The meeting was called to order by Vice-Chairman Rose Spears at 6 :35pm.
Minutes for Correction/Approval December 1 , 2009 and January 5, 2010
Both sets of minutes were approved as read.
Items Recommended by Plan Commission for Approval:
1. PC 2010-01 Pain Kleinwachter dba We Grow Kids (Daycare) — Special Use Request
It was noted that a staff review had been completed and the Plan Commission had
parking lot concerns. It was also noted that one of the units was formerly a bar. The
liquor license there was discussed and Attorney Kramer said that as long as the license
was in place prior to the daycare going in, it would be permitted. He said the restaurant
was going to close and the only definite plan was for the daycare. He said all the
improvements were in place and DCFS regulates all the fencing to be used.
Alderman Werderich commented that the daycare would be a valuable asset in his Ward
and Attorney Kramer added that this daycare also provides care for special-needs
children. This matter will move to the City Council consent agenda.
In an unrelated item not on the agenda, Attorney Kramer noted that IDOT wants
additional roadway that will come right to the curb at his office location. He noted
concerns with the sign and said it is 100 sq. ft.---larger than the new ordinance allows,
however, it only needs to be moved and will not be changed. Paul Zabel will research
how the sign might be affected by the sign ordinance.

1. EDC 2010-05 Building Permit Report,for December 2009
It was noted there were 23 permits issued in December.
2. EDC 2010 —06 Building Permit Report for January 2010
No comment.
3. EDC 2010-07 Building Inspection Report Summary for January 2010
The committee requested that the original format be used for this report. Paul will revise
and this will come back to the committee next month.
4. EDC 2010-08 Sign Ordinance Discussion
Ms. Spears said the Mayor had received a call regarding the use of sandwich board style
signs. The Mayor is requesting a moratorium on the sign restrictions to allow businesses
to use these signs without a permit or maximum time frame due to the current state of the
economy. Alderman Golinski was also contacted about differences in the sign code
between temporary banner and temporary sign.
The Mayor asked to allow this temporary moratorium, but said a permit would still be
needed with a fee of $50. She requested it for 1 year and said the business in question is
set back from the highway and she feels the sandwich boards have a positive impact.
Currently, such a sign is only allowed for 14 days and 5 times a year.
Alderman Spears said she thought the City should work with business owners for
sandwich style signs as well as banner signs. She also felt the temporary banners should
be limited to 32 sq ft. If sandwich board signs were allowed, the available space on the
sidewalk was also discussed. Ads on parked trucks were also discussed and it was agreed
this type of sign should not be allowed.
It was noted that the sandwich board request is for temporary relief while the temporary
sign request is for permanent relief. Displaying the sandwich board signs only during
business hours was also recommended. Multiple signs in one location were also
discussed. Alderman Werderich suggested that if a moratorium is applied to the
sandwich boards, a date to revisit should be established. It was agreed that there should
be a moratorium of 6 months for the sandwich boards and they should only be displayed
during business hours. The size will be determined by industry standards
Recommendation for temporary signs and banners was for 32 square feet or less. The
matter will be moved to City Council for further discussion. Bart Olson will verify with
Attorney Orr if a City Council vote or amendment is needed. Alderman Sutcliff said the
Zoning Board should be advised as well.
It was decided to move forward with a Public Hearing based upon the recommendations
of the committee

5. EDC 2010-09 Permitted Uses Within M-1 District
A request was made to set up a nano-brewery with the product being sold to restaurants
or pubs. The application would yield 1 -2 kegs at a given time. Alderman Werderich
asked if there are any City restrictions on size. It would be added as a permitted use in
the M- 1 district according to Mr. Olson. The committee agreed that a new business
would be an asset
Mr. Olson said that if a City Council vote is not needed for a zoning text amendment, a
Plan Commission Hearing would be needed, and then it would move forward to City
Council at a later date.
In a related matter, Mayor Burd said that Attorney Orr and Administrator Olson are
updating City procedures and information will be given to all Aldermen.
6. EDC 2010-10 Ideas for Regional Events and Attractions
Alderman Golinski had brought up this matter in regards to an upcoming baseball
tournament that would attract over 2,000 people. He said these visitors need to have
information about local businesses. Park District personnel are currently working on a
related brochure.
Alderman Werderich suggested keeping this item on old business to be able to discuss it
further and said the method of information distribution needs to be addressed. Alderman
Sutcliff showed an example of a vendor services map. Such a map could be sent to
registrants in registration packets for events. Glory Spies is currently working on a
similar brochure. Mayor Burd suggested email blasts and to work with the Chamber.
She also said a meeting with the Chamber and Sue Vos of the Tourism Bureau would be
beneficial to discuss available amenities. She cited the example of the Hunting & Fishing
Days that draws many people who need such amenities. Mayor Burd said she had a
recent meeting with the new hotel owner to discuss how to market packages of services
in the area. Bart said he had also spoken with the Chamber about this idea and the Mayor
will follow up.
This item will return to this committee for further discussion.
7. EDC 2010-11 Review of Committee Liaisons
Ms. Spears noted that it was the committee' s decision to appoint liaisons and asked for
the committee' s recommendation to be liaison for the YEDC. Mayor Burd asked if
Alderman Moons would then be bumped from this position. Ms. Spears replied that he is
not a member of this committee and the governing ordinance states the liaison
opportunity should be given to a member of the committee. Aldermen Sutcliff and
Werderich agreed to her request and it was noted this does not need to go before the
Council.

