Minutes for Correction/Approval May 4, 2010 The minutes were approved as read. Items Recommended by Plan Commission for Approval: None New Business 1. EDC 2010-18 Building Permit Report for April 2010 Mayor Burd noted that if the City can obtain 200 building permits, the water stipends could be discarded. 2. EDC 2010-19 Building Inspection Report Summary for April 2010 Alderman Spears said she would like addresses included on all the entries. Mr. Zabel said some of the addresses are blank since there are multiple inspections on a given property. The blank spots refer to the address above according to Zabel. She also asked for addresses for TPI on the bill list. Zabel added that the inspections being done by ICCI are now minimal. 1 3. PC 2010-05 Autumn Creek Annexation/PUD Agreement Amendment Ms. Noble said Pulte is seeking to amend the Annexation Agreement to cover several items. They are asking for security reduction—they wish to post a cash bond rather than a letter of credit. The bond would be in the amount of$25,000 for each plat of subdivision. Engineering felt the amount should be $50,000. Mr. Olson said the City has never had an issue with Pulte and he said the cash bonds would be drawn from if necessary. Alderman Spears asked if the City had it in writing that only Pulte and Centex would be allowed to build, however, Olson said the City could require a letter of credit when a permit was pulled by someone other than these 2 builders. Another request from Pulte concerns the final plat for phase 2. Ms. Noble said it has been asked that the area north of Kennedy Road be re-platted. Lot sizes may also change and density could be greater. Mr. Pallardy said eventually Pulte would like to build an age-targeted product. Mr. Pallardy added that the SSA's would continue. A year ago, Pulte paid SSA's as part of the sales contract. Ms. Spears asked who would maintain the retention ponds. Ms. Spears said the fees were based on the numbers of homes, but she was concerned about the lower density. Mr. Pallardy said the density had not changed and the homeowners' fees had not changed and that they continue to fund the HOA's. Pulte is asking for an extension of building code locks, however the fire marshal is not in support of this. He is willing to make concessions for the sprinkler requirements. Alderman Spears said in regards to life safety issues, she does not like it to be open- ended, it will cost the City money and she wants to avoid lawsuits. Ms. Noble said the 2009 code adoption would require sprinklers. Spears suggested providing incentives to the homeowners if sprinklers were installed. The original agreement had a 5-year lock on the codes according to Mr. Olson, while Spears favored a 1-year lock. Ms. Sutcliffsaid the City should work with the developers. Mayor Burd thanked Pulte for going above and beyond what the current code requires. Golinski said he was OK with using the 2006 codes and a 5-year lock. Alderman Werderich commented that if sprinklers are a "sticking point", he does not think the City should require them. He was also OK with the 5-year lock and he feels 2009 codes should be adopted minus sprinklers. For the record, Mr. Pallardy said there have not been unsafe conditions with the use of the 2000 codes. He said there would be no changes seen in 2006 or 2009 codes. When asked when building would begin again, Mr, Pallardy said they are doing market research at this time and there is some movement at Autumn Creek. He said he hopes the market will pick up in 2011. Alderman Golinski asked Attorney Orr if the $50,000 cash bond was adequate to protect the City. She recommended that the agreement must be written to say that the minimum is $25,000 or permits would not be issued. She added that she would recommend an additional $3,000 to $4,000 for more than 4 temporary certificates of occupancy. 2 Mr. Pallardy said a letter of credit costs him more money in the long run, but it is easier than issuing several checks. Mr. Olson said that a fee lock is being requested in addition to the building code lock. Olson added that the City is now drafting the agreements rather than the developer. Alderman Spears cautioned that other developers could come to the City and request locked-in fees that in turn, will not benefit the City's budget. Mayor Burd said the building process must begin again and she urged support for their requests. Alderman Spears suggested that if the City had not given concessions 5 years ago, there might not be a deficit and she does not want the burden of the deficit placed on the residents. Sutcliffcommented that it's a balance---that there would be more empty lots if no building was occurring. Golinski said the tax base must be increased to help the City. The businesses look at residential permits as a positive sign. He encouraged extending the same fee structure. Finally, Ms. Noble said the park planner wishes to include some language regarding the trail and recommended the basin be completed and a seed mix be applied. This moves forward to Public Hearing on June 22. 