to address alcoholic beverages. If the Economic Development Committee agrees that this issue needs to be corrected, I would ask for direction to initiate a zoning code amendment. Staff would then research whether this particular issue should be addressed by amending the permitted uses list, making this use a special use, or some other method. Zoning code amendments do require a public hearing at a Plan Commission. While I acknowledge that the Zoning Commission could review this issue and direct a change via the comprehensive zoning code update, I do not expect that 1 comprehensive update to be completed for several months, and the Zoning Commission will not be meeting again until late April.