Comprehensive Plan Recommendation for Property
The 2008 Comprehensive Plan recommends Mixed Use land use for the subject parcel.
The Comprehensive Plan defines Mixed Use as,
". . . classification establishes unique areas which are best fitfor medium density residential,
small office complexes or open space. "
" . . . identifies locutions to sense as a buffer between intensive land uses (commercial, industrial,
or of and low-density residential uses. This land use classification, Mixed Use,
acknowledges that the highest and best use of Imrd not only differs ftrom location to location, but
is also dependent on the existing development conditions and on market conditions. "
"Examples ofpotential developments in the mixed use classification include single,family
attached residential units, age restrictive residential, one story office buildings, or recreational
amenities (playgrounds, ballfields, or golf courses). Again, it should be acknowledged that each
development is unique and in no manner does a previous development set the precedentfor
another. Each development submittal will be handled as a unique case with the highest and best
use of the land to the City of Yorkville determined on a case by case basis "
The Comprehensive Plan defines Commercial Use as,
". . . classification includes uses such as retail, service, restaurant entertainment. This land use
classification intends to promote market-sensitive development of commercial uses within
strategically located areas to efficiently, effectively and conveniently serve the growing local
population while reinforcing the importance of the United GO) of Yorkville cis a regional

"Further, as a goal of this Comprehensive Plan, use-oriented districts should be encouraged to
provide an agglomeration of uses. These use-oriented districts include, but are not limited to,
entertainment, healthcare, downtown, cultural and recreation. "
"Generally, at the intersections of arterials and major collector thoroughfares (Baseline Road,
Route 47, Galena Road, Eldamain Road, US 34, Route 71, Route 126, Highpoint Road, Atnent
Road, Walker Road, and Caton Farm Road) "
Staff Review Comments:
• The petitioner is requesting an amendment to Bristol Bay PUD for parcel 02- 10-300-011 ,
which is located just east of Cannonball Trail and just south of Galena Road, in order for
the subject parcel to be rezoned from R-3 (General Residence District) to B-3 (Service
Business District).
• The 7.89 acre property directly adjacent to the northern boundary line of the subject
property (located at the intersection at Galena and Cannonball Trail) is currently zoned
B-3 .
• Mixed use, as shown in the Comprehensive Plan, is used as a buffer between commercial
and general residential, and can include medium density residential or small office space.
At this location, single family attached or age-restricted residential is appropriate. Gross
density is not to exceed 3 .5 units/acre.
• The current plan for the property, as outlined in the annexation agreement, zoned as R-3,
has a density of 8 .5 du/ac, totaling approximately 185 units for the 22 acre parcel.
• If this property is re-zoned to B-3, the property to the south of this parcel is zoned R-3,
and therefore would still provide an appropriate mixed use transition from Commercial to
General Residential.
• Zoning review: The surrounding property to the north is zoned B-3, the property to the
east is not yet annexed to the city, the property to the south is zoned R-3, and the property
to the west is zoned R-2.
R-3 Zoning per Annexation Agreement:
• Minimum Lot Area per Dwelling: Allowable density of 9 dwelling units per acre
• Minimum Lot Width: 50 feet
• Minimum Front Yard: 30 feet with 10 feet of public utility/sidewalk easement
• Minimum Side Yard: 10 feet
• Minimum Corner Side Yard: 20 feet
• Minimum Rear Yard: 30 feet
• Maximum Building Coverage: 35%
• Minimum Floor Area Per Dwelling Unit: 1 ,010 square feet for up to 20% of units, 1 ,400
square feet for all others
• Minimum Building Separations: side to side: 20 feet, side to rear: 40 feet, rear to rear: 60
feet, front to side: 50 feet, front to front: 50 feet, rear to front: 100 feet
• Minimum number of dwelling units per building: 6
• Minimum Number of Enclosed Parking Spaces: 1 or 2 per dwelling unit based on
Preliminary PUD Plat design
• Private Streets and motor courts
• Permitted Obstruction to Side Yards: covered porches up to 3 feet, one story baylbox
windows and chimneys up to 2 feet