4. PC 2010-06 Bristol Bay Annexation/PUD Agreement Amendment This item is similar to Autumn Creek and concessions are being requested. Ms. Noble said the City owes Centex money and the developer will waive the fees associated with the Rob Roy construction if the City takes on the intersection improvements. The City was committed to build the interceptor per the Annexation Agreement. Subsequently the City did not have adequate bond proceeds to do so. Attorney Orr detailed the various items the City would be required to pay for and said the trade-off is a prospective way of handling this. Water recapture is included in this and Mr. Olson added that re-capture is still owed to Grande Reserve. Bart discussed improvements to Rt. 47 to Rt. 30 and said Phase 1 engineering has begun. Mayor Burd added that if the Ochoa project proceeds, the improvements would be accelerated. Ms. Noble discussed the parks and said 3 parks were completed and $50,000 was paid for each of 2 other parks. There was also a donation of 75 acres. Ms. Spears asked if there was adequate parking in the parks. No parking lots are planned according to Mr. Olson, however, there is nearby parking already available. Alderman Werderich commented that he would not want to "walk away" from 127 acres of parkland. He asked for a dollar value on the 3 parks and also asked for cost analysis of intersection improvements before making a decision. He said it would not be wise to trade 1 debt for another. Mr. Olson also detailed the other developer requests. This will proceed to Public Hearing on June 22. 3 5. EDC 2010-20 Muellner Construction, Inc. Redevelopment Agreement Ms. Noble said this is a redevelopment agreement where the City and IDOT have come together. IDOT will take a temporary easement and a permanent easement to widen the road. For part of the temporary easement, the City is proposing to put in sewer and provide public utilities and drains. The building will be demolished and the property owner is asking for a zero lot frontage building setback. The City will approve this providing the building adheres to architectural designs and Mr. Muellner said he plans to rebuild with the same design. This item proceeds to City Council on June 8 on the consent agenda. 6. EDC 2010-21 Temporary Banner Sign Deposits Ms. Noble said she suggested that the $50 fee be swapped with a$50 deposit. Materials for the banner were also discussed and it was decided that vinyl would be added as an acceptable material. This item will move forward to the Council consent agenda. 7. EDC 2010-21 Developer Fees and Deposits and Tracking A spreadsheet was developed to begin tracking of developer fees. Alderman Spears showed an example of a spreadsheet from 2004. No further action 8. EDC 2010-22 Telecommunications Tower Fees-Discussion It was noted that a committee had been formed to discuss tower fees. Golinski asked for comparison research from surrounding towns including fees and insurance. This item will return to this committee next month. Old Business: 1. EDC 2010-17 Sign Ordinance Amendment—Banner Duration It was agreed to change the ordinance to extend the display time to 30 days. This will go to consent agenda. 2. EDC 2010-15 Route 47 Project—Sign Relocations The Rte. 47 road-widening will impact 24 signs. Some are being recommended for demolition, while 16 are non-conforming signs. The City is proposing to grandfather in those signs. This will move forward to the June 81h Council meeting on the consent agenda. 3. EDC 2010-10 Ideas for Regional Events and Tournaments The flier listing various area businesses was revised to include businesses on the south side of town. It was suggested the tournament organizers or coaches could help in the distribution and that brochures could be kept at the concession stands. Alderman Sutcliff suggested laminating a large brochure. Additional Business Alderman Spears asked about the Telecommunications Consortium Liaison. Alderman Spears will assume the Liaison position for the July 8th meeting. Meeting was adjourned at 8:42pm. Backizround & Request: On March 2, 2010, the Economic Development Committee (EDC) referred a request to the Plan Commission for a text amendment to allow for the manufacturing of alcoholic beverages as a permitted use within the M-1 Limited Manufacturing District. The request also proposed to define and identify "microbreweries" as permitted Special Uses with the City's business districts. Plan Commission Action: The Plan Commission reviewed the requested text amendment at a public hearing held on June 9, 2010 and made the following action: Motion to recommend approval of the text amendment subject to the following conditions: 1. Amend Title 10-8A-1 to identify the manufacturing of"Beverages - alcoholic"' as a permitted use in the M-1 Manufacturing District. 2. Amend Title 10-2-3 of the Zoning Ordinance to include the following definition: Alcoholic Beverage: any beverage that is the product of distillation of fermented liquids, whether rectified or diluted, whatever may be the origin thereof, and includes synthetic ethyl alcohol but does not include denatured alcohol or wood alcohol. 3. Require a limitation in the amount of alcoholic beverages produced by any one manufacturer to a maximum of 15.000 barrels (465,000 gallons)per calendar year. 4. Amend Title 10-7B to identify "microbreweries/brew pubs" as an allowed Special Use within the B-1 Limited Business District, B-2 General Business District, B-3 Service Business District and B-4 Business District. 