Staff Recommendations:
• As per the amendment to the annexation agreement: "the New Owner has petitioned the
City to rezone the Property pursuant to the City Zoning Ordinances as setforth in the
2005 Annexation Agreement from R-3 Residential District to B-3 Business District in
order to permit the New Owner to proceed to present a concept plan for a planned unit
development with commercial uses on this Property;" Staff agrees that a Conceptual PUD
Plan of the parcel shall be submitted for approval after re-zoning is approved.
• Staff recommends approval of re-zoning from R-3 to B-3 . Additional commercial area
near the Galena/Cannonball Trail intersection and in close proximity to the Steven G.
Bridge Regional Ballfields (Yorkville' s popular lighted ballfield complex) with retail
such as restaurants, an ice cream shop, convenience store, sports shop, etc., can provide
valuable amenities to the users of this facility.

AMENOMENT TO
ANNEXATION OR PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT
PETITIONER ROUTE
Step 1: Petitioner must submit a completed application, Tees" and all pertinent materials to the
Community Development Department a minimum of 45 days prior to the targeted Plan Commission
meting. Petitioner is responsible for making submittals to other review agency such as Kendall
County, Illinois Department of Transportation, Illinois Department of Natural Resources, U.S. Amry
Corps of Engineers, etc., to allow timely review by City.

Step 2: Plan Commiselon : The Plan Commission meets the 2nd Wednesday of the month at 7:130 p.m.

A Public Hearing will be held at time for the Amendment to Annexation/PUD Agreement. For
a public hearing, the petitioner shag complete and submit to the Community Development
Department the application with a legal description 45 days prior to the public hearing at the Plan
Commission meeting. Notice will be given by publication by the United City of Yorkville in the
Kendall County Record at least 16 days but no more than 30 days prior to the puM heating
dala.
Before this amendment can male forward to the Economic Development Committee, a "draft'
Amendment to this Annexation or PUD Agreement must be written.
Step 3: Economic Development Committee: The Economic Development Committee meets the first
Tuesday of the month at 7:00 p.m. in the Conference Room at City Hall. The pro)erdwill be dicmesed in
an Informal atmosphere at the Economic Development meeting where no formal voting takes place. This
seWon is to discuss and coreider recommendations of prior committee meetings and for review of the
draft amended agreement
Step 4: Ci)y Council: Meetings are held the 2n6 and 40' Tuesdays of each month at 7 pm. in the Council
Chambers at Cdr Hall,
A Public Hearing will be held at this time for the Amendment to AnnexdordPUD Agreement.
Notice will be given by publication by the United City of Yorkville in the Kendall County Record at
least 15 days but no more than 30 days prior to the public hearing data. A certified affidavit must
be filed by the petitioner with the Community Development Department's office containing the
names, addresses and permanent parcel numbers of all parties that were notified.

AMENDED AND RESTATED ANNEXATION AGREEMENT AS TO A PORTION
OF THE PROPERTY AND A PLANNED UNIT DEVELOPMENT AGREEMENT
(Bristol Bay Subdivision) .
This Amendment (the "Amendment") to the Annexation Agreement as to a Portion of the
Property Being Included in the Annexation Agreement as to a Portion of the Property, Amended
and Restated Annexation Agreement as to a Portion of the Property and a Planned Unit
Development Agreement (Bristol Bay Subdivision), dated April 26, 2005 (the "2005 Annexation
Agreement"), is entered into this day of , 2010, by and among the United
City of Yorkville, Kendall County, Illinois, a municipal corporation and Standard Development,
Inc., a corporation of the State of Illinois, successor to MSRET, LLC, a Delaware limited
liability company; Centex Homes, a Nevada General Partnership as successor to LaSalle Bank
National Association under Trust Agreement dated April 1 , 2005, known as Trust No. 133367,
LaSalle Bank National Association under Trust Agreement dated April 1 , 2005, known as Trust
No. 133368 and LaSalle Bank National Association under Trust Agreement dated April 1 , 2005,
known as Trust No. 133370; Lay-Com, Inc., an Illinois corporation; JR Yorkville L.L.C., an
Illinois limited liability company and NR Yorkville, L.L.C., an Illinois limited liability company,
as tenants in common; and, John Rosenwinkel and Susan Rosenwinkel, individually, and as co-
trustees of EMR Trust No. 100 dated December 10, 2002 (hereinafter collectively referred to as
"Owners"); and,
WHEREAS, due to the changes in the economic conditions in the country and most
particularly in the region, other than Lay-Com, Inc., the Owners are successors to the parties to
the 2005 Annexation Agreement due to conveyance resulting from foreclosures or other
settlement agreements; and,

WHEREAS, the Annexation Agreement provided for the annexation of approximately
630 acres of land to the City and included a certain parcel of real estate consisting of
approximately 22 acres (the "Property"), legally described on Exhibit A attached hereto and
made a part hereof, then owned by MSRET, LLC, a party to the 2005 Annexation Agreement
which Property was conveyed in 2009 to Standard Development, Inc., a corporation of the State
of Illinois (the "New Owner"); and,
WHEREAS, the New Owner has petitioned the City to rezone the Property pursuant to
the City Zoning Ordinances as set forth in the 2005 Annexation Agreement from R-3 Residential
District to B-3 Business District in order to permit the New Owner to proceed to present a
concept plan for a planned unit development with commercial uses on this Property; and,
WHEREAS, the New Owner is prepared to participate all public hearings as required by
law to accomplish this Amendment to the 2005 Annexation Agreement and as may be required
to rezone the Property to B-3 Business District under the City's Zoning Ordinance.
NOW, THEREFORE, the parties hereto agree as follows:
1 . Paragraph D under the "Recitals" as restated in Paragraph I of the 2005
Annexation Agreement is hereby amended to reflect the rezoning of the Property to B-3 .
2. Paragraph 4 of the 2005 Annexation Agreement is hereby amended as pertaining
to the Property, to state that prior to the execution of this Agreement, the Corporate Authorities
(as defined in the 2005 Annexation Agreement), shall have directed that the required public
hearings have been held and the Corporate Authorities shall have adopted such ordinances as
may be necessary to rezone the Property to B-3 .

3 . That the Zoning Map as referenced in Paragraph 5 of the 2005 Annexation
Agreement, prepared by Smith Engineering Consultants, Inc., and last revised April 4, 2005, is
hereby amended to reflect the rezoning of the Property from R-3 to B-3 after adoption of such
ordinances as have been deemed necessary.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to the
Annexation Agreement as to a Portion of the Property Being Included in the Annexation
Agreement as to a Portion of the Property, Amended and Restated Annexation Agreement as to a
Portion of the Property and a Planned Unit Development Agreement (Bristol Bay Subdivision) to
be executed by their duly authorized officers on the above date at Yorkville, Illinois.

At the last EDC meeting, Attorney Dan Kramer had asked what the protocol will be for
his business' s sign after it is removed by IDOT during the Route 47 construction project,
expected to occur in 2012 and 2013 . Specifically, Mr. Kramer was asking if a blanket variance
for relocating signs affected by construction will be granted, or if each sign will be required to be
brought into conformance. As you may recall, the City revised its entire sign ordinance in 2009,
rendering Mr. Kramer's sign (and many others) as legal, non-conforming to our current sign
code. Under the letter of the law, in order to permit any sign to be moved to another location and
retain its aesthetics and size, the City has to grant a variance.
Over 30 signs on Route 47 will need to be relocated or brought into conformance as part
of the Route 47 construction project. A list of these signs and associated pictures are attached.
There are a few different options for this issue:
1 ) The City Council could pass an ordinance allowing all signs effected to be moved
without need for a variance at this time only and allow them to continue in a legal, non-
conforming state. This would mean that if any sign owner wanted to change their sign in
the future, they would have to comply with the current sign code or seek a variance
individually.
2) The City Council could demand that all signs to be moved/removed conform with the
current sign code. In this case, IDOT would be responsible for reimbursing each sign
owner for the cost of a sign that meets the sign code (but not necessarily exceeds). This
option would significantly change the aesthetics of the Route 47 corridor, as all of the
pole-style and lollipop-style signs would be replaced with monument signs or similar. If
an owner wanted to keep their current sign (but have it moved out of the Route 47 right-
of-way), they could seek a variance. For this option, the square footage of a sign per
business is likely to decrease. Whereas signs were formerly allowed to contain multiple
businesses at sizes as large as 4 x 8 for each business, they are now limited to a single 32
square foot sign for parcels 3 acres or less or two 64 square foot signs for parcels 3 acres
or larger, dependant on street frontage. In both cases, no sign can be taller than eight feet
in height. Electronic message boards would be allowed for 50% of the total square
footage of any new sign.
I recommend that the EDC make a recommendation to City Council to treat all of the signs in the
same manner, and as described in Option #2. Furthermore, because this agenda item deals with
the sign code and it has the potential to vastly increase the workload on the Zoning Board of
Appeals, it may be desirable to seek their input on this issue.