5. Amend Title 10-2-3 of the Zoning Ordinance to include the following definitions: Microbrewery or Brew Pub: A restaurant-brewery that brews beer primarily,for sale in the restaurant and is dispensed directly from the brewery's storage tanks. Total production capacity shall not exceed 15,000 barrels per calendar year (465,000 gallons). One (1) U.S. barrel is equivalent to thirty-one (3 1)gallons. 6. Permit off-premise consumption, and require all sales be in a hand-capped, sealed container with a total maximum production of 15,000 barrels per calendar year inclusive of on-premise and off-premise sales. 1 Action Item: Crouch-yes, Lindblom-yes, Jones-yes, Baker-yes, Holdiman-yes, Kraupner-yes, Adams-yes; Winninger-yes 8 ayes; 0 no Staff Comments: • The Plan Commission's discussion included concerns regarding existing legacy covenants that could preclude the sale or manufacturing of alcohol on some parcels and if certain areas of Bristol Township are "dry" which would not permit the sale of alcohol. Staff has conferred with City Attorney Orr regarding the legacy covenants. If covenants do exist on any property, they would need to be reviewed on a case-by case basis, as some covenants are no longer enforceable, such as those that violate civil rights. With regards to the query about areas of Bristol Township being dry, it would not be an issue as municipal authority supersedes that of the township. • Staff has also contacted some local breweries regarding their average annual production of alcoholic beverages, and generally the yearly production ranged between 1,100 barrels (Rock Bottom Restaurant-Orland Park) and 19,000 barrels (Two Brothers Tap House- Warrenville). Therefore, the recommendation by the Plan Commission to limit production to 15,000 barrels per calendar year is consistent with local breweries. • The City's Liquor Control Ordinance will need to be amended to establish a new licensing classification for brew pubs and the manufacturing of alcohol. This will be presented at an upcoming Public Safety Committee meeting and then forwarded to City Council for approval. Staff Recommendation: Staff is in favor of the proposed text amendment, per the Plan Commission's recommendation as stated herein. For your reference, attached is a copy of a draft ordinance and staff's memorandum to the Plan Commission regarding the proposed text amendment. 2 Ordinance No. AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS,AMENDING THE ZONING CODE OF ORDINANCES WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, it is in the best interests of the City that the Zoning Code of Ordinances is amended so that the City can allow and regulate the manufacturing of alcoholic beverages in the M-1 Limited Manufacturing District, and allow and regulate microbreweries/brew pubs as a special use within business districts in order to protect the health, safety, and welfare of its citizens; and, WHEREAS, the Plan Commission convened and held a public hearing on the 9`h day of June 2010, on the question of the text amendment to the Zoning Code of Ordinances; and, WHEREAS, upon conclusion of said public hearing, the Plan Commission recommended the approval of the text amendment to the Zoning Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. BackgroundlRecluest: The Economic Development Committee has referred a request to amend the City's zoning ordinance to allow for the manufacturing of alcoholic beverages as a permitted use within the M-1 Limited Manufacturing District. There is also a request to define and identify "microbreweries" as permitted Special Uses with the City's business districts. M-1 Limited Manufacturing District: As proposed, the production and processing of alcoholic beverages would be allowed as a permitted use within the M-1 Limited Manufacturing District. This would include the bottling and wholesale distribution of the product on the premises with delivery to retailers, restaurants or pubs but no point-of--sale purchases made to the public. Currently, the manufacturing of nonalcoholic beverages is permitted in the M-1 District. The zoning ordinance would be amended to define an alcoholic beverage as follows: Alcoholic Beverage: any beverage that is the product of distillation of,fermented liquids, whether rectified or diluted, whatever may be the orifin thereof, and includes synthetic ethyl alcohol but does not include denatured alcohol or brood alcohol. Staff is also proposing a limitation in the amount of alcoholic beverages produced by any one manufacturer to a maximum of 5,000 barrels (155,000 gallons) of alcohol per calendar year. This restriction on production is consistent with a smaller scale operation that is appropriate for the manufacturing areas in Yorkville in terms of anticipated truck traffic and storage capacity, but also ensures that a major brewing company, such as an Anheuser Busch, does not locate within the district. Since the City of Yorkville's zoning districts are cumulative, all uses permitted in the M-1 Limited Manufacturing District is also permitted in the M-2 General Manufacturing District. There are over approximately 80 parcels within the M-1 zoning district with a majority located in the Fox Industrial Park and the Yorkville Business Center. The attached map illustrates the M-1 and M-2 districts within the City that may be affected by the proposed text amendment. As with any manufacturer of any alcoholic beverage, a State License from the Illinois Liquor Control Commission is required. A copy of an application for State of Illinois Manufacturer's Liquor License has been attached for your reference. MicrobrewerieslBrew Pubs in Business Districts: For the purposes of allowing a retail/restaurant the ability to brew alcoholic beverages on- premises for sale to patrons, staff proposes to amend the City's zoning ordinance to define and identify "microbreweriesfbrew pubs" as an allowed Special Use with the City's business districts which include: ' Definition derived from the Illinois Liquor Control Act of 1934(235 ILLS 511-3.01). B-I Limited Business District, B-2 General Business District, B-3 Service Business District and B-4 Business District. "Microbrewery or Brew Pubs" would be defined as follows: Microbrewery or Brew Pub: A restaurant-brewery that brews beer primarily.for sale in the restaurant andlor bar and is dispensed directiv.fr•om the brewery's storage tanks. Total production capacity shall not exceed 5,000 barrels per calendar year (155,000 gallons). One (1) U.S. barrel is equivalent to thirty-one (31)gallons.2 Illinois State law does not have a production capacity for on-premise sales, but does cap the amount of oft-premise sales to 50,000 gallons per year (approximately 1,600 barrels). Therefore, the Plan Commission should also consider if beer brewed on-site will only be for on-premise consumption or can it be sold directly to consumers for off-premise consumption. If off-premise consumption is permitted, staff suggests adding language that states all sales shall be in hand-capped, sealed containers and in specified quantities, for example up to one-half(1/2) barrel for off-site consumption, with a total maximum production of 5,000 barrels per calendar year inclusive of on-premise and off-premise sales. Since it is envisioned that microbreweries/brew pubs will be an ancillary use within a restaurant or eating establishment, staff proposes that the brewing component of the facility be no more than twenty-five percent (25%) of the total floor area. This will ensure that the majority of the commercial space is used for a retail/commercial purpose (and not merely as a brewery) and will generate the appropriate sales tax revenue as anticipated for uses located within the business districts of the City. Staff is recommending identifying microbrewery/brew pub uses as a Special Use in the business districts so that approval is granted on a case-by-case basis to guarantee compliance with the proposed maximum total floor area requirement for the brewery operation and production capacity. Engineering Enterprises, Inc., has previously assisted Staff in assembling the project cost estimate when the City submitted an application for funding Cycle 8 in 2008. The application was prepared with our previous grant writers for the ComED old `Trolley Line Trail' from Windett Ridge to Riverfront Park. Engineering Enterprises, Inc, again has offered their services to prepare engineering and construction estimates and Staff is planning on meeting with them on July 14th to discuss potential projects. At this time, Staff has identified two potential trail applications that would be strong applications for ITEP funding; 1)the ComED shared-use trail from Windett Ridge to Riverfront Park or 2)Kennedy Road shared-use trail from Route 47 to Steven G. Bridge Park at Mill Road. Please note that we cannot use federal funds to match federal funds, so this grant cannot be used to supplement the cost of the trail along Route 47.The bridge crossing the school property was also discussed,but at this time,we do not have a lease agreement with the school in place, and we would not serve as many residents with this connection. In addition,the goal of ITEP is to reduce surface transportation, and a great number of homes and public facilities (schools and parks) are served by completing the ComED or the Kennedy Road trail.The number of existing homes that would be connected by the school bridge and trail is 81 and final build out is 201 homes. Evaluation ComED Trail Advantages: 1) Preliminary engineering is complete 2) Lease agreement with ComED is secure 3) Lease agreement with HOA to bypass the ComED substation south of 71 is secure 4) Agreement to construct trail is secure with YBSD(they have an existing lease agreement with ComED) 5) IDOT has provided us with letters of support for this project crossing 126 and 71 6) Providing a recreational trail with very few vehicular crossings (driveways, access roads, etc.) 7) Phase I engineering has been completed and it indicates strong commitment to the project 8) Directly connects 677 homeowners (built out at 1356)to downtown Yorkville 9) Trail will connect to trail system in Raintree Village that links to Yorkville's Junior High School Disadvantages: 1) Route 47 is underway and will be providing a trail less than 1 mile west of the ComED trail running parallel to this proposed project; staff believes 47 and ComED trails are different user groups (destination users to businesses not recreational users), but this could double our resources at this time if 47 continues to move forward(this was not the case with the previous application) when it might be better to select a different trail 2) The project cost is considerably greater than the recommended$1 million project limit 