In the interest of covering City overhead expenses and time consumed inspecting and reviewing
plans for each and every project, I am proposing the following increases for permit and plan review fees:
Approximate cost to the City of Yorkville per inspection = $45 (inspector, assistant, overhead expenses)
Permit fees:
Deck permit fee, proposed increase from $50 to $ 135
(3 inspections X $45/each = $ 135)
Commercial Driveway / Parking Lot permit fee, proposed increase from $50 to $90
(2 inspections X $45/each = $90)
In-ground Swimming Pool permit fee, proposed increase from $50 to $135
(3 inspections X $45/each = $ 135)
Above-ground Swimming Pool permit fee, proposed increase from $50 to $90
(2 inspections X $45/each = $90)
Plumbing Alteration permit fee, proposed increase from $50 to $ 135
(3 inspections X $45/each = $ 135)
Detached Garage permit fee, proposed increase from $ 100 to $ 180
(4 inspections X $45/each = $180)

PAYMENT OF FEES:
A permit shall not be valid until the fees prescribed by law have been paid. Nor shall an amendment to a permit be released
until the additional fee, if any, has been paid.
FEE WAIVER FOR PUBLIC GOVERNMENTAL AGENCIES:
Permit fees associated with construction, alteration, or addition to any public governmental agency may be subject to a 50-
100% discount with approval and consent of the City administrator. All out-of-pocket expenses and charges by outside
agencies or consultants shall be paid in full prior to final approval and/or issuance of the Certificate of Occupancy.
MISCELLANEOUS FEES:
During the construction or remodeling process, inspections shall be made to ensure compliance with applicable building codes,
ordinances, or any State and Federal regulations.

In the event that a building official or City engineer determines, after a requested inspection, that the work fails to comply
with the approved plans associated with the permit or fails to meet the requirements imposed by a local Ordinance or a
State Statute, the permit holder may be subject to re-inspection fees in accordance with the following schedule:

SURCHARGE:
It shall be unlawful for any person, firm or corporation to erect, construct, alter, extend, repair, move, remove, demolish or
occupy any building, structure or equipment regulated by the building code, or cause same to be done, in conflict with or in
violation of any of the provisions of the building code. Any work performed prior to obtaining the appropriate permit shall be
subject to a permit fee surcharge in the amount of 50% of the permit fee at a minimum charge of $50.00.
STOP WORK ORDER:
Upon notice from the building official that work on any building or structure is being prosecuted contrary to the provisions of
the locally adopted building code or in an unsafe and dangerous manner, such work shall be immediately stopped. The stop
work order shall be in writing and shall be given to the owner of the property involved, or to the owner's agent, or to the '..
person doing the work; and shall state the conditions under which work will be permitted to resume. Any person who shall '..
continue any work in or about the structure after having been served with a stop work order, except such work as that person '..
is directed to perform to remove a violation or unsafe condition, shall be subject to fines in the amount of $200.00 - $750.00 '..
per offense. Each and every day constitutes a separate offense and shall be fined accordingly.
REFUNDS:
Any and all permits subject to a refund shall be subject to review and approval by the City administrator.
CERTIFICATE OF OCCUPANCY:
No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or
structure or portion thereof shall be made until the building official has issued a Certificate of Occupancy therefor as provided
herein. Issuance of a Certificate of Occupancy shall not be construed as an approval of a violation of the provisions of the
building code or of other ordinances of the United City of Yorkville. Certificates presuming to give authority to violate or cancel
the provisions of the building code or other ordinances of the United City of Yorkville shall not be valid.