1DOT has suggested for maximum project funds requested(see below for cost analysis) Kennedy Road Trail Advantages: 1) All but 2 properties have secured easements for the trail 2) The 2 properties where additional easements are required can be included in the trail for acquisition costs eligible for reimbursement(50%) 3) This trail will provide an extended connection from the Route 47 trail(ending near Menards)to the regional ballfields 4) Connection between downtown Yorkville and residents in Autumn Creek and Grande Reserve will be provided once the Route 47 trail is complete 5) Funding would help to remove sidewalk from 47 to Prairie Meadows and replace with trail(this is the completed trail connection of the Kennedy Road trail to Route 47) 6) Residents from downtown Yorkville will be able to bike to the Blackberry Creek Trail through Grande Reserve and to Oswego(at Mill Road connection) 7) Yorkville will have completed their required connection to get residents to downtown Oswego and the Fox River Trail (waiting for the Village of Oswego completes the Mill Road trail) 8) Residents from south of the river(with the Route 47 trail)will be able to ride their bike to the Metra Park&Ride in Oswego 9) The project cost will be at the recommended$1 million dollars by IDOT 10) First signalized pedestrian crossing for residents north of the tracks in Grande Reserve to safely cross the BNSF railroad 11) Directly connects 618 homeowners (built out at 1791)to commercial centers, downtown Yorkville, and other facilities 12) Connects to future Disc Golf Course just north of tracks Disadvantages: 1) Existing sidewalk will be removed for trail construction Cost Analysis ComED Trail The ComED Trail, approximately 2.27 miles long, would link to the existing trail in Raintree Village (which continues to Windett Ridge)to Riverfront Paris.The project includes 3 small bridges to cross the small creek meandering through this property. This trail would link residents on the south end of town to downtown Yorkville and provide a valuable recreational amenity. The previous cost estimate for the ComED trail in the 2008 ITEP application was approximately $2,860,494.00.This would require the city to contribute$572,098.80 as the 20%match. Kennedy Road The 3.06 mile trail connection along Kennedy Road from north of the Burlington Northern Santa Fe tracks to Route 47 is a primary connection for the shared-use trail plan. The trail is vital to link residents between the Park and Ride,two elementary schools (Autumn Creek and Grande Reserve),YorkviIle's lighted regional ballfields, commercial shopping, the Post Office, and REC Center, as well as downtown Yorkville. The cost estimate used for the CMAQ application was$1,101,660.00. Please note this did NOT include removing sidewalk along Kennedy Road and replacing it with trail.The cost estimate for this application will increase due to the addition of this lineal footage of trail to complete the connection to Route 47. For the previous estimate, funding would be split to 80% (ITEP)at$881,328.00 and 20%(City) at $220,332.00. IDNR Recreational Trails funding is an allowable match for the 20%and therefore if another grant cycle was opened after we were awarded the ITEP grant,we could apply for additional funding and it would be eligible. ITP Committee Staff is seeking input from the ITP committee members as to which trail project to pursue.We will also solicit comments from the Park Board at the next meeting on July 22"a,prior to bring the application to a committee or Council. This code update is in an effort to protect and maintain our residential and commercial properties while ensuring that the most effective construction standards and latest industry practices are being implemented and followed in our community. Currently, the City enforces construction standards under the 2000 ICC (International Code Council) series of codes which includes such provisions as the International Building Code, International Residential Code, International Plumbing Code, International Electrical Code, and the International Fire Code. Since their adoption by the City, there have been three (3) updates to the ICC series of codes. Therefore, the Building Code Update Committee, along with staff, will review the existing codes over the next several months and discuss changes that may be considered for final adoption by the City Council. Next Steps: Staff has coordinated with the appointed Building Code Update Committee members and has determined that the 3rd Monday of every month at 6:30 pm may be a suitable meeting time. The following schedule has been prepared for consideration and approval by this committee. Additionally, an overview of the proposed review process has been attached for your reference. However, the disparity in the total application costs from community to community is due to the number and type of applications required, and if Telecommunication Towers are deemed permitted or special uses. In addition, when deposits to cover staff reviews, outside consultants and publication costs are considered, the total up-front costs can vary widely. The City of Yorkville does charge an engineering review fee deposit for Telecommunication Tower requests which ranges from $1,000 to $20,000, depending upon the acreage of the site and is consistent with other communities. 